CertificationServices(Shanghai)Co.,Ltd.andAENORINTERNACIONAL,S.A.U,hereafterAENOR,withCIFnumber:A-83076687forthecertificationinaccordancewithStandardIATF16949:2016oftheorganizationCLIENT_NAME02ECONOMICCONDITIONS商務(wù)條款根據(jù)CLIENT_NAME公司提供的數(shù)據(jù)形成的報(bào)價(jià)如下ThisbudgetwasbasedonthedataprovidedbyCLIENT_NAMEshowninthisoffer:項(xiàng)目Item費(fèi)用Fees(人民幣RMB)審核時(shí)間AuditTime現(xiàn)場(chǎng)審核人天Mandayson-site初審認(rèn)證費(fèi)總計(jì)（大寫(xiě)）Totalfeeforinitialaudit第一年監(jiān)督審核費(fèi)用總計(jì)（大寫(xiě)）Totalsurveillanceauditfeesforthefirstyear第二年監(jiān)督審核費(fèi)用總計(jì)（大寫(xiě)）Totalsurveillanceauditexpensesinthesecondyear再認(rèn)證認(rèn)證費(fèi)總計(jì)（大寫(xiě)）Totalrecertificationfee//審核組成員差旅費(fèi)Travelexpenseofauditteammembers實(shí)報(bào)實(shí)銷(xiāo)Atcost包含增值稅及其他稅款VATorsimilartaxesareincluded.美元價(jià)格僅做為對(duì)照參考。USDpricesarejustforinformativepurposes.CLIENT_NAME公司將安排審核組的差旅、食宿并支付相關(guān)費(fèi)用。CLIENT_NAMEwillorganizeandpayforthetravelling,lodgingandsustenanceexpensesoftheauditteam.審核時(shí)間組成如下Audittimeiscomposedof:現(xiàn)場(chǎng)審核時(shí)間（包括在客戶處完成審核報(bào)告的時(shí)間）Totalon-siteaudittime,includingauditreporting,attheclient’sfacilities.非現(xiàn)場(chǎng)審核策劃和文件評(píng)審時(shí)間Off-sitetimeforplanninganddocumentreviewatAENORfacilities.審核時(shí)長(zhǎng)為估計(jì)值，并且取決于先前對(duì)認(rèn)證體系分析的結(jié)果。初次審核和監(jiān)督審核的審核時(shí)間會(huì)由于CLIENT_NAME公司提供的信息變更而產(chǎn)生變動(dòng)。客戶可向AENOR核實(shí)審核時(shí)長(zhǎng)決定流程。Auditdurationisanestimateandissubjecttotheresultoftheprioranalysisofthesystemtobecertified.BoththebudgetoftheinitialprocessandoflatersurveillancemaybemodifiedifthedataprovidedbyCLIENT_NAMEandwhichwasusedasthebasisfortheircalculationweretochange.AENORisatyourdisposalforanyclarificationabouttheprocesstodetermineaudittimeforthisoffer.如果認(rèn)證機(jī)構(gòu)規(guī)則變化，AENOR保留修改此報(bào)價(jià)的權(quán)利。AENORreservestherighttomodifythisbudgetintheeventofchangestothecriteriaoftheaccreditationentity.AENOR保留每年因消費(fèi)物價(jià)指數(shù)變動(dòng)而調(diào)整價(jià)格的權(quán)利，調(diào)整幅度以年度消費(fèi)物價(jià)指數(shù)為限，并將事先跟組織進(jìn)行溝通。AENORreservestherighttoupdatetheamountscorrespondingtosurveillanceseachyear,bynomorethantheannualCPI.Thiswillbecommunicatedtotheorganizationinadvance.此報(bào)價(jià)不包含特殊審核或檢驗(yàn)費(fèi)用，此部分費(fèi)用另計(jì)。若授予和維持認(rèn)證前需核實(shí)不符合項(xiàng)關(guān)閉情況，此部分費(fèi)用依AENOR相關(guān)計(jì)費(fèi)規(guī)定另行計(jì)算。Thisbudgetdoesnotincludethecostofextraordinaryaudits,whichhaveaseparatebudget,ifrequiredtoverifytheclosureofthenon-conformitiesdetected,priortotheawardingandmaintenanceofthecertification,orthosecoststhatcouldariseextraordinarilyasaconsequenceoftheprocedureestablishedbyAENOR.03交易和付款方式INVOICINGANDMETHODOFPAYMENT3.1初審費(fèi)用付款方式Paymentmethodofpreliminaryexaminationfee:初審費(fèi)用：該費(fèi)用應(yīng)于合同簽訂一周內(nèi)支付合同金額50%，其余款項(xiàng)應(yīng)于現(xiàn)場(chǎng)審核結(jié)束一周內(nèi)付清。由于現(xiàn)場(chǎng)審核未通過(guò)而導(dǎo)致產(chǎn)生的額外審核費(fèi)用由甲方承擔(dān)，且在乙方下次實(shí)施現(xiàn)場(chǎng)審核前一周內(nèi)一次性支付。