3、準(zhǔn)工時(shí)制,即每日工作 小時(shí),每周工作 天。 不定時(shí)工作制,即勞動(dòng)保障部門(mén)審批,乙方所在崗位實(shí)行不定時(shí)工作制。 綜合計(jì)算工時(shí)工作制,即經(jīng)勞動(dòng)保障部門(mén)審批,乙方所在崗位實(shí)行以 周期, 總工時(shí)小時(shí)的綜合計(jì)算工時(shí)工作制。四、 勞動(dòng)報(bào)酬第七條 甲方每月8日以貨幣的形式足額支付乙方工資,結(jié)算周期為上月月初到上月月末,實(shí)行先工作后發(fā)薪的制度。第八條 乙方正常工作基本月薪 ,年度獎(jiǎng)金: 。根據(jù)公司經(jīng)營(yíng)狀況和乙方工作表現(xiàn)、乙方工資及獎(jiǎng)金可另行調(diào)整。第九條 甲方按照國(guó)家有關(guān)規(guī)定對(duì)乙方所應(yīng)承擔(dān)的社會(huì)保險(xiǎn)費(fèi)用及個(gè)人所得稅進(jìn)行代繳。第十條 甲方調(diào)整乙方工作崗位的,根據(jù)乙方能力及其相關(guān)職位,雙方協(xié)商一致后調(diào)整乙方勞動(dòng)報(bào)酬
4、。五、社會(huì)福利和福利待遇第十一條 甲方根據(jù)國(guó)家有關(guān)規(guī)定為非農(nóng)業(yè)戶(hù)口乙方繳納上海市城鎮(zhèn)社會(huì)保險(xiǎn)(養(yǎng)老、醫(yī)療、失業(yè)、住房公積金),個(gè)人繳納部分由甲方從乙方工資中代扣代繳;為農(nóng)業(yè)戶(hù)口乙方繳納上海市小城鎮(zhèn)社會(huì)保險(xiǎn)小三金(失業(yè)、生育、工傷);外來(lái)員工由甲方繳納綜合保險(xiǎn)。甲乙雙方解除、終止勞動(dòng)合同時(shí),甲方按有關(guān)規(guī)定為乙方辦理社會(huì)保險(xiǎn)相關(guān)手續(xù)。第十二條 乙方工傷待遇按國(guó)家和地方有關(guān)政策法規(guī)規(guī)定執(zhí)行。第十三條 因公出差按公司規(guī)定實(shí)行差旅費(fèi)報(bào)銷(xiāo)與補(bǔ)貼。六、勞動(dòng)紀(jì)律第十四條 合同期間,乙方應(yīng)嚴(yán)格遵守國(guó)家的各項(xiàng)法律法規(guī)及甲方依法制定的各項(xiàng)規(guī)章制度及要求,嚴(yán)格遵守勞動(dòng)安全衛(wèi)生、操作規(guī)程及工作規(guī)范;應(yīng)愛(ài)護(hù)甲方財(cái)產(chǎn),遵守
5、職業(yè)道德,積極維護(hù)公司榮譽(yù)和利益。第十五條 乙方違反勞動(dòng)紀(jì)律 ,甲方可依據(jù)本公司的規(guī)章制度給予紀(jì)律處分,直至解除本勞動(dòng)合同。另外,由于乙方的原因?qū)追皆斐山?jīng)濟(jì)損失的,原則上必須按照實(shí)際損失金額由乙方向甲方承擔(dān)損害賠償責(zé)任,數(shù)目重大者甲方有權(quán)追究其法律責(zé)任。第十六條 在本合同履行過(guò)程中,甲方根據(jù)國(guó)家有關(guān)規(guī)定可以制定新的規(guī)章制度,也可以對(duì)公司制定的規(guī)章制度進(jìn)行修改,發(fā)布的各種規(guī)章制度、操作規(guī)定、通知、公告等均對(duì)乙方有約束力。第十七條 若本合同條款與國(guó)家新規(guī)定及甲方新規(guī)章制度相抵觸,乙方同意服從國(guó)家新規(guī)定和甲方新規(guī)章制度。七、勞動(dòng)合同的履行和變更第十八條 甲方應(yīng)按照約定為乙方提供適當(dāng)?shù)墓ぷ鲌?chǎng)所、勞動(dòng)
6、條件和工作崗位,并按時(shí)向乙方支付勞動(dòng)報(bào)酬。乙方應(yīng)當(dāng)認(rèn)真履行自己的勞動(dòng)職責(zé),并親自完成本合同約定的工作任務(wù)。第十九條 甲、乙雙方協(xié)商一致,可以變更本合同內(nèi)容,并以書(shū)面的形式確定。 八、勞動(dòng)合同的解除、終止和續(xù)訂第二十條 經(jīng)甲、乙雙方當(dāng)事人協(xié)商一致,本合同可以解除。雙方應(yīng)提前三十日(試用期為提前三日)以書(shū)面形式通知對(duì)方,方可解除本協(xié)議。第二十一條 乙方有下列情形之一的,甲方可以隨時(shí)解除本合同: 1、嚴(yán)重違反勞動(dòng)紀(jì)律和規(guī)章制度的; 2、嚴(yán)重失職,營(yíng)私舞弊,給甲方造成重大損失的; 3、乙方?jīng)]有經(jīng)過(guò)甲方同意,同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對(duì)完成甲方的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)甲方提出,拒不改正的;
7、4、因勞動(dòng)合同期滿(mǎn)致使本合同無(wú)效的; 5、依法被追究刑事責(zé)任或勞動(dòng)教養(yǎng)的; 6、乙方利用職務(wù)之便收受賄賂的或泄漏公司機(jī)密造成公司損失的。第二十二條 有下列情形之一的,乙方可以隨時(shí)通知甲方解除本合同。 1、在試用期內(nèi)的; 2、甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動(dòng)的; 3、甲方未按照勞動(dòng)合同約定支付勞動(dòng)報(bào)酬或者提供勞動(dòng)條件的。第二十三條 符合下列情形之一的,甲方提前三十日(試用期為提前三日)以書(shū)面形式通知乙方,解除本合同: 1、患病或非因工負(fù)傷,在規(guī)定醫(yī)療期滿(mǎn)后,不能從事原工作,也不能從事甲方另行安排的工作的; 2、乙方不能勝任工作,經(jīng)過(guò)調(diào)整工作崗位,仍不能勝任工作的; 3、本合同訂
8、立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無(wú)法履行,經(jīng)甲、乙雙方協(xié)商,未能變更本合同內(nèi)容達(dá)成協(xié)議的; 4、按照相關(guān)法規(guī)及程序甲方依法裁員的。第二十四條 乙方有下列情形之一的,甲方不得按本合同第二十四條的約定與乙方解除勞動(dòng)和同: 1、在甲方工作期間患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者部分喪失勞動(dòng)能力的; 2、患病或因工負(fù)傷,在規(guī)定的醫(yī)療期間的; 3、女職工在孕期、產(chǎn)期、哺乳期的; 4、法律、行政法規(guī)規(guī)定的其他情形。第二十五條 符合下列情形之一的,本勞動(dòng)合同即可終止: 1、勞動(dòng)合同期滿(mǎn); 2、乙方死亡、或者被法院宣告死亡或者宣告失蹤的; 3、甲方依法被宣告破產(chǎn)的; 4、甲方被吊銷(xiāo)營(yíng)業(yè)執(zhí)照、責(zé)令關(guān)
9、閉、撤銷(xiāo)或者甲方?jīng)Q定提前解散的; 5、法律、行政法規(guī)規(guī)定的其他情形。九、賠償責(zé)任、違約責(zé)任第二十六條 乙方未能提前書(shū)面提出解除勞動(dòng)合同的賠償金:未按照勞動(dòng)合同法提前三十日書(shū)面形式通知甲方解除勞動(dòng)合同,需按照乙方日工資的標(biāo)準(zhǔn)來(lái)補(bǔ)足時(shí)間的賠償。第二十七條 乙方造成直接損失的賠償金:賠償金按乙方實(shí)際造成的損失計(jì)算,賠償金的范圍包括: 1、乙方損壞甲方財(cái)物而導(dǎo)致的直接經(jīng)濟(jì)損失; 2、乙方疏忽導(dǎo)致的甲方直接經(jīng)濟(jì)損失; 3、乙方拒絕合理的工作安排而導(dǎo)致甲方經(jīng)濟(jì)損失。第二十八條 甲方根據(jù)乙方的要求出資為乙方辦理了外省市專(zhuān)業(yè)技術(shù)人員、管理人員的調(diào)動(dòng)引進(jìn)手續(xù),在入戶(hù)手續(xù)完畢后,必須在本公司服務(wù)期滿(mǎn) 年。服務(wù)期內(nèi)
