15、nt to evide nee the loaded qua ntity determ in ate at load ing port.5.2At discharg ing port: Final weight determ in ati on of the GOODS shall be decided by China Certification & Inspection Group Co, Ltd /or its subsidiary co. (CCIC) or the average between the CCIC China and SGS China at discharging

16、port, the cost of CCICChina will be for the Buyer , and the cost of SGS China will be for the Seller. Final dry weight is based on actual weight measurement mentioned in Certificate of Weight issued by CCIC China or the average Buyer Contract No.Seller sContract No.5 / 12between the CCIC China and S

17、GS China at discharging port minus actual free moisture shown in Certificate of Quality issued by CCIC or the average of the free Moisture between the CCIC China and SGS China at dischargi ng Port.第五條：重量決定5.1每船貨物將在裝貨港由船長與馬來西亞SGS根據(jù)船的吃水測量重量，測量費用由賣方承擔。如此測量的重量稱為賣方的發(fā)票重量”，買方有權(quán)出席或者派第三方出席監(jiān)督裝貨港的重量測定。5.2在卸貨港：

18、最終貨物的重量將由中國認證&檢驗集團有限公司/或其附屬公司(CCIC)在卸貨港或者中國CCIC與中國SGS的平均值來確定，其中中國CCIC費用由買方承擔,中國SGS費用由賣方承擔。最終的干噸數(shù)按照中國CCIC在卸貨港出具的重量證上的實際重量數(shù)或者中國CCIC與中國SGS的平均值減掉中國CCIC在卸貨港出具的質(zhì)量證上的 自由水分數(shù)或者中國CCIC與中國SGS的平均值的結(jié)果。ARTICLE 6 -SAMPLING AND ANALYSIS6.1Sampling and analysis will be carried out at Seller s expense by SGS Malaysia

19、duringloading at the loading port. The Buyer may, at Buyer sexpense, have its represe ntatives prese nt at the time of sampli ng and an alysis.6.2Notwithsta nding the forego ing, in order to en sure a fair in specti on, after arrival of the vessel, the seller will commissi on SGS China to con duct s

20、ampli ng. Sampli ng and analysis will be carried out independently by CCIC China and SGS China at the discharging port. Subject to paragraph 6.3 below, the CCIC China result shall be the basis of the Final Settlement. All expenses in connection with such sampling and an alysis by CCIC China shall be

21、 on the Buyers acco unt. The sample take n for an alysis shall be in 3 parts and sealed, one sampled for an alysis by CCIC China, one sampledfor analysis by SGS China, and one retained for the purpose of an umpire analysis(sampled by SGS Chin a), if required, to be an alysed by an in depe ndent ISO-

22、approved laboratory . The third party analysis cost to be borne by the losing party.6.3If the CCIC China discharge port results are above or below the rejection level, or the differe nee betwee n CCIC Chi na and SGS Chi na an alysis results at discharge port are over 0.5 % (inclusive of 0.5%) for AI

23、2O3, SiO2, or moisture, the seller can choose either using the average between the CCIC China and SGS China discharge port as the final basis, or can choose to challenge CCIC China discharge port results and use umpire sample results as the final settlement.If the difference is less than 0.5% (exclu

24、sive of 0.5%), the discharging port CCIC China report as a basis for final settlement.第六條：質(zhì)量檢驗6.1在裝港取樣分析由SGS Malaysia施行，并由賣方承擔檢驗成本。買方有權(quán)到場或派第 三方到取樣分析現(xiàn)場，相關(guān)費用由買方自行承擔。Buyer Contract No.Seller sContract No.6 / 126.2盡管前有所述，為保證檢驗的公平，貨物到卸港后，賣方委托SGS China進行取樣/檢驗。卸港取樣以及分析由 CCIC China和SGS China單獨實施。除6.3所述情況，此

All previous documents, undertakings and agreement, whether verbal, written or otherwise. Between the parties concerning the subject mat
