3、 1. 于 2013 年 1 月 1 日生效的經(jīng)修訂的marpol 附則，除非附則明確許可，禁止將任何種類(lèi)的垃圾排放入海。the revised marpol annex v with an entry into force date of 1 january 2013, prohibits the discharge of all types of garbage into the sea unless explicitly permitted under the annex. 2. marpol 附則規(guī)定，除了 marpol 附則第 3、4、5 和 6 條的特殊許可外，禁止排放一切垃圾。m

4、arpol 附則推翻了歷史上按垃圾性質(zhì)來(lái)認(rèn)定哪些垃圾可以排放入海的規(guī)定方式以與距岸距離的定義。第 7 條規(guī)定了應(yīng)急和非正常情況下的例外情況。原則上排放限于食品廢棄物、標(biāo)明的貨物殘余、動(dòng)物尸體以與洗滌水中包含的標(biāo)明的對(duì)環(huán)境無(wú)害的清潔劑、添加劑和貨物殘余。建議船舶使用港口接收設(shè)施作為排放所有垃圾的首選方式。under the revised marpol annex v, discharge of all garbage is now prohibited, except as specifically permitted in regulations 3, 4, 5 and 6 of marpo

5、l annex v . marpol annex v reverses the historical presumption that garbage may be discharged into the sea based on the nature of the garbage and defined distances from shore. regulation 7 provides limited exceptions to these regulations in emergency and non-routine situations. generally, discharge

6、is restricted to food wastes, identified cargo residues, animal carcasses, and identified cleaning agents and additives and cargo residues entrained in washwater which are not harmful to the marine environment. it is recommended that ships use port reception facilities as the primary means of discha

12、d observe the requirements of the plan in order to prevent garbage pollution. 6 / 30 第一章 垃圾管理計(jì)劃實(shí)施人員職責(zé)duties of the persons of the implementation of the plan 1 總負(fù)責(zé)人職責(zé)duties of the persons in full charge of carrying out the plan 本船垃圾管理計(jì)劃實(shí)施總負(fù)責(zé)人是本船船長(zhǎng)，其主要職責(zé)是：the ships master is in full charge of implemen

13、tation of the plan. his duties will include: (1). 負(fù)責(zé)垃圾管理計(jì)劃在船上的全面貫徹實(shí)施；overall implementation of the plan on board. 19、nnex v of marpol 73/78 reads as follows: 第 10 條regulation 10 公告標(biāo)牌、垃圾管理計(jì)劃和垃圾記錄保存placards. garbage management plans and garbage recording-keeping (1)(a) 總長(zhǎng)度為12 m 或以上的船舶和固定或浮動(dòng)平臺(tái)均應(yīng)貼告示以使船員和乘客知曉本附則第3、4、5 和 6 條中適用的排放要求。every ship of 12 m or more in length overall and fixed or floating platforms shall displ

20、ay placards which notify the crew and passengers of the discharge requirements of regulations 3, 4, 5 and 6 of this annex, as applicable. 28、o made in an official language of the state whose flag the ship is entitled to fly, the entries in that language shall prevail in case of a dispute or discrepancy. 30、n a reasonable time. this document shall be preserved for a period of two years from the date of the last entry is made on the record; 10 / 30 (d)如發(fā)生本附則第 7 條所指的任何排放或意外落失， 垃圾記錄簿上應(yīng)予以記錄，或?qū)θ魏涡∮?400總噸的船舶，應(yīng)在該船的正式航海日志中記錄該排放或落失的地點(diǎn)、情況和原因、排放或落失的物品細(xì)目、以與為防止或盡量減少這種排放或意外落失業(yè)已采取的合理預(yù)防措施。in the event of any discharge

31、 or accidental loss referred to in regulation 7 of this annex an entry shall be made in the garbage record book, or in the case of any ship of less than 400 gross tonnage, an entry shall be made in the ships official log-book, of the location, circumstances of, and the reasons for the discharge or l

32、oss, details of the items discharged or lost, and the reasonable precautions taken to prevent or minimize such discharge or accidental loss. (4) 主管機(jī)關(guān)可以對(duì)下述船舶免除垃圾記錄簿要求the administration may waive the requirements for garbage record books for: (i) 核準(zhǔn)載運(yùn) 15 名或以上人員，航行持續(xù)時(shí)間為1h 或以下的船舶；或any ship engaged on vo

33、yages of one (1) hour or less in duration which is certified to carry 15 persons or more; or (ii) 從事海床勘探與開(kāi)發(fā)的固定或浮動(dòng)的平臺(tái)。fixed or floating platforms while engaged in exploration and exploitation of the sea-bed. (5) 本公約締約國(guó)政府的主管機(jī)關(guān)，可檢查停靠其港口或近海裝卸站的適用本規(guī)定的任何船舶的垃圾記錄簿或船舶的正式航海日志，并可將記錄簿或日志中的任何記錄制成副本并要求船長(zhǎng)證明該副本是該項(xiàng)記

35、on applies while the ship is in its ports or offshore terminals and may make a copy of any entry in those books, and may require the master of the ship to certify that the copy is a true copy of such an entry. any copy so made , which has been certified by the master of the ship as a true copy of an

36、 entry in the ship s garbage record bookor ships official log-book, shall be admissible in any judicial proceedings as evidence of the facts stated in the entry. the inspection of a garbage record book or ships official log-bookand the taking of a certified copy by the competent authority under this

37、 paragraph shall be 11 / 30 performed as expeditiously as possible without causing the ship to be unduly delayed. 39、污染chapter iii prevention of pollution from garbage 1. 為了確保經(jīng)濟(jì)效益和環(huán)境保護(hù)，船舶垃圾管理人員應(yīng)合理調(diào)節(jié)以下工作to achieve cost-effective and environmentally sound results, many garbage management planners use a combination of three complementary techniques to manage garbage: 1.1 減少垃圾產(chǎn)生的來(lái)源reduction at source 1.2 垃圾再利用或再循環(huán)reus
