1、.:.;會(huì)展場地租賃合同Exhibition Place Lease Contract合同編號(hào): Contract Number: 出租方甲方: Lessor (Party A): 承租方乙方 Lessee (Party B): 根據(jù)及其他法律法規(guī)的規(guī)定,甲乙雙方在自愿、平等、公平、老實(shí)信譽(yù)的根底上,就會(huì)展場地租賃的有關(guān)事宜達(dá)成如下協(xié)議。 In accordance with “Contract Law of the Peoples Republic of China and other relevant laws and regulations, the Parties have, base

2、d on the principles of equality, willingness, fairness, honest and credit, entered into the Contract concerning issues related to lease of exhibition place and agreed as follows: 第一條 租賃場地及用途 Article 1 Lease Place and Purpose 1詳細(xì)位置: 1. Location: 2用途:用于乙方舉行 活動(dòng)。 2. Purpose: to hold the event of by Part

3、y B. 第二條 租賃期限 Article 2 Term of Lease 1租賃期限為: 年 月 日至 年 月 日; 1. The term of lease shall start from and end on ; 第三條 運(yùn)用時(shí)限 Article 3 Time of Use 1乙方運(yùn)用租賃區(qū)域的時(shí)限為 時(shí)至 時(shí)。在租賃期限內(nèi),乙方應(yīng)在商定的時(shí)限內(nèi)運(yùn)用租賃區(qū)域;如乙方需在商定時(shí)限之外運(yùn)用租賃區(qū)域的,應(yīng)提早征得甲方贊同并向甲方支付超時(shí)運(yùn)用費(fèi),超時(shí)費(fèi)用按照 方式計(jì)算。1. 4、n the term of lease, Party B shall use the lease area within the stipulated time, and shall obtain Party As approval in prior and pay overtime use fee to Party A in case Party B uses the lease area beyond the stipulated time. 第四條 租金支付 Article 4 Rental Payment 1租金的計(jì)算按照以下規(guī)范計(jì)算: 1. 6、before.4 余款支付: 4 Payment of spare money: 5 支付方式: 5 Payment method: 第五條 甲方提供的根本效力 Article 5 Basic Services Provided by Party A 1在租賃期限內(nèi)甲方向乙方提供以下根本效力: 1. Party A will provide Party B with the following basic services within the term of lease: 1租賃區(qū)域和公共區(qū)域的原建筑照明。 (1) Lighting of the original buildings in

7、the lease area and public area; 215-20名效力人員。 (2) 15-20 waiter;3音響系統(tǒng)及燈光系統(tǒng) (3) Acoustic system and Lighting system;4其他:提供DJ一名 (4) Other stipulations: Supply a DJ for Lessee;2如乙方需甲方提供根本效力之外的其他效力,雙方應(yīng)另行達(dá)成補(bǔ)充協(xié)議。補(bǔ)充:如甲乙雙方未達(dá)成補(bǔ)充協(xié)議的,在本協(xié)議其他條款商定的效力條款最終不得超出本協(xié)議第五條之范圍,否那么視為商定無效。2. A supplement agreement shall be ent

8、ered into between the Parties in case Party B needs other services provided by Party A in addition to basic services. 第六條 設(shè)備的運(yùn)用 Article 6 Use of Facilities 1甲方應(yīng)在簽約前向乙方照實(shí)闡明與租賃區(qū)域有關(guān)的場地情況,并向乙方提供場地設(shè)備技術(shù)數(shù)據(jù)等書面資料。乙方應(yīng)向甲方照實(shí)闡明會(huì)展情況,并根據(jù)甲方提供的數(shù)據(jù)資料判別場地能否滿足會(huì)展需求。 修正后:1.簽約前,乙方曾經(jīng)進(jìn)展充分了解甲方出租場地的有關(guān)情況,知悉甲方提供場地的相關(guān)數(shù)據(jù)資料,并確認(rèn)甲方的場

