33、plemented according to the timetable issued by the company. 公司對(duì)某些特定崗位實(shí)行不定時(shí)工作制,經(jīng)勞動(dòng)部門(mén)批準(zhǔn)且受限于中華人民共和國(guó)適用法律法規(guī)的規(guī)定,該等員工的工作時(shí)間安排可不同于上述標(biāo)準(zhǔn)工作時(shí)間。The company will implement flexible working hour system on certain special positions, as approved by the labor department and the applicable law and regulation of the Peo
34、ples Republic of China, the working hours arrangement of such employees may differ from the foresaid standard working hours. 4.3 合同期及試用期 Contract period and probation period員工在上班的第一天辦妥一切報(bào)到手續(xù)后,由人力資源部門(mén)代表公司與其簽訂勞動(dòng)合同。除非法律另有規(guī)定,所有的合同均為固定期限合同。合同期限一般為 3 年,也可以由公司和員工自行約定其他期限。After employees settle all the repo
35、rt-to-duty procedures on the first day of working, the human resource department will sign labor contract with them on behalf of the company. Unless otherwise regulated by law, all the contracts shall be fixed-term contracts. The period of contract is normally 3 years, or other periods agreed betwee
36、n the company and the employees. 勞動(dòng)合同到期時(shí),經(jīng)公司和員工協(xié)商一致,可續(xù)簽合同。When labor contracts expires, it may be renewed after the company and employees reach an agreement through negotiation. 任何首次受雇于公司的員工都應(yīng)在其勞動(dòng)合同期限開(kāi)始之日起的不超過(guò) 3 個(gè)月期間為試用期(直接工人試用期可為 2 個(gè)月) 。試用期結(jié)束后,除非公司認(rèn)為員工不符合錄用條件,員工將繼續(xù)為公司工作。Any employee employed by the
37、 company shall have a probation period no more than 3 months after the beginning date of his/her labor contract.(Direct labor probation period can be 2 months), After the probation period expires, unless the company believes that the employee doesnt meet the recruitment condition, the employee will
38、continue to work for the company. 公司在試用期內(nèi)或結(jié)束之時(shí)可對(duì)員工的工作表現(xiàn)進(jìn)行評(píng)估。員工不符合錄用條件的情況包括但不限于:During or after the probation period, the company may evaluate the work performance of employees. The circumstances that employees dont meet recruitment conditions include but not limited to: 9員工提供或要求第三方為其提供虛假的個(gè)人信息或文件或與雇傭
39、有關(guān)其他信息或文件。Employees provide or require any third party to provide false personal information or document or other information or document relating to employment. 員工未能通過(guò)公司所指定的醫(yī)院的健康體檢。Employees fail to pass the health examination at the hospital designated by the company. 員工對(duì)其前雇主負(fù)有未了結(jié)的債務(wù),且公司認(rèn)為該等債務(wù)可能會(huì)對(duì)
40、員工在公司的工作帶來(lái)不利的影響。Employees have unsettled debt with former employer, and the company believes that such debt will bring negative influence to the employees work in the company. 員工對(duì)其前雇主負(fù)有競(jìng)業(yè)限制義務(wù)。Employees have competitive restriction obligation to their former employers. 員工不能勝任公司的工作任務(wù)。Employees are not
41、 capable of work tasks in the company. 員工未能通過(guò)公司的工作表現(xiàn)評(píng)估。Employees fail to pass the work performance assessment in the company. 員工的身體條件不符合其工作崗位的崗位要求(例如特殊崗位的要求) 。Employees physical conditions dont meet the position requirements of their work positions (such as requirements for special positions). 4.4 培
42、訓(xùn)、升職和調(diào)動(dòng) Training, promotion and transfer根據(jù)員工的能力和工作表現(xiàn),公司將自行決定向適合的員工提供平等的培訓(xùn)及升職機(jī)會(huì)。公司有權(quán)要求接受公司出資的專(zhuān)項(xiàng)或?qū)I(yè)技術(shù)培訓(xùn)的員工與公司簽訂一份服務(wù)期協(xié)議。Based on the ability and work performance of employees, the company will decide at its discretion to provide proper employees with the equal training and promoting opportunities. The
