文件編號DOC No.SAP-011版本Version A員工代表選舉程序Workers representative electoral procedure生效日期Effective date2013-09-20頁次Page9 / 9修 訂 歷 史 Revision History版次Version次數(shù)Times修訂內(nèi)容Revision Content日期Date制訂人InitiatorA-新發(fā)行 First Issue核 準Approved審核Checked制 訂Prepared1.0目的 Purpose為了使公司員工代表能夠充分代表員工行使自己的權(quán)利,公司尊重并保護工人自由選舉員工代表,建立并維持有效的申訴和投訴機制,使員工代表代表員工就相關(guān)問題于管理層交涉,并監(jiān)督其處理結(jié)果的公證性,切實保證員工的合法權(quán)益。In order to make the workers representative exercise their rights on behalf of workers, The company shall respect and protect workers free elections of workers representative, establish and maintain effective appeal and complaint mechanism, make the employee representatives communicate with management on relevant issues on behalf of the staff, and supervise the fairness of processing results, effectively guarantee the legitimate rights and interests of employees.2.0適用范圍 Scope本程序適用于員工代表的選舉;員工代表權(quán)利的行使;公司管理層和員工代表定期的例會;公司管理層就員工代表意見的處理。This procedure applies to workers representatives election; The exercise of the rights for workers representative; The management of company and workers representatives regular meeting; The management of the company handle workers representatives advice. 3.0定義(無)Definition: None4.0職責(zé)Responsibility4.1公司行政部協(xié)助組織員工進行員工代表的選舉并保持選舉記錄。Administration department help organize workers representatives vote and keep record. 4.2管理代表關(guān)注并審議員工意見,至少每季度一次與員工代表召開會議并保持對此類事件的處理。Management representative focus and review employees opinions, organize the workers representative for the meeting at least once a quarter. 4.3員工代表職責(zé):Workers responsibility4.3.1代表員工就工時、工資、人權(quán)、福利、健康安全、工作環(huán)境等員工關(guān)心的問題于管理層交涉。On behalf of the employees negotiate with management on issues that employees care such as working hours, salary, human rights, welfare, health and safety, working environment, etc.4.3.2定期參加管理層的會議,提報員工所關(guān)心的問題和公司EICC實施情況。Regularly attend the management meeting, reported the staffs concerns and EICC execution situation.4.3.3協(xié)助員工申訴及調(diào)查處理取證工作。Assist employees to complain, investigate and forensics.4.3.4監(jiān)督員工投訴及處理的公證性。Supervise the fairness of the handling of staffs complaints.4.3.5有權(quán)享受與其它員工相同的待遇。Have the right to enjoy the same treatment as other employees.4.3.6有權(quán)在不受任何歧視或打擊報復(fù)的情況下獨立開展工作Have the right to work independently without any discrimination or retaliation.4.3.7有權(quán)認真學(xué)習(xí)EICC規(guī)范及公司公布的同等文件并貫徹給員工。Have the right to learn EICC standards and the similar documents issued by the company, Promptly transmit them to the staff and carry out it.4.3.8不定期收集員工關(guān)心的問題或意見反饋給管理代表,并監(jiān)督處理公證性。Collect employees issues of common concern or advice and reflect to the management representative irregularly, and supervise the fairness of the handling.5.0程序內(nèi)容Procedure5.1員工代表選舉員工代表任期一年,期滿后需要重新選舉,可連任二屆。經(jīng)過民主選舉,以得票多少為依據(jù)并且在征得其本人同意情況下,由公司發(fā)布公告。The term of the workers representatives is one year, need to re-election after the expiry, may server two terms. Through democratic election, based on the number of votes and under the condition of his/her consent, announced by the company.5.2員工代表名額和選舉區(qū)域劃分:The number of delegates and election regional division: 本公司按部門確定員工代表的名額,原則上每50名員工中選舉產(chǎn)生1名員工代表,當各部門人數(shù)增加時,需要增加相應(yīng)的員工代表名額:每增加50人,增加1名員工代表。