1、房屋租賃合同中英文房 房 屋 租 賃 合 同House Lease ContractParty A: LandlordParty B: TenantParty C: Agent第一條:租賃物業(yè)Tenancy :甲方同意將位于杭州市西湖區(qū)房屋及房?jī)?nèi)設(shè)備 設(shè)施在良好狀態(tài)下出租給乙方。建筑面積為平米。Party A hereby agrees to leaseihu Distrt Hangzhou and the fitures, fittings and equipment therein are cleaned and in tenantable conditions to Party B.To
2、tal area of the leased property is .2、簽訂本合同之前,甲方必須向乙方出示有關(guān)物業(yè)的房地產(chǎn)產(chǎn)權(quán)證。產(chǎn)權(quán)證編號(hào):如 不能提供該文件,甲方必須提供相關(guān)有效的可證明其物業(yè)所有權(quán)的文件。假設(shè)該物業(yè)產(chǎn)權(quán)證上所有權(quán)人的名稱與此合同中甲方名稱不一致。那么必須提供甲方與物業(yè)所有權(quán)人的合法租賃協(xié)議的復(fù)印件。Prior to the eecution of this agreement, Party A shall provide to Party B the Real Estate Ownership Certifate in respect of the Property.
3、Ownership Certifate No.:.If this document is not available, Party A shall provide an alternative and acceptable proof of ownership.If the name on the ownership certifate is not the same as the name of Party A on this tenancy agreement, a copy of the additional leasing agreement between the rightful
4、legal owner and party A must be supplied.第二條:租期Term of Tenancy :1、 租賃期為月,自年月日起至年月日止。The above property is hereby leased for a term of months, mencingOn, and epiring on .2、在租期開(kāi)場(chǎng)三日前,出租房屋及其家俱電器應(yīng)已裝修或安裝布置完畢,處于可供租賃的良好狀態(tài)。The above property and its equipment and furniture shall be fully renovated or install
5、ed and in tenantable conditions three days before the mencement of the lease.3、租期屆滿,甲方有權(quán)收回出租房屋及全部家俱、電器,乙方亦應(yīng)如期交還附件 1; 乙方如要求續(xù)租,那么享有優(yōu)先續(xù)租權(quán),但必須在本租約固定期滿前二個(gè)月向甲方提出書面申請(qǐng),租金雙方另行協(xié)商;如乙方不再續(xù)租,甲方有權(quán)向新租客展示該房。On epiry of this lease, Party A has the right to take back the leased property in full, and Party B must deliv
6、er the leased property on the date of epiry (endi I).If Party B wishes to renew the lease after the tenancy period, Party B shall have the priority to renew the lease with two months advance written note to Party A.The revised rental shall be negotiated between the two parties.If party B not renew t
7、he lease contract, Party A have rights show the property to new tenant.第三條:租金Rent :1、租金標(biāo)準(zhǔn)人民幣:元/ 每月。Rent: RMB / Per month.2、付款方式:押月付月,押金不得充抵房屋租金。Payment method: as much as 1 month(s)rs;s rent as deposit and 3 month(s) for each payment.The deposit shall not be used as the rent.3.付款時(shí)間為:Payment time:4、
8、租金支付方式:以人民幣支付。甲方收到押金后,向乙方開(kāi)具收據(jù)。The rent shall be paid in RMB.Party A shall issue a receipt upon the receipt of deposit.5、 在本租約有效期內(nèi),租金不予調(diào)整。押金Deposit :1、本租約押金計(jì) RMB。租約期滿,乙方如不再續(xù)租,甲方應(yīng)在租賃期完畢后叁日內(nèi)(在 乙方將全部水,電,煤氣費(fèi)和中央空調(diào)費(fèi)等雜費(fèi)及 費(fèi)付清后)將押金退還不計(jì)利息。如因賬 期原因,乙方承當(dāng)?shù)娜克?,電,煤氣費(fèi)和中央空調(diào)費(fèi)等雜費(fèi)及 費(fèi)無(wú)法在柒日內(nèi)付清,甲方有權(quán) 保存局部押金并在上述工程付清后返回剩余押金給乙方
9、,但保存的押金局部不因超過(guò)上一賬期應(yīng)付額 的二倍。The deposit is RMBin total.On pletion of the tenancy contract, if Party B will not continue to rent the leased property, Party A must return the deposit in full to Party B (without interest) within three days after the termination of the contract under the condition that Par
10、ty B has paid all the outstanding utilities fee such as water, electrity, gas, central air-conditioning fee and telephone bill.If such outstanding utilities fees could not be settled due to the time limit of its account within 7 days, Party A has the right to keep part of the deposit and pay back th
11、e balance to Party B after the outstanding utilities fee is settled.However the kept part of deposit should be limited to twe the amount of the previous billing period.2、甲方因乙方違背本合同的規(guī)定而受的損失,可在保證金中扣抵合理數(shù)目,在甲方作出該種抵扣前, 需通知乙方將被抵扣的金額和理由,乙方有權(quán)回絕不合理或不公正的抵扣,缺乏局部乙方必須在接到甲方付款通知后 7 天內(nèi)補(bǔ)足。Party A may deduct a reason
