2、upational hazard and frequent accident such as construction chemical transportation metallurgy mine field and so on.第一條 本合同由_ (單位)與_ 工會(huì)根據(jù)勞動(dòng)法、安全生產(chǎn)法、職業(yè)病防治法等法律法規(guī)以及省、市有關(guān)條例規(guī)定結(jié)合本企業(yè)實(shí)際情況經(jīng)企業(yè)代表和職工代表協(xié)商一致簽訂。Article 1 The contract is established between_ and the Trade Union of _ in accordance with “Labor Law” “S

3、afe Production Law” “Occupational Disease Prevention and Cure Law” and related provincial and municipal regulations based on the actual situation and subject to the equal consultation between panys representative and employees representative.1.企業(yè)依照國(guó)家有關(guān)法律法規(guī)加強(qiáng)安全生產(chǎn)管理。建立健全安全生產(chǎn)責(zé)任制勞動(dòng)安全衛(wèi)生制度;組織編制安全生產(chǎn)規(guī)章制度、安全

4、操作規(guī)程及崗位操作規(guī)程組織制定實(shí)施安全生產(chǎn)事故應(yīng)急救援預(yù)案。pany must strengthen the production safety management according to relevant laws and regulations. pany should set up the system of job responsibility and the system of safe production and hygiene organize to work out internal rules and regulation operational instruction

5、s post operation rules as well as the emergency solution for production accident.2.企業(yè)應(yīng)不斷改善勞動(dòng)條件。有計(jì)劃地進(jìn)行安全設(shè)施的更新改造提供資金保證確保專(zhuān)款專(zhuān)用。pany should gradually improve the working environment. It should designedly modify the facilities for safe production and hygiene afford fund and insure its special use.3.企業(yè)應(yīng)對(duì)職工

6、進(jìn)行勞動(dòng)安全衛(wèi)生教育和培訓(xùn)未經(jīng)培訓(xùn)合格不得上崗作業(yè)。特殊工種作業(yè)人員必須經(jīng)過(guò)國(guó)家有關(guān)部門(mén)培訓(xùn)取得相應(yīng)資格操作證后方可安排其從事作業(yè)。pany should organize education and training on safe production and hygiene while people who fail or have not attended the safety training are not allowed for operation. Operators designed to special positions can start work only after

7、 obtaining the related qualification.4.企業(yè)根據(jù)各工種的崗位需要為職工提供符合國(guó)家標(biāo)準(zhǔn)及行業(yè)標(biāo)準(zhǔn)的勞動(dòng)保護(hù)用品。對(duì)不按規(guī)定穿戴和不正確使用勞動(dòng)保護(hù)用品和違反操作規(guī)程的職工有權(quán)查處。pany should provide personal protective equipment of national and industry standards according to different position requirements. pany is entitled to give opinions and investigate the liabil

8、ities of the employees who dont dress or use the protective equipment according to the requirements.5.企業(yè)對(duì)直接從事有毒有害崗位的職工進(jìn)行上崗前、離崗時(shí)的健康檢查每年定期進(jìn)行健康檢查并建立職業(yè)衛(wèi)生健康檔案。對(duì)其他崗位的職工也應(yīng)定期進(jìn)行體檢。并及時(shí)向工會(huì)通報(bào)職業(yè)病檢查情況。pany should organize the employees directly engaged in toxic and hazardous operations to take the health checkup

9、before and after the related work and individual health files are archived for operators of this nature. Scheduled health checkup should also be carried out for the employees of other positions. The result of occupational disease checkup should be announced to trade union.6.企業(yè)依法按國(guó)家、省、市規(guī)定要求和時(shí)限為職工辦理工傷

10、保險(xiǎn)并按時(shí)足額繳納工傷保險(xiǎn)費(fèi)用。職工因患職業(yè)病或因工受傷的工資和醫(yī)療費(fèi)按國(guó)家和省、市有關(guān)規(guī)定執(zhí)行。pany should cover the employees with industrial injury insurance in accordance with the law by national provincial and municipal requirements and time limits as well in full and on time pay the cost of industrial injury insurance. Medical expenses and