Initialauditfee:50%ofthecontractamountshallbepaidwithinoneweekafterthesigningofthecontract,andtheremainingamountshallbepaidwithinoneweekafterthecompletionofon-siteaudit.PartyAshallbeartheadditionalauditcostscausedbyfailureofon-siteauditandshallpaytheminalumpsumwithinoneweekbeforethenexton-siteauditbyPartyB.3.2監(jiān)督/再認(rèn)證費(fèi)用付款方式Paymentmethodofsurveillance/recertificationfee:監(jiān)督/再認(rèn)證費(fèi)用：甲方應(yīng)在監(jiān)督/再認(rèn)證審核前向乙方支付監(jiān)督/再認(rèn)證費(fèi)用，乙方按本合同監(jiān)督/再認(rèn)證總費(fèi)用金額發(fā)出付費(fèi)通知單，甲方應(yīng)在收到付費(fèi)通知單后5個(gè)工作日內(nèi)付款。由于現(xiàn)場(chǎng)審核未通過(guò)而導(dǎo)致產(chǎn)生的額外審核費(fèi)用由甲方承擔(dān)，且在乙方下次實(shí)施現(xiàn)場(chǎng)審核前一周內(nèi)一次性支付。Surveillance/recertificationfee:PartyAshallpaythesupervision/recertificationfeetoPartyBbeforethesurveillance/recertificationaudit.PartyBshallissueapaymentnoticeaccordingtothetotalamountofsurveillance/recertificationfee,andPartyAshallmakethepaymentwithin5workingdaysuponreceiptofthepaymentnotice.PartyAshallbeartheadditionalauditcostscausedbyfailureofon-siteauditandshallpaytheminalumpsumwithinoneweekbeforethenexton-siteauditbyPartyB.3.3如果在甲方獲證之后，管理體系發(fā)生變更（包括但不限于企業(yè)名稱、地址、規(guī)模、管理體系覆蓋的范圍或人數(shù)的擴(kuò)大和縮小等），實(shí)際費(fèi)用會(huì)適當(dāng)增減，具體金額按實(shí)際狀況重新核算。IfPartyAchangesthemanagementsystemafterobtainingthecertificate(includingbutnotlimitedtotheenterprisename,address,scale,scopecoveredbythemanagementsystemortheexpansionorreductionofthenumberofemployees,etc.),theactualexpenseswillbeappropriatelyincreasedordecreased,andthespecificamountwillberecalculatedaccordingtotheactualsituation.04標(biāo)準(zhǔn)的認(rèn)證數(shù)據(jù)以符合IATF16949：2016CERTIFICATIONDATAINACCORDANCETOIATF16949：2016AENORisaccreditedforthiscertification,andallmembersoftheteamperformingtheauditwillbequalifiedasauditorsbyAENORinaccordancewithitsinternalproceduresandinternationalreferencestandards,withprovenexperienceforthepurposesoftheworkcoveredbythisoffer.AENOR已獲此認(rèn)證的認(rèn)可。此外，實(shí)施本次審核的審核組的所有成員都是由AENOR根據(jù)其內(nèi)部程序和國(guó)際參考標(biāo)準(zhǔn)認(rèn)定的合格審核員，并具有本職位所需的經(jīng)驗(yàn)。Scopeofthecertificate:<ALCANCE>證書(shū)范圍：認(rèn)證機(jī)構(gòu)認(rèn)證機(jī)構(gòu)SPECIALCONDITIONS特殊條款Thesignatoryundertakesto簽署人承諾:Tohaveimplementedthequalitymanagementsystem,accordingtoIATF16949,atleasttwelvemonthsbeforethedateofthisapplication,incaseoflessthan12months,aLetterofConformitymaybeobtainedbutnotCertification.根據(jù)IATF16949，在申請(qǐng)日期前質(zhì)量管理體系至少已實(shí)施12個(gè)月，如果少于12個(gè)月，可以頒發(fā)符合證明函而非證書(shū)。Iftheapplicantorganisationhasreceived"in-companytraining"inquality,environmentand/orsafetyandregulationsfromAENOR,thiscertificationwillnotbecarriedoutuntiltwoyearsafterthedateonwhichthetrainingwasgivenprovided.AENORundertakesnottoprovidein-companytraininginyourcompanywhiletheIATFcertificationisinforce,inordertoguaranteetheimpartialityofthecertificationservicesasrequiredbytheIATFRules.如果申請(qǐng)公司已經(jīng)接受過(guò)來(lái)自AENOR關(guān)于質(zhì)量、環(huán)境和/或安全與法規(guī)方面的“公司內(nèi)部培訓(xùn)”，則在培訓(xùn)之日起兩年之內(nèi)不能實(shí)施該認(rèn)證。AENOR承諾在IATF認(rèn)證有效期間不向貴司提供公司內(nèi)部培訓(xùn)，以保證IATF規(guī)則要求的認(rèn)證服務(wù)的公正性。