2025年度商住兩用居間租賃合同匯編本合同共三部分組成,僅供學(xué)習(xí)使用,第一部分如下:第一條合同標(biāo)的1.1本合同租賃的商住兩用房屋位于______市______區(qū)______路______號______單元______室,房屋所有權(quán)人為______。1.2租賃房屋的建筑面積為______平方米,房屋結(jié)構(gòu)為______,房屋用途為商住兩用。第二條租賃期限2.1本合同租賃期限自______年______月______日起至______年______月______日止。2.2租賃期滿后,如雙方同意續(xù)租,應(yīng)提前______個(gè)月書面通知對方,經(jīng)雙方協(xié)商一致,可簽訂續(xù)租合同。第三條租金及支付方式3.1租金為人民幣______元/月,租金支付方式為______。3.2租金支付日期為每月______日前,逾期支付租金的,應(yīng)向出租人支付______%的滯納金。第四條租金調(diào)整4.1租賃期限內(nèi),如遇國家政策調(diào)整,租金可根據(jù)國家相關(guān)規(guī)定進(jìn)行調(diào)整。4.2租賃期限屆滿后,如雙方同意續(xù)租,租金可協(xié)商確定。第五條使用與維修5.1租賃房屋僅用于商住兩用,不得改變房屋結(jié)構(gòu)和使用性質(zhì)。5.2租賃期間,房屋及其附屬設(shè)施的自然磨損和合理損耗由出租人承擔(dān)。5.3租賃期間,因非人為因素造成的房屋及其附屬設(shè)施損壞,由出租人負(fù)責(zé)維修。第六條轉(zhuǎn)租6.1租賃期間,未經(jīng)出租人書面同意,承租人不得轉(zhuǎn)租。6.2經(jīng)出租人同意,承租人可以轉(zhuǎn)租,但轉(zhuǎn)租人應(yīng)具備合法的主體資格。第七條違約責(zé)任7.1承租人未按時(shí)支付租金的,應(yīng)向出租人支付______%的違約金。7.2承租人違反本合同約定,擅自改變房屋結(jié)構(gòu)和使用性質(zhì)的,出租人有權(quán)解除合同,并要求承租人恢復(fù)原狀。7.3因出租人原因?qū)е潞贤獬?,出租人?yīng)向承租人支付______倍的租金作為違約金。第八條合同解除8.1因不可抗力導(dǎo)致合同無法繼續(xù)履行的,雙方均不承擔(dān)違約責(zé)任。8.2出租人因房屋出售、征收等原因,需要解除合同的,應(yīng)提前______個(gè)月書面通知承租人,并支付______倍的租金作為違約金。8.3承租人因房屋損壞等原因,需要解除合同的,應(yīng)提前______個(gè)月書面通知出租人。第九條爭議解決9.1雙方在履行合同過程中發(fā)生爭議,應(yīng)友好協(xié)商解決。9.2協(xié)商不成的,可以向合同簽訂地的人民法院提起訴訟。第十條其他約定10.1本合同未盡事宜,可由雙方另行簽訂補(bǔ)充協(xié)議。10.2本合同一式兩份,雙方各執(zhí)一份,自雙方簽字(或蓋章)之日起生效。出租人(蓋章):______

______第二部分:第三方介入后的修正第一條第三方定義1.1本合同所指的第三方,包括但不限于中介方、評估機(jī)構(gòu)、擔(dān)保公司、律師事務(wù)所等,其在合同中的作用和責(zé)任由本合同具體約定。1.2第三方介入本合同,應(yīng)經(jīng)甲乙雙方同意,并由甲乙雙方共同簽訂書面協(xié)議,明確第三方的職責(zé)和權(quán)利。第二條第三方職責(zé)2.1第三方在合同中的主要職責(zé)包括但不限于:(1)協(xié)助甲乙雙方進(jìn)行租賃房屋的評估、鑒定等工作;(2)為甲乙雙方提供擔(dān)保、法律咨詢等服務(wù);(3)監(jiān)督合同的履行,確保甲乙雙方的權(quán)益得到保障。2.2第三方應(yīng)按照甲乙雙方的要求,在規(guī)定的時(shí)間內(nèi)完成相關(guān)工作,并對工作結(jié)果負(fù)責(zé)。第三條第三方權(quán)利3.1第三方在合同中的主要權(quán)利包括但不限于:(1)根據(jù)合同約定,收取相應(yīng)的服務(wù)費(fèi)用;(2)在合同履行過程中,對甲乙雙方的違約行為進(jìn)行制止和糾正;(3)根據(jù)合同約定,享有對違約方的追償權(quán)。3.2第三方在行使權(quán)利時(shí),應(yīng)遵守法律法規(guī)和合同約定,不得損害甲乙雙方的合法權(quán)益。第四條第三方責(zé)任限額4.1第三方在本合同中的責(zé)任限額由甲乙雙方在合同中約定,具體包括:(1)第三方因自身原因?qū)е潞贤瑹o法履行的,應(yīng)向甲乙雙方支付______倍的違約金;(2)第三方因故意或重大過失導(dǎo)致合同
