18、該依據(jù)中華人民共和國(guó)出入境檢驗(yàn)檢疫局的檢驗(yàn)報(bào)告或者是賣方的調(diào)試人員在安裝調(diào)試時(shí)出具的報(bào)告，有權(quán)要求替換或補(bǔ)償，所有的費(fèi)用（包括商檢費(fèi)、替補(bǔ)件來回的運(yùn)費(fèi)、保險(xiǎn)費(fèi)、倉儲(chǔ)費(fèi)、貨物裝貨卸貨費(fèi)等）均由賣方承擔(dān)。賣方的質(zhì)量保證為簽定關(guān)于此批貨物的驗(yàn) 收?qǐng)?bào)告后12個(gè)月內(nèi)；由于貨物內(nèi)在的質(zhì)量、差的做工、 選 材不當(dāng)而造成操作中的貨物損壞，買方應(yīng)立即書面通知賣方，并同時(shí)隨附中國(guó)商檢局出具的檢驗(yàn)報(bào)告作為索賠依據(jù)。賣方在接到買方的索賠后，有責(zé)任立即解決相應(yīng)的質(zhì)量問題、全部或部分地替換貨物或根據(jù)貨物損壞的程度進(jìn)行折價(jià);如果賣方在收到買方的上述索賠 后 一個(gè) 月 內(nèi) 未 能 作 出 答復(fù)，則視為索賠已為賣方所接受。15
