ofthetrialperiodisthree(3)montBuringthetrialperiodtheEMPLOYEEwillbeboundbyallarticlesofthiseontract.試用期自本合同簽署之日起開始,時(shí)間為三個(gè)月。在試用期間,該員工受本合同全部條款所約束。AfterthespecifiedtrialperiodandifnonoticeofterminationisgiventheEMPLOYEEautomaticallybecomesemployedunderthetermsandconditionsofthisCONTRACT.在約定的試用期內(nèi),若該員工沒有收到關(guān)于解除勞動(dòng)關(guān)系的通知,在試用期滿后,該員工自動(dòng)轉(zhuǎn)為本公司正式員工,執(zhí)行本合同規(guī)定的條款。ARTICLE3:DURATIONOFTHECONTRACT第三條:合同期限ThedurationofthisCONTRACTistwenty-foum(27ths.本合同期限為27個(gè)月。ThisCONTRACTmaybeextendeduponagreementofbothPARTIES.AnextensiontothisCONTRACTshallcomeintoforceonlyafterawrittenagreementhasbeensignedbybothPARTIES.本合同經(jīng)合同雙方同意后可以續(xù)簽。只有在合同雙方簽署書面協(xié)議后,續(xù)簽的合同方能生效。ARTICLE4:SALARY第四條:工資TheCOMPANYshalldefineitsownsalarypolicyinaccordaneewithregulationsstipulatedbythestateandmunicipalgovernment.TheCOMPANYshallensurethatthemonthlysalaryoftheEMPLOYEEisnotlessthantheminimumpaystandardsetbythelocalgovernment.本公司將依照中華人民共和國和北京市有關(guān)政策法規(guī)制定本公司的員工工資標(biāo)準(zhǔn)。本公司保證該員工的月工資將不低于當(dāng)?shù)卣?guī)定的最低工資。TheEMPLOYEEwillreceiveagrosmonthlyo口annualsalaryof3,000.00renminbi(RMB3,000.00)andincreasethereafterthebasisofthestaffperformanee,theeconomicdevelopmentoftheCOMPANYandaccordingtothesalarypolicyoftheCOMPANYapprovedbytheBoardofDirectorsoftheCOMPANY,andetc.該員工稅前工資將為"每月或口每年叁仟元人民幣,今后將按照該員工的工作表現(xiàn)、本公司的經(jīng)濟(jì)效益以及由本公司制定并經(jīng)董事會(huì)批準(zhǔn)的工資標(biāo)準(zhǔn)每年遞增。
********Co.,Ltd********Co.,LtdSuchsalaryshallbetransferredtothebankaccountdesignatedbytheEMPLOYEEbetweenthethirdandfifthdayofeachmonth.上述工資將于每月3號(hào)至5號(hào)期間匯入該員工所指定的銀行賬戶。ARTICLE5PREMIUM&BONUS第五條:獎(jiǎng)金及分紅AtthefulldiscretionoftheChairmanandbaseduponhis/hergeneralattitudeandtheresultofhis/herworkandfulfilmentofhis/herobjectivesdetailedwithhis/hermanagerandatthebeginningofeachcalendaryeartheEMPLOYEEwillbeentitledtoanannualbonusnotexceedingone(1)monthofsalaryandshallbepaidtotheEMPLOYEEforeachfullcalendaryearwhichtheEMPLOYEEworksfortheCOMPANYintwo(2)instalmentsthefollowingyear.經(jīng)本公司董事長同意,并且根據(jù)該員工的工作態(tài)度、工作成果及其上級(jí)主管規(guī)定之工作目標(biāo)的完成狀況,該員工將有權(quán)在每個(gè)公歷年初享受年終獎(jiǎng)金(獎(jiǎng)金總額不超過該員工的月工資)。員工為公司工作滿一年時(shí),獎(jiǎng)金將于次年分兩次發(fā)放給個(gè)人。