1、國(guó)際貨物運(yùn)輸代理協(xié)議(中英文)AGENCY AGREEMENT OF CARGO TRANSPORTATIONContract date:簽約日期：甲方（托運(yùn)方）：乙方（承運(yùn)方）：Party A (consignor)Party B (consignee for transport)( 雙方信息略 )根據(jù)中華人民共和國(guó)合同法及相關(guān)道路運(yùn)輸?shù)姆煞ㄒ?guī)規(guī)定，甲乙雙方遵循合法、公平、平等、協(xié)商一致、誠(chéng)實(shí)信用原則簽訂本合同，共同遵守。兩方就有關(guān)代理貨物運(yùn)輸及責(zé)任、權(quán)利事宜達(dá)成以下協(xié)議：Parties hereto, in accordance to CONTRACT LAW OF PEOPLE S R

3、ch party.一、代理范圍：SCOPE OF AGENCY1. 乙方作為國(guó)際貨物運(yùn)輸代理，接受甲方委托承辦下列國(guó)際運(yùn)輸事宜：Party B, as being the agency of international cargo transportation, accept party A sconsignation of international cargo transportation as follow.二、甲方責(zé)任：Party A s duty and responsibility1. 甲方應(yīng)當(dāng)對(duì)所提供委托單、報(bào)關(guān)單、許可證、合同、商檢證明、核銷文件、發(fā)票、裝箱單、提單等有關(guān)文件、

4、單證之真實(shí)性、合法性、完備性負(fù)責(zé)。Party A should be responsible for authenticity, validity and integrality of his offered entrust form, customs declaration,licence, contract, certificate of commodity inspection, file of cancel after verification, invoice, packing list and bill of lading as like.2. 甲方按本協(xié)議結(jié)算條款之運(yùn)、雜費(fèi)費(fèi)率規(guī)

5、定償付運(yùn)費(fèi)及其他相應(yīng)費(fèi)用，對(duì)于運(yùn)費(fèi)到付貨物的運(yùn)費(fèi)，甲方作為第二償付人，在收貨方任何原因拒付運(yùn)費(fèi)情形下履行運(yùn)費(fèi)償付的責(zé)任。Party A should, in accordence to the regulation of transportation fee and other expense rate in settlement clause hereof, make payment of transportation fee and other fee, and as joint payer, in any circumstances when and if consignee refus

6、e to pay transportation fee, fulfil the performance of the same.三、乙方責(zé)任：Party Bs duty and responsibility1. 乙方應(yīng)嚴(yán)格遵照國(guó)際運(yùn)輸操作流程執(zhí)行。Party B should implement strictly conform to the procedure of international transportation.2. 乙方應(yīng)盡力保證甲方委托之運(yùn)輸在規(guī)定時(shí)間內(nèi)完成。Party B should do his endeavor to fulfill the transportatio

7、n consigned by party A within period.3. 乙方保證所從事相關(guān)活動(dòng)不超出本協(xié)議規(guī)定之代理范圍，并保證自覺維護(hù)客戶之利益，不得以任何不正當(dāng)之理由損害甲方利益。Party B promise that its undertaken activities shall not excess its agent scope stipulated herein and guarantee to make conscious efforts to safeguard client sinterests, don t hurt party A s interests wit

8、hout improper cause.4. 乙方應(yīng)對(duì)已經(jīng)簽收的貨物負(fù)責(zé)，直至移交給其承運(yùn)人或甲方及其代表。Party B should be responsible for the goods and cargo being signed for its receiptuntill the same is transferred to carrier or party A or party As representative.5. 乙方有責(zé)任向甲方提供運(yùn)輸咨詢，并幫助甲方設(shè)計(jì)最安全、快捷、經(jīng)濟(jì)之運(yùn)輸線路和方案。對(duì)于已運(yùn)輸貨物，乙方應(yīng)按甲方要求有責(zé)任就貨物狀況作出報(bào)告。Party B has

9、responsibility of provide party A with transportation consultatiion and asist to plan most safe, fast and economical transit and schedule. For delivered transit goods party B shall be under the obligation to effect the report on status of goods by the requirement of party A.6. 除不可抗力之外，乙方應(yīng)對(duì)因乙方過失、故意等原

12、ation of loading2、到達(dá)最終目的地時(shí)間：the time of reaching destination七、結(jié)算 Settlement of payment1. 出口貨物裝船、裝機(jī)完畢，乙方簽發(fā)提單 /運(yùn)單并開到運(yùn)雜費(fèi)清單及發(fā)票。甲方收到運(yùn)雜費(fèi)發(fā)票及清單后，應(yīng)在 _ 工作日內(nèi)付清運(yùn)雜費(fèi)，并換回提單 /運(yùn)單。Party B shall, upon finishing of shipment or loading on airplane of exported goods, issue the bill of lading / waybill and make out the bi

13、ll of carriage / incidental expense and invoice to party A which should, upon receipt of the same, effect the payment of carriage / incidental expense and exchange back the bill of loading / waybillwithindays.2. 進(jìn)口貨物甲方需在乙方倉庫提貨或乙方送貨時(shí)（前）償付運(yùn)雜費(fèi)或簽訂付款協(xié)議書。Party A should, prior picking up the imported goods

14、 in party B s warehouse ordelivering by party B, effect the payment of carriage / incidental expense or sign the payment agreement.3. 對(duì)乙方開出的運(yùn)雜費(fèi)帳單甲方若有異議，則應(yīng)在收到運(yùn)雜費(fèi)帳單_ 工作日內(nèi)向乙方提出，并與協(xié)助乙方的對(duì)帳工作。Should party A have contestation or protest to the bill of carriage / incedental expense issued by party B, shall

15、submit the problem concerned within days formreceipt of the same and asist party B s balance of account.4. 如果甲方收到乙方開具的雜費(fèi)帳單且無異議，但未能在_ 工作日完成運(yùn)雜費(fèi)償付或未能在付款協(xié)議指定期限內(nèi)完成運(yùn)雜費(fèi)償付，則乙方將就未嘗付運(yùn)雜費(fèi)向甲方收取 _ 滯納金。Should party A, upon receipt of the bill of carriage / incedental expense and have no dissent to the same, fail t