11、 wages for workers suffering from occupational diseases or work-related injuries should be paid according to the national provincial and municipal implementation of the relevant provisions.7.在生產(chǎn)過(guò)程中發(fā)生工傷事故和嚴(yán)重職業(yè)危害時(shí)企業(yè)應(yīng)及時(shí)報(bào)告工會(huì)工會(huì)有權(quán)依法參加事故調(diào)查提出處理意見(jiàn)并要求追究有關(guān)人員的責(zé)任。The occurrence of industrial injury and serious o

12、ccupational hazard during production process should be reported timely to Trade Union; Trade Union is entitled to inquire into the case and give opinions and furthermore investigate the liabilities of people in charge.8.企業(yè)在研究制定和修改勞動(dòng)安全衛(wèi)生規(guī)章制度、安全技術(shù)措施時(shí)工會(huì)應(yīng)參加涉及職工勞動(dòng)安全衛(wèi)生健康的重大問(wèn)題須經(jīng)職工代表大會(huì)(職工大會(huì))討論審議通過(guò)。The Trade

13、 Union should take pert in the studying and amending rules and regulations on labor health and safe production as well as safety techniques; any major issues concerning employees safety and health should be consulted and approved by the Employees Representative Convention.9.工會(huì)支持企業(yè)加強(qiáng)安全生產(chǎn)管理積極協(xié)助行政落實(shí)企業(yè)安

14、全衛(wèi)生規(guī)章制度監(jiān)督國(guó)家勞動(dòng)安全衛(wèi)生法規(guī)的執(zhí)行。工會(huì)有責(zé)任教育職工嚴(yán)格遵守企業(yè)的各項(xiàng)安全生產(chǎn)規(guī)章制度和操作規(guī)程教育和組織職工接受安全技術(shù)培訓(xùn)和管理。Trade Union should support the pany to strengthen production safety management actively assist the pany in the implementation of health and safe production rules and regulation. Trade union has the responsibility of educating w

15、orkers to strictly abide by the rules and regulations related to industrial safety the responsibility of educating and organizing employees to receive safety techniques training and management.10.工會(huì)有權(quán)糾正違章指揮對(duì)強(qiáng)令工人冒險(xiǎn)作業(yè)行為或當(dāng)發(fā)現(xiàn)明顯事故隱患和職業(yè)危害時(shí)有權(quán)停止作業(yè)并提出解決的建議行政應(yīng)當(dāng)及時(shí)研究答復(fù);當(dāng)發(fā)現(xiàn)危及職工生命安全的情況時(shí)有權(quán)組織職工撤離危險(xiǎn)場(chǎng)所。Trade Union is

16、 entitled to correct improper instruction and stop the operation and proposes the solutions when workers take the risk or apparent danger or occupational hazards are observed; the pany should make the decision and action thereafter. Trade Union is authorized to evacuate employees out of the dangerou

17、s places when their lives are expected to the hazard.11.其他由企業(yè)、職工提出要求協(xié)商的與勞動(dòng)安全衛(wèi)生有關(guān)的問(wèn)題。Other issues regard to health and labor safety put forward by pany and employees for further consulting.第二條 本合同由集體合同監(jiān)督檢查小組負(fù)責(zé)監(jiān)督企業(yè)應(yīng)每年不少于一次向職工代表大會(huì)(職工大會(huì))報(bào)告勞動(dòng)安全衛(wèi)生協(xié)議履行情況。Article 2 The supervision group of the collective co

18、ntract is responsible for superintending the execution of the present contract. pany should report the implementation of the contract to the Employees Representative Convention at least once every year.第三條 本合同有效期為 年自 年 月 日起至 年 月 日止并于期滿前三個(gè)月內(nèi)進(jìn)行下一輪勞動(dòng)安全衛(wèi)生集體協(xié)商。Article 3 The validity of the contract is _ y(s) starting from _ to _ and the next round of consultation on health and labor safety shall begin within 3 months before the expiry thereof.第四條 本合同一式四份雙方各執(zhí)一份一份由勞動(dòng)保障行政部門(mén)存檔一份報(bào)上級(jí)工會(huì)備案并在10日內(nèi)向全體職工公布。Article 4 The contract is made in four copies each party holding one Labor and Social
