Ⅰ.AnIntroductiontoInspectionUnitTheinspectionworkistheactundertakenbytheinspectionstafffromtheinspectionagenciesincludingdeclaringinspectionandquarantinetoinspectionandquarantineinstitutions,goingthroughrelevantformalitiesandstartinginspectionandquarantineprocedurewhichareallinaccordancewithlaw.Theinspectionunitisthemainbodyinvolvedininspection.Itreferstothedomesticlegalpersonsororganizationsthathaveobtainedinspectionqualificationbylegallyregisteringattheinspectionandquarantineagenciesorobtainedinspectionrightapprovedbythem.Theinspectionstaffintheinspectionagenciesisresponsibleforthespecificworkofquarantineagencies.Thenationalgovernmentmanagesinspectionstaffviaregistration.

Afterobtainingastatequalificationcertificateofinspection,theinspectionstaffcanbeginworkingonlyiftheyhaveappliedtothequarantineagenciesandgottheLicenseforInspector.Astothenon-tradeinspection,theinspectionstaffcandirectlygothroughformalitieswithvaliddocuments.

Accordingtothenatureoftheirregistration,therearetwotypesofinspectionunits：self-serviceinspectionunitandsubstitutedinspectionagency.Accordingtotheclassificationofinspectionunits,inspectioncanbedividedintoself-serviceinspectionandsubstitutedinspection.

一、報檢單位概述報檢工作是由報檢單位的報檢員來負責的，依法向檢驗檢疫機構(gòu)申報檢驗檢疫、辦理相關(guān)手續(xù)、啟動檢驗檢疫流程的行為。報檢單位是發(fā)生報檢行為的主體，依法在檢驗檢疫機構(gòu)注冊登記取得報檢資格或經(jīng)檢驗檢疫機構(gòu)批準取得報檢權(quán)的境內(nèi)法人或者組織。報檢單位的具體工作則是由報檢單位的報檢員負責。國家對報檢員實行注冊管理。報檢人員取得“報檢員資格證”后，向檢驗檢疫機構(gòu)提出申請，獲得“報檢員證”方可從事工作。非貿(mào)易性質(zhì)的報檢行為，報檢人員憑有效的證件直接辦理手續(xù)。按照報檢單位登記的性質(zhì)，可分為自理報檢單位和代理報檢單位兩種。按照報檢單位的類型分類，報檢行為分為自理報檢和代理報檢。Ⅱ.Self-serviceInspectionUnitTheself-serviceinspectionunitistheconsigneeorconsignorofentry-exitgoodsorothergoodssubjecttoinspection,ortheunitsforproducing,processing,storingandoperatingimportandexportgoods,whogothroughinspectionprocedureanddeclaretotheentry-exitquarantineagencybythemselvesorbysubstitutedinspectionagency.Itmustberegisteredandputonrecordsatthequarantineagencyandgetinspectionunitcodebeforehandlingrelevantinspectionanddeclarationbusinessinthefirstinspection.Self-serviceinspection,alsocalledself-serviceinspectionact,referstotheinspectionactinwhichtheengagedunitinspectsanddeclarestheimportandexportgoodsproduced,processed,storedoroperatedbyitsownenterprise.二、自理報檢單位自理報檢單位，是指根據(jù)我國法律法規(guī)規(guī)定辦理出入境檢驗檢疫報檢/申報，或委托代理報檢單位辦理出入境檢驗檢疫報檢/申報手續(xù)的出入境貨物或其他報檢物的收發(fā)貨人、進出口貨物的生產(chǎn)、加工、儲存和經(jīng)營單位等，在首次報檢時須辦理備案登記手續(xù)，取得報檢單位代碼后，可辦理相關(guān)檢驗檢疫報檢/申報業(yè)務。自理報檢是指自理報檢單位自行報檢本企業(yè)生產(chǎn)、加工、儲存或者經(jīng)營的進出口貨物的報檢行為，也稱自理報檢行為。1.TheRangeofSelf-serviceInspectionUnit

（2）Theconsigneeoragentofimportedgoods;

（3）Theenterprisesthatproducegoodsforexporting;

（4）Theenterprisesoftransportingandpackingexportedgoods,ortheenterprisesofproducingpackagesfordangerousexportedgoodsaswellaspackingandtransportingthem;

（5）Chinese-foreignjointventure,Chinese-foreignco-operativeenterprise,andwhollyforeign-ownedenterprise;

（6）TheresidentrepresentativeinstitutionsofforeignenterprisesinChina;

（7）Theunitsforisolatedbreedingentry&exitanimalsandgrowingplants;

（8）Theunitsforproducing,processing,storingandtransportingtheproductsofentry&exitanimalsandplants;（9）Theunitsthatofferchemicalfumigationanddegassingservicetoentry&exitanimalandplantandtheirproducts,containers,packagingandtransportationtools;（10）Thescientificresearchinstitutionsthathaveentry&exitexchangebusiness;

（11）Otherunitsthatneedinspection.

