4.3分包Subcontracting

4.3.1承包人不得將其承包的全部工程轉(zhuǎn)包給第三人，或?qū)⑵涑邪娜?/p>

部工程肢解后以分包的名義轉(zhuǎn)包給第三人。

4.3.2分包的內(nèi)容ContentofSubcontracting

當(dāng)事人約定某些非主體、非關(guān)鍵性工作分包給第三人：

4.3.3分包人的資格能力應(yīng)與其分包工作的標(biāo)準(zhǔn)和規(guī)模相適應(yīng)。

4.3.4按投標(biāo)函附錄約定分包工程的，承包人應(yīng)向發(fā)包人和監(jiān)理人提交

分包合同副本。

appencHxt。thebidletter,thecontractorshallsubmitacopyof

thesubcontracttotheemployerandsupervisor.

4.3.5承包人應(yīng)與分包人就分包工程向發(fā)包人承擔(dān)連帶責(zé)任。

severallyliabletotheemployerforthesubcontractworks.

4.3.6在工程施工過程中，承包人進(jìn)行專業(yè)分包必須遵守以下規(guī)定：

Duringtheconstructionoftheproject,thecontractorshould

abidebythefollowingruleswhencarryingoutprofessional

subcontracting:

(1)專業(yè)分包工程不得再次分包。

Professionalsubcontractingprojectsshallnotbesubcontracted

again.

(2)承包人和專業(yè)分包人應(yīng)當(dāng)依法簽訂專業(yè)分包合同，并按照合同履

行約定的義務(wù)。專業(yè)分包合同必須明確約定工程款支付條款、結(jié)算方式

以及保證按期支付的相應(yīng)措施，確保工程款的支付。

Thecontractorandtheprofessionalsubcontractorshallsigna

professionalsubcontractaccordingtolaw,andperformthe

agreedobligationsinaccordancewiththecontract.Professional

subcontractsshouldclearlystipulatethepaymentterms,

settlementmethodsandcorrespondingmeasurestoensure

paymentontimetoensurethepaymentofconstructionfunds.

(3)承包人對(duì)施工現(xiàn)場安全負(fù)總責(zé)，并對(duì)專業(yè)分包人的安全生產(chǎn)進(jìn)行

培訓(xùn)和管理。專業(yè)分包人應(yīng)將其專業(yè)分包工程的施工組織設(shè)計(jì)和施工安

全方案報(bào)承包人備案。專業(yè)分包人對(duì)分包施工現(xiàn)場安全負(fù)責(zé)，發(fā)現(xiàn)事故

隱患，應(yīng)及時(shí)處理。

Thecontractorisfullyresponsibleforthegeneralsafetyofthe

constructionsite,andtrainsandmanagesthesafetyof

professionalsubcontractors.Theprofessionalsubcontractor

shallreporttheconstructionorganizationdesignand

constructionsafetyplanoftheprofessionalsubcontracted

projecttotheemployerfortherecord.Theprofessional

subcontractorisresponsibleforthesafetyofthesubcontracted

constructionsite,andshoulddiscoverthehiddendangerofthe

accidentandshouldhandledintime.

(4)所有專業(yè)分包計(jì)劃和專業(yè)分包合同須報(bào)監(jiān)理人審批，并報(bào)發(fā)包人

核備。監(jiān)理人審批專業(yè)分包并不解除合同規(guī)定的承包人的任何責(zé)任和義

務(wù)。

Allprofessionalsubcontractingplansandprofessional

subcontractsshouldbesubmittedtothesupervisorforapproval,

andreportedtotheemployerforverification.Theapprovalof

theprofessionalsubcontractorbythesupervisordoesnot

relieveanyoftheresponsibilitiesandobligationsofthe

contractorstipulatedinthecontract.

4.3.7發(fā)包人對(duì)承包人與專業(yè)分包人之間的法律與經(jīng)濟(jì)糾紛不承擔(dān)任何

責(zé)任和義務(wù)。

Theemployershallnotberesponsibleorliableforlegaland

economicdisputesbetweenthecontractorandtheprofessional

subcontractor.

4.4聯(lián)合體Consortium

4.4.1聯(lián)合體各方應(yīng)共同與發(fā)包人簽訂合同。聯(lián)合體各方應(yīng)為履行合同

承擔(dān)連帶責(zé)任。

Allpartiestotheconsortiumshalljointlysignacontractwiththe

employer.Thepartiestotheconsortiumshallundertakethe

jointlyandseverallyliabilitiesfortheperformanceofthe

contract.