ARTICLE6:PERSONALINCOMETAX第六條:個(gè)人所得稅TheEMPLOYEEshallpayindividualincometaxinaccordaneewiththerelevantlawsandregulationsftPeople 'sRepublicofChina.TheCOMPANYshawithholdsuchamountandpayittothecompetenttaxbureau.該員工須按照中華人民共和國相關(guān)法律法規(guī)繳納個(gè)人所得稅。本公司將為該員工代扣代徼個(gè)人所得稅,并將應(yīng)納稅款上交相應(yīng)稅務(wù)機(jī)關(guān)。ARTICLE7:TRAINING第七條:培訓(xùn)TheCOMPANYwillestablishanEMPLOYEEtrainingsystemandprovidenecessarytrainingtotheEMPLOYEEinaccordaneewiththerelevantlawsandregulationsofthePeople 'sRepublicofChinaandasthe本公司將依照中華人民共和國有關(guān)法律法規(guī)及公司需求,為該員工設(shè)計(jì)一套培訓(xùn)體系,向該員工提供必要的培訓(xùn)。ARTICLE8:WORKINGHOURS第八條:工作時(shí)間TheCOMPANYwillimplementworkinghoursystemoffortyminimum(40)hoursperweekinaccordaneewiththerelevantlawsandregulationsexclusiveoflunchtime.本公司依照相關(guān)法律法規(guī)實(shí)行每周40小時(shí)工作制(每周工作時(shí)間不得少于40小時(shí)),不包括午餐時(shí)間。TheworkinghoursarefromMondaytoFridayfrom9:00AMto6:00PMwithaone(1)hourforlunchthatmayvaryintimesoastohaveatleastonestaffmemberintheofficeduringlunchtime.工作時(shí)間從周一至周五,每天上午 9點(diǎn)至下午6點(diǎn),午餐時(shí)間為一個(gè)小時(shí)。午餐時(shí)間將根據(jù)具體情況進(jìn)行安排以確保屆時(shí)至少有一名員工留守辦公室。SubjecttotheoperationneedstheCOMPANYmayadoptirregularworkinghoursystemorcalculatetheworkinghoursonsyntheticbasis.根據(jù)實(shí)際工作需要,本公司可能采用不規(guī)則時(shí)間工作制或依照綜合標(biāo)準(zhǔn)計(jì)算工作時(shí)間。TheCOMPANYmayextendtheworkinghoursoftheEMPLOYEEafterconsultationwiththeEMPLOYEEaccordingtotherelevantlawsandregulations.
********Co.,Ltd********Co.,Ltd依照有關(guān)法律法規(guī),與該員工進(jìn)行協(xié)商后,本公司可以延長該員工的工作時(shí)間。TheCOMPANYpaystheEMPLOYEE300percentofthesalary,basedonanhourlyamountaccordingtoArticle4,heretoforworkingduringofficialpublicholidays.若需要員工在法定節(jié)假日加班,公司將根據(jù)本合同第4條中所列工資標(biāo)準(zhǔn)計(jì)算出該員工的每小時(shí)工資,并按照每小時(shí)工資標(biāo)準(zhǔn)的 3倍支付加班工資。NotwithstandingwhatprovidedhereoftheCOMPANYshallextendtheworkinghoursregardlessofArticle8.1andArticle8.3inanyofthefollowingcases:若出現(xiàn)下列情況,無論是否符合本合同第 8.1條和第8.3條中的規(guī)定,本公司均可延長工作時(shí)間:Immediateactionwhichmustbecarriedoutincaseofnaturaldisasters,accidentsorothereventsthatwillendangertheEMPLOYEEproperty,orsafety;由于發(fā)生自然災(zāi)害、事故或其它危及該員工生命、健康、財(cái)產(chǎn)及安全的事件,必須采取緊急措施;Urgentrepairwhichmustbecarriedoutincaseofbreakingdownofoperationequipment,communication,transportationandotherfacilitieswhichwillendangerCOMPANYbusinessorpublicinterest;由于運(yùn)營設(shè)備、通訊設(shè)備、運(yùn)輸設(shè)備及其它設(shè)備發(fā)生故障,危害到本公司的業(yè)務(wù)或公共利益,必須進(jìn)行緊急維修;ContinuousoftheoperationorbusinessoftheCOMPANYwhichshallnotbeinterruptedonstipulatedholidaysandrestdays.