1.自理報檢單位的范圍（1）有進出口經(jīng)營權(quán)的國內(nèi)企業(yè)；（2）進口貨物的收貨人或其代理人；（3）出口貨物的生產(chǎn)企業(yè)；（4）出口貨物運輸包裝及出口危險貨物運輸包裝生產(chǎn)企業(yè)；（5）中外合資、中外合作、外商獨資企業(yè)；（6）國外企業(yè)常駐中國代表機構(gòu)；（7）進出境動物隔離飼養(yǎng)和植物繁殖生產(chǎn)單位；（8）進出境動植物產(chǎn)品的生產(chǎn)、加工、存儲、運輸單位；（9）對進出境動植物、動植物產(chǎn)品、裝載容器、包裝物、交通運輸工具等進行藥劑熏蒸和消毒服務的單位；（10）有進出境交換業(yè)務的科研單位；（11）其他需要報檢的單位。2.FilingandRegistrationofSelf-serviceInspectionUnit

（1）Inspectionandquarantineinstitutionsimplementfilingmanagementsysteminallself-serviceinspectionunits

（2）Iftheunithandlesinspectionmattersforthefirsttime,itshouldpresentrelevantcertificatetolocalinspectionandquarantineinstitutionsandapplyforfilingandregistration.（3）TheGeneralAdministrationofQualitySupervision,InspectionandQuarantineofthePeople’sRepublicofChina（AQSIQ）isresponsibleforunifiedmanagementofself-serviceinspectionunitsacrossthecountry.Thelocalsubordinateinspectionandquarantinebureausareresponsiblefororganizingandimplantingfilingandregistrationofself-serviceinspectionunitsundertheirjurisdiction.Theinspectionandquarantineinstitutionsineachdistricttakechargeofspecificmanagement,suchasfiling,registrationandinformationchangeofself-serviceinspectionundertheirjurisdiction,theregularcheckonfilinginformationofself-serviceinspectionunitsaccordingtoactualsituations,dailysupervisionandadministration.（4）Theapplicantsofself-serviceinspectionunitscandirectlymakeapplicationstoinspectionandquarantineinstitutionsinthelocalityofitsindustryandcommerceregistrationforfilingandregistrationorsubmitapplicationsonline.Thesubmittedmaterialsinclude：Theapplicationformoffilingandregistrationforself-serviceinspectionunits;Originalsandcopiesof“businesslicenseofenterpriselegalperson”,stampedwithenterpriseofficialseal;Originalsandcopiesoforganizationorinstitutioncodecertificate,stampedwithenterpriseofficialseal;Theenterpriseswithimport-exportoperationrightmustproviderelevantproofmaterials;Othersupportingmaterialsthatapplicantsneedtooffertoinspectionandquarantineinstitutions;Otherrelevantmaterialsthatinspectionandquarantineinstitutionsrequire.

（5）Theinspectionandquarantineinstitutionmustreviewandcheckthematerialsprovidedbyapplicants,andputitonrecordandissue“thefilingandregistrationcertificateofself-serviceinspectionunit”totheapplicantsaftergainingtheapproval.Applicantsmustcarryunitcachetorcachetstamptoget“thefilingandregistrationcertificateofself-serviceinspectionunit”.Itsperiodofvalidityis5years.Afteritsexpiration,applicantsshouldgototheoriginalfilinginstitutionstogothroughcertificateextensionandreplacementprocedures.

（6）Self-serviceinspectionunitsshouldacceptsupervisionandadministrationfrominspectionandquarantineinstitutions,abidebylocalmanagementprinciplesandgothroughfilingandregistrationproceduresintheinspectionandquarantineinstitutionsinthelocalityofitsindustryandcommerceregistration.

（7）Theself-serviceinspectionunitswhoneedtoterminatethefilingandregistrationshouldgototheoriginalinspectioninstitutionstogothroughcancellationproceduresinwrittenform.Thecancellationwillbepermittedafterverification.