12、able amount from the security deposit towards payment of any actual damages Party A may have incurred or suffered as a result of Party B"s breach of this Agreement.Prior to making such deductions, Party A shall inform Party B of the amount, and the reason for making such deductions.Party B shal
13、l be entitled to object to such deductions if Party B believes that such deductions are unreasonable or unjustified.If the security deposit is not suffient to cover such amounts; Party B must pay the defiency within seven (7) days of the receipt of a demand from Party A.第五條:其它費(fèi)用Other Charges :1、 乙方承
14、當(dāng)在租賃期內(nèi)所用的水、電、煤氣、寬帶、有線電視,管理公司每月按實(shí)際耗用量結(jié)算乙 方按單繳付,同時(shí)乙方承當(dāng) 物業(yè)費(fèi) 。During the period of tenancy, Party B shall pay all monthly charges for usage of water, electrity, gas, broadband and cable TV based on the actual consumption amount, billed from the management offe.And party B shall pay property fees.2、乙方所用
15、,按電信局標(biāo)準(zhǔn)收費(fèi),每月根據(jù)實(shí)際用量結(jié)算,乙方按單繳付。All telephone charges shall be paid by Party B and based on the actual usage according to the Telemunation Bureau standard tariffs on receipt of the bills.第六條:甲方的責(zé)任Landlordrs;s Responsibilities :1、 本租約簽訂后,甲方不得無(wú)故收回房屋。租賃期內(nèi),甲方需提早收回該房屋的,應(yīng)提早 30 日通 知乙方,將已收取的租金余額退還乙方并按月租金的100支付乙
16、方違約金。Party A is not permitted to take back the leased property during the term of contract without any reason.During the term of contract, Party A shall inform Party B 30 days in advance in case Party A needs to reclaim the premise in advance and Party A shall return the balance of the collected ren
17、t to Party B and pay default fine equal to100 of the monthly rent to Party B.2、甲方應(yīng)保證物業(yè)公司向乙方提供足夠的效勞,如冷水、熱水、電的供給及各種設(shè)備的正常工作。甲方應(yīng)負(fù)責(zé)租賃期內(nèi)房屋及其設(shè)備的正常維修,并承當(dāng)維修房屋及設(shè)備的正常磨損而產(chǎn)生的費(fèi)用。Party A shall ensure that the estate management offe provides suffient and timely serve to Party B, such as supply of cold water, hot wa
18、ter, electrity and ensure the proper maintenance of all kinds of equipment.Party A shall be responsible for all normal maintenance of the leased property and equipment during the term lease, and Party A shall bear all maintenance charges.3、甲方應(yīng)對(duì)甲方的固定設(shè)施,包括該物業(yè)的構(gòu)造、屋頂、管道、設(shè)施、排污、管道和纜線包括電 力及 等進(jìn)展維護(hù),使之處于完好狀態(tài);
19、假如對(duì)上述各項(xiàng)的造成的損壞或破壞,不是由乙方的忽略或不良行為造成的,那么甲方在收到乙方發(fā)出的通知后 7 天內(nèi)修理或修繕該損害處。To maintain and keep Party Ars;s fitures, including the structure, roof, sanitary and plumbing facilities, drains, pipes and cables (including electrity and telephone) in good conditions.Party A should promptly repair or remedy any defe
20、cts therein after being notified of such defects by Party B, provided all such defects are not as a result of the Party Brs;s careless mistake or misconduct.Party A shall do the necessary repairs or maintenance within seven days after receiving the note from Party B.4、 甲方謹(jǐn)在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位出
21、租此房屋于乙方。Party A hereby represents and warrants that Party A is the legal owner of the leased property and has the necessary legal capacity to lease the property to Party B.5、所有權(quán)變動(dòng):租賃期內(nèi)該房屋所有權(quán)發(fā)生變動(dòng)的,本合同在乙方與新所有權(quán)人之間具有法律效力。Transferring of the ownership: In case the ownership of the premise changes during
22、the lease period, the Contract shall be kept effective between Party B and the new owner.第七條:乙方責(zé)任Tenantrs;s Responsibilities :1、 乙方應(yīng)按本租約第三、五條約定,按期交納租金及其他費(fèi)用。如乙方遲延支付,超過(guò)期限五個(gè)工 作日,那么甲方有權(quán)解除本租約。Party B should promptly pay the rent, deposit and other charges as set out in Clauses 3 and 5 of the Agreement.In
23、 the event that Party B delays to pay the rent for five working days, Party A has the right to terminate the contract.2、 未經(jīng)甲方書面同意,乙方不得將所租房屋分租或轉(zhuǎn)租給第三方及與第三方以任何方式共用該房屋; 假設(shè)出現(xiàn)上述情形,那么甲方有權(quán)解除本租約,房客的家庭成員及朋友的短暫居住或拜訪除外。During the period of Tenancy, unless with written consent from Party A, Party B shall not tra
