如何查詢美國專利一.專利用處

發(fā)明人最不想遇到的狀況莫過于花費(fèi)許多時(shí)間與精力將自己新的構(gòu)想付諸實(shí)現(xiàn)后，才發(fā)現(xiàn)同樣的發(fā)明早已有人做過。避免這種狀況的最好辦法，就是在研發(fā)初期做好信息收集的工作。根據(jù)國際經(jīng)濟(jì)暨發(fā)展組織（OrganizationforEconomicCooperationandDevelopment：OECD）的統(tǒng)計(jì)結(jié)果，有百分之八十以上的科技知識(shí)被描述在專利文件中，而大部分被描述在專利中的技術(shù)并沒有被記載在其它的發(fā)行刊物。因此，發(fā)明人絕不可忽視專利信息的重要性。什么是專利信息？提到專利，一般人會(huì)認(rèn)為專利只是一個(gè)保護(hù)產(chǎn)品的法律權(quán)利。事實(shí)上，除了可以保護(hù)產(chǎn)品外，專利也像是產(chǎn)品的使用手冊，有文字及圖標(biāo)敘述產(chǎn)品的組件、特征、用途，以及使用方法。此外，專利信息還包括任何可以從專利局發(fā)行的文件中所獲得的信息，包括技術(shù)資料、市場信息、法律信息、以及公司的任何信息。二.專利主要內(nèi)容

一）封面：包括專利的基本資料﹙如專利號(hào)碼、專利申請日、發(fā)明人姓名等﹚和發(fā)明摘要。

封面：封面提供專利的基本資料，在每一筆基本資料旁都印有以[]框起來的號(hào)碼，也就是大家熟知的INID碼（InternationallyagreedNumbersfortheIdentificationofBibliographicDatacode；INIDcode）。每個(gè)INID碼各代表不同的數(shù)據(jù)項(xiàng)，例如[54]代表發(fā)明名稱，[76]代表發(fā)明人姓名與戶籍地。由于INID碼是國際統(tǒng)一的號(hào)碼，因此各國的專利都是以[54]來表示發(fā)明名稱。封面上還包括摘要，對發(fā)明作簡單描述，在摘要下方還會(huì)指出專利所包括的請求項(xiàng)與圖標(biāo)張數(shù)。另外，封面還可能包括專利的代表圖標(biāo)。以下是美國專利中常見INID碼及代表的意義：[19]公告的國家或組織：出現(xiàn)在2001年1月2日前公告的美國專利中，顯示在專利封面左上角的UnitedStatesPatent右方，位于下方的英文為第一發(fā)明人的姓。[12]公告型態(tài)：出現(xiàn)在2001年1月2日后公告的美國專利中，會(huì)顯示UnitedStatesPatent，位于下方的英文為第一發(fā)明人的姓。[11]專利號(hào)碼：出現(xiàn)在2001年1月2日前公告的美國專利中，不同的專利種類有不同格式的專利號(hào)碼。舉例來說，「發(fā)明專利」的專利號(hào)碼為純數(shù)字的序號(hào)，如6,666,666?！感率綐訉＠沟膶＠?hào)碼以字母D開頭（D表示Design）后加數(shù)字序號(hào)，如D333,333?！钢参飳＠沟膶＠?hào)碼以PP開頭后加數(shù)字序號(hào)，如PP8,112。[10]專利識(shí)別碼：出現(xiàn)在2001年1月2日后公告的美國專利中，舉例來說，US6,541,321B1代表美國發(fā)明專利第6,541,321號(hào)，其中的B1表示專利在獲準(zhǔn)前并沒有被早期公開過。在美國采用早期公開制度后，2000年11月29日后申請的案件在提出申請后一段時(shí)間（通常為18個(gè)月），美國專利局即公開專利申請案的內(nèi)容†，這類的專利識(shí)別碼會(huì)以B2做結(jié)尾。[45]專利公告日：專利公告的日期。[54]發(fā)明名稱：專利申請人對發(fā)明的命名。[75]發(fā)明人資料：包括發(fā)明人姓名，以及發(fā)明人的戶籍地。用于當(dāng)發(fā)明人為申請人但不為專利權(quán)人時(shí)。[76]發(fā)明人資料：包括發(fā)明人姓名，以及發(fā)明人的戶籍地。用于當(dāng)發(fā)明人同時(shí)為申請人及專利權(quán)人時(shí)。[73]專利權(quán)受讓人：專利權(quán)的擁有人，通常為發(fā)明人的任職公司。[21]專利申請案號(hào)：專利提出申請時(shí)，美國專利局給予的申請?zhí)柎a。[22]專利申請日：專利申請的日期。[63]專利的母案及其相關(guān)信息：當(dāng)專利為延續(xù)案時(shí)，其所依據(jù)的母案資料。[51]國際專利分類號(hào)：代表發(fā)明所屬的發(fā)明類別。[52]美國專利分類號(hào)：代表發(fā)明所屬的發(fā)明類別。[58]檢索范圍：為審查委員在審查時(shí)，檢索過的專利所屬的美國專利分類號(hào)。[56]引證案：為審查委員在進(jìn)行專利審查時(shí)所參考過的相關(guān)資料，包括美國專利文件（U.S.PatentDocuments）、外國專利文件（ForeignPatentDocuments）與其它刊物（OtherPublication）。[74]代理人資料：提供代理人的姓名或代理律師事務(wù)所的名稱。[57]發(fā)明摘要：為發(fā)明的簡單描述。