10、,乙方不得提出辭職解除合同。若在服務(wù)期內(nèi)自行離開(kāi)公司或違紀(jì)被甲方解除合同的,按 元人民幣的賠償額,根據(jù)乙方未服務(wù)滿(mǎn)的年限,按比例折算(年平均賠償金額)賠償。 第二十九條 甲乙雙方任何一方違反本合同,給另一方造成經(jīng)濟(jì)損失的,根據(jù)違約者責(zé)任大小,需承擔(dān)違約責(zé)任。第三十條 乙方不得在任何情況下將甲方的保密資料直接或者間接泄露給任何外人,如經(jīng)甲方發(fā)現(xiàn)按甲方損失大小賠償。十、勞動(dòng)爭(zhēng)議的處理第三十一條 甲乙雙方協(xié)商解決。第三十二條 甲乙雙方協(xié)商不成,可由爭(zhēng)議的一方申請(qǐng)勞動(dòng)仲裁。十一、其他第三十三條 本合同未盡事宜,按國(guó)家和當(dāng)?shù)卣嘘P(guān)法律、法規(guī)規(guī)定辦理。第三十四條 從本合同簽訂生效之日起,原合同即日廢止。

20、& BenefitsArticle 11Article 12Article 13According to the States related rules, Party A will pay Shanghai social insurance in urban area (i.e. pension insurance, unemployment insurance, medical insurance and housing fund) for Party B whose household registration is non- rural family. And Party A will
21、 deduct Party Bs part from his or her salary; in case Party Bs household registration is rural family, Party A will pay Shanghai social insurance in small towns and counties (unemployment insurance, maternity insurance and employment injury insurance) for Party B; in case Party B is an out-of-town e
22、mployee, Party A will cover comprehensive insurance for Party B. When the labor contract is terminated by both parties, Party A will handle the related procedures for Party Bs social insurance according to the related regulations.Party B will be treated as stipulated by the State and Shanghai in cas
23、e he or she is injured during the work.In case Party B travels on business, Party A will reimburse travelling expenses and give subsidy to Party B in accordance with the company rules.6. Labor DisciplinesArticle 14Article 15Article 16Article 17Within the contract term, Party B shall abide by the Sta
24、tes laws and regulations as well as the rules formulated by Party A according to the laws; follow labor security and hygiene systems, production processes, operating instructions and job specifications; take good care of Party As property; and safeguard the benefits and reputation of the company.In
25、case Party B violates any of the labor disciplines, Party A may punish Party B or even release the contract according to the rules and regulations of the company. Moreover, Party B will be held liable for Party As economic losses on a case-by-case basis, in the event that Party Bs behavior damages P
26、arty As interests. In case of the considerable amount of losses, Party A will retain the right to pursue legal actions against Party B.During the contract performance, Party A may formulate new or revise rules and regulations based on the States related regulations. The rules and regulations, operat
27、ing provisions, notices and proclamations are binding on Party B.In case any article herein conflicts with the new regulations and rules issued by the State and Party A, Party B agrees to obey the latter.7. Labor Contract Performance & AlternationArticle 18Article 19Party A shall furnish Party B wit
28、h proper working place, labor conditions and position, and shall also pay the remuneration to Party B on time, conforming to the provisions herein. Party B shall fulfill his responsibilities herein in due diligence.The contract may be revised in written form, after both parties agreement through neg
29、otiation. 8. Labor Contract Cancellation, Termination & Renewal Article 20The contract may be canceled based on both parties mutual negotiation. Either party intending to cancel the contract shall inform the other party in written form 30 days in advance (Probation period: 3 days in advance).Article