由于無法因?yàn)榉ǘㄐ菁俸碗p休日而中斷本公司持續(xù)開展的經(jīng)營運(yùn)作或業(yè)務(wù);Overhaulandmaintenanceoftheequipmentwhichshallonlybemadeonstipulatedholidaysandrestdays;and只能在法定休假和雙休日進(jìn)行的設(shè)備檢修與維護(hù);Emergencyoperationassignmentconcerningnationaldefenee.由于國防原因需要采取緊急措施。ARTICLE9:DISCIPLINE第九條:勞動(dòng)紀(jì)律ApartfromtheprovisionsofthisCONTRACTtheEMPLOYEEmustrespectallrelevantlawsandregulationsofthePeopleregulationsoftheCOMPANYandprovisionsofanyrelevantcollectivelabourcontract.除本合同所規(guī)定之條款外,該員工還須遵守中華人民共和國相關(guān)法律法規(guī)、本公司制定的規(guī)章制度,以及其它勞動(dòng)合同方面的相關(guān)規(guī)^定OTheEMPLOYEEmustrespectandexecuteanyandallformalinstructionsgiventohim/herregardingthedutiesandresponsibilitiesofhis/hertasksofwork.該員工須遵守并執(zhí)行一切與其工作職責(zé)有關(guān)的正式指令。Incasesofanoffence,grossmisconduct,andoranyviolationoflabourdisciplinetheCOMPANYwillnormallycarryoutthefollowingprocedure:若該員工出現(xiàn)過錯(cuò)、嚴(yán)重過失及/或其它違反勞動(dòng)紀(jì)律的行為,本公司一般依照以下程序?qū)υ搯T工進(jìn)行處罰:-Oralwarnin口頭警告-Firstwrittenwarning—次書面警告-Finalwrittenwarning二次書面警告-Dismissal除HowevertheCOMPANYreservestherighttoomitanyofthesestagesasthecasemaybe.然而,本公司有權(quán)根據(jù)實(shí)際情況對(duì)上述某些步驟進(jìn)行調(diào)整。TheEMPLOYEEhastherighttoappealagainstwrittenwarningsordismissaltotheLabourDisputeCommitteeifany.該員工有權(quán)針對(duì)其受到的書面警告或開除決定向勞動(dòng)爭議委員會(huì)提出申訴(如需)。ARTICLE10:SICKNESS&INJURYLEAVE第十條:病假及傷假TheEMPLOYEEwillbeentitledtosicknessandinjuryleavesinaccordaneewiththerelevantlawsandregulations.該員工有權(quán)根據(jù)相關(guān)法律法規(guī)享受病假及傷假。TheEMPLOYEEapplyingforsicknessorinjuryleaveshallfillinaapplicationform 'hisahdrgmtaaagevaLeaveformorethantwo(2)daysshallbeapprovedbytheChiefExecutiveOfficeroftheCOMPANYandsubmittedtotheOfficeManager,HumanResourcesManagerortheirManagerforverificationandfilingbeforegoingforleave.申請(qǐng)病假或傷假時(shí),該員工應(yīng)填寫休假申請(qǐng)表”,并必須得到其上級(jí)主管的準(zhǔn)許。若該員工的休假超過兩(2)天,則需經(jīng)本公司首席執(zhí)行官允許,且應(yīng)在休假前將休假申請(qǐng)表提交至行政經(jīng)理、人力資源部經(jīng)理或直屬上級(jí)經(jīng)理以供審核及存檔。