（8）Whentheself-serviceinspectionunitsandtheirregisteredinspectionstaffwhohavebeenputonrecordandregisteredintheinspectionandquarantineinstitutionsinthelocalityofitsindustryandcommerceregistrationgotootherplacesforinspection,theydonotneedtogothroughfiling,registrationandinspectorregistrationformalitiesaftertheinspectionandquarantineinstitutionshaveverifiedandacceptedtheprovidedfilingandregistrationinformationandcarryoutmanagementaccordingtorelevantregulations.2.自理報檢單位備案登記（1）檢驗檢疫機構(gòu)對自理報檢單位實行備案管理制度。（2）首次辦理報檢業(yè)務的單位，須持有關(guān)證件向當?shù)貦z驗檢疫機構(gòu)申請辦理備案登記手續(xù)。（3）國家質(zhì)檢總局負責全國自理報檢單位的統(tǒng)一管理工作，各地直屬檢驗檢疫局負責所轄地區(qū)自理報檢單位備案登記等工作的組織實施，各地檢驗檢疫機構(gòu)負責轄區(qū)內(nèi)自理報檢單位的備案登記、信息更改、根據(jù)實際情況對自理報檢單位的備案信息定期進行核實、日常監(jiān)督管理等具體管理工作。（4）自理報檢單位備案登記的申請人可以直接向其工商注冊所在地檢驗檢疫機構(gòu)提出申請或網(wǎng)上提交申請，提交材料包括：①“自理報檢單位備案登記申請表”；②加蓋企業(yè)公章的“企業(yè)法人營業(yè)執(zhí)照”復印件及原件；③加蓋企業(yè)公章的組織機構(gòu)代碼證復印件及原件；④有進出口經(jīng)營權(quán)的企業(yè)須提供有關(guān)證明材料；⑤申請人需要向檢驗檢疫機構(gòu)提供的其他有關(guān)證明材料；⑥檢驗檢疫機構(gòu)要求的其他相關(guān)材料。（5）檢驗檢疫機構(gòu)對申請人提供的資料進行審核，通過以后予以備案登記，并向申請人頒發(fā)“自理報檢單位備案登記說明書”,申請人須攜帶單位公章或公章印模以領(lǐng)取“自理報檢單位備案登記證明書”。其有效期為5年，期滿后應當?shù)皆瓊浒傅臋z驗檢疫機構(gòu)辦理延期換證手續(xù)。