24、nsfer or sublease the Property in whole or in part or in any manner whatsoever share the use thereof in mon or jointly with any third party.Otherwise Party A has the right to terminate the Agreement.This ecludes the staying of family and friends for short term.3、乙方應(yīng)保護(hù)房屋及其設(shè)備,如因使用不當(dāng)而導(dǎo)致?lián)p壞,乙方應(yīng)負(fù)責(zé)賠償。Party
25、 B must take good care of the property and its contents, otherwise Party B should pay pensation to Party A for his improper use of the property.4、除房?jī)?nèi)已有的裝飾和設(shè)施之外,乙方如要增加設(shè)備或其他裝修須征得甲方同意。租賃期滿,乙方 向甲方交還房產(chǎn)時(shí),必須恢復(fù)其原狀正常磨損除外。In addition to the decoration and equipment already in the property, if Party B wishes t
26、o make any alterations or decoration to the property, Party B should get the consent of Party A.On pletion of the Lease, Party B must hand over the property to Party A in its orinal condition (ecept for its normal wear tear).5、在未經(jīng)甲方書面同意下,乙方不得擅自設(shè)立、安裝或挪動(dòng)設(shè)施及設(shè)備,不能擅自設(shè)立隔斷,不得 擅自對(duì)房屋的構(gòu)造改動(dòng)或增加。Not to erect, in
27、stall or remove any fitures or partitioning, or to make any structural additions and alterations without the prior written consent of Party A.6、 租賃房屋過(guò)程中,乙方必須遵守中華人民共和國(guó)的有關(guān)法律、細(xì)那么、規(guī)章及法令的規(guī)定, 制止利 用房屋進(jìn)展違背法律及不道德的行為。Party B must ply and adhere in the use of the leased property according to all laws, regulati
28、ons and decrees of the Peoplers;s Republ of China.The leased property is not to be used for any purpose that is unlawful or immoral.7、 房屋除供乙方居住之外,未經(jīng)甲方書面同意,房屋不可作辦公或協(xié)議未曾說(shuō)明之用。The leased property is only for residential use.Party B shall not use the leased property as offe or some other purposes without
29、 the written agreement of Party B.8、 租賃期內(nèi),乙方需提早退租,應(yīng)提早 30 日通知甲方,并按月租金的100支付甲方違約金。During the term of contract, If party B terminates the Tenancy Agreement, Party B shall inform Party A 30 days in advance.Party B need pay default fine equal to100of the monthly rent to Party A.第八條:房屋不能居住時(shí)When the proper
30、ty is unfit for use or occupation :房屋由于火災(zāi)、惡劣天氣、戰(zhàn)爭(zhēng)或其它甲方不可抗拒因素, 而不是因?yàn)橐曳街苯踊蜷g接的忽略及成心行為造成房屋毀壞而不能被正常使用及居住時(shí),乙方從該日起停頓支付租金,直至房屋可再被使用及居住時(shí)為止。If the leased property are substantially destroyed or damaged by fire, bad weather, war, force majeure, or other causes beyond the control of Party A and not attributable
31、 directly or indirectly to the negligence or male of Party B or are otherwise rendered unfit for use or occupation, the rent shall cease to be payable from the date the leased property bee unfit for use or occupation until the leased property shall again be rendered accessible and fit for use.第九條:適用
32、法及爭(zhēng)議的解決Leslation Arbitration of the Dispute: 本租約受中華人民共和國(guó)法律的約束,如發(fā)生與本租約有關(guān)的爭(zhēng)議,由雙方友好協(xié)商解決。協(xié)商不成,提請(qǐng)?jiān)O(shè)在上海的中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì),仲裁依該委員會(huì)的規(guī)定進(jìn)展仲裁。This Lease Agreement is under the legal authority of PRC.In case any dispute arises over this agreement, the two Parties shall negotiate friendly, if failed, shall submit to
33、the China Intrs;l Econom Trade Arbitration mittee in Shanghai.The arbitration shall be carried out according to the rules of the Arbitration mittee.第十條:其它Others :1、 本租約附件是本租約不可分割的組成局部。The endi forms are an internal part of the contract.2、居間方已告知甲方到當(dāng)?shù)囟悇?wù)機(jī)關(guān)納稅,并已告知乙方到當(dāng)?shù)嘏沙鏊k理臨時(shí)居住證明。Party A has been acknow
34、ledged by the Agency to pay the personal ta at local ta offe.Party B has also been acknowledged by the Agency to ly The Temporary Residential Certifate at local pole offe.3、 合同經(jīng)甲、乙雙方簽字蓋章后生效。本合同及附件壹式叁份,其中甲方、乙方、居間經(jīng)紀(jì)方 各執(zhí)壹份。中英文具同等法律效力。中英文條款及意思如有不一致之處, 以中文為準(zhǔn)。The Contract shall take effect after Party A and Party B sign and affi seals.The Contract (including the endes) has three copies.Party A, Party B and the agency keep one each as proof.Both Chin