IncaseofanysuddensicknessorinjurytheEMPLOYEEshallinformhis/hermanagernolaterthantheendofthefirstday.AwrittenconfirmationshallbesubmittedtotheOfficeManagerandHumanResourcesManagerforverificationandfilingwithintwo(2)daysafterheorshecomesbacktowork.若該員工突發(fā)疾病或受傷,需在當(dāng)天結(jié)束前通知其上級(jí)經(jīng)理,并在返回崗位后的兩(2)個(gè)工作日內(nèi)將書面說明提交行政經(jīng)理及人力資源部經(jīng)理以供審核及存檔。IftheEMPLOYEEisabsentformorethanone(1)weekhe/shemustensurethattheChiefExecutiveOfficerarekeptinformedoftheprogressatweeklyintervals.若該員工的病假超過一周,該員工必須每周向首席執(zhí)行官報(bào)告其病情狀況。TheEMPLOYEEtakingsicknessorinjuryleavesformorethanone(1)daymustprovideamedicalcertificateissuedbyaqualifieddoctor.Failureorrefusaltoprovidethecertificateorprovidingfalseorinaccurateinformationwillbedeemedasagrossmisconduct.
********Co.,Ltd********Co.,Ltd若該員工休病假或傷假超過一天,必須提供由專業(yè)醫(yī)師出具的病假條。若該員工無法或拒絕提供病假條或提供虛假信息,將被視為嚴(yán)重過失。ARTICLE11:LABOURSAFETY&HYGIENE第十一條:勞動(dòng)安全及勞動(dòng)衛(wèi)生保障TheCOMPANYwillestablishasoundlaboursafetyandhygienefacilitiesandshallstrictlyimplementrulesandstandardsoflaboursafetyandhygieneofthePeopleRepublicofChina,conductlaboursafetyandhygieneeducation,preventaccidentsandreduceoccupationalhazards.本公司將建立一套合理的勞動(dòng)安全衛(wèi)生保護(hù)措施,嚴(yán)格落實(shí)中華人民共和國勞動(dòng)安全衛(wèi)生制度和標(biāo)準(zhǔn),開展勞動(dòng)安全衛(wèi)生教育,防止事故發(fā)生,減少職業(yè)病危害。TheCOMPANYshallprovidetheEMPLOYEEwithlaboursafetyandhygieneconditionsandnecessaryarticlesinconformitywiththerelevantlawsandregulations.本公司將依照有關(guān)法律法規(guī)為該員工提供勞動(dòng)安全衛(wèi)生條件以及必要的設(shè)備。TheEMPLOYEEshallhavetherighttorefusetocarryoutanydangerousoperationforceduponhim/herbymanagementpersonnelinviolationoftherelevantregulations.若該員工的上級(jí)主管違反相關(guān)法律法規(guī),要求其從事危險(xiǎn)性工作,該員工有權(quán)拒絕。ARTICLE12:SOCIALINSURANCES第十二條:社會(huì)保險(xiǎn)TheCOMPANYmustjoinsocialinsuraneeschemesfortheEMPLOYEEinaccordaneewiththerelevantlawsandregulationsofthePeople
********Co.,Ltd********Co.,LtdChinaandshallpayontimesocialinsuraneepremiumstothesocialinsuraneeinstitutionsaccordingtothestandardssetbythelocalauthorities.本公司嚴(yán)格遵守中華人民共和國有關(guān)法律法規(guī)為該員工繳納社會(huì)保險(xiǎn),并且依照當(dāng)?shù)卣块T制定的標(biāo)準(zhǔn)將保險(xiǎn)費(fèi)按時(shí)、全額支付給社會(huì)保險(xiǎn)機(jī)構(gòu)。