9、地可以滿足乙方會(huì)展需求。1. Party A shall provide true information regarding situation of the lease area to Party B before signing the Contract, together with written materials including on-site facilities and technical data. Party B shall provide true information of the exhibition to Party A, and to judge if th

10、e place could meet the exhibition requirements in accordance with the data materials provided by Party A. 甲方未照實(shí)提供場地、設(shè)備的有關(guān)情況而呵斥乙方辦展活動(dòng)無法順利進(jìn)展的,應(yīng)賠償由此給乙方呵斥的損失;乙方未照實(shí)闡明展品情況,呵斥場地設(shè)備無法滿足展品需求的,乙方自行承當(dāng)損失,呵斥甲方場地設(shè)備損壞的,應(yīng)承當(dāng)賠償責(zé)任。 In case Party A fails to provide true information of the place and facilities, which cau

11、ses Party B a failure in the exhibition, Party A shall compensate Party B for any loss incurred; Party B shall bear the loss if Party B fails to state clearly the situation of exhibits so that the site facilities could not meet the needs, and shall undertake the liability of compensation in case of

12、damage to Party As facilities. 2甲方協(xié)助乙方進(jìn)展展臺(tái)搭建、安裝、裝配、搬遷及善后等任務(wù)。乙方進(jìn)展上述活動(dòng)時(shí)不應(yīng)妨礙甲方場地內(nèi)的其他展覽和活動(dòng)。補(bǔ)充:乙方進(jìn)展展臺(tái)搭建、安裝、裝配、搬遷及善后等任務(wù)相關(guān)費(fèi)用不包含在乙方支付給甲方的的租金內(nèi),乙方進(jìn)展展臺(tái)搭建、安裝、裝配、搬遷及善后等任務(wù)產(chǎn)生費(fèi)用由乙方自行承當(dāng)。2. Party A abidance Party B shall take charge of building, installation, dismantling, removing of the booth and after- treatment at

13、 its own cost, which shall not interfere with other exhibitions and activities inside Party As place. 3在租賃期限內(nèi),雙方應(yīng)共同堅(jiān)持租賃區(qū)域和公共區(qū)域的清潔和暢通。 3. Within the term of lease, the Parties shall together keep the lease area and public area clean and unobstructed. 4如無甲方書面特別答應(yīng),以下物品制止進(jìn)入甲方場館: 4. The following article

14、s shall not enter into Party As place without Party As special permission in writing: 1危險(xiǎn)物,包括但不限于武器、槍支、刀、劍、彈藥、炸藥易燃物、放射物或其他危險(xiǎn)物品。 (1) Dangerous articles including but not limited to any weapon, gun, knife, sword, cartridge, explosive flammable articles, radioactive articles or other dangerous articles

15、. 2未經(jīng)海關(guān)贊同的進(jìn)口物品。 (2) Imported goods without the Customs permission. 3任何影響甲方正常運(yùn)作或被有關(guān)部門制止的物品。 (3) Any article affecting normal operation of Party A or forbidden by relevant authorities. 第七條 甲方權(quán)益義務(wù) Article 7 Rights and Obligations of Party A 1甲方有權(quán)監(jiān)視乙方在租賃期限內(nèi)遵守本合同商定及甲方的有關(guān)規(guī)章制度,并對乙方違反 有關(guān)商定的行為予以制止。補(bǔ)充:由于乙方違反甲

16、方管理制度導(dǎo)致會(huì)展活動(dòng)無法進(jìn)展的,相關(guān)責(zé)任由乙方自行承當(dāng),給甲方呵斥損失的,甲方保管清查乙方責(zé)任的權(quán)益。 1. Party A shall be entitled to monitor Party Bs act to conform to stipulations contained herein and relevant rules and regulations of Party A within the term of lease, and prohibit any Party Bs act against relevant stipulations. 2甲方應(yīng)按商定為乙方提供場地及相關(guān)