（6）自理報檢單位接受檢驗檢疫機構(gòu)的監(jiān)督管理，遵守屬地管理原則，在其工商注冊所在地檢驗檢疫機構(gòu)辦理備案登記手續(xù)。（7）自理報檢單位需要終止備案登記的，以書面形式向原備案登記的檢驗檢疫機構(gòu)辦理注銷手續(xù)，經(jīng)審核后予以注銷。（8）已經(jīng)在工商注冊所在地檢驗檢疫機構(gòu)備案登記的自理報檢單位及其已經(jīng)注冊的報檢員，前往注冊地以外報檢時，檢驗檢疫機構(gòu)核實其提供的自理報檢單位備案登記信息后予以受理，并按照有關(guān)規(guī)定進行管理，自理報檢單位無需在異地辦理備案登記和報檢員注冊手續(xù)。3.TheInformationModificationofSelf-serviceInspectionUnitTheself-serviceinspectionunitsthathaveinformationchangesshouldchangeinformationtimelytoensuretheaccuracyofthefilingandregistrationinformation.Ifthenameofself-serviceinspectionunit,registrationaddress,natureoftheenterprise,legalrepresentative,inspectionstaff,placeofbusiness,registeredcapital,telephonenumber,faxnumber,E-mailaddress,contactpersonandpostalcodehavechanged,inspectionandquarantineinstitutionhandlesinformationchangeproceduresaccordingtotheapplicationsubmittedbyself-serviceinspectionunits.Ifthename,addressandlegalrepresentativeofself-serviceinspectionunithavechanged,inspectionandquarantineinstitutionshouldissue“thefilingandregistrationcertificateofself-serviceinspectionunit”again.3.自理報檢單位的信息變更自理報檢單位備案登記的信息有變動的，應及時更改，以確保其備案登記信息的準確性。自理報檢單位的名稱、注冊地址、企業(yè)性質(zhì)、法定代表人、報檢員、營業(yè)場所、注冊資金、電話號碼、傳真號碼、電子信箱、聯(lián)系人、郵政編碼等內(nèi)容有更改的，檢驗檢疫機構(gòu)根據(jù)自理報檢單位提出的更改申請及時辦理信息變更手續(xù)。自理報檢單位名稱、地址、法定代表人有更改的，檢驗檢疫機構(gòu)重新頒發(fā)“自理報檢單位備案登記證明書”。4.RightsandObligationsofSelf-serviceInspectionUnit（1）Rights：①Basedoninspectionandquarantinelaws,theunitcangothroughinspectionanddeclarationformalitiesofentry&exitgoods,staff,meansoftransport,animalsandplants,andtheirproductsaccordingtothelaw.Otherrelatedproceduresarealsoincluded.②TheunithastherighttorequestinspectionandquarantineinstitutionstocompleteinspectionandquarantineworkwithininspectionandquarantineperiodasstipulatedbyAQSIQ,andissuetheproofdocumentafterhandlinginspectionandprovidingeveryconditionofsampling,inspectionandquarantine.③Iftheself-serviceinspectionunithasobjectiontotheinspectionandquarantineresultsmadebyinspectionandquarantineinstitutions,ithastherighttoapplytooriginalinspectionandquarantineinstitutionsorsuperiorinstitutionsandevenAQSIQforreinspectionwithinthestipulatedtime.④Theself-serviceinspectionunithastherighttorequireinspectionandquarantineinstitutionanditsstafftokeepsecret,whentheunitprovidesrelevantcommercialandshippingdocumentsinconfidentialcircumstances.⑤Theself-serviceinspectionunithastherighttochargeandaccuseinspectionandquarantineinstitutionanditsstaffofanyactivitythatviolateslawsorregulations.4.自理報檢單位的權(quán)利和義務（1）權(quán)利：①根據(jù)檢驗檢疫法律規(guī)定，依法辦理出入境貨物、人員、運輸工具、動植物及其產(chǎn)品等與其相關(guān)的報檢/申報手續(xù)。②按有關(guān)規(guī)定辦理報檢并提供抽樣、檢驗檢疫的各種條件后，有權(quán)要求檢驗檢疫機構(gòu)在國家質(zhì)檢總局統(tǒng)一規(guī)定的檢驗檢疫期限內(nèi)完成檢驗檢疫工作，并出具證明文件。③自理報檢單位對檢驗檢疫機構(gòu)的檢驗檢疫結(jié)果有異議的，有權(quán)在規(guī)定的期限內(nèi)向原檢驗檢疫機構(gòu)或其上級檢驗檢疫機構(gòu)以至國家質(zhì)檢總局申請復驗。④自理報檢單位在保密情況下提供有關(guān)商業(yè)及運輸單據(jù)時，有權(quán)要求檢驗檢疫機構(gòu)及其工作人員予以保密。⑤自理報檢單位有權(quán)對檢驗檢疫機構(gòu)及其工作人員的違法、違紀行為進行控告、檢舉。（2）Obligations①Theunitshouldcomplywithrelevantstatelaws,regulationsandinspectionandquarantinerules,andberesponsiblefortheauthenticityofinspection.②Theself-serviceinspectionunitshouldselectinspectionstaffaccordingtotherequirementsofinspectionandquarantineinstitutions.Inspectionstaffshouldgothroughinspectionformalitieswith“thequalificationcertificateofinspectionapplier”issuedbyinspectionandquarantineinstitutions.Theself-serviceinspectionunitshouldstrengthenthemanagementofitsinspectionstaffandbearlegalresponsibilitiesfortheirinspectionconduct.③Theunitshouldprovidecorrect,complete,legalandvaliddocuments,andfillinthedeclarationformcompletely,accuratelyandclearly.Itshouldhandletheinspectionmattersintheprescribedplacewithinthespecifiedtime.④Aftergoingthroughinspectionprocedures,theself-serviceinspectionunitshouldcontactwithinspectionandquarantineinstitutionsasrequired,andassisttheirstafftohandlespotinspection,drawsamples,andalsoimplementsupervisionaswellasotherrelevantrequirementsproposedbyinspectionandquarantineinstitutions.⑤Theunitshouldstrengthenthebatchmanagementofexportedgoodsthathavepassedinspectionandbeenreleased.Wrongdelivery,wrongshipping,missingdeliveryisnotpermittedincasethatdocumentsandgoodsdonotconformwitheachother;theentrygoodswithoutinspectionandquarantineverificationorpermissioncannotbesold,used,unloadedordelivered.⑥Theunitshouldpayinspectionandquarantinefeeswhenapplyingforinspectionandquarantineandappraisal.（2）義務：①遵守國家有關(guān)法律法規(guī)和檢驗檢疫規(guī)章，對所報檢的真實性負責。②自理報檢單位應當按檢驗檢疫機構(gòu)的要求選用報檢員，由報檢員憑檢驗檢疫機構(gòu)核發(fā)的“報檢員證”辦理報檢手續(xù)。自理報檢單位應加強對本單位報檢員的管理并對報檢員的報檢行為承擔法律責任。③提供正確、齊全、合法、有效的證單，完整、準確、清楚地填制報檢單，并在規(guī)定的時間和地點辦理報檢手續(xù)。④自理報檢單位在辦理報檢手續(xù)以后，應該按照要求及時與檢驗檢疫機構(gòu)聯(lián)系，協(xié)助檢驗檢疫工作人員進行現(xiàn)場檢驗檢疫、抽（采）樣及檢驗檢疫處理等事宜，并落實檢驗檢疫機構(gòu)提出的檢驗檢疫監(jiān)管及有關(guān)要求。⑤對已經(jīng)檢驗檢疫合格放行的出口貨物應加強批次管理，不得錯發(fā)、錯運、漏發(fā)，以免造成貨證不符；對入境貨物，未經(jīng)檢驗檢疫合格或許可，不得銷售、使用或拆卸、運遞。⑥申請檢驗檢疫、鑒定等工作時，應該按照規(guī)定繳納檢驗檢疫費。Ⅲ.SubstitutedInspectionAgencyThesubstitutedinspectionagencyistheenterpriselegalpersoninsidetheterritoryofChina,whohasbeenregisteredandputonrecordintheindustrialandcommercialadministrationdepartments,aswellasinspectionandquarantineinstitutionsandlegallyacceptstheentrustmentfromrelevantpartiestohandleinspectionanddeclarationforthem..Substitutedinspectionreferstotheinspectionactthatthesubstitutedinspectionagencyhandlestheentryandexitinspectionandquarantineproceduresforrelevanttradepartiesontherelevanttradepartiesoftheirentrustment.Itisalsoknownassubstitutedinspectionact.Thesubstitutedinspectionisdividedintodirectandindirectsubstitutedinspection三、代理報檢單位代理報檢單位，是指經(jīng)檢驗檢疫機構(gòu)注冊登記，依法接受有關(guān)關(guān)系人委托，為有關(guān)關(guān)系人辦理報檢/申報業(yè)務，在工商行政管理部門注冊登記的境內(nèi)企業(yè)法人。代理報檢是指代理報檢單位接受有關(guān)貿(mào)易關(guān)系人委托，為有關(guān)貿(mào)易關(guān)系人辦理出入境檢驗檢疫手續(xù)的報檢行為，也稱代理報檢行為。代理報檢分為直接代理報檢和間接代理報檢。