ARTICLE13:HOLIDAYS第十三條:休假TheEMPLOYEEenjoysstatutoryholidaysforofficialpublicholidays,wedding,andfuneralsinlinewiththerelevantlawsandregulationsofthePeopleChina.該員工依照中華人民共和國有關(guān)法律法規(guī)享受法定休假,包括法定節(jié)假日、婚假、喪假、產(chǎn)假。TheEMPLOYEEisentitledyearly(forafullyearworked)toapaidannualvacationoften(10)workingdaysexclusiveofthestatutoryholidays.該員工在本公司工作滿一年后有權(quán)享受每年十個(gè)工作日的帶薪年假,不含法定節(jié)假日。Theholiday ' srefereneeperiodisfromthefirstdayofJanuarytothethiofDecember.Holidaysaccruedduringoneperiodhavetobetakenonthefollowingholidayperiod.Forthefirstyearofemployment,holidayswillbeaccruedatproratatemporis.每年1月1日至12月31日作為一個(gè)休假年度,當(dāng)年未休的假期只可累積到次年使用。在本公司工作未滿一年的新員工可在次年享受年假,具體的年假天數(shù)按照其實(shí)際工作時(shí)間計(jì)算。AftertheEMPLOYEEcompletesfive(5)yearsofcontinuousworkfortheCOMPANYtheEMPLOYEEisentitledyearly(forafullyearworked)toone(1)furtherworkingdayofpaidannualvacationforeachfullyearwhichtheEMPLOYEEworksforCOMPANY,butthepaidannualvacationshallnotexceedtwenty(20)workingdaysintheaggregate.
********Co.,Ltd********Co.,Ltd該員工在本公司任職滿五年后,在本公司每工作滿一年,每年可以增加一個(gè)工作日的帶薪年假,但每年帶薪年假累積最多不超過二十個(gè)工作日。AllleavemustbetakenattimesagreedwiththeChiefExecutiveOfficeroftheCOMPANYtendaysinadvanee.所有休假必須提前10天向本公司申請(qǐng)并獲得首席執(zhí)行官的同意。ARTICLE14:EXCLUSIVITY&NON-COMPETITION第十四條:唯一性及非競爭協(xié)定TheEMPLOYEEmustdevoteinfullallhis/herworkingtimetotheCOMPANY.該員工在本公司工作期間必須勤奮敬業(yè)。ItisstrictlyforbiddenfortheEMPLOYEEtohaveanyotherprofessionalactivityforhimself/herselforandrelativesorandthirdpartiesevenfreeofcharge.嚴(yán)格禁止該員工在本公司任職期間為其自身及/或親屬及/或第三方提供任何有償或無償專業(yè)勞動(dòng)。TheEMPLOYEEundertakesnottoexercisedirectlyorindirectlyonbehalfofanycompetitortotheCOMPANYevenasfreeofchargeorforhimself/herselfanyactivitywhichmaycompetewiththebusinessoftheCOMPANYforone(1)yearaftertheterminationofthepresentCONTRACT.ThisArticle14.3isnotapplicableifterminationoftheCONTRACTisduetoCOMPANYforotherreasonsthantheonescoveredbyArticle14andArticle15.該員工與本公司解除本合同后一年內(nèi)不得直接或間接地代表本公司的任何競爭對(duì)手從事任何可能傷及本公司利益的有償或無償活動(dòng)。若由于其它原因而非本合同第14條和第15條解除本合同的,不適用本合同第14.3條。TheEMPLOYEEshallpaytheCOMPANYanamountofRMB10,000toRMB100,000asapenaltyclauseifhe/shedoesnotcomplywithArticle14.1.,Article14.2.,andArticle14.3.hereto.ThisamountdoesnotincludethepossibleactualdamageswhichmaybeclaimedbytheCOMPANY.