17、配套設(shè)備和運(yùn)營條件,保證乙方正常的會(huì)展活動(dòng)。 2. Party A shall provide the place and relevant supporting facilities and operation conditions as stipulated to ensure the normal operation of exhibition by Party B. 3除有明確商定外,甲方不得不干涉乙方正常的會(huì)展活動(dòng)。 3. Except as otherwise clearly stipulated, Party A shall not interfere with Party Bs

18、 normal exhibition activities. 4甲方應(yīng)對市場進(jìn)展物業(yè)管理,并擔(dān)任場內(nèi)的平安防備和運(yùn)營設(shè)備的建立及維護(hù)、包括:建筑物包括公共區(qū)域及租賃場地的管理及維修保養(yǎng);對乙方裝修的審查和監(jiān)視;水、電、 氣、空調(diào)、電梯、扶梯等設(shè)備、管道、線路、設(shè)備及系統(tǒng)的管理、維修及保養(yǎng);清潔管理;保安管理并擔(dān)任市場的公共平安;消防管理;內(nèi)外各種通道、道路、停車場的管理。 4. Party A shall conduct property management to the market, and take charge of security inside the place and con

19、struction and maintenance of operation facilities, including management, repair and maintenance of buildings (including those in public area and lease area), inspecting and monitoring Party Bs decoration, management, repair and maintenance of equipment, pipelines, lines, facilities and system such a

20、s water, power, gas, air conditioning, escalators, and etc., cleaning management, security management and public security of the market, fire protection management, and management of all passageways, roads and parking lots inside and outside. 第八條 乙方權(quán)益義務(wù) Article 8 Rights and Obligations of Party B 1乙

21、方應(yīng)按照商定用途運(yùn)用甲方場地,自覺遵守甲方依法制定的各項(xiàng)規(guī)章制度,服從甲方的監(jiān)視。 1. Party B shall use Party Bs place for the purpose as stipulated, and shall observe Party As rules and regulations established in accordance with laws and accept Party As supervision. 2乙方應(yīng)按合同商定及時(shí)支付甲方租金。 2. Party B shall pay the rental to Party A in time as

22、stipulated herein. 3. 乙方有責(zé)任維護(hù)租賃區(qū)域和公共區(qū)域的整潔。租賃期限屆滿,乙方應(yīng)按時(shí)建議修正為:應(yīng)在 小時(shí)內(nèi)把本人及參展商的一切物品展臺(tái)、展架、遺棄物以及渣滓移出租賃區(qū)域。有關(guān)物品未能按時(shí)移出的,甲方將視為遺棄物進(jìn)展處置。乙方也可以委托甲方對上述物品進(jìn)展清理,所需費(fèi)用由乙方承當(dāng)。3. Party B shall have the liability to maintain the lease area and public area in a clean status. Upon expiration of the term of lease, Party B shal

23、l remove all its or the participating exhibitors articles for exhibition (booth, display, derelicts and garbage) out of the lease area. Any article that has not been removed out in time shall be treated as derelicts. Party B may also entrust Party A to treat the above articles at Party Bs cost. 4乙方應(yīng)

24、合理運(yùn)用場內(nèi)的各項(xiàng)設(shè)備,如需安裝設(shè)備、擺放展品、設(shè)置宣傳廣告等,應(yīng)先征得甲方贊同,呵斥損壞的應(yīng)承當(dāng)修復(fù)或賠償責(zé)任。 4. Party B shall use facilities inside the area in a reasonable way, and shall obtain Party As prior permission in case of need for equipment installation, exhibits display and publicizing advertisement setup, and shall undertake the liabilit

25、y for repair or compensation to any damage. 5乙方保證本人和本人的客戶不會(huì)對甲方或甲方場所進(jìn)展的其他展覽會(huì)有任何攻擊、損害或干擾的不正當(dāng)競爭行為。 5. Party B shall pledge that it or its customers will not have any unfair competition acts such as attack, damage or interference against Party A or other exhibitions at Party As place. 6乙方擔(dān)任對本人財(cái)富進(jìn)展妥善保管,并