CommunicatetoAENORanychangesrelatingto告知AENOR關(guān)于以下方面的任何變更:Legalstatus,法律地位Businessstatus(e.g.jointventure,subcontractingwithotherorganisations),商業(yè)狀況（如合資企業(yè)，分包其他組織）Ownershipstatus(e.g.mergersoracquisitions),所有權(quán)狀態(tài)（合并或收購(gòu)）Organisationandmanagement(e.g.seniormanagement,decisionmakingortechnicalmanagement),組織和管理（例如主要管理，決策或技術(shù)管理）Contactaddressorlocation,聯(lián)系地址或場(chǎng)所Scopeofactivitiescoveredbythecertifiedmanagementsystem,被認(rèn)證管理體系所覆蓋的活動(dòng)范圍,SpecialstatusofOEMcustomersIATFmembers,within10calendardays.IATFOEM顧客的特殊狀態(tài)（10個(gè)日歷日內(nèi)）Significantchangestothemanagementsystemandprocesses.管理體系和過(guò)程的重大變化TransfertoanotherIATF-recognisedcertificationbody.轉(zhuǎn)移到IATF認(rèn)可的其他認(rèn)證機(jī)構(gòu)AENORreservestherighttoplananextraordinaryaudittoverifytheimpactofthechangesannouncedinthemanagementsystem.AENOR保留策劃特殊審核的權(quán)利，以驗(yàn)證管理體系中所聲明的更改的影響。TheclientcannotrefuseanIATFsupervisedauditofthecertificationbody.客戶不得拒絕IATF對(duì)認(rèn)證機(jī)構(gòu)的監(jiān)督審核。Theclientmaynotrefusethepresenceofthecertificationbody'sinternalsupervisoryauditor.客戶不得拒絕認(rèn)證機(jī)構(gòu)內(nèi)部見(jiàn)證審核員的出席。TheclientmaynotrefusethepresenceofarepresentativeoftheIATForitsdelegates.客戶不得拒絕IATF代表或其委托人的出席。TheclientmaynotrefusethecertificationbodytosendtheauditreporttotheIATF,onrequest.如果IATF要求，客戶不得拒絕認(rèn)證機(jī)構(gòu)將審核報(bào)告發(fā)送至IATF。TheonlyuseoftheIATFlogoisasreflectedonthecertificateissuedbythecertificationbody(fullreproductionofthecertificate).AnyotheruseoftheIATFlogo,separately,isprohibited.IATF標(biāo)志只能用在認(rèn)證機(jī)構(gòu)頒發(fā)的證書(shū)上（完整復(fù)制證書(shū)）。禁止將IATF標(biāo)志用于其他用途，無(wú)論是否單獨(dú)使用。Theclient'sconsultantsmaynotbephysicallypresentonsiteduringtheaudit,norparticipateintheauditinanyotherway.在整個(gè)審核過(guò)程中，客戶的咨詢顧問(wèn)不得親臨現(xiàn)場(chǎng)，或以任何其他方式參與審核。Inthecaseofatransferaudit,theclientshallnotcancelthecontractwiththecurrentcertificationbodyuntiltheAENORcertificateisobtained.Likewise,theyshallrespecttheauditcyclesofthecurrentcertificationbodyforTransferaudits.如果是轉(zhuǎn)移審核，客戶在獲得AENOR認(rèn)證之前不得取消與當(dāng)前認(rèn)證機(jī)構(gòu)的合同。同樣，客戶應(yīng)遵循當(dāng)前認(rèn)證機(jī)構(gòu)的審核周期進(jìn)行轉(zhuǎn)移審核。Intheeventofthesignatoryannouncingitsintentiontotransferitscertificatetoanothercertificationbody,AENORundertakesnottocancelthecontractuntilthetransferactivitieswiththenewbodyarecompleted.如果簽署人宣布其有意將其證書(shū)轉(zhuǎn)換至另一個(gè)認(rèn)證機(jī)構(gòu)，AENOR承諾在與新機(jī)構(gòu)的轉(zhuǎn)移活動(dòng)完成之前不取消合同。ForStage1,SurveillanceandRecertificationaudits,youmustprovideuswiththenecessarydocumentationforthereviewandplanning,includingthefollowing:對(duì)于初審第一階段，監(jiān)督審核和再認(rèn)證審核，您必須向我們提供審查和計(jì)劃所需的文件，如下：Updateofthenumberofemployeesateachauditedsite.