********Co.,Ltd********Co.,Ltd若該員工違反本合同第14.1條、第14.2條及第14.3條的規(guī)定,其必須向本公司支付1萬-10萬人民幣作為賠償。該筆賠償不包括本公司對(duì)可能造成的實(shí)際損害進(jìn)行索賠的金額。ARTICLE15:CONFIDENTIALITY第十五條:保密協(xié)定TheEMPLOYEEshallkeepstrictlysecretandconfidentialandnottodisclosetoanythirdPARTYanyandalltechnical,economic,financial,clientormarketinginformationacquiredfromtheCOMPANYandorobtainedbecauseofhis/heractivitiesintheCOMPANY.該員工須嚴(yán)守公司機(jī)密,不得向任何第三方透露自本公司處獲得的及/或由于該員工在本公司任職而獲得的任何技術(shù)、經(jīng)濟(jì)、財(cái)務(wù)、客戶或市場信息。TheEMPLOYEEshallnotuseanysuchinformationforanypurposewhatsoeverexceptwithinandforthetasks,duties,andresponsibilitiesprovidedinthisCONTRACT.丄 該員工亦不得將上述信息用于本合同規(guī)定之工作職責(zé)以外的一切活動(dòng)。TheEMPLOYEEagreesthatanydisclosureornonauthoriseduseofsuchinformationshallbeconsideredasaseriousmisconductexceptinthecasewherebytheEMPLOYEEhasreceivedapriorwrittenpermissionfromtheCOMPANYmanagement.該員工認(rèn)同,除非該員工已事先收到本公司管理部門發(fā)出的書面許可,否則,泄露上述信息或在未被授權(quán)的情況下使用上述信息將被視為嚴(yán)重過失行為。TheEMPLOYEEshallcomplywithhis/herconfidentialityobligationspursuanttothisArticle15forthewholetermofthisCONTRACTanddurationoffive(5)yearsaftertheterminationoftheCONTRACT.
********Co.,Ltd********Co.,Ltd該員工在本公司任職期間以及在本合同解除后五 (5年內(nèi)應(yīng)當(dāng)按照本合同第15條的規(guī)定遵守保密協(xié)議。TheEMPLOYEEshallpaytheCOMPANYanamountofRMB10,000toRMB100,00(bsapenaltyifhe/shedoesnotcomplywithhis/herconfidentialityobligationspursuanttothisArticle15.ThisamountdoesnotincludethepossibleactualdamageswhichmaybeclaimedbytheCOMPANY.若該員工違反本合同第15條的規(guī)定,沒有盡到其應(yīng)盡的保密義務(wù),則該員工必須向本公司支付1萬-10萬人民幣作為賠償。該筆賠償不包括本公司對(duì)可能造成的實(shí)際損害進(jìn)行索賠的金額。ARTICLE16:RESPONSIBILITIESOFTHEPARTIES第十六條:雙方職責(zé)EitherofthePARTIESshallperformitsresponsibilitiesunderthisCONTRACTstrictlyinaccordancewiththeprovisionhereof.合同任何一方都應(yīng)按照本合同所規(guī)定的條款嚴(yán)格履行各自職責(zé)。EitherofthePARTIESshouldbearresponsibilitiesforcompensationifitviolatesthisCONTRACT,infringesupontheinterestsoftheotherPARTYandcausesdamagestotheotherPARTY.若合同任何一方違反本合同以及損害本合同另一方的利益并給本合同另一方造成損害,該方承擔(dān)違約責(zé)任。ARTICLE17:TERMINATIONOFTHECONTRACT第十七條:合同終止EitherofthePARTIESshallbeentitledtoterminatethisCONTRACTforreasonsexpresslyprovidedbytherelevantlawsandregulatio^s^ebpie 'sRepublic
********Co.,Ltd********Co.,LtdofChina.SuchterminationofthisCONTRACTshallcomplywiththeproceedingsprovidedbytherelevantlawsandregulations.