26、保證其展品或其他物品,將不占用或堆放在非租賃區(qū)域包括室外場地;否那么甲方有權(quán)予以處置,所需費(fèi)用由乙方承當(dāng)。 6. Party B shall properly keep its own properties, and ensure its exhibits or other articles would not occupy or pile up at the non-lease area (including outdoor field); otherwise Party A shall be entitled to handle such exhibits and articles at

27、Party Bs cost. 7乙方如為宣傳會(huì)展活動(dòng)而需運(yùn)用甲方稱號(hào)、商標(biāo)和標(biāo)識(shí),應(yīng)事先獲得甲方書面贊同,否那么乙方應(yīng)承當(dāng)由此產(chǎn)生的法律責(zé)任。 13. Party B shall obtain Party As prior approval in case of needs of using Party As name, trademark and logo for publicizing the exhibition; otherwise Party B shall undertake the legal liabilities incurred hereby. 8. 乙方會(huì)展活動(dòng)及展現(xiàn)物品

28、應(yīng)在國家法律法規(guī)規(guī)定范圍內(nèi)進(jìn)展,如會(huì)展中有違法活動(dòng)或者乙方展覽之物品能夠進(jìn)犯第三人的權(quán)益包括但不限于人身權(quán)、財(cái)富權(quán)等,甲方有權(quán)立刻終止本協(xié)議,呵斥甲方損失的,甲方有權(quán)清查乙方的責(zé)任。9. 補(bǔ)充:會(huì)展期間,如因乙方或乙方緣由導(dǎo)致第三人呵斥甲方的損失,乙方對甲方應(yīng)承當(dāng)全部賠償責(zé)任。第九條 違約責(zé)任 Article 9 Default Liabilities 1甲方未按商定提供場地或用水、用電等市場內(nèi)的運(yùn)營設(shè)備或條件致使乙方不能正常運(yùn)營 的,應(yīng)減收相應(yīng)租金,乙方有權(quán)要求甲方繼續(xù)履行合同或解除合同,并要求甲方賠償相應(yīng)的損失。 1. In case Party A fails to provide th

29、e place or water, power and other operation facilities or conditions in the market, which causes Party B a failure in normal operation, Party A shall reduce the amount of rental, and Party B shall be entitled to request Party A to continue to perform the Contract or terminate the Contract, and to co

30、mpensate for relevant loss. 2乙方未按照商定支付租金及其他費(fèi)用的,應(yīng)每日向甲方支付遲延金額的 %的違約金。 2. In case Party B fails to pay the rental and other expenses as stipulated, it shall pay Party A the liquidated damages as per % of the amount not duly paid for each day overdue. 3. 補(bǔ)充:如乙方擅自中止或解除合同,甲方曾經(jīng)收取的費(fèi)用不需向乙方退還,甲方有權(quán)追收乙方尚未支付的費(fèi)用。

31、第十條 爭議處理 Article 10 Settlement of Disputes 本合同項(xiàng)下發(fā)生的爭議,由雙方當(dāng)事人協(xié)商處理,或向有關(guān)部門懇求調(diào)解處理;協(xié)商或調(diào)解處理不成的,按以下第 種方式處理。 Any dispute arising from or in connection with the Contract shall be settled by the Parties through consultation, or may be submitted to relevant department for mediation; failing the same, of the fo

32、llowing ways shall be adopted. 一依法向人民法院起訴; 1. File a lawsuit to Peoples Court in accordance with laws; 二提交仲裁委員會(huì)仲裁。 2. Submit the dispute to Arbitration Committee for arbitration. 第十一條 不可抗力 Article 11 Force Majeure 因發(fā)生自然災(zāi)禍、艱苦疫情等不可抗力或突發(fā)事件的,經(jīng)核實(shí)可全部或部分免除責(zé)任,但應(yīng)及時(shí)通知對方,并在合理期限內(nèi)提供有效證明。 In case of any force majeure or emergency such as natural disasters and key epidemic situations, liabilities may, upon ver
