14、use only印鑒核符簽名：備注：開證申請(qǐng)人承諾書中國(guó)光大銀行：我公司已辦妥一切進(jìn)口手續(xù)，現(xiàn)請(qǐng)貴行按我公司不可撤銷跟單信用證申請(qǐng)書內(nèi)容（見正面英文）開出不可撤銷跟單信用證，我公司茲承諾如下： 一、我公司同意貴行依照開證之日有效的國(guó)際商會(huì)跟單信用證統(tǒng)一慣例開出不可撤銷跟單信用證及辦理該信用證項(xiàng)下一切事宜，并同意承擔(dān)由此產(chǎn)生的一切責(zé)任。二、我公司保證該信用證項(xiàng)下進(jìn)口業(yè)務(wù)具有真實(shí)的貿(mào)易背景，一切手續(xù)符合國(guó)家現(xiàn)行有關(guān)法律法規(guī)和外匯管理規(guī)定，并根據(jù)貴行要求及時(shí)提供相應(yīng)的有效憑證和資料。貴行有權(quán)根據(jù)有關(guān)法律法規(guī)及貴行的有關(guān)規(guī)定決定是否受理我公司的開證申請(qǐng)。三、我公司保證在貴行規(guī)定的時(shí)間內(nèi)向貴行支付該信用

15、證項(xiàng)下的貨款、手續(xù)費(fèi)、利息及一切費(fèi)用（包括電訊費(fèi)、雜費(fèi)、國(guó)外受益人拒絕承擔(dān)的有關(guān)銀行費(fèi)用、因貴行發(fā)生信用證項(xiàng)下墊款我公司應(yīng)付的逾期利息、違約金、賠償金及貴行為實(shí)現(xiàn)債權(quán)而支付的費(fèi)用等）所需的外匯和人民幣資金。四、我公司保證于貴行到單通知書中規(guī)定的期限之內(nèi)通知貴行辦理對(duì)外承付款，否則貴行可認(rèn)為我公司已接受單據(jù)并同意承付。五、我公司保證在交單相符的條件下辦理有關(guān)承付手續(xù)。如我公司認(rèn)為交單不符而請(qǐng)求貴行拒付，我公司保證于貴行到單通知書中規(guī)定的日期之前將全套單據(jù)如數(shù)退還貴行并隨附書面拒付理由，由貴行按照國(guó)際慣例決定能否對(duì)外拒付。如果貴行確定我公司所提拒付理由不成立，或雖然拒付理由成立，但我公司未能退回全

16、套單據(jù)，或單據(jù)退到貴行時(shí)已超過到單通知書中規(guī)定的期限，貴行有權(quán)主動(dòng)辦理對(duì)外承付，并從我公司帳戶中扣款。如果帳戶中資金不足，不足部分按逾期貸款處理，我公司保證按貴行的有關(guān)規(guī)定和要求辦理必要的手續(xù)。六、如果在貴行開立信用證及/或?qū)ν飧犊钗夜臼褂觅F行提供的授信融資便利時(shí)，我公司保證按照貴行的有關(guān)規(guī)定辦妥一切手續(xù)。七、該信用證及其項(xiàng)下業(yè)務(wù)往來函電及單據(jù)，如因郵、電或其他方式傳遞過程中發(fā)生遺失、延誤、錯(cuò)漏，貴行當(dāng)不負(fù)責(zé)。八、由于開立信用證所基于的基礎(chǔ)合同發(fā)生糾紛或由于第三方原因造成貴行損失的，我公司承擔(dān)賠償責(zé)任。九、該信用證如需修改，由我公司向貴行提出書面申請(qǐng)，貴行根據(jù)具體情況確定能否辦理修改。我公司

17、確認(rèn)所有修改當(dāng)由信用證受益人接受時(shí)才能生效。我公司保證支付因信用證修改而產(chǎn)生的一切費(fèi)用（包括受益人拒絕承擔(dān)的有關(guān)銀行費(fèi)用）。十、我公司在收到貴行開出的信用證、修改副本后，保證及時(shí)與申請(qǐng)書核對(duì)，如有不符之處，保證在接到副本之日起的兩個(gè)工作日之內(nèi)通知貴行。如未通知，當(dāng)視為正確無誤。十一、本不可撤銷信用證申請(qǐng)書（正面）以及信用證修改申請(qǐng)書一律用英文填寫，如我公司用中文填寫引起歧義，貴行概不負(fù)責(zé)。因申請(qǐng)書（含修改申請(qǐng)書）字跡不清或詞義含混而引起的一切后果由我公司負(fù)責(zé)。十二、我公司已全面、準(zhǔn)確地閱讀并理解了不可撤銷跟單信用證申請(qǐng)書和本承諾書的各項(xiàng)條款。我公司特做出如上承諾，保證嚴(yán)格遵守。十三、本承諾書在貴行解除該信用證項(xiàng)下的全部對(duì)外責(zé)任前和我公司在該信用證業(yè)務(wù)項(xiàng)下承擔(dān)的全部債務(wù)（如有）清償完畢前一直有效。十四、（此為選擇性條款，雙方的選擇是：1