4.4.2聯(lián)合體協(xié)議經(jīng)發(fā)包人確認(rèn)后作為合同附件。在履行合同過程中，

未經(jīng)發(fā)包人同意，不得修改聯(lián)合體協(xié)議。

Theconsortiumagreementshallbetakenasanannextothe

contractwithconfirmationoftheemployer.Duringthe

performanceofthecontract,theconsortiumagreementshall

notbechangedormodifiedwithouttheconsentofthe

employer.

4.4.3聯(lián)合體牽頭人負(fù)責(zé)與發(fā)包人和監(jiān)理人聯(lián)系，并接受指示，負(fù)責(zé)組

織聯(lián)合體各成員全面履行合同。

Theleaderoftheconsortiumisresponsibleformakingcontact

withtheemployerandsupervisorandreceivinginstructionsto

organizeallmembersoftheconsortiumtofullyperformthe

contract.

4.4.4未經(jīng)發(fā)包人事先同意，聯(lián)合體的組成與結(jié)構(gòu)不得變動(dòng)。

Thecompositionandstructureoftheconsortiumshallnotbe

changedwithoutthepriorconsentofthecontractor.

4.5承包人項(xiàng)目經(jīng)理Contractor'sProjectManager

4.5.1承包人應(yīng)按合同協(xié)議書的約定指派項(xiàng)目經(jīng)理，并在約定的期限內(nèi)

到職。承包人更換項(xiàng)目經(jīng)理應(yīng)事先征得發(fā)包人同意，并應(yīng)在更換14天

前將擬更換的項(xiàng)目經(jīng)理的姓名和詳細(xì)資料提交發(fā)包人和監(jiān)理人。承包人

項(xiàng)目經(jīng)理短期離開施工場地，應(yīng)事先征得監(jiān)理人同意，并委派代表代行

其職責(zé)。

Aprojectmanagerwhichbeingappointedbythecontractor

pursuanttothestipulationhereofshallbeondutywithinthe

stipulatedtimelimit.Thecontractorshallobtaintheconsentof

theemployerinadvancewherereplacingtheprojectmanager,

andshallsubmitthenameanddetailsoftheprojectmanagerto

bereplacedtotheemployerandsupervisor14daysbeforethe

replacement.Ifthecontractor'sprojectmanagerleavesthe

constructionsiteforashortperiodoftime,heshallobtainthe

priorconsentofthesupervisorandappointarepresentativeto

performhisduties.

4.5.2承包人項(xiàng)目經(jīng)理應(yīng)按合同約定以及監(jiān)理人按第3.4款作出的指

示，負(fù)責(zé)組織合同工作的實(shí)施。在情況緊急且無法與監(jiān)理人取得聯(lián)系時(shí),

可采取保證工程和人員生命財(cái)產(chǎn)安全的緊急措施，并在采取措施后24

小時(shí)內(nèi)向監(jiān)理人提交書面報(bào)告。

Theprojectmanagerofthecontractorshall,pursuanttothe

stipulationhereofandtheinstructionsgivenbythesupervisor

underarticle3.4,beresponsiblefororganizingthe

implementationofthecontract.Incaseofemergencyand

unabletogetintouchwiththesupervisor,emergencymeasures

canbetakentoensurethesafetyoftheprojectandpersonnel,

andawrittenreportcanbesubmittedtothesupervisorwithin

24hoursafterthemeasuresaretaken.

4.5.3承包人為履行合同發(fā)出的一切函件均應(yīng)蓋有承包人授權(quán)的施工場

地管理機(jī)構(gòu)章，并由承包人項(xiàng)目經(jīng)理或其授權(quán)代表簽字。

Allcorrespondencesentbythecontractorfortheperformance

ofthecontractshallbestampedwiththesealoftheconstruction

sitemanagementbodyauthorizedbythecontractorandsigned

bythecontractorprojectmanagerorhisauthorized

representative.

4.5.4承包人項(xiàng)目經(jīng)理可以授權(quán)其下屬人員履行其某項(xiàng)職責(zé)，但事先應(yīng)

將這些人員的姓名和授權(quán)范圍書面通知發(fā)包人和監(jiān)理人。

Thecontractor'sprojectmanagermayauthorizeitssubordinate

personneltoperformcertainduties,howevershallnotifyin

advancetheemployerandsupervisorinwritingofthenames

andauthorizationscopeofthesepersonnel.