The company determine the number of employee representatives by department, in principle, Elect one of employee representatives from every 50 workers, when employees grow in number, the number of employee representatives need to be increased correspondingly: 1 employee representative will be added for every 50 people increase.5.3選舉辦法:實行差額選舉Election method: implement multi-candidate election本公司本著公平、公正、公開的原則,每個職能部門按5.2之規(guī)定推薦3-6名作為侯選人,(注員工代表非管理層員工),將推薦人填寫在員工代表推薦表上,行政部門根據(jù)員工代表推薦表進行統(tǒng)計公布,然后組織全體員工投票選舉,票數(shù)最高者當選。選舉時投票數(shù)超過2/3時認為此次投票有效。為證實選舉法的公平、公正、公開,選舉記錄(包括選票的統(tǒng)計表)應(yīng)當保持至該員工代表任期結(jié)束。The company is in line with the principle of fairness, justice, public, each department recommend 3-6 people as a candidate according to the provisions of 5.2, (Note :The management cant be assigned as the workers representative), fill out employee representatives recommend table with recommended, administrative department make a statistics and release the list according to the table of the employee representatives recommend, then organize the staff to vote, the highest number of votes is elected. In order to prove the fairness, justice and public of the electoral law, voting records (including the statistical table of votes) should be kept till the end of his term of the workers representative.5.4補選 by-election當員工代表在任期離職、期滿或不能再行使職責(zé)時,需要由原名額單位重新進行選舉出一名員工代表,其任期一年,可連任。When an employee representative leave within his term, expiration or unable to perform his/her duties any more, the original quota unit need to elect another employee representative, the term is one year, can be re-elected.5.5增選 Co-opt當公司擴大生產(chǎn)規(guī)模,需要增選員工代表,任期為一年,可連任。When the company expand production scale, employee representative need to be co-opted, The term is one year, can be re-elected.5.6罷免 Recall5.6.1當選舉區(qū)域內(nèi)員工(20%以上署名提報)認為員工代表不能代表員工的利益時,可以選舉本選舉區(qū)域的全體會議投票表決,投票率50%以上罷免該員工代表(參加人數(shù)應(yīng)占選舉區(qū)域的3/4以上員工參加)。由該選舉區(qū)域按4.2條款規(guī)定重新選舉員工代表。When the employees of electoral area think that the employee representatives can not represent their interests (the number of signatures is more than 20%), can vote through election meeting for deposition, recall the employee representatives if the voter turnout is more than 50% (The participants population occupy should above number of people three-quarters of electoral area).The electoral area re-elect workers representatives as stipulated in the clause 4.2. 5.6.2當員工代表連續(xù)三次不能參加例會或連續(xù)二次不提交任何建議時,應(yīng)由該區(qū)域員工重新選舉員工代表。When the employee representative doesnt attend the regular meeting three times in succession or not to submit any advice two consecutive, The employee representative shall be re-elected by the employees of this department.5.7例會 Regular meeting5.7.1員工代表可以自由組織定期進行例會,進行討論公司相關(guān)的健康、安全、衛(wèi)生、福利、常規(guī)設(shè)施、工資、加班以及其它以相關(guān)的事宜。Workers representatives are free to organize regular meeting, discuss related to health, safety, health, welfare, conventional facilities, wage, overtime, and other related matters on the company.5.7.2員工代表需要定期收集本區(qū)域內(nèi)員工的各項建議和意見,并匯總后在與管理層討論的例會上提交。The workers representatives need to collect all the suggestions and comments from employees periodically and summary and submit at the discussion meeting with management.5.7.3員工代表需要定期至少每季度參加一次與管理層討論的例會,不可缺席(除不可避免的自然災(zāi)害原因外)。The workers representatives need to attend the regular meeting regularly at least once every quarter to discuss with the management, cant absent (except the inevitable cause like natural disasters).5.7.4當員工代表不能參加與管理層討論的例會時,需要將其相關(guān)建議轉(zhuǎn)由其它員工代表在例會上提交。