二）圖標(biāo)：包括描繪發(fā)明的圖標(biāo)。

圖標(biāo)：專利中常會(huì)以圖標(biāo)來協(xié)助讀者了解發(fā)明，圖式中會(huì)對不同的組件標(biāo)示號(hào)碼，方便在文字部分作說明。此外，圖標(biāo)對英文非母語的讀者也有很大的幫助，對于簡單的發(fā)明，常?？梢杂每磮D說故事的方式了解發(fā)明的內(nèi)容。在美國專利中，習(xí)知技術(shù)的圖標(biāo)會(huì)標(biāo)示PriorArt，反之沒有標(biāo)示PriorArt的圖標(biāo)為發(fā)明的圖標(biāo)，讀者常?？梢越逵杀容^習(xí)知技術(shù)與新發(fā)明的圖標(biāo)，了解發(fā)明的特征。•發(fā)明名稱：同于專利封面上所印的發(fā)明名稱。•發(fā)明領(lǐng)域（FieldoftheInvention）：簡短描述發(fā)明所屬的技術(shù)領(lǐng)域。•習(xí)知技術(shù)（DeionoftheRelatedArt或DeionofPriorArt）：描述習(xí)知技術(shù)的缺點(diǎn)以及有待解決的問題。•發(fā)明總覽（SummaryoftheInvention）：概括地描述申請專利的發(fā)明以及其優(yōu)點(diǎn)。•各圖標(biāo)的簡單說明（BriefDeionoftheDrawings）：對每一圖標(biāo)做簡短的說明。•發(fā)明的詳細(xì)說明或較佳實(shí)施例的詳細(xì)說明（DetailedDeionoftheInvention或DetailedDeionofthePreferredEmbodiments）：以文字詳細(xì)敘述發(fā)明的內(nèi)容與特征，為專利中描述發(fā)明的最主要地方。通常會(huì)利用發(fā)明的例子（實(shí)施例）來協(xié)助說明

三）說明書的內(nèi)容部分：包括文字描述。

四）申請專利范圍：包括請求項(xiàng)（或稱權(quán)利項(xiàng)）定義專利的保護(hù)范圍。

申請專利范圍：申請專利范圍的部分包括一個(gè)以上的請求項(xiàng)，各請求項(xiàng)以阿拉伯?dāng)?shù)字依序編號(hào)，站在法律的角度，請求項(xiàng)是專利中最重要的部分。請求項(xiàng)是專利中用來界定專利保護(hù)范圍的地方，也是用來判斷是否侵權(quán)的指針。請求項(xiàng)由三部份所組成：前言（preamble）、連接詞（transitionalphrase）與主體（body）。依序說明如下：•前言：為發(fā)明的名稱，有時(shí)還包括發(fā)明使用的環(huán)境或條件。•連接詞：緊接在前言之后，用來導(dǎo)引出主體部分。常見的連接詞有comprising（包括）、consistingof（僅包括）、和consistingessentiallyof（主要包括）。連接詞的選擇影響專利保護(hù)范圍甚大，不同的連接詞會(huì)界定出不同的保護(hù)范圍。舉例來說，「comprising」表示專利不僅保護(hù)包括在請求項(xiàng)中所有的構(gòu)件（組件或步驟），任何東西只要包括請求項(xiàng)中所有的構(gòu)件，不管是否還包括其它未在請求項(xiàng)中出現(xiàn)的構(gòu)件，都構(gòu)成侵權(quán)；「consistingof」則表示專利僅保護(hù)包括在請求項(xiàng)中的構(gòu)件，當(dāng)有東西還包括其它未在出現(xiàn)在請求項(xiàng)的構(gòu)件時(shí)，則不構(gòu)成侵權(quán)；「consistingessentiallyof」常見于醫(yī)藥類的專利，用來表示專利保護(hù)包括在請求項(xiàng)中所有的構(gòu)件以及其它不改變發(fā)明特性的構(gòu)件，如果其它藥物成分另外含有添加物會(huì)改變專利保護(hù)成分的特性，則不構(gòu)成侵權(quán)。常見的請求項(xiàng)分為獨(dú)立項(xiàng)（IndependentClaim）與依附項(xiàng)（DependentClaim）。獨(dú)立項(xiàng)主要用來單獨(dú)界定較廣的保護(hù)范圍，包括發(fā)明的一些基本構(gòu)件。不同于獨(dú)立項(xiàng)可以單獨(dú)界定保護(hù)范圍，依附項(xiàng)必須依附在其它請求項(xiàng)上，其保護(hù)范圍包括所依附的請求項(xiàng)中的構(gòu)件以及其本身的構(gòu)件，進(jìn)一步縮小所依附的請求項(xiàng)的保護(hù)范圍三.如何使用專利信息