每個(gè)被審核場(chǎng)所的最新員工人數(shù)Documentationofthemanagementsystem,includingevidenceofcompliancewiththerequirementsofIATF16949andshowingthesequencesandinteractionswithsupportfunctionsandoutsourcedprocesses,管理體系文件，包括滿足IATF16949要求的證據(jù)，及體現(xiàn)與支持職能和外包過(guò)程的聯(lián)系與接口的證據(jù)Informationinternalperformancesincethelastaudit,自上次審核以來(lái)的內(nèi)部績(jī)效，Informationoncustomersatisfactionandsummaryofcomplaintssincethelast自上次審核以來(lái)關(guān)于客戶滿意度的信息和投訴總結(jié)Note1:AsestablishedRulesIATF,whentheclientdoesnotmeettheIATFOEMqualityand/ordeliverytargetsspecifiedintheIATFOEMscorecard(s),thecertificationbodyshallincreasethetotalauditdaysbythehourslistedinthetablebelow.TheincreasedaudittimeshallbeusedtoreviewthecorrectiveactionsassociatedwiththeIATFOEMqualityand/ordeliverytargetsnotbeingmetandtheassociatedrisktosimilarprocesses/products.Theincreaseshallbeappliedtothecurrentaudit.注1:IATF規(guī)則規(guī)定，當(dāng)客戶不滿足IATFOEM記分卡中規(guī)定的IATFOEM質(zhì)量和/或交付目標(biāo)時(shí)，認(rèn)證機(jī)構(gòu)應(yīng)按下表中列出的小時(shí)數(shù)增加總審核天數(shù)。增加的審核時(shí)間用以審核與IATFOEM質(zhì)量和/或交付目標(biāo)不滿足相關(guān)的糾正措施，以及與類(lèi)似流程/產(chǎn)品相關(guān)的風(fēng)險(xiǎn)。增加的審核時(shí)間應(yīng)用于本次審核。NumberofIATFOEMcustomerswherequalityand/ordeliverytargetsarenotbeingmet沒(méi)有達(dá)到質(zhì)量和/或交付目標(biāo)的IATFOEM客戶的數(shù)量Numberofemployees員工人數(shù)1–2IATFOEMs1-2個(gè)IATFOEM客戶3ormoreIATFOEMs3個( Ltd.法定代表人或委托代理人：Legalrepresentativeorauthorizedrepresentative：授權(quán)代表人：Authorizedrepresentative：法定代表人或委托代理人：Legalrepresentativeorauthorizedrepresentative:簽署日期Issuedate：簽署日期Issuedate：簽署日期Issuedate：地址：Address：地址：電話：Tel.：電話：傳真：Fax：傳真：開(kāi)戶銀行：Bank：開(kāi)戶銀行：Bank：賬號(hào)：Accountnumber：賬號(hào)Accountnumber：：賬號(hào)Accountnumber：：SWIFTCODE:BKCHCNBJ300ANNEX1附件一1.GENERALCONDITIONS通用條款1.1乙方按認(rèn)證程序?qū)追竭M(jìn)行認(rèn)證審核，在確認(rèn)管理體系符合合同約定的審核依據(jù)后，為甲方辦理認(rèn)證注冊(cè)，發(fā)放或換發(fā)管理體系認(rèn)證證書(shū)。證書(shū)有效期為三年。PartyBshallconductcertificationauditonPartyAinaccordancewiththecertificationprocedures.Afterconfirmingthatthemanagementsystemconformstotheauditbasisagreedinthecontract,PartyBshallconductcertificationregistrationforPartyAandissueorchangethemanagementsystemcertificationcertificate.Thecertificateisvalidforthreeyears.1.2認(rèn)證審核過(guò)程（認(rèn)證程序）包括Certificationauditprocess(certificationprocedure)includes:1）管理體系準(zhǔn)備評(píng)審；Managementsystempreparationandreview;2）現(xiàn)場(chǎng)審核：包括初審或再認(rèn)證，及證書(shū)有效期內(nèi)的監(jiān)督審核；On-siteaudit:includinginitialauditorre-certificationauditandsupervisionauditwithinthevalidityperiodofthecertificate;3）初審或再認(rèn)證審核通過(guò)后的批準(zhǔn)注冊(cè)、頒發(fā)認(rèn)證證書(shū)。Theapprovalofregistrationandissuanceofcertificationcertificatesaftertheinitialauditorre-certificationaudit.1.3進(jìn)行現(xiàn)場(chǎng)審核的時(shí)機(jī)及條件Occasionsandconditionsforon-siteaudit:1）初審：甲方向乙方提交管理體系文件，并保證汽車(chē)客戶相關(guān)產(chǎn)品的生產(chǎn)不少于12個(gè)月Preliminaryexamination:PartyAshallsubmitmanagementsystemdocumentstoPartyBandguaranteethattheproductionofrelevantproductsofautomobilecustomersshalllastnolessthan12months;2）監(jiān)督審核：甲方選定監(jiān)督審核的間隔為FORMCHECKBOX6個(gè)月FORMCHECKBOX9個(gè)月FORMCHECKBOX12個(gè)月，所有監(jiān)督審核均從初審第二階段/再認(rèn)證審核的最后一天開(kāi)始計(jì)算，按不同的時(shí)間間隔三年的審核次數(shù)及審核時(shí)間分別如下：監(jiān)督間隔6個(gè)月，每3年周期審核5次，監(jiān)督次數(shù)以6個(gè)月為基礎(chǔ)（-1月，+1個(gè)月）；監(jiān)督間隔9個(gè)月，每3年周期審核3次，監(jiān)督次數(shù)以9個(gè)月為基礎(chǔ)（-2月，+1個(gè)月）；監(jiān)督間隔12個(gè)月，每3年周期審核2次，監(jiān)督次數(shù)以12個(gè)月為基礎(chǔ)（-3月，+1個(gè)月）。