43、company will be entitled to signing a service period agreement with the employees accepting the specific or professional training paid by the company. 根據(jù)業(yè)務(wù)需要,公司可將員工調(diào)往 XX 的其他崗位或其他關(guān)聯(lián)公司工作。Based on business demand, the company may transfer employees to other positions or other affiliated companies of Li
44、ghtning. 如果員工希望調(diào)動(dòng)工作,應(yīng)向其直接主管提出書(shū)面申請(qǐng),直接主管將協(xié)同人力資源部共同考慮員工的申請(qǐng)。如果公司認(rèn)為員工所申請(qǐng)的調(diào)動(dòng)不具有可行性,則該等申請(qǐng)將不會(huì)被批準(zhǔn),其直接主管或人力資源部應(yīng)盡量在合理的時(shí)間內(nèi)將此結(jié)果告知員工。If employees wish to transfer work, they shall submit written application to their direct director, who will assist the human resource department in considering the employees applic
45、ations. If the company believes that the transfer applied by employees are is not feasible, then such applications wont be approved, their direct directors or human resource department shall inform such employees about the result in reasonably short period. 4.5 勞動(dòng)關(guān)系的終止和解除 Termination and cancellatio
46、n of labor relation104.5.1有下列情形之一的,在中國(guó)法律允許的情況下,公司可立即單方解除勞動(dòng)合同:For any of the following circumstances, the company may unilaterally cancel the labor contract allowed by Chinese law: 員工在試用期內(nèi)被證明不符合錄用條件(包括但不限于本手冊(cè)第 4.3 部分所列的條件) ;Employees are proven to be not meeting the recruitment conditions during prob
47、ation period (including but not limited to the conditions listed in article 4.3 of this manual); 員工嚴(yán)重違反了公司的規(guī)章制度(包括但不限于本手冊(cè)) 。該等行為的實(shí)例如下所列,但下述實(shí)例并非意在窮盡所有的可能:Employees have seriously violated the companys regulations and systems (including but not limited to this manual). Such behaviors have examples are
48、 listed as followed, but which examples are not exhausting all the possibilities: 偷竊公司或其他員工的產(chǎn)品、財(cái)物(如金錢(qián)、產(chǎn)品、原材料、工具等) ;Steel product, property (such as money, product, raw material, tool, etc) of the company or other employees; 欺詐行為,包括但不限于:Fraudulent conduct, including but not limited to: 欺騙公司和/或同事,偽造文件
49、或記錄(如申請(qǐng)病假的醫(yī)院證明,身份證、學(xué)歷及專(zhuān)業(yè)資格證明及其他個(gè)人信息) ;Cheat on the company and/or colleagues by forging documents or records (such as hospital certificate for applying sick leave, ID certificate, diploma, professional qualification certificate and other individual information); 貪污公司財(cái)物(如利用假發(fā)票) ;Embezzling of company
50、 property (such as using fake invoice); 偽造數(shù)據(jù)、報(bào)表或材料(如假銷(xiāo)售紀(jì)錄、假簽名等) ;或Forge data, statement or material (such as false sales record, false signature); or 未經(jīng)允許私取公司財(cái)產(chǎn)、禮品及禮券等。Take company property, gift or gift certificate without permission. 在非吸煙區(qū)吸煙,可能或已經(jīng)導(dǎo)致危險(xiǎn)后果或污染產(chǎn)品/材料;Smoke in non-smoking area, which may
51、 or already cause dangerous consequence or contaminate products/materials; 故意破壞公司或其他員工財(cái)產(chǎn);Purposefully damage the properties of the company or other employees; 在公司內(nèi)外無(wú)理取鬧、聚眾鬧事、打架斗毆,影響辦公室秩序、工作秩序和社會(huì)秩序;Make trouble out of nothing, gather a crowd and make disturbances, have group fighting, affect office o