參考專利信息來規(guī)劃研究方向：發(fā)明人可藉由專利信息取得技術(shù)協(xié)助，解決技術(shù)瓶頸。并藉由專利信息可以啟發(fā)研究靈感，避免重復(fù)研發(fā)或侵犯已取得專利的發(fā)明技術(shù)。專利信息中同時(shí)包含專利權(quán)人的資料，可作為發(fā)明人日后考慮合作對象的參考。藉由專利信息來追蹤競爭對手的研發(fā)進(jìn)展：發(fā)明人可利用專利信息了解競爭對手在相關(guān)領(lǐng)域的研究成果以及在市場上的規(guī)劃。舉例來說，藉由獲得對方尚在申請的專利案資料，可以預(yù)測競爭對手可能推出的產(chǎn)品；藉由獲得對方放棄的專利案資料，可以預(yù)測競爭對手可能放棄生產(chǎn)的產(chǎn)品；藉由獲得對方相關(guān)領(lǐng)域發(fā)明人的資料，可以知道競爭對手所投入的人力資源；藉由了解對方在哪些國家申請專利，可獲得競爭對手的市場規(guī)劃。利用專利信息來了解技術(shù)發(fā)展的趨勢：藉由分析專利信息，發(fā)明人可了解不同國家的產(chǎn)業(yè)結(jié)構(gòu)與技術(shù)趨勢，進(jìn)而擬定市場策略的依據(jù)四如何查詢美國專利