合同任何一方均有權(quán)依照中華人民共和國相關(guān)法律法規(guī)終止履行本合同。本合同的終止須遵照有關(guān)法律法規(guī)操作進(jìn)行。FurthermoretheCOMPANYmayterminatetheCONTRACTforanyoneofthefollowingreasons:此外,在下列情況下,本公司可隨時(shí)解除本合同:TheEMPLOYEEhasaconflictbetweenpersonalinterestandtheinterestoftheCOMPANYindealingwithsupplier,customers,andindividualsofotherorganisationsdoingorseekingtodobusinesswiththeCOMPANY.該員工在與本公司的供貨商、客戶及其它機(jī)構(gòu)的人員開展業(yè)務(wù)或收集業(yè)務(wù)信息期間發(fā)生其個(gè)人與本公司利益上的沖突。TheEMPLOYEEhasaskedfororreceivedanyadvantageorbenefitseitherinmonetaryornonmonetarytermofanykindformpersonsororganisationshavingbusinessactivitiesdirectlyorindirectlywiththeCOMPANY.該員工向與本公司有直接或間接業(yè)務(wù)往來的任何個(gè)人或機(jī)構(gòu)索取或收受任何貨幣或非貨幣形式的財(cái)物或好處。TheEMPLOYEEfailstoperformhis/herresponsibilitiesunderArticles14andArticle15ofthisCONTRACT.該員工違反本合同第14條和第15條的規(guī)定。TheEMPLOYEEleftfromhis/herworkformorethanfive(5)workingdayswithoutpriorconsentfromtheChiefExecutiveOfficerexceptinthecaseofforcemajeurewhichpreventtheEMPLOYEEfrominformingtheChiefExecutiveOfficer.該員工事先未經(jīng)首席執(zhí)行官準(zhǔn)許擅自離崗超過五個(gè)工作日,若因不可抗力導(dǎo)致該員工無法通知首席執(zhí)行官除外。TheEMPLOYEEmayalsohandoverawrittennoticeofhis/herresignationforpersonalreasons30daysahead.IftheEMPLOYEEdoesnotprovidetheCOMPANYwithonemonthhe/sheshouldpayrtotitheCOMPANYone
COMPANYwithonemonth********Co.,Ltd********Co.,LtdcalendarmonthofsalaryandallowaneementionedinArticle4asthecompensation.若由于其個(gè)人原因,該員工可提前三十天以書面形式提出辭職。若該員工沒有提前三十天向公司遞交辭呈,該員工將向公司支付依本合同第4條所規(guī)定的一個(gè)月的月工資及補(bǔ)助作為補(bǔ)償金。TheCOMPANYshallpaytotheEMPLOYEEanycompensationpursuanttorelevantlawsandregulationsofthePeopleterminationofthisCONTRACTuniessotherwiseprovidedbythelawsorresultingfromtheoccurreneeoftheterminationeventsagreedbyPARTIEShereoforresignationoftheEMPLOYEEforpersonalreasons.ThemaximumamountofcompensationbytheCOMPANYwillnotexceedonecalendarmonthofsalaryandallowaneementionedinArticle4若本合同解除,本公司將遵照中華人民共和國有關(guān)法律法規(guī)向該員工支付補(bǔ)償金,該補(bǔ)償金總數(shù)不超過本合同第 4條所規(guī)定的一個(gè)月的月工資與補(bǔ)助總額。合同雙方依法另行約定解除本合同或者該員工出于個(gè)人原因提出辭職的除外。IncaseofterminationofthisCONTRACTduetofaultoftheEMPLOYEEorresignationoftheEMPLOYEEforpersonalreasons:若因該員工的過失或該員工出于個(gè)人原因解除本合同,貝COMPANYneednotpaytotheEMPLOYEEtheyearlybonusprovidedinArticle5hereto;and本公司無須向該員工支付本合同第5條規(guī)定的年終獎(jiǎng)金;TheEMPLOYEEshallrefundtotheCOMPANYalltheexpensesandcosts