（5）Othermattersrelatedtoinspectionandquarantine.1.代理報檢單位的范圍（1）辦理報檢手續(xù)。（2）繳納檢驗檢疫費用。（3）聯(lián)系和配合出入境檢驗檢疫機構(gòu)實施檢驗檢疫。（4）領(lǐng)取檢驗檢疫證單和通關(guān)證明。（5）其他與檢驗檢疫相關(guān)的事宜。

2.RegistrationofSubstitutedInspectionUnit

（1）AQSIQcarriesoutregistrationsystemwithinallsubstitutedquarantineunitswhomustget“RegistrationCertificateforSubstitutedInspectionUnits”beforeengaginginaspecifiedrangeofinspectionbusinessinthepermittedinspectionarea.Theinspectionandquarantineinstitutionsineachareashallnotacceptinspectionbusinessofinspectionandquarantineunitswithoutregistration.

（2）AQSIQshalluniformlyadministertheregistrationofsubstitutedinspectionunitsacrossthecountry,andberesponsibleforthesupervisionforregistrationwork.TheinspectionandquarantinebureausdirectlyundertheAQSIQareresponsibleforregistrationacceptanceandpreliminaryverificationofsubstitutedinspectionunitswithinitsjurisdiction,andimplementadministrativelicensingaccordingtoapprovalopinionsofAQSIQ.Theinspectionandquarantineinstitutionsatallplacestakechargeofdailysupervisionandmanagementworkofregistrationofsubstitutedinspectionunits.（3）Theapplicationsofsubstitutedquarantineunitsaregenerallyacceptedonceortwiceeachyear,foronemonthforeachtime.ThespecificacceptancetimewouldbeannouncedbyAQSIQonemonthinadvance.

