4、建設(shè)資質(zhì)和能力的專業(yè)公司施工；鑒于：乙方系專業(yè)從事隧道工程建設(shè)的施工公司，具有相應(yīng)的工程資質(zhì)和能力，中標承包本合同工程；據(jù)此，甲方將一號隧道的洞身鉆爆開挖、洞門修建、防排水設(shè)施、錨網(wǎng)噴支護、襯砌、洞內(nèi)溝槽及洞室和相應(yīng)的隧道施工附屬項目承包給乙方施工，經(jīng)雙方協(xié)商一致，訂立本合同，共同遵守。WHEREAS: Party A being general contractor of railway engineering will, for necessity of railway construction and gain employers consent, contract through bi

21、 and defects repair.六、工程質(zhì)量標準與驗收 Project Quality Standards and Acceptance1、乙方必須嚴格按照甲方技術(shù)交底、現(xiàn)行鐵路驗收標準和鐵路施工規(guī)范組織施工。乙方所承包的工程，必須達到國家或本行業(yè)現(xiàn)行的工程質(zhì)量驗收標準。Party B should, in strict conformity with party As technical direction and existing railway acceptance standard / norm, carry out execution hereof. 22、contracted by party B should satisfy to the acceptance standard which are stipulated by state or industry.2、凡因乙方原因造成的施工質(zhì)量不合格的工程，乙方應(yīng)在規(guī)定的時間內(nèi)無償進行返工，如果返工后仍達不到驗收標準的，甲方有權(quán)委派其它單位或個人進行整修，費用由乙方承擔(dān)。Provided that any defect / unqualified work in project execution due to party B, rework should be carried out by p

32、for archiving.十一、安全施工 Safe Construction1、乙方在施工中必須嚴格按施工技術(shù)規(guī)范、操作步驟及安全保護措施進行施工生產(chǎn)，如果由于乙方原因造成的人員傷亡和財產(chǎn)損失等事故，一切責(zé)任和后果均由乙方承擔(dān)。Party B should in strict accordance with norm of construction technology, operation procedure and safe protection measure, carry out execution, where any accidents of personal casualtie

35、，雙方必須遵守。Parties hereto should conform with the progress schedule which is agreed by parties and being the integral part of this contract.2、乙方必須按照上報甲方的施工組織設(shè)計方案進行施工，嚴格執(zhí)行進度計劃，如果由于乙方原因造成進度滯后，乙方應(yīng)當(dāng)及時調(diào)整施工計劃，確保施工進度。Party B should in accordance with Design Schedule of Construction Organization, conduct in st

36、rict progress plan, where any progress delay occur due to party B, the adjustment of execution should be make for ensure project progress.十三、承包工程價款支付和結(jié)算 Settlement and Payment1、甲方不撥預(yù)付款，根據(jù)實際完成情況，按本合同第四條規(guī)定每月甲方根據(jù)由項目總工審核批準的工程量核定工程價款。每次應(yīng)付金額為其驗工計價的80%，同時扣減甲方供應(yīng)的材料及提供的水電費；扣留20%作為工程質(zhì)量保證金。No advance payment w

38、cceptance completion after deduction of the costs of materials, water and power, which are supplied by party A in addition to deduction of 20% of due payment as quality retention.2、乙方施工工程全部完成并通過甲方、監(jiān)理、業(yè)主的驗收達到質(zhì)量要求后，進行工程結(jié)算。結(jié)算支付限額為合同總價的90%，扣減合同總價的10%作為保修金。待承包工程缺陷責(zé)任期、保修期滿后，保修金一次付清（無息）。Engineering settlem

In the event of any conflict between the terms and provisions of the main body of the Contract and the Schedules or Annexes, the terms and provisions of the main body of this Contract shall prevail.本

54、ng and Measuring十、施工用電：Construction Power Supply十一、施工機具：Construction Equipment十二、通風(fēng) Air supply一、隧道開挖前的準備工作1. 隧道施工前，應(yīng)根據(jù)工程地質(zhì)、水文地質(zhì)資料制定防排水方案；隧道進洞前要做好洞頂、洞口、輔助坑道的地面排水系統(tǒng)，防止地表水的下滲和沖刷；施工中要對洞內(nèi)的出水部位、水量大小、涌水情況、變化規(guī)律，補給來源及水質(zhì)成份做好觀測和記錄，并不斷改善防排水措施。Before the tunnel construction, the waterproof and dewatering plans s
