Houseuserequirementsandmaintenanceresponsibility 6.1 租賃期間

15、少對(duì)乙方使用該房屋的影響。 6.3Duringtheleasingperiod,PartyAshallensurenormalavailabilityandsafestatusofth epremisesandaccessoryfacilities.IfPartyAintendstocarryoutinspectionandmainten anceonthepremises,PartyAshallnotifyPartyB daysinadvance.Duringtheinspectionandmaintenance,PartyBshallprovidecoordinat ion.PartyAs

16、hallminimizetheinfluenceontheuseofthepremises. 6.4 乙方需裝修或者增設(shè)附屬設(shè)施和設(shè)備的，應(yīng)事先征得甲方的書(shū)面同意，按規(guī)定 須向有關(guān)部門(mén)報(bào)批的，則應(yīng)由甲方報(bào)請(qǐng)有關(guān)部門(mén)批準(zhǔn)后，方可進(jìn)行。乙方增設(shè)的附 屬設(shè)施和設(shè)備的歸屬及其維修責(zé)任由甲、乙雙方另行書(shū)面約定。 6.4IncasethatPartyBintendstodecoratethepremisesoraddaccessoryfacilitiesandeq uipments,PartyBshallobtainwrittenpermissionfromPartyAinadvance;ifitisre

17、quireds o,( PartyA PartyBentrustedbyPartyA)shallsubmitsuchbehaviortothecompetentde partmentforapprovalbeforetheimplementation.Theownershipandmaintenanceofth eaccessoryfacilitiesandequipmentsaddedbyPartyBshallbeadditionallyagreedbybo thpartiesinwrittenform. 七、房屋返還與續(xù)租 VII. Housereturnandrentingrenewal

18、 7.1 乙方應(yīng)在本合同的租賃期限屆滿(mǎn)之后的日內(nèi)返還該房屋，未經(jīng)甲方同意逾期 返還該房屋的， 每逾期一日， 乙方應(yīng)以日租金%向甲方支付該房屋占用期間的使 用費(fèi)。 7.1PartyBshallreturnthepremiseswithin daysaftertheterminationoftheleasingperiod,andincaseofanydelayforthereturnofthe premiseswithoutpermissionofPartyA,PartyBshallpayPartyAtheusefeeofthepremis esatthedailyrateequivalentt

19、o %ofdailyrentduringtheoccupationofthepremise s. 7.2 乙方如果需要續(xù)租的，應(yīng)在租賃期限屆滿(mǎn)兩個(gè)月之前向甲方提出，甲方同意的， 雙方另行簽訂相關(guān)續(xù)租文書(shū)。乙方在同等條件下享有優(yōu)先承租權(quán)。 7.2 IncasethatPartyBwantstorenewtheContract,PartyBshallraisetherenewalintention toPartyAtwomonthsbeforetheterminationoftheleasingperiod,andwiththeapprovalof PartyA,therenewalcontrac

20、twillbeadditionallysignedbetweenbothparties.Underthee quivalentcondition,PartyBshallhavethepriorityforobtainingthelease. 21、norenewalcontractissignedbybothparties andPartyBcontinuespayingtherent,whichisnotrefusedbyPartyA,thenon-fiGed-term leasingrelationsareestablishedbetweenbothpartiesaccordingtorelevantlawsandre gulations.Duringsuchnon-fiGed-termleasingrelations,PartyAshallhavetherighttoter minatetheleasingrelationsbyn

22、otifyingPartyBone(1)monthinadvance. 7.4 乙方返還該房屋應(yīng)符合正常使用后的狀態(tài)。返還時(shí)，應(yīng)經(jīng)甲方驗(yàn)收認(rèn)可，并相 互結(jié)清各自應(yīng)當(dāng)承擔(dān)的費(fèi)用。 7.4 ThepremisesreturnedbyPartyBshallbeconsistentwiththestatusafternormaluseoft hepremises.Uponreturnofthepremises,PartyBshallinspectthepremisesbeforeitsac ceptanceandtherelevantfeesforrespectivepartiesshallbeset

23、tled. 八、轉(zhuǎn)租與轉(zhuǎn)讓 VIII. Subleaseandtransfer 8.1 除甲方已經(jīng)在本合同中同意乙方轉(zhuǎn)租外，乙方在租賃期限內(nèi)，不可將該房屋部 分或全部轉(zhuǎn)租給他人。 8.1 EGceptthatPartyAagreesinthisContractthatthepremisesmaybesubleasedbyParty B,PartyBshallnotsubleasepartorallofthepremisestoanyotherpersonwithintheleasin gperiod,withoutwrittenpermissionofPartyA.Anyhowonelivin

24、groomintheoriginalhou seholdtypeshallnotbeseparatedforsubleasing. 九、解除合同的條件 IG.Conditionsforcontractcancelation 9.1 甲乙雙方同意在租賃期限內(nèi)，有下列情形之一的，本合同終止，雙方互不承擔(dān) 責(zé)任： 9.1Bothpartiesagreethatduringtheleasingperiod,thisContractshallbeterminatedneit herpartyneedingtoassuminganyresponsibilityincaseofanyofthefollowi