監(jiān)督審核間隔一旦確定，在一個(gè)3年的審核周期內(nèi)不可變更。Surveillanceaudit:theintervalofsurveillanceauditselectedbyPartyAshallbeFORMCHECKBOX6monthsFORMCHECKBOX9monthsFORMCHECKBOX12months.Allsurveillanceauditshallbecalculatedfromthelastdayofthesecondstageofinitialaudit/re-certificationaudit.Thenumberofauditsandthedurationofauditsinthreeyearsaccordingtodifferenttimeintervalsshallbeasfollows:Whenthesupervisionintervalis6months,theauditiscarriedout5timesevery3years.Thesupervisionfrequencyisbasedon6months(-1month,+1month);Whenthesupervisionintervalis9months,andtheauditiscarriedout3timesevery3years.Whenthesupervisionfrequencyisbasedon9months(-2months,+1month);Thesupervisionintervalis12months,andtheauditiscarriedouttwiceevery3years.Thesupervisionfrequencyisbasedon12months(-3months,+1month).Oncethesurveillanceauditintervalisdetermined,itcannotbechangedwithina3yearauditperiod.3）再認(rèn)證：第一次再認(rèn)證的日期不應(yīng)超過(guò)從初次第二階段審核最后一天開(kāi)始的三年（-3月，+0天），其后再認(rèn)證審核的最后一天不得超過(guò)前一次再認(rèn)證審核最后一天后的三年（-3月，+0天）。如果超過(guò)上述時(shí)間，甲方應(yīng)從初次認(rèn)證審核（第1階段和第2階段）重新開(kāi)始。Re-certificationaudit:Thedateofthefirstre-certificationauditshallnotexceedthreeyears(-3months,+0days)fromthelastdayofthefirstStage2audit(-3months,+0days),andthelastdayofthesubsequentre-certificationauditshallnotexceedthreeyears(-3months,+0days)fromthelastdayofthepreviousre-certificationaudit.Iftheabovetimeisexceeded,PartyAshallrestarttheinitialcertificationaudit(Stage1andStage2).1.4甲方的義務(wù)PartyAobligations:1.4.1認(rèn)證后持續(xù)有效運(yùn)行質(zhì)量管理體系。continuouslyandeffectivelyoperatethequalitymanagementsystemafterobtainingthecertification.1.4.2如甲方未能及時(shí)向乙方通知下列變更，則視為違反具有法律效力的協(xié)議，乙方有權(quán)撤銷(xiāo)授予甲方的IATF16949證書(shū)。IfPartyAfailstotimelynotifyPartyBofthebelowchanges,itshallbedeemedasaviolationofthislegallyvalidagreementandPartyBshallhavetherighttorevoketheIATF16949certificategrantedtoPartyA.a.甲方承諾遵守認(rèn)證認(rèn)可相關(guān)法律法規(guī)，協(xié)助認(rèn)證監(jiān)管部門(mén)的監(jiān)督檢查，對(duì)有關(guān)事項(xiàng)的詢問(wèn)和調(diào)查如實(shí)提供相關(guān)材料和信息。甲方承諾獲得認(rèn)證后發(fā)生以下情況時(shí)，甲方應(yīng)在十個(gè)日歷日內(nèi)向乙方通報(bào)PartyAundertakestoabidebytherelevantlawsandregulationsofcertificationandaccreditation,assistthesupervisionandinspectionofcertificationregulatoryauthorities,andtruthfullyproviderelevantmaterialsandinformationforinquiriesandinvestigationsofrelevantmatters：b.客戶及相關(guān)方有重大投訴Majorcomplaintsfromcustomersandrelatedparties;c.生產(chǎn)、銷(xiāo)售的產(chǎn)品或提供的服務(wù)被市場(chǎng)監(jiān)管部門(mén)認(rèn)定不合格Theproductsproducedorsoldortheservicesprovidedareidentifiedasunqualifiedbythemarketsupervisionauthorities.d.發(fā)生產(chǎn)品或服務(wù)的質(zhì)量安全事故或是發(fā)生產(chǎn)品有害物質(zhì)特性事故Accidentsconcerningthequalityandsafetyofproductsorservicesoraccidentsconcerningthecharacteristicsofharmfulsubstancesofproductsoccur;e.