1/14房屋租賃合同出租方(甲方):Lessor(PartyA):承租方(乙方):Lessee(PartyB):居間方(丙方):Intermediaryparty(PartyC):ShanghaiDeovolenteRealtyCo.,Ltd.根據《中華人民共和國合同法》、《上海市房屋租賃條例》等相關法律法規(guī)的規(guī)定,甲、乙雙方經丙方居間介紹,在平等、自愿、公平和誠信的基礎上,經協(xié)商一致,就乙方承租甲方的房屋事宜,簽訂本合同,以資共同遵守:ThisContractismadebyPartyCandbetweenbothpartiesafternegotiationonanequal,voluntary,fairandgood-faithbasisinaccordancewith“ContractLawofthePeople’sRepublicofChina”,“ShanghaiMunicipalityRegulationsontheLeasingofBuildingPremises”andotherrelevantlawsandregulations,withregardtotheissuethatPartyBwillrentthehouseofPartyA:一、出租房屋基本情況:(下稱“該房屋”,實際情況以權屬證明或相關法律文書的記載內容為準)I.Basicinformationoftheleasedhouse:(hereinafterreferredtoas“thepremises”,andtheactualsituationshallbebasedontheownershipcertificationortherecordsofrelevantlegaldocuments)1.1房屋類型:□住宅□花園住宅□辦公樓□商鋪□廠房□倉庫□其他。1.1Typeofthepremises:□Residentialhouse□Gardenhouse□Officebuilding□Shop□Plantbuilding□Warehouse□Others.1.2房屋座落:區(qū)路弄號室以及號車位。1.2 BothpartieshaveagreedthatPartyAshallhandoverthepremisestoPartyBbefore,.UnderthewitnessofPartyC,bothpartiesshallsignAppendixII:LetterofHouseHandoveratthetimeofdelivery.3.2該房屋租賃期限自年月日起至年月日止。3.2Thepremisesareleasedfrom,to,.四、租金、支付方式與支付日期IV.Rent,methodandtimeofpayment4.1甲乙雙方約定,該房屋每月租金為(□人民幣□美元□)元(大寫萬仟佰拾元整)。4.1Bothpartieshaveagreedthattherentofthepremisespermonthis(□RMB□USD□)(Say:Only).該房屋租金月內不變。自第月起,以個月為周期,月租金遞增%。Therentofthepremisesshallnotbechangedwithinmonths.Themonthlyrentwillbeincreasedattherateof%fromthethmonthwithmonthsastheperiod.4.2租金以個月為一期支付。乙方應于每期首月日前向甲方支付租金。逾期支付的,每逾期一日,則乙方需按日租金的%支付逾期違約金。4.2Therentshallbepaidwithmonthsasapaymentperiod.PartyBshallpaytherentbeforethedayinthefirstmonthofeverypaymentperiod.Incaseofpaymentdelay,thepenaltyshallbecollectedatthedailyrateof%.4.3乙方支付租金的方式如下:□現金支付;□銀行轉賬:甲方收取租金的賬戶如下:戶名:開戶行:賬號:。4.3PartyBshallpaytherentbythefollowingmeans:□cashpayment;□banktransfer.TheaccountofPartyAtoreceivetherent:Accountname:OpeningBank:AccountNo.:.4.4以上租金(□包含□不包含)甲方出具租賃發(fā)票的費用。4.4 Theaboverent(□includes□excludes)thefeesontheleasinginvoicesissuedbyPartyA.五、保證金(押金)和其他費用V.Guaranteedeposit(securitydeposit)andotherfees5.1甲乙雙方約定,在(□交房□簽訂本合同)時,乙方應向甲方支付房屋租賃保證金(押金),保證金(押金)為個月的租金,即(□人民幣□美元□)元(大寫萬仟佰拾元整)。甲方收取該保證金(押金)后應向乙方出具收款憑證。租賃關系終止時,甲方收取的房屋租賃保證金(押金)除用于抵充本合同約定由乙方承擔的費用外,剩余部分無息歸還乙方。5.1Bothpartieshaveagreedthatatthetimeof(□handoverofthepremises□signingthisContract),PartyBshallpayPartyAtheguaranteedeposit(securitydeposit)ofthepremises,whichisequivalenttotherentofmonth(s),thatis,(□RMB□USD□)(SayOnly).Uponreceivingtheguaranteedeposit(securitydeposit),PartyAshallissuethereceiptvouchertoPartyB.Atthetimeoftheterminationofleasingrelation,theguaranteedeposit(securitydeposit)collectedbyPartyAshallbeusedtooffsetthefeesundertakenbyPartyBasagreedinthisContractandtheremainingportionshallbereturnedtoPartyBwithoutinterest.5.2租賃期間內發(fā)生的水費、電費、煤氣費、電話(通訊)費、電視收視費等房屋使用費用由乙方承擔;物業(yè)管理費由(□甲方□乙方)承擔。