25、ngsituations; (一) 該房地產(chǎn)占用范圍內(nèi)的土地使用權(quán)依法提前收回的； (1) Theuserightofthelandoccupiedbytherealestatehasbeenlegallyretrieved; (二) 該房地產(chǎn)因社會(huì)公共利益被依法征用的； (2) Thepremisesareoccupiedbymeansoflegalrequisitionduetosocialandpublicintere sts; (三) 該房地產(chǎn)因城市建設(shè)需要被依法列入房屋拆遷許可范圍內(nèi)的； (3) Thisrealestatehastobelegallyputintothedisman

26、tlingrangeduetourbanconstructio n; (四) 該房屋毀損、滅失或者被鑒定為危險(xiǎn)房屋的； (4) Thepremisesaredamaged,destroyedorverifiedasdangeroushouse; (五) 甲方已告知乙方該房屋出租前已設(shè)定抵押，現(xiàn)被處分的； (5) PartyAhasnotifiedPartyBthatthepremiseshavebeenpledgedbeforeleasingandno whasbeendisposed; 9.2 甲乙雙方同意，有下列情形之一的，一方可書(shū)面通知另一方解除本合同。違反 合同的一方，應(yīng)向另一方按月租

29、deven daysaftereGigentnoticeofPartyB; (二) 甲方交付的該房屋不符合本合同的約定，致使不能實(shí)現(xiàn)租賃目的的；或甲方 交付的房屋存在缺陷，危及乙方安全的； (II) ThepremiseshandedoverbyPartyAdonotcomplywiththeagreementinthisContrac t,whichthereforemakesitimpossibletorealizetheleasingpurpose;orthepremiseshan dedoverbyPartyAhavethedefectsendangeringthesafetyofPa

30、rtyB; (三) 乙方在甲方按時(shí)交付該房屋的情形下，未能配合辦理交房手續(xù)，經(jīng)甲方催告 后 日仍未配合辦理交房手續(xù)的； (III) InspiteofthetimelyhandoverofthepremisesbyPartyA,PartyBfailstocooperatetog othroughtheproceduresforthehandoverofthepremises daysaftertheeGigentnoticeofPartyA; (四) 乙方未征得甲方書(shū)面同意改變?cè)摲课萦猛?，致使該房屋損壞的； (IV) PartyBchangedtheuseofthepremiseswithou

31、twrittenpermissionofPartyAandther eforeincurredthedamageofthepremises; (五) 因乙方原因造成該房屋主體結(jié)構(gòu)損壞的； (V) ThemainstructureofthepremisesisdamagedduetothereasonsofPartyB; (六) 乙方擅自轉(zhuǎn)租該房屋或轉(zhuǎn)讓該房屋承租權(quán)的； (VI) PartyBsubleasesthepremisesortransferstheleasingrightofthepremiseswithoutp ermissionofPartyA; (七) 乙方逾期不支付租金累計(jì)超

32、過(guò) 天的； (VII) Partyfailstopaytherentuptomorethan days; 十、違約責(zé)任 G.Breachingliability 10.1 該房屋交付時(shí)存在缺陷的，甲方應(yīng)自交付日起 日內(nèi)進(jìn)行修復(fù)，逾期不修 復(fù)的，甲方同意減少租金并變更有關(guān)租金條款。 10.1Incaseofanydefectwiththepremisesatthetimeofhandover,PartyAshallmakether epairwithin daysafterthehandover,andifnorepairismadeevenafterthestipulatedperiod,Pa

36、損失。 10.4 IfPartyBdecoratesthepremisesoraddstheaccessoryfacilitiesorequipmentswithout writtenpermissionofPartyAorbeyondthescopeandrequirementsagreedinwrittenper missionofPartyA,PartyAmayrequirePartyBtorecoverthepremisestotheoriginalstate ,orcompensatefortheloss. 10.5 租賃期間，非本合同規(guī)定的情況，乙方中途擅自退租的，乙方應(yīng)按月租金的

37、 倍向甲方支付違約金。若違約金不足以抵付甲方損失的，乙方還應(yīng)負(fù)責(zé)賠償。 10.5Duringtheleasingperiod,incaseofthesituationotherthanthosestipulatedintheCo ntract,PartyBstopstherenting,PartyBshallpayPartyAtheliquidateddamagesequival entto time(s)ofmonthlyrent.IftherentisnotenoughtooffsetthelossincurreduponPartyA,Part yBshallprovidefurtherc

38、ompensation. 十一、其他條款 GI.Others 11.1 本合同及附件一自甲、乙雙方于本合同簽章處簽字或簽章后立即生效。 11.1ThisContractanditsAppendiGIshallcomeintoeffectuponthesignaturesorsealsta mpingofPartiesAandB. 11.2 本合同空格處填寫(xiě)文字與鉛印文字具有同等法律效力，若填寫(xiě)文字與鉛印文字 相沖突，以填寫(xiě)文字為準(zhǔn)。若有未盡事宜，可簽訂補(bǔ)充協(xié)議進(jìn)行約定，若補(bǔ)充協(xié)議 與本協(xié)議相沖突，以補(bǔ)充協(xié)議為準(zhǔn)。 11.2 ThewordsfilledandprintedintheblankpartofthisContractshallhavesamelegalforce withtheContractitself,andincaseofany
