如果承包人一方在指示規(guī)定的時刻內，或者（如指示中沒有規(guī)定時刻）在合理的時刻內未執(zhí)行上述指示時業(yè)主應有權雇用他人執(zhí)行該項指示，并向其支付有關費用。工程師應在與業(yè)主和承包人及時協(xié)商之后，確定由此造成的或隨此而需要的全部費用，并應由業(yè)主從承包人處收回，也悲傷由業(yè)主從任何應支付或將支付給承包人的任何款項中扣除，工程師應相應地通知承包人，并呈交業(yè)主一份副本。

在承包人負責照管工程期間，如果工程或其他任何部分或材料或用于工程中的設備，除第20。4款所規(guī)定的風險外，不管由于任何緣故而遭受缺失或損壞，承包人應自費補償此類缺失或損壞，以使永久工程在各方面均符合合同的規(guī)定，并達到工程師中意的程度。