4.6承包人人員的管理ManagementofContractor'sPersonnel

4.6.1承包人應(yīng)在接到開始工作通知之日起28天內(nèi),向監(jiān)理人提交承

包人的項(xiàng)目管理機(jī)構(gòu)以及人員安排的報(bào)告，其內(nèi)容應(yīng)包括項(xiàng)目管理機(jī)構(gòu)

的設(shè)置、各主要崗位的技術(shù)和管理人員名單及其資格，以及設(shè)計(jì)人員和

各工種技術(shù)工人的安排狀況。承包人應(yīng)向監(jiān)理人提交施工場地人員變動(dòng)

情況的報(bào)告。

Thecontractorshall,within28daysfromthedateofreceiving

thenoticeofcommencement,submittothesupervisorthe

reportofthecontractor'sprojectmanagementorganizationand

personnelarrangement,whichshallincludetheestablishmentof

theprojectmanagementorganization,thelistoftechnicaland

managementpersonnelwiththeirqualificationsforeachmajor

post,andthearrangementofthedesignersandtechnical

workersforeachtypeofwork.Thecontractorshallsubmittothe

supervisorareportonthechangesinthepersonnelofthe

constructionsite.

4.6.2為完成合同約定的各項(xiàng)工作，承包人應(yīng)向施工場地派遣或雇傭足

夠數(shù)量的下列人員：

Inordertocompletetheworkstatedinthecontract,the

contractorshallsendoremployasufficientnumberofthe

followingpersonneltotheconstructionsite:

(1)具有相應(yīng)資格的專業(yè)技工和合格的普工；

Professionaltechnicianswithcorrespondingqualificationsand

qualifiedgeneralworkers;

(2)具有相應(yīng)施工經(jīng)驗(yàn)的技術(shù)人員；

Technicalpersonnelwithcorrespondingconstruction

experience;

(3)具有相應(yīng)崗位資格的各級(jí)管理人員。

Managersatalllevelswithcorrespondingpostqualifications.

4.6.3承包人安排在施工場地的主要管理人員和技術(shù)骨干應(yīng)相對(duì)穩(wěn)定。

承包人更換主要管理人員和技術(shù)骨干時(shí)，應(yīng)取得監(jiān)理人的同意。

Themainmanagementpersonnelandtechnicalbackbone

arrangedbythecontractorintheconstructionsiteshallbe

relativelystable.Wherethecontractorchangesthemain

managementpersonnelandthetechnicalbackbone,heshall

obtaintheconsentofthesupervisor.

4.6.4特殊崗位的工作人員均應(yīng)持有相應(yīng)的資格證明，監(jiān)理人有權(quán)隨時(shí)

檢查。監(jiān)理人認(rèn)為有必要時(shí)，可進(jìn)行現(xiàn)場考核。

Staffmembersinspecialpostshallholdcorresponding

certificatesofqualification,andsupervisorsshallhavetheright

toinspectthematanytime.Ifthesupervisordeemsitnecessary,

hemaycarryouttheon-siteexamination.

4.6.5盡管承包人已派遣了各類人員，但若這些人員仍不能滿足合同進(jìn)

度計(jì)劃和質(zhì)量要求時(shí)，監(jiān)理人有權(quán)要求承包人繼續(xù)增派或雇傭這類人員,

并書面通知承包人和抄送發(fā)包人。

承包人在接到上述通知后應(yīng)立即執(zhí)行監(jiān)理人的上述指示，不得無故拖延,

由此增加的費(fèi)用和（或）工期延誤由承包人承擔(dān)。

Althoughthecontractorhasdispatchedvariouspersonnel,if

thesepersonnelstillcannotmeetthecontractscheduleand

qualityrequirements,thesupervisorhastherighttorequirethe

contractortocontinuetosendorhiresuchpersonnel,andnotify

thecontractorandemployer.

Thecontractorshall,uponreceiptofabovenotice,immediately

implementtheaboveinstructionsofthesupervisor,andshall

notdelayfornoreasonandtheincreasedcostsand/ordelays

intheconstructionperiodshallbebornebythecontractor.