（4）Thesubstitutedinspectionunitsshouldmeetthefollowingconditionsuponregistration：①Obtainthe“businesslicenseforenterpriselegalperson”issuedbydepartmentforindustryandcommerce,andthebusinessscopeofthislicenseexplicitlyclarifiesthesubstitutedinspectionorrelatedoperationrights;②RegisteredcapitalshavemorethanonemillionYuan;③Haveafixedbusinesssiteandthefacilitiesforhandlingthebusinessofinspectionandquarantine.④Thesoundandeffectiveinternalmanagementsystemshouldbeestablished;⑤Havenolessthanfivepersonswhohavepassedtheexaminationofinspectionandquarantineinstitutionsandobtained“qualificationcertificateofinspectionappliers”,andsignlegal“l(fā)aborcontract”witheachinspectionstaffaswellaspaysocialinsuranceforthem.

Branchcompanieswhoapplyforregistrationofsubstitutedinspectionunitsintheirownnameshouldget“businesslicense”,andmeettheaboverequirementsNo.③,No.④andNo.⑤.TheregistrationcapitalofitsparentcompanyshouldbemorethanonemillionYuan.

（5）Registrationofsubstitutedinspectionunitsadoptsthewayofonlineapplicationandwrittenconfirmation.Theapplicationunitsshouldapplytotheinspectionandquarantineinstitutionsinthelocalityofitsindustryandcommerceregistration.Thewrittenmaterialsthatapplicationunitsshouldsubmitinclude：“Theapplicantformforregistrationofsubstitutedentry-exitinspectionandquarantine”;enterprisestatement;Copiesof“businesslicenseofenterpriselegalperson”（theoriginalshallbesubmittedforverificationatthesametime）;“Copiesoforganizationorinstitutioncodecertificate”（theoriginalshallbesubmittedforverificationatthesametime）;Copiesof“qualificationcertificateofinspectionapplier”ofwould-beinspectionstaff（theoriginalshallbesubmittedforverificationatthesametime）;Thesamplesealmouldofapplicationunits;Copiesof“regulationsofenterprise”,stampedwithofficialsealsofapplicationunitsandfinal“copyofthequalificationverificationreport”,andtheoriginalshallbesubmittedforverificationatthesametime;Copiesof“l(fā)aborcontract”thatapplicationunitssignwiththeirwould-beinspectionstaff,stampedwithofficialseal,andtheoriginalshallbesubmittedforverificationatthesametime;Thecopiesandoriginalof“registrationcertificateforsocialinsurance”,andthedocumentsastheproofforapplicationunitstopaysocialinsuranceforeachinspectionstaff,whichareissuedorconfirmedbylaborandsocialsecuritydepartments;Copiesofmanagementsystemonsubstitutedquarantineoftheapplicationunits;otherdocumentsstipulatedbytheAQSIQtobesubmitted.2.代理報檢單位注冊登記（1）國家質(zhì)檢總局對代理報檢單位實行注冊登記制度，必須在取得“代理報檢單位注冊登記許可證書”以后，方可在許可的報檢區(qū)域內(nèi)從事指定范圍的代理報檢業(yè)務，各地檢驗檢疫機構(gòu)不受理未經(jīng)注冊登記的報檢單位的報檢業(yè)務。（2）國家質(zhì)檢總局統(tǒng)一管理全國代理報檢單位的注冊登記工作，對代理報檢單位注冊登記工作進行監(jiān)督。各直屬檢驗檢疫局負責所轄地區(qū)代理報檢單位注冊登記的受理和初審工作，并根據(jù)國家質(zhì)檢總局的審批意見實行行政許可。各地檢驗檢疫機構(gòu)負責代理報檢單位注冊登記的日常監(jiān)督管理工作。（3）代理報檢單位注冊登記申請一般每年受理一至兩次，每次時間為一個月，具體受理時間由國家質(zhì)檢總局提前一個月對外公布。（4）代理報檢單位注冊登記時應具備下列條件：①取得工商行政管理部門頒發(fā)的“企業(yè)法人營業(yè)執(zhí)照”，該執(zhí)照經(jīng)營范圍中列明有代理報檢或與之相關(guān)的經(jīng)營權(quán)；②注冊資金在100萬元人民幣以上；③有固定的工作場所及開展報檢業(yè)務所需要的條件和設(shè)施；④建立健全的行之有效的內(nèi)部管理制度；⑤擁有不少于5名經(jīng)檢驗檢疫機構(gòu)考試合格并取得“報檢員資格證”的人員，并與每個報檢員簽訂合法的勞動合同，并為每個報檢員繳納社會保險。分公司以自己的名義申請代理報檢企業(yè)注冊登記的，應當取得營業(yè)執(zhí)照，具備前款第③④⑤項要求的條件，且總公司注冊資金在人民幣100萬元以上。（5）代理報檢單位注冊登記實行網(wǎng)上申請、書面確認的方式，申請單位須向工商注冊所在地的直屬檢驗檢疫局申請，申請單位應提交的書面材料：①“代理出入境檢驗檢疫報檢單位注冊登記申請書”；②企業(yè)聲明；③“企業(yè)法人營業(yè)執(zhí)照”復印件（同時交驗副本原件）；④“組織機構(gòu)代碼證”復印件（同時交驗正本）；⑤擬任報檢員的“報檢員資格證”復印件（同時交驗正本）；⑥申請單位的印章印模；⑦加蓋有申請單位公章的“公司章程”復印件和最后一次“驗資報告復印件”，同時交驗原件；⑧申請單位與其擬任報檢員簽訂的“勞動合同”復印件，同時交驗原件，且復印件加蓋公章；⑨“社會保險登記證”復印件及其原件，以及由勞動和社會保障部門出具或者確認的申請單位為每個報檢員繳納社會保險的證明文件；⑩申請單位有關(guān)代理報檢的管理制度的復印件；11國家質(zhì)檢總局規(guī)定需要的其他文件。3.SupervisionandAdministrationofSubstitutedInspectionUnits （1）TheInformationModificationofSubstitutedInspectionUnitIncaseofanymodificationwithasubstitutedinspectionunit'sname,address,legalrepresentative,businessscopeorothermajorissues,theagencyshall,within15daysasofthemodification,applytotheinspectionandquarantinebureaudirectlyundertheAQSIQatitslocalityandgothroughtheinformationmodificationformalities.Thesubstitutedquarantineunitwhochangesregistrationinformationwithoutpermissionbearsthelegalresponsibilityandconsequenceforitsbehaviors.