ishedforcommercialpurposes.國(guó)(1)ContractingPartiessamekindsoflimitationsorexceptionswithregardtotheprotectionofperformersandproducersofphonogramsnationallegislation,inconnectionwiththeprotectionofcopyrightinrightsprovidedforinthisTreatytocertainspconflictwithanormalexploitationoftheperformanceorphonogramanddonotunreasonablyprejudicethelegitimateinterestsoftheperformeroroftheproducerofthephonogram.(1)ThetermofprotectiontobegrantedtoperformersunderthisTreatyshalllast,atleast,untiltheendofaperiodof50yearstheendoftheyearinwhichtheperformancewasfixedinaphonogram.(2)ThetermofprotectiontobegrantedtoproducersofphonogramsunderthisTreatyshalllast,atleast,untiltcomputedfromtheendoftheyearinwhichthephonogramwaspublished,orfailingsuchpublicationwithin50yephonogram,50yearsfromtheendoftheyearinwhichthefixationwasContractingPartiesshallprovideadequatelegalremediesagainstthecircumventionofeffectivetechnologicalmeasuresthatareusedbyperformersorproducersofphonogramsinconnectionwiththeexerciseoftheirrightsunderthisTreatyandthatrestrictacts,inrespectoftheirperformancesorphonogrnotauthorizedbytheperformersortheproducersofphonogramsconcernedorpermittremediesagainstanypersonknowinglyperforminganactsknowing,orwithrespecttocivilremedieshavingreasonableinfringementofanyrightcoveredbythisTreaty:(ii)todistribute,importfordistribution,broadcast,communicateormakauthority,performances,copiesoffixedperformance(2)AsusedinthisArticlinformationwhichidentifiestheperformer,theperformaperformer,theproducerofthephonogram,thephonogram,theowneroftermsandconditionsofuseoftheperformanceorphonogram,andanyitemsofinformationisattachedtoacopyofafixedperformanceoraavailableofafixedperformanceoraphonogramtothepublic.mTheenjoymentandexerciseoftherightsprovidedforinthisTrSubjecttotheprovisionsofArticle15(3),noreservationstothisTrea(1)ContractingP