5.2Thecostarisingfromwater,electricity,gas,telephonecall(communication)andTVandsoon(或etc.)duringtheleasingperiodshallbeundertakenbyPartyB;propertymanagementfeeshallbeundertakenby(□PartyA□PartyB).六、房屋使用要求和維修責任VI.Houseuserequirementsandmaintenanceresponsibility6.1租賃期間,乙方發(fā)現該房屋及其附屬設施有損壞或故障時,應及時通知甲方修復;甲方應在接到乙方通知后的日內進行維修。逾期不維修的,乙方可代為維修,費用由甲方承擔。6.1Duringtheleasingperiod,ifPartyBdiscoversanydamageortroublewiththepremisesandtheaccessoryfacilities,PartyBshalltimelynotifyPartyAforrepair;PartyAshallcarryouttherepairwithinday(s)afterreceivingthenotification.Incaseofdelayofrepair,PartyBmaymaketherepairinplaceofPartyAatthecostofPartyA.6.2租賃期間,乙方應合理使用并愛護該房屋及其附屬設施。因乙方使用不當或不合理使用,致使該房屋及其附屬設施損壞或發(fā)生故障的,乙方應負責維修。乙方拒不維修的,甲方可代為維修,費用由乙方承擔。6.2Duringtheleasingperiod,PartyBshallmakereasonableuseofthepremisesandtheaccessoryfacilities.AnydamageortroublearisingfromimproperuseorunreasonableuseofthepremisesandaccessoryfacilitiesshallberepairedbyPartyB.IntheeventthatPartyBrefusestherepair,PartyAmaycarryouttherepairinplaceofPartyBatthecostofPartyB.6.3租賃期間,甲方應保證該房屋及其附屬設施處于正常的可使用和安全的狀態(tài)。甲方對該房屋進行檢查、養(yǎng)護,應提前日通知乙方。檢查養(yǎng)護時,乙方應予以配合。甲方應減少對乙方使用該房屋的影響。6.3Duringtheleasingperiod,PartyAshallensurenormalavailabilityandsafestatusofthepremisesandaccessoryfacilities.IfPartyAintendstocarryoutinspectionandmaintenanceonthepremises,PartyAshallnotifyPartyBdaysinadvance.Duringtheinspectionandmaintenance,PartyBshallprovidecoordination.PartyAshallminimizetheinfluenceontheuseofthepremises.6.4乙方需裝修或者增設附屬設施和設備的,應事先征得甲方的書面同意,按規(guī)定須向有關部門報批的,則應由(□甲方□甲方委托乙方)報請有關部門批準后,方可進行。乙方增設的附屬設施和設備的歸屬及其維修責任由甲、乙雙方另行書面約定。6.4IncasethatPartyBintendstodecoratethepremisesoraddaccessoryfacilitiesandequipments,PartyBshallobtainwrittenpermissionfromPartyAinadvance;ifitisrequiredso,(□PartyA□PartyBentrustedbyPartyA)shallsubmitsuchbehaviortothecompetentdepartmentforapprovalbeforetheimplementation.TheownershipandmaintenanceoftheaccessoryfacilitiesandequipmentsaddedbyPartyBshallbeadditionallyagreedbybothpartiesinwrittenform.七、房屋返還與續(xù)租VII.Housereturnandrentingrenewal7.1乙方應在本合同的租賃期限屆滿之后的日內返還該房屋,未經甲方同意逾期返還該房屋的,每逾期一日,乙方應以日租金的%向甲方支付該房屋占用期間的使用費。7.1PartyBshallreturnthepremiseswithindaysaftertheterminationoftheleasingperiod,andincaseofanydelayforthereturnofthepremiseswithoutpermissionofPartyA,PartyBshallpayPartyAtheusefeeofthepremisesatthedailyrateequivalentto%ofdailyrentduringtheoccupationofthepremises.7.2乙方如果需要續(xù)租的,應在租賃期限屆滿兩個月之前向甲方提出,甲方同意的,雙方另行簽訂相關續(xù)租文書。