（2）RoutineVerificationofSubstitutedQuarantineUnitsTheinspectionandquarantineinstitutionsimplementtheroutineverificationsystemwithinsubstitutedquarantineunitseverytwoyears.EachsubstitutedinspectionunitshallapplytotheinspectionandquarantinebureauatitslocalityforroutineverificationfromMarch1sttoMarch31stintheverificationyearandsubmitthe"RoutineVerificationReport"oflastyear.InspectionandquarantineinstitutionsshouldfinishitsroutineverificationbeforeMay31stinthatyear.Subordinateinspectionandquarantinebureausconductvariousformsofreviewontheauthenticityandsubstantivecontentsoftheverifiedmaterials.Theformsincludeon-sitecheck,spottingreview,discussions,issuanceofquestionnairesandsoon.Thecontentverifiedincludesregisteredcapital,thenumberofinspectionstaff,operationsite,conditionsrequiredforsubstitutedquarantinebusiness,annualsubstitutedquarantinebusiness,inspectionerrors,theinformationonabidancebytheadministrativeprovisionsforsubstitutedinspectionunitsaswellasinspectionandquarantineregulationsandlaws,andfeedbackfromrelevantentrusters.3.代理報檢單位監(jiān)督管理（1）代理報檢單位的信息變更代理報檢單位的名稱、地址、法定代表人、非法人企業(yè)的負責人、經(jīng)營范圍等重大事項發(fā)生變更的，應當在變更之日起30日內(nèi)辦理信息更改手續(xù)，向直屬檢驗檢疫局申請變更。代理報檢單位隨意更改注冊信息的，產(chǎn)生的法律責任和后果由代理報檢單位承擔。（2）代理報檢單位例行審核檢驗檢疫機構(gòu)每2年對代理報檢單位實行一次例行審核制度，代理報檢單位應當在審核年度的3月1日至3月31日向所在地檢驗檢疫機構(gòu)申請例行審核，提交上2年度的《例行審核報告書》。檢驗檢疫機構(gòu)應當在當年的5月31日前完成代理報檢企業(yè)的例行審核。直屬檢驗檢疫局對例行審核材料的真實性及實質(zhì)性內(nèi)容進行包括現(xiàn)場核查、實地檢查、座談會、發(fā)放調(diào)查表等多種形式的審查。審查內(nèi)容包括注冊資金、報檢員人數(shù)、經(jīng)營場所及辦理檢驗檢疫代理業(yè)務所需要的條件，年度代理報檢業(yè)務及報檢差錯情況，遵守代理報檢單位管理規(guī)定情況，遵守檢驗檢疫法律法規(guī)情況，有關(guān)委托人的反映等。4.ClassificationManagementofSubstitutedInspectionUnit’sCreditRatingsTheevaluationofsubstitutedquarantineunits’creditratingsisonthebasisoftheinformationonabidancebylawsandregulationsindailysubstitutedquarantinebusinessaswellasitsperformanceonobligationfulfillment,gradingsystemisadoptedhere.Accordingtogradingresultsandadditionalconditions,itisdividedintofourlevels,namelyA,B,C,andD.ForsubstitutedquarantineunitsofLevelAandLevelB,differentdegreesofconvenientcustomsclearancemeasuresandloosemanagementmeasurescanbeprovidedtothem;forLevelCandD,themeasuresofreinforcedmanagementcanbeseparatelyadoptedsuchastightenedsupervision,drawingupblacklistandsoon.4.代理報檢單位信用等級分類管理代理報檢單位信用等級評定以代理報檢單位在日常代理報檢業(yè)務中遵守法律法規(guī)、履行代理報檢職責的情況為依據(jù)，實行評分制度，并根據(jù)評分的結(jié)果及附加條件確定A、B、C、D四個等級。對于A級、B級的代理報檢單位，可給予不同程度的便利通關(guān)措施和寬松的管理措施；對于C級、D級的代理報檢單位，可以分別采取嚴加監(jiān)管、列入“黑名單”等強化管理措施。5.RightsandObligationsofSubstitutedQuarantineUnitRights：（1）Aftertheregistrationofsubstitutedquarantineunitsislicensed,itsinspectionstaffwhohaveregisteredatinspectionandquarantineinstitutionsandobtained“thequalificationcertificateofinspectionapplier”cangothroughsubstitutedquarantinebusinesswithininspectionandquarantineinstitutionsintheapprovedsubstitutedquarantineareas,butthenamecannotbelenttoothersfordealingwithinspectionbusiness.（2）Exceptforthosespecialrules,substitutedquarantineunithasrightstoactasanagentforentry-exitinspectionandquarantinemattersthattheconsignorsentrust.（3）Theconsigneeofimportgoodscanentrustinspectiontosubstitutedquarantineunitsintheplaceofcustomsdeclarationorplaceofreceipt.Theconsignorofexportgoodscanentrustinspectiontosubstitutedquarantineunitsintheplaceoforiginorcustomsdeclaration.（4）TheunithastherighttorequestinspectionandquarantineinstitutionstocompleteinspectionandquarantineworkwithininspectionandquarantineperiodasstipulatedbyAQSIQ,andissuetheproofdocumentsafterhandlinginspectionandprovidingeveryconditionofsampling,inspectionandquarantine.（5）Ifthesubstitutedquarantineunithasobjectiontotheinspectionandquarantineresultsmadebyinspectionandquarantineinstitutions,ithastherighttoapplytooriginalinspectionandquarantineinstitutionsorsuperiorinstitutionsandevenAQSIQforreinspectionwithinthestipulatedtime.（6）Thesubstitutedquarantineunithastherighttorequireinspectionandquarantineinstitutionanditsstafftokeepsecret,whentheunitprovidesrelevantcommercialandshippingdocumentsinconfidentialcircumstances.（7）Thesubstitutedquarantineunithastherighttochargeandaccuseinspectionandquarantineinstitutionanditsstaffofanyactivitythatviolateslawsorregulations.

