AheadoftheAIActvoteintheEuropeanParliament,civilsocietycallsonMembersoftheEuropeanParliament(MEPs)toensuretheEUArtificialIntelligenceAct(AIAct)prioritisesfundamentalrightsandprotectspeopleaffectedbyartificialintelligence(AI)systems.

IncreasinglyweseethedeploymentofAIsystemsto

monitorandidentifyusinpublicspaces

,

predictourlikelihoodofcriminality

,re-directpolicingandimmigrationcontroltoalreadyover-surveilledareas,facilitate

violationsoftherightto

claim

asylum

andthepresumptionofinnocence,

predictouremotions

and

categoriseus

usingdiscriminatoryinferences,andtomakecrucialdecisionsaboutusthatdetermineouraccesstowelfare,educationandemployment.

Withoutproperregulation,AIsystemswillexacerbateexistingsocietalharmsofmasssurveillance,structuraldiscrimination,centralisedpoweroflargetechnologycompanies,theunaccountablepublicdecision-makingandenvironmentalextraction.Thecomplexity,lackofaccountabilityandpublictransparency,andfewavailableprocessesforredresspresentchallengesforpeopletoenforcetheirrightswhenharmedbyAIsystems.Inparticular,thesebarrierspresentaparticularriskforthemostmarginalisedinsociety.

TheEU’sAIActcan,andshould,addresstheseissues,ensuringthatAIdevelopmentanduseoperateswithinaframeworkofaccountability,transparencyandappropriate,fundamental-rightsbasedlimitations.WearecallingforMEPstoensurethefollowingintheAIActvote:

1.EmpowerpeopleaffectedbyAIsystems

Ensure

EnsurepeopleaffectedbyAIsystemsare

notifiedandhavetherighttoseekinformation

whenaffectedbyAI-assisteddecisionsandoutcomes;

Includearightforpeopleaffectedto

odgeacomplaintwithanationalauthority

,iftheirrightshavebeenviolatedbytheuseofanAIsystem;

Includearighttorepresentationofnaturalpersonsandtherightforpublicinterestorganisationsto

lodgestandalonecomplaints

withanationalsupervisoryauthority;

Include

rightstoeffectiveremedies

fortheinfringementofrights.

2.EnsureaccountabilityandtransparencyfortheuseofAI

Includeanobligationonuserstoconductandpublisha

fundamentalrightsimpactassessment

beforeeachdeploymentofahigh-riskAIsystemandmeaningfullyengagecivilsocietyandaffectedpeopleinthisprocess

Requireallusersofhigh-riskAIsystems,andusersofallsystemsinthepublicsphere,to

registertheuseintheEuropeanAIdatabase

beforedeployment;

Ensurethattheclassificationprocessforhigh-riskAIsystemsprioritiseslegalcertaintyandprovidesnoloopholeforproviderstocircumventlegalscrutiny;

EnsurethatEU-basedAIproviderswhosesystemsimpactpeopleoutsideoftheEUaresubjecttothesamerequirementsasthoseinsidetheEU.

3.ProhibitAIsystemsthatposeanunacceptableriskforfundamentalrights

Afullbanon

real-timeandpostremotebiometricidentification

inpubliclyaccessiblespaces,byallactors,withoutexception;

Aprohibitionofallformsof

predictiveandprofilingsystems

inlawenforcementandcriminaljustice(location/place-basedandperson-based);

Prohibitionson

AIinmigrationcontexts

tomakeindividualriskassessmentsandprofilesbasedonpersonalandsensitivedata,andpredictiveanalyticsystemswhenusedtointerdict,curtailandpreventmigration;

Aprohibitionon

biometriccategorisationsystems

thatcategorisenaturalpersonsaccordingtosensitiveorprotectedattributesaswellastheuseofanybiometriccategorisationandautomatedbehaviouraldetectionsystemsinpubliclyaccessiblespaces;

Abanontheuseof

emotionrecognitionsystems

toinferpeople’semotionsandmentalstatesfromphysical,physiological,behavioural,aswellasbiometricdata.

WecallonMEPstovotetoincludetheseprotectionsintheAIactandensuretheRegulationisavehicleforthepromotionoffundamentalrightsandsocialjustice.