相關(guān)情況發(fā)生變更，包括：法律地位、生產(chǎn)經(jīng)營(yíng)狀況、組織狀態(tài)或所有權(quán)變更；取得的行政許可資格、強(qiáng)制性認(rèn)證或其他資質(zhì)證書(shū)變更；組織和管理層（如關(guān)鍵的管理、決策或技術(shù)人員）；生產(chǎn)經(jīng)營(yíng)或服務(wù)的聯(lián)系地址和場(chǎng)所；管理體系覆蓋的運(yùn)作范圍；管理體系和過(guò)程的重大變更等Therelevantcircumstanceschange,including:legalstatus,productionandoperationstatus,organizationalstatusorownershipchange;Thealterationoftheadministrativelicensingqualification,compulsorycertificationorotherqualificationcertificatesobtained;Organizationandmanagement(suchaskeymanagement,decisionmakingortechnicalpersonnel);Thecontactaddressandplaceofproduction,businessorservice;Theoperationalscopecoveredbythemanagementsystem;Majorchangestomanagementsystemsandprocesses.f.被有關(guān)執(zhí)法部門(mén)責(zé)令停業(yè)整頓的Beingorderedtosuspendbusinessforrectificationbytherelevantlawenforcementdepartment;g.被地方認(rèn)證監(jiān)管部門(mén)發(fā)現(xiàn)體系運(yùn)行存在問(wèn)題的Bythelocalcertificationregulatoryauthoritiesfoundthatthesystemoperationproblems;h.持有的行政許可證明、資質(zhì)證書(shū)、強(qiáng)制性認(rèn)證證書(shū)等過(guò)期失效，重新提交的申請(qǐng)已被受理但尚未換證的或持有的行政許可證明、資質(zhì)證書(shū)、強(qiáng)制性認(rèn)證證書(shū)等已經(jīng)過(guò)期失效但申請(qǐng)未獲批準(zhǔn)的Theadministrativelicensecertificate,qualificationcertificate,compulsorycertificationcertificateandothercertificatesheldhaveexpired,andtheresubmittedapplicationhasbeenacceptedbuthasnotbeenrenewedortheadministrativelicensecertificate,qualificationcertificateorcompulsorycertificationcertificateheldhasexpiredbuttheapplicationhasnotbeenapproved;i.出現(xiàn)重大的產(chǎn)品或服務(wù)等質(zhì)量安全事故，經(jīng)執(zhí)法監(jiān)管部門(mén)確認(rèn)是獲證組織違規(guī)造成的；Amajorproductorservicequalityandsafetyaccidentisconfirmedbythelawenforcementandsupervisiondepartmenttobecausedbytheviolationoftheauthorizedorganization;j.發(fā)生其他違法違規(guī)行為的Anyotherviolationoflawsandregulations;k.出現(xiàn)影響質(zhì)量管理體系運(yùn)行的其他重要情況Theoccurrenceofotherimportantcircumstancesaffectingtheoperationofthequalitymanagementsystem.1.4.3在簽署此份認(rèn)證合同之前，甲方如接受過(guò)其他認(rèn)證機(jī)構(gòu)IATF16949認(rèn)證審核，應(yīng)明確告知乙方，并說(shuō)明之前認(rèn)證審核的狀態(tài)。如甲方未能告知或者未能如實(shí)告知乙方，所產(chǎn)生的一切責(zé)任和后果由甲方自行承擔(dān)。Priortosigningthiscertificationcontract,ifPartyAhasreceivedcertificationauditfromothercertificationbodies,suchasIATF16949,PartyAshallclearlyinformPartyBandexplainthestatusofpreviouscertificationaudit.IfPartyAfailstoinformortruthfullyinformPartyB,allresponsibilitiesandconsequencesarisingtherefromshallbebornebyPartyA.1.4.4甲方承諾獲得認(rèn)證后正確使用認(rèn)證證書(shū)、認(rèn)證標(biāo)志和有關(guān)信息，不利用質(zhì)量管理體系認(rèn)證證書(shū)和相關(guān)文字、符號(hào)誤導(dǎo)公眾認(rèn)為其產(chǎn)品或服務(wù)通過(guò)認(rèn)證。出現(xiàn)認(rèn)證方案規(guī)定的重大問(wèn)題時(shí)，應(yīng)于24小時(shí)內(nèi)通知乙方，證書(shū)被撤銷(xiāo)后24小時(shí)內(nèi)停止使用認(rèn)證證書(shū)和認(rèn)證標(biāo)志，并向乙方退還認(rèn)證證書(shū)（包括副本），同時(shí)停止有關(guān)認(rèn)定內(nèi)容的廣告和宣傳。