30、 21Party A may cancel the contract in case any of the following occurs:Party B severely violates the labor disciplines and regulations;Party Bs gross negligence or jobbery causes great losses for Party A;Party B holds another job without the permit of Party A, which seriously affects the completion
31、of Party As work task, or Party B refuses to correct the error after Party As warning;The contract turns invalid due to expiration;Party B is held criminally responsible or reeducated through labor; orParty B accepts bribes by taking advantage of duty or causes the loss of the company by virtue of d
32、ivulging the commercial secrets. Article 22Party B may notify Party A of terminating the contract at any time, in case any of the following occurs:1. Within the probation;2. Party A forces Party B to work by violence, threat or illegal limitations of Party Bs freedom.3. Party A fails to pay Party Bs
33、 salary or provide work conditions as stipulated herein.Article 23Party A may cancel the contract upon 30 days prior written notice to Party B (Probation: 3 days in advance), in case any of the following occurs:1. Party B, due to sickness or injury inflicted off the job, can not resume his or her wo
34、rk or do the other job reassigned by Party A after specified period of medical treatment; 2. Party B is unqualified, even after a training or job adjustment;3. The objective conditions on which the contract is based have materially changed to the extent that it is impossible to perform the contract
35、while both parties cannot reach an agreement to amend the contract to reflect the changed conditions; or4. Party A downsizes according to related laws and procedures.Article 24Party A is not allowed to cancel the labor contract as per Article 24 in case any of the following occurs:Party B is confirm
36、ed partly or totally incapacitated due to an industrial injury or an occupational disease when working for Party A;Party B is in a period of medical treatment for sickness or work injury;The female employee is in pregnancy, maternity or lactation; orOther situations stipulated in laws and administra
37、tive provisions.Article 25The contract will terminate in case any of the following occurs:1. The labor contract expires;2. Party B is dead, pronounced dead or pronounced missing by the peoples court;3. Party A is declared bankruptcy legally;4. Party As business license is revoked; Party A is compell
38、ed to close down or dissolve; or Party A decides to dissolve in advance; or5. Other situations stipulated in laws and administrative provisions.9. Compensation for the Breach or Cancellation of the Contract Article 26In case Party B fails to notify Party A of cancelling the contract in written form
39、30 days in advance as per the Labor Contract Law, he or she shall compensate Party A for the advanced time based on Party Bs daily wage.Article 27In case Party Bs behavior causes the losses of Party A, the compensation amount is calculated based on the actual losses caused by Party B. The compensati
40、on includes: 1. The direct economic losses caused by Party Bs damages of Party As property;2. The direct economic losses resulting from Party Bs negligence; and3. The economic losses due to Party Bs rejection of the reasonable work assigned by Party A.Article 28As required by Party B, Party A may ha
41、ndle the procedures for the introduction of Party B as a professional or manager from other provinces cities. After the procedure is fulfilled, Party B shall serve the company for _ years.