When the employee representatives cannot attend the discussion meeting with the management, need to transfer the relevant suggestions to other representatives and submit at the meeting.5.7.5公司指定EICC管理代表就相關(guān)問題與員工代表面對面溝通,管理代表應(yīng)為公司管理層人員或被認為同等職級的人員,至少每季度與員工代表召開一次定期會議,必要時可以召開臨時會議,應(yīng)保持書面會議記錄。EICC management representative appointed by company communicate with employee representatives face to face on relevant issues, management representative shall be the companys management personnel or the personnel that is considered the same rank, There will be a regular meetings with employee representatives at least every quarter. And written meeting minutes shall be maintained as well.5.7.6管理代表在例會中應(yīng)充分聽取員工的意見,并積極地采取處理措施,為證明員工代表例會的真實性,所有的員工代表例會均需有所有與會員工代表簽名作實。Management representative should be fully listen to the opinions of the staff in the meeting, and take measures actively, all the workers representatives need to sign to prove the authenticity of the workers representatives meeting.5.8員工代表權(quán)益及義務(wù)行使The rights and obligations exercise of workers representative5.8.1員工代表均應(yīng)認真學(xué)習(xí)EICC規(guī)范及本公司公布的社會責(zé)任手冊、程序文件及其支持性文件,并明確自己權(quán)利范圍。The workers representatives shall earnestly study the EICC standards, the social responsibility manual, procedure documents and its supporting documents, and they should clear the scope of their rights.5.8.2員工代表應(yīng)協(xié)助本區(qū)域員工申訴,員工訴狀經(jīng)由申訴人簽名后可由員工代表幫助直接提交管理層的溝通例會,也可以由申訴者本人將訴狀投放意見箱。 The workers representatives shall assist the staff to complain, The complaint with the complainants signature from staff is submitted to the management at the communication meeting directly by the workers representatives. The complaint also can complain by dropping the enclosed suggestion form into the suggestion box. 5.8.3總經(jīng)理室人員在收集意見箱中的員工投訴或建議時應(yīng)至少由二名員工代表在場,由員工代表記錄所收集的員工意見或建議。At least two workers representatives present while the general managers office personnel collect the staff complaints or suggestions, The collected opinions or suggestions should be recorded by the workers representatives.5.8.4公司管理層在處理員工投訴時,當需要調(diào)查取證時應(yīng)通知相應(yīng)區(qū)域的員工代表一同進行調(diào)查處理取證工作。The management should notify related departmental workers representatives to investigate and collect evidence when dealing with employee complaints and need to obtain evidence.5.8.5員工代表監(jiān)督員工投訴及處理的公正性,在員工投訴處理記錄上簽名,并向申訴者反饋處理結(jié)果;如果認為處理的不夠公正,可聯(lián)絡(luò)其它區(qū)域員工代表商議,如一致認為其處理確實不夠公正,則提交與管理層的例會,要求公司管理層作出適當?shù)奶幚?,直至至少?0%以上的員工代表滿意或申訴者本人滿意為止。The workers representative supervise the fairness of employees complaints and dealing with, sign the employee complaint handling records, and reflect the complaint handling results to complainants; If consider the handling is unfair, may contact employee representatives from other sectors to discuss, if agreed that its treatment is really unfair, can submit to a management meeting to make appropriate treatment, until at least more than 50% of the workers representatives are satisfied or the complainant is satisfied.5.8.6公司管理層調(diào)查和處理員工的投訴或意見及員工代表會議中所反映的問題,并將結(jié)果通報給員工代表,保持書面處理記錄。Company management investigates and deals with complaints or comments and the problems reflected at the workers representatives meeting, and reports the results to the workers representatives, keep a written handle record.5.8.7員工代表因為開會、學(xué)習(xí)、調(diào)查取證等行使員工代表權(quán)益所占用的時間,公司均按照正常出勤來計算工資。For the workers representative, the time occupied by exercising workers representative rights and interests which attending meeting, studying and investigating and collecting evidence will be calculated