二十年前，大部分專利資料收集的工作都是以雇用人工的方式，在收藏專利的圖書館中進(jìn)行。在專利資料計(jì)算機(jī)化與網(wǎng)絡(luò)普及后，許多主要的專利局都已在網(wǎng)絡(luò)上提供免費(fèi)的專利信息服務(wù)。以下將以美國專利局為例，說明如何利用網(wǎng)絡(luò)資源進(jìn)行專利資料的收集。美國專利局(提供1790年至今的美國專利以及2001年后的早期公開申請案的線上查詢。其中，1790到1975年的專利由于只有圖像文件（TIFF格式文件），因此只提供專利號(hào)碼與美國專利分類號(hào)的檢索。在進(jìn)入美國專利局的網(wǎng)站后，點(diǎn)選左邊一欄Patents下的Search：接著，使用者會(huì)進(jìn)入PatentFull-TextandFullDatabases的畫面：畫面上綠色區(qū)域?qū)儆讷@準(zhǔn)專利（IssuedPatents），黃色區(qū)域?qū)儆谏暾埌傅脑缙诠_資料（PatentPublications），兩區(qū)域各有快速檢索（QuickSearch或BooleanSearch）、進(jìn)階搜尋（AdvancedSearch或ManualSearch）、以及專利號(hào)碼檢索（PatentNumberSearch）三種搜尋的方式。快速檢索：使用者可以輸入單一兩個(gè)關(guān)鍵詞組合（如AND、OR、和ANDNOT的組合）進(jìn)行檢索，同時(shí)可指定關(guān)鍵詞所出現(xiàn)的字段（如標(biāo)題、發(fā)明摘要、發(fā)明人姓名等）與專利公告的年份。例如，要搜尋「專利權(quán)人」為MicrosoftCorporation（微軟軟件公司），「發(fā)明名稱」為searchengine（搜尋引擎），從1976年到現(xiàn)在的專利，則將檢索條件設(shè)定如下：搜尋結(jié)果如下：點(diǎn)選欲閱讀的專利，如美國專利第6,523,021號(hào)則會(huì)顯示專利的文字內(nèi)容。如下所示：要注意的是，這部分只顯示專利文件的文字部分，并不包括圖標(biāo)。如果使用者對圖標(biāo)有興趣，可以點(diǎn)選「Images」閱覽專利的TIFF圖片文件，如下所示。若欲閱覽專利的下頁，可按下專利左上角「GotoPage」下方的箭頭，進(jìn)入下一頁；進(jìn)階搜尋：使用者可以輸入多個(gè)關(guān)鍵詞，并以代號(hào)指定關(guān)鍵詞出現(xiàn)的字段進(jìn)行檢索。例如：要搜尋「專利名稱」為camera（相機(jī)），「專利權(quán)人」為Sony（新力），「專利權(quán)人所位于城市」為Tokyo（東京），從1976年到現(xiàn)在的專利，則需要鍵入搜尋條件「TTL/cameraandAN/sonyandAC/tokyo」并選擇年份「1976topresent」，如下：進(jìn)階搜尋：使用者可以輸入多個(gè)關(guān)鍵詞，并以代號(hào)指定關(guān)鍵詞出現(xiàn)的字段進(jìn)行檢索。例如：要搜尋「專利名稱」為camera（相機(jī)），「專利權(quán)人」為Sony（新力），「專利權(quán)人所位于城市」為Tokyo（東京），從1976年到現(xiàn)在的專利，則需要鍵入搜尋條件「TTL/cameraandAN/sonyandAC/tokyo」并選擇年份「1976topresent」，如下：專利號(hào)碼檢索：利用專利號(hào)碼或?qū)＠暾埌傅墓_號(hào)碼搜尋進(jìn)行檢索。關(guān)鍵詞檢索可說是一般使用者最常用的檢索方式，但是這種方式容易遺漏掉某些專利。另一種比較常見的方法，是利用美國專利分類號(hào)來做檢索。美國專利分類號(hào)給予各技術(shù)類別技術(shù)不同的分類號(hào)碼，有系統(tǒng)的將專利依技術(shù)類別分類。利用分類號(hào)檢索，可取得較完整的專利資料。檢索的方式有兩種，一種是以關(guān)鍵詞找出一些專利后，再利用這些專利鎖列舉的專利分類號(hào)在QuickSearch內(nèi)進(jìn)行一次全面的檢索。另一種方式是利用美國專利局的專利分類號(hào)數(shù)據(jù)庫找出相關(guān)技術(shù)的分類號(hào)，再利用這些分類號(hào)做檢索。專利局還提供利用關(guān)鍵詞找出專利分類號(hào)的功能，網(wǎng)址位于_blank"By」可連結(jié)至參考過本篇專利的其它專利‡美國專利分類號(hào)美國專利分類號(hào)有系統(tǒng)的將專利申請案依照技術(shù)類別分類，并賦予不同技術(shù)類別不同的專利分類號(hào)。分類號(hào)的格式為「大分類號(hào)/小分類號(hào)」，其中大分類號(hào)代表的是主要的技術(shù)分類，小分類號(hào)代表的是每個(gè)主要技術(shù)分類下更細(xì)小的分類。以368/28為例，368代表的是量測時(shí)間的系統(tǒng)或組件，28代表的是具有顯示日期功能的組件。美國專利局有提供各美國專利分類碼所代表類別的線上查詢，網(wǎng)址為：_blank"（一）利用專利或公開申請案所提供的資料。每一個(gè)專利或公開申請案的封面上都會(huì)印有該發(fā)明所屬的美國專利分類號(hào)，因此可藉由找出特定發(fā)明的專利或公開申請案得知該發(fā)明的專利分類號(hào)。請參考「專利封面導(dǎo)讀」。（二）利用關(guān)鍵詞來檢索。例如，要知道手表（Watch）的分類號(hào)，可在進(jìn)入_blank";后，點(diǎn)選網(wǎng)頁中的字母「W」，如下所示：之后網(wǎng)頁會(huì)顯示所有以W字母開頭的技術(shù)類別及其分類號(hào)，使用者可以依字母順序找到Watch所屬的分類號(hào)，如下所示：另外，也可利用輸入關(guān)鍵詞的方式來檢索，但由于檢索出來的資料比較復(fù)雜，建議還是使用上面點(diǎn)選字母的方式會(huì)比較容易。（三）利用瀏覽的方式尋找。美國專利局有將大分類號(hào)與其對應(yīng)技術(shù)類別的描述，依大分類號(hào)的順序列在網(wǎng)頁內(nèi)，網(wǎng)址是_blank"Search）網(wǎng)頁，輸入美國專利分類號(hào)，進(jìn)行專利檢索。例如要檢索「美國專利分類號(hào)」為368/28，從1976年到現(xiàn)在的專利，則可以將檢索條件設(shè)定如下:在term1中輸入368/28，下拉菜單中選中currentUSclassification點(diǎn)research