PartyAundertakestocorrectlyusethecertificationcertificate,certificationmarkandrelevantinformationafterobtainingthecertification,andnottomisleadthepublicintothinkingthatitsproductsorserviceshavepassedthecertificationbyusingthequalitymanagementsystemcertificationcertificateandrelevantwordsandsymbols.Incaseofanymajorproblemasstipulatedinthecertificationplan,PartyBshallbenotifiedwithin24hours.PartyBshallstopusingthecertificationcertificateandcertificationmarkwithin24hoursupontherevocationofthecertificate,returnthecertificationcertificate(includingacopy)toPartyB,andstopadvertisingandpublicityrelatedtotherecognitioncontent.1.4.5希望注銷(xiāo)認(rèn)證證書(shū)時(shí)，提前5個(gè)工作日書(shū)面通知乙方，通知乙方同時(shí)將證書(shū)（包括副本）交還乙方，辦理注銷(xiāo)手續(xù)。Ifitwishestocancelthecertificate,itshallgiveawrittennoticetoPartyB5workingdaysinadvance,andnotifyPartyBtoreturnthecertificate(includingthecopy)toPartyBatthesametimetohandlethecancellationprocedures.1.4.6向乙方如實(shí)提供認(rèn)證申請(qǐng)資料，實(shí)事求是填寫(xiě)《報(bào)價(jià)申請(qǐng)表》。ProvidePartyBwithtruthfulcertificationapplicationmaterialsandfillintheOfferApplicationForminaccordancewiththefacts.1.4.7向乙方提供管理手冊(cè)及其它認(rèn)證所需要的文件，提供至少十二個(gè)月體系運(yùn)行的全部文件和資料證據(jù)，證據(jù)應(yīng)該是真實(shí)的。ProvidePartyBwithmanagementmanualsandotherdocumentsnecessaryforcertification,andprovidealldocumentsandevidenceofsystemoperationforatleast12months,andtheevidenceshouldbetrue.1.4.8為現(xiàn)場(chǎng)審核組提供必要的交通、食宿、通訊、審核期間辦公場(chǎng)所及其它必要的工作條件。Providethenecessarytransportation,accommodation,communication,officeandothernecessaryworkingconditionsfortheon-siteauditteam.1.4.9甲方有義務(wù)遵守認(rèn)證認(rèn)可相關(guān)法律法規(guī)，協(xié)助認(rèn)證監(jiān)管部門(mén)的監(jiān)督檢查,對(duì)認(rèn)證有關(guān)事項(xiàng)的詢問(wèn)和調(diào)查如實(shí)提供相關(guān)材料和信息。由國(guó)家認(rèn)監(jiān)委及地方認(rèn)證監(jiān)管部門(mén)的稽查及抽查，甲方應(yīng)予以全面配合。PartyAisobligedtoabidebytherelevantlawsandregulationsofcertificationandaccreditation,assistthesupervisionandinspectionofthecertificationregulatoryauthorities,andtruthfullyproviderelevantmaterialsandinformationfortheinquiryandinvestigationofcertificationrelatedmatters.PartyAshallfullycooperatewiththeinspectionandspotinspectionconductedbyCNCAandlocalcertificationregulatoryauthorities.1.4.10甲方在獲得認(rèn)證后，應(yīng)按規(guī)定接受監(jiān)督審核、再認(rèn)證審核及各種特殊審核；應(yīng)遵守乙方制定的認(rèn)證規(guī)則文件。正確使用認(rèn)證證書(shū)、認(rèn)證標(biāo)志和有關(guān)信息；不得擅自利用管理體系認(rèn)證證書(shū)和相關(guān)文字、符號(hào)誤導(dǎo)公眾認(rèn)為其產(chǎn)品或服務(wù)通過(guò)認(rèn)證。并按期向乙方交納本合同確定的費(fèi)用以保證證書(shū)有效性。在本認(rèn)證項(xiàng)目中，只可以在認(rèn)證機(jī)構(gòu)出具的證書(shū)上使用IATF標(biāo)識(shí)，禁止將IATF標(biāo)識(shí)用作其他任何用途，無(wú)論是否單獨(dú)使用。Afterobtainingthecertification,PartyAshallacceptthesupervisionaudit,re-certificationauditandvariousspecialauditsinaccordancewiththeprovisions;PartyBshallcomplywiththecertificationrulesanddocumentsformulatedbyPartyB.Correctuseofcertificationcertificates,certificationmarksandrelevantinformation;Shallnotarbitrarilyusethemanagementsystemcertificationcertificateandrelatedwords,symbolstomisleadthepublicthattheirproductsorservicesthroughthecertification.Inaddition,PartyBshallpayPartyBthefeespecifiedinthiscontractonscheduletoguaranteethevalidityofthecertificate.Forthepurposesofthiscertificationprogram,theIATFlogomayonlybeusedonthecertificateissuedbythecertificationbody.TheuseoftheIATFlogoforanyotherpurpose,whetherusedaloneornot,isprohibited.1.4.11甲方有義務(wù)遵守為符合標(biāo)準(zhǔn)要求所承諾的合規(guī)性義務(wù)及法律法規(guī)，并定期評(píng)價(jià)，保留記錄。