5.代理報檢單位的權(quán)利、義務權(quán)利：（1）代理報檢單位被許可登記注冊后，有權(quán)在批準的代理報檢區(qū)域內(nèi)由其在檢驗檢疫機構(gòu)注冊并持有“報檢員證”的報檢員向檢驗檢疫機構(gòu)辦理代理報檢業(yè)務，但不得出借名號供他人辦理報檢業(yè)務。（2）除另有規(guī)定外，代理報檢單位有權(quán)代理委托人委托的出入境檢驗檢疫報檢業(yè)務。（3）進口貨物的收貨人可以在報關(guān)地或收貨地委托代理報檢單位報檢，出口貨物發(fā)貨人可以在產(chǎn)地或報關(guān)地委托代理報檢單位報檢。（4）按照有關(guān)規(guī)定代理報檢，并提供抽樣、檢驗檢疫的各種條件后，有權(quán)要求檢驗檢疫機構(gòu)在質(zhì)檢總局規(guī)定的期限內(nèi)完成檢驗檢疫工作，并出具證明文件。（5）代理報檢單位對檢驗檢疫機構(gòu)的檢驗檢疫結(jié)果有異議的，有權(quán)在規(guī)定的期限內(nèi)向原檢驗檢疫機構(gòu)或其上級檢驗檢疫機構(gòu)乃至國家質(zhì)檢總局申請復驗。（6）代理報檢單位在保密情況下提供有關(guān)商業(yè)