4.7撤換承包人項(xiàng)目經(jīng)理和其他人員

Replacementofcontractorprojectmanagerandotherpersonnel

承包人應(yīng)對(duì)其項(xiàng)目經(jīng)理和其他人員進(jìn)行有效管理。監(jiān)理人要求撤換不能

勝任本職工作、行為不端或玩忽職守的承包人項(xiàng)目經(jīng)理和其他人員的，

承包人應(yīng)予以撤換。

Thecontractorshalleffectivelymanageitsprojectmanagerand

otherpersonnel.Ifthesupervisorrequeststoreplacethe

contractor'sprojectmanagerandotherpersonnelwhicharenot

qualifiedfortheirjoborduty,misbehaviororneglectofduty,

thecontractorshallreplacethem.

4.8保障承包人人員的合法權(quán)益

Safeguardoflegitimaterightsandinterestsofcontractor's

personnel

4.8.1承包人應(yīng)與其雇傭的人員簽訂勞動(dòng)合同，并按時(shí)發(fā)放工資。

Thecontractorshallsignlaborcontractswithitsemployeesand

paywagesontime.

4.8.2承包人應(yīng)按勞動(dòng)法的規(guī)定安排工作時(shí)間，保證其雇傭人員享有休

息和休假的權(quán)利。因設(shè)計(jì)、施工的特殊需要占用休假日或延長工作時(shí)間

的，應(yīng)不超過法律規(guī)定的限度，并按法律規(guī)定給予補(bǔ)休或付酬。

Thecontractorshallarrangeworkinghoursinaccordancewith

theprovisionsoftheLaborLawtoensureitsemployeesenjoy

therighttorestandvacation.Ifthespecialneedsofthebidding

sectionconstructiontakeupholidaysorextendworkinghours,

shallnotexceedthelimitsprescribedbylaw,andshallbe

compensatedorpaidinaccordancewiththeprovisionsofthe

law.

4.8.3承包人應(yīng)為其雇傭人員提供必要的食宿條件，以及符合環(huán)境保護(hù)

和衛(wèi)生要求的生活環(huán)境，在遠(yuǎn)離城鎮(zhèn)的施工場地，還應(yīng)配備必要的傷病

防治和急救的醫(yī)務(wù)人員與醫(yī)療設(shè)施。

Thecontractorshallprovidenecessaryaccommodationforits

employeesandlivingenvironmentwhichmeettherequirements

ofenvironmentalprotectionandhygiene.Intheconstruction

sitefarawayfromthetown,thecontractorshallalsobe

equippedwithnecessarymedicalpersonnelandmedical

facilitiesforthepreventionandtreatmentofinjuriesandfirst

aid.

4.8.4承包人應(yīng)按國家有關(guān)勞動(dòng)保護(hù)的規(guī)定，采取有效的防止粉塵、降

低噪聲、控制有害氣體和保障高溫、高寒、高空作業(yè)安全等勞動(dòng)保護(hù)措

施。其雇傭人員在施工中受到傷害的，承包人應(yīng)立即采取有效措施進(jìn)行

搶救和治療。

Thecontractorshalltakeeffectivelaborprotectionmeasuresto

preventdust,reducenoise,controlharmfulgasesandensure

hightemperature,coldandhighaltitudeoperationsafetyin

accordancewithrelevantnationallaborprotectionregulations.

Thecontractorshallimmediatelytakeeffectivemeasuresto

rescueandtreattheemployeeswhoareinjuredinthe

construction.

4.8.5承包人應(yīng)按有關(guān)法律規(guī)定和合同約定，為其雇傭人員辦理保險(xiǎn)。

torelevantlaws,regulationsandthecontractagreement.

4.8.6承包人應(yīng)負(fù)責(zé)處理其雇傭人員因工傷亡事故的善后事宜。

4.9工程價(jià)款應(yīng)?？顚Ｓ肞rojectpriceshouldbeearmarked

發(fā)包人按合同約定支付給承包人的各項(xiàng)價(jià)款應(yīng)專用于合同工作。

承包人必須在發(fā)包人指定的當(dāng)?shù)劂y行設(shè)立專用帳戶，并接受發(fā)包人的監(jiān)

管。

contractshallbeusedexclusivelyforthecontractwork.