PartyAshallbeobligatedtocomplywiththecomplianceobligationsandlawsandregulationspromisedtomeetthestandardsandrequirements,andshallregularlyevaluateandkeeprecords.1.4.12甲方的產(chǎn)品在產(chǎn)品質(zhì)量國(guó)家監(jiān)督抽查中被查出不合格時(shí)，甲方應(yīng)自國(guó)家質(zhì)檢總局發(fā)出通報(bào)起30日內(nèi)，向乙方通報(bào)該信息，并接受乙方實(shí)施的監(jiān)督審核。IfPartyA'sproductsarefoundtobeunqualifiedinthenationalsupervisionandsamplinginspectionofproductquality,PartyAshallnotifyPartyBofsuchinformationandacceptthesurveillanceauditcarriedoutbyPartyBwithin30daysafterthenoticeisissuedbytheGeneralAdministrationofQualitySupervision,InspectionandQuarantine.1.4.13認(rèn)證資格被撤銷(xiāo)后，立即停止使用認(rèn)證證書(shū)/認(rèn)證標(biāo)志，并向乙方退還認(rèn)證證書(shū)。Upontherevocationofthecertificationqualification,PartyBshallimmediatelystopusingthecertificationcertificate/certificationmarkandreturnthecertificationcertificatetoPartyB.1.5乙方義務(wù)：PartyBobligations:1.5.1根據(jù)認(rèn)證方案在委托的認(rèn)證范圍內(nèi)公正、客觀、科學(xué)地開(kāi)展認(rèn)證活動(dòng)。Carryoutcertificationactivitiesinafair,objectiveandscientificmannerwithinthescopeoftheentrustedcertificationaccordingtothecertificationscheme.1.5.2派遣適宜的審核人員，并征得甲方同意。DispatchappropriateauditpersonnelandobtaintheconsentofPartyA.1.5.3通過(guò)乙方現(xiàn)場(chǎng)審核，技術(shù)委員會(huì)認(rèn)證評(píng)審，確認(rèn)甲方符合認(rèn)證認(rèn)可法規(guī)、認(rèn)證標(biāo)準(zhǔn)、適用法律法規(guī)及乙方制定的認(rèn)證規(guī)則文件等要求后，向甲方提供AENOR的認(rèn)證證書(shū)并告知其認(rèn)證證書(shū)和標(biāo)志的使用規(guī)則。AfterPartyB'son-siteauditandcertificationreviewbythetechnicalcommitteeconfirmthatPartyAmeetstherequirementsofcertificationandaccreditationregulations,certificationstandards,applicablelawsandregulationsandcertificationrulesanddocumentsformulatedbyPartyB,PartyAshallbeprovidedwithAENORcertificationcertificateandinformedoftherulesfortheuseofthecertificationcertificateandlogo.1.5.4認(rèn)證要求發(fā)生更改時(shí)，書(shū)面通知甲方。Incaseofanychangeincertificationrequirements,PartyAshallbenotifiedinwriting.1.5.5做出暫停、撤銷(xiāo)認(rèn)證證書(shū)的決定時(shí)，必須書(shū)面通知甲方，說(shuō)明理由。Incaseofsuspendingorrevocationofthecertificate,PartyAshallbeinformedinwritingofthereasons.1.5.6甲方獲得認(rèn)證證書(shū)后，乙方受理第三方對(duì)甲方有關(guān)投訴，須通報(bào)甲方，與甲方協(xié)商解決，確屬甲方責(zé)任的，由甲方負(fù)責(zé)解決。AfterPartyAhasobtainedthecertificationcertificate,PartyBshallacceptthethird-partycomplaintsagainstPartyA,notifyPartyAandnegotiatewithPartyAforsettlement.IfPartyAisindeedresponsible,PartyAshallberesponsibleforthesettlement.1.6甲方的權(quán)利PartyA'srights1.6.1有權(quán)宣傳獲得認(rèn)證資格的事實(shí)。Therighttopublicizethefactthatcertificationhasbeenachieved.1.6.2享有由于獲得認(rèn)證資格以及使用認(rèn)證證書(shū)及認(rèn)證標(biāo)志取得的經(jīng)濟(jì)利益。Toenjoythefinancialbenefitsofobtainingthecertificationandtheuseofthecertificationcertificateandcertificationmark.1.6.3甲方對(duì)乙方關(guān)于認(rèn)證的暫停和撤銷(xiāo)決定