Thecontractorshouldsetupaspecialaccountatthelocalbank

designatedbytheemployerandbesubjecttothesupervisionof

4.10承包人現(xiàn)場查勘Contractorsitesurvey

4.10.1發(fā)包人應(yīng)將其持有的現(xiàn)場地質(zhì)勘探資料、水文氣象資料提供給

承包人，并對(duì)其準(zhǔn)確性負(fù)責(zé)。但承包人應(yīng)對(duì)其閱讀上述有關(guān)資料后所作

出的解釋和推斷負(fù)責(zé)。

dataandhydrometeorologicaldataheldbyhimandbe

responsiblefortheaccuracythereof.However,thecontractor

shallberesponsiblefortheinterpretationandinferenceafter

readingtheaboverelevantinformation.

4.10.2承包人應(yīng)對(duì)施工場地和周圍環(huán)境進(jìn)行查勘，并收集有關(guān)地質(zhì)、

水文、氣象條件、交通條件、風(fēng)俗習(xí)慣以及其他為完成合同工作有關(guān)的

當(dāng)?shù)刭Y料。在全部合同工作中，應(yīng)視為承包人已充分估計(jì)了應(yīng)承擔(dān)的責(zé)

任和風(fēng)險(xiǎn)。

Thecontractorshallsurveytheconstructionsiteand

surroundingenvironmentandcollectrelevantdataand

informationofgeological,hydrological,meteorological

conditions,trafficconditions,customsandotherrelatedtothe

completionofthecontractwork.Inallcontractwork,the

contractorshallbedeemedtohavefullyestimatedthe

responsibilitiesandriskstobeborne.

4.11不利物質(zhì)條件Unfavorablematerialcondition

4.11.1不利物質(zhì)條件，除專用合同條款另有約定外，是指承包人在施

工場地遇到的不可預(yù)見的自然物質(zhì)條件、非自然的物質(zhì)障礙和污染物，

包括地下和水文條件，但不包括氣候條件。

Adversematerialconditions,unlessotherwisestipulatedinthe

particularconditionhereof,refertotheunforeseennatural

materialconditions,unnaturalmaterialobstaclesandpollutants

encounteredbythecontractorattheconstructionsite,including

undergroundandhydrologicalconditions,however,excluding

climaticconditions.

4.11.2承包人遇到不利物質(zhì)條件時(shí)，應(yīng)采取適應(yīng)不利物質(zhì)條件的合理

措施繼續(xù)施工，并及時(shí)通知監(jiān)理人。監(jiān)理人應(yīng)當(dāng)及時(shí)發(fā)出指示，指示構(gòu)

成變更的，按第15條約定辦理。監(jiān)理人沒有發(fā)出指示的，承包人因采

取合理措施而增加的費(fèi)用和（或）工期延誤，由發(fā)包人承擔(dān)。

provisionsofarticle15.Ifthesupervisorfailstogiveinstructions,

thecontractorshallbeartheincreasedcostsand/ordelaysin

theconstructionperiodasaresultoftakingreasonable

measures.

5.2.2承包人應(yīng)根據(jù)合同進(jìn)度計(jì)劃的安排，向監(jiān)理人報(bào)送要求發(fā)包人交

貨的日期計(jì)劃。發(fā)包人應(yīng)按照監(jiān)理人與合同雙方當(dāng)事人商定的交貨日期，

向承包人提交材料和工程設(shè)備。

5.2.3材料和工程設(shè)備的接收、運(yùn)輸與保管：

5.2.4發(fā)包人要求向承包人提前交貨的，承包人不得拒絕，但發(fā)包人應(yīng)

承擔(dān)承包人由此增加的費(fèi)用。

5.2.5承包人要求更改交貨日期或地點(diǎn)的，應(yīng)事先報(bào)請(qǐng)監(jiān)理人批準(zhǔn)。由

5.2.6發(fā)包人提供的材料和工程設(shè)備的規(guī)格、數(shù)量或質(zhì)量不符合合同要

求，或由于發(fā)包人原因發(fā)生交貨日期延誤及交貨地點(diǎn)變更等情況的，發(fā)

包人應(yīng)承擔(dān)由此增加的費(fèi)用和（或）工期延誤，并向承包人支付合理利

潤。

5.3材料和工程設(shè)備專用于合同工程

5.3.1運(yùn)入施工場地的材料、工程設(shè)備，包括備品備件、安裝專用工器

具與隨機(jī)資料，必須專用于合同約定范圍內(nèi)的工程，未經(jīng)監(jiān)理人同意,

承包人不得運(yùn)出施工場地或挪作他用。

constructionsite,includingspareparts,installationofspecial

toolsandequipmentandthedatatoequipment,mustbeused

exclusivelyfortheprojectswithinthescopeofthecontract.

Withouttheconsentofthesupervisor,thecontractorshallnot

betransportedoutoftheconstructionsiteorusedforother

purposes.

5.3.2隨同工程設(shè)備運(yùn)入施工場地的備品備件、專用工器具與隨機(jī)資料,

應(yīng)由承包人會(huì)同監(jiān)理人按供貨人的裝箱單清點(diǎn)后共同封存，未經(jīng)監(jiān)理人

同意不得啟用。承包人因合同工作需要使用上述物品時(shí)，應(yīng)向監(jiān)理人提

出申請(qǐng)。

withengineeringequipmentshallbejointlysealedbythe

contractorandthesupervisorafterbeingcountedpursuantto

needstousetheaboveitemsduetothecontractwork,itshall

applytothesupervisor.

5.4禁止使用不合格的材料和工程設(shè)備

5.4.1監(jiān)理人有權(quán)拒絕承包人提供的不合格材料或工程設(shè)備，并要求承

包人立即進(jìn)行更換。監(jiān)理人應(yīng)在更換后再次進(jìn)行檢查和檢驗(yàn)，由此增加

的費(fèi)用和（或）工期延誤由承包人承擔(dān)。

5.4.2監(jiān)理人發(fā)現(xiàn)承包人使用了不合格的材料和工程設(shè)備，應(yīng)即時(shí)發(fā)出

指示要求承包人立即改正，并禁止在工程中繼續(xù)使用不合格的材料和工

程設(shè)備。

Ifthesupervisordiscoversthatthecontractorhasused

unqualifiedmaterialsandengineeringequipment,heshall

immediatelyissueinstructionstorequirethecontractorto

correctthesituationimmediatelyandprohibitthecontinueduse

ofunqualifiedmaterialsandengineeringequipmentinthe

project.

5.4.3發(fā)包人提供的材料或工程設(shè)備不符合合同要求的，承包人有權(quán)拒

絕，并可要求發(fā)包人更換，由此增加的費(fèi)用和（或）工期延誤由發(fā)包人

承擔(dān)。

理人有權(quán)要求承包人增加或更換施工設(shè)備，承包人應(yīng)及時(shí)增加或更換,

由此增加的費(fèi)用和（或）工期延誤由承包人承擔(dān)。

地建設(shè)的臨時(shí)設(shè)施應(yīng)專用于合同工程。未經(jīng)監(jiān)理人同意，不得將上述施

工設(shè)備和臨時(shí)設(shè)施中的任何部分運(yùn)出施工場地或挪作他用。

8.1.1發(fā)包人提供測量基準(zhǔn)點(diǎn)、基準(zhǔn)線和水準(zhǔn)點(diǎn)的期限：

8.1.2承包人應(yīng)負(fù)責(zé)管理施工控制網(wǎng)點(diǎn)。施工控制網(wǎng)點(diǎn)丟失或損壞的，

承包人應(yīng)及時(shí)修復(fù)。承包人應(yīng)承擔(dān)施工控制網(wǎng)點(diǎn)的管理與修復(fù)費(fèi)用，并

在工程竣工后將施工控制網(wǎng)點(diǎn)移交發(fā)包人。

8.2施工測量ConstructionSurvey

8.2.1承包人應(yīng)負(fù)責(zé)施工過程中的全部施工測量放線工作，并配置合格

的人員、儀器、設(shè)備和其他物品。

andpay-offworkintheconstructionprocessinadditionto

equipmentwithqualifiedpersonnel,instruments,equipment

andotherarticles.

8.2.2監(jiān)理人可以指示承包人進(jìn)行抽樣復(fù)測，當(dāng)復(fù)測中發(fā)現(xiàn)錯(cuò)誤或出現(xiàn)

超過合同約定的誤差時(shí)，承包人應(yīng)按監(jiān)理人指示進(jìn)行修正或補(bǔ)測，并承

擔(dān)相應(yīng)的復(fù)測費(fèi)用。

性、準(zhǔn)確性和完整性負(fù)責(zé)。發(fā)包人提供上述基準(zhǔn)資料錯(cuò)誤導(dǎo)致承包人測

量放線工作的返工或造成工程損失的，發(fā)包人應(yīng)當(dāng)承擔(dān)由此增加的費(fèi)用

和（或）工期延