乙方在同等條件下享有優(yōu)先承租權。7.2 IncasethatPartyBwantstorenewtheContract,PartyBshallraisetherenewalintentiontoPartyAtwomonthsbeforetheterminationoftheleasingperiod,andwiththeapprovalofPartyA,therenewalcontractwillbeadditionallysignedbetweenbothparties.Undertheequivalentcondition,PartyBshallhavethepriorityforobtainingthelease.7.3租賃期限屆滿,甲乙雙方未續(xù)簽租賃合同,乙方繼續(xù)支付租金,甲方未表示拒絕的,則按法律相關規(guī)定,雙方之間成立不定期租賃關系。在不定期租賃關系中,甲方有權提前一個月通知乙方租賃關系終止。7.3 Aftertheterminationoftheleasingperiod,ifnorenewalcontractissignedbybothpartiesandPartyBcontinuespayingtherent,whichisnotrefusedbyPartyA,thenon-fixed-termleasingrelationsareestablishedbetweenbothpartiesaccordingtorelevantlawsandregulations.Duringsuchnon-fixed-termleasingrelations,PartyAshallhavetherighttoterminatetheleasingrelationsbynotifyingPartyBone(1)monthinadvance.7.4乙方返還該房屋應符合正常使用后的狀態(tài)。返還時,應經甲方驗收認可,并相互結清各自應當承擔的費用。7.4 ThepremisesreturnedbyPartyBshallbeconsistentwiththestatusafternormaluseofthepremises.Uponreturnofthepremises,PartyBshallinspectthepremisesbeforeitsacceptanceandtherelevantfeesforrespectivepartiesshallbesettled.八、轉租與轉讓VIII.Subleaseandtransfer8.1除甲方已經在本合同中同意乙方轉租外,乙方在租賃期限內,需事先征得甲方的書面同意,方可將該房屋部分或全部轉租給他人。但原始戶型同一間居住房屋,不得分割轉租。8.1 ExceptthatPartyAagreesinthisContractthatthepremisesmaybesubleasedbyPartyB,PartyBshallnotsubleasepartorallofthepremisestoanyotherpersonwithintheleasingperiod,withoutwrittenpermissionofPartyA.Anyhowonelivingroomintheoriginalhouseholdtypeshallnotbeseparatedforsubleasing.8.2在租賃期限內,甲方如需出售該房屋,應提前兩個月通知乙方。乙方在簽署本合同之時,已確認放棄優(yōu)先購買權。8.2Duringtheleasingperiod,ifPartyAwantstosellthepremises,PartyAshallnotifyPartyBtwo(2)monthsinadvance.PartyBconfirmedthewaiverofthepreemptionofthepremisesatthetimeofsigningthisContract.九、解除合同的條件IX.Conditionsforcontractcancelation9.1甲乙雙方同意在租賃期限內,有下列情形之一的,本合同終止,雙方互不承擔責任:9.1Bothpartiesagreethatduringtheleasingperiod,thisContractshallbeterminatedneitherpartyneedingtoassuminganyresponsibilityincaseofanyofthefollowingsituations;(一)該房地產占用范圍內的土地使用權依法提前收回的;(1)Theuserightofthelandoccupiedbytherealestatehasbeenlegallyretrieved;(二)該房地產因社會公共利益被依法征用的;(2)Thepremisesareoccupiedbymeansoflegalrequisitionduetosocialandpublicinterests;(三)該房地產因城市建設需要被依法列入房屋拆遷許可范圍內的;(3)Thisrealestatehastobelegallyputintothedismantlingrangeduetourbanconstruction;(四)該房屋毀損、滅失或者被鑒定為危險房屋的;(4)Thepremisesaredamaged,destroyedorverifiedasdangeroushouse;(五)甲方已告知乙方該房屋出租前已設定抵押,現被處分的;(5)PartyAhasnotifiedPartyBthatthepremiseshavebeenpledgedbeforeleasingandnowhasbeendisposed;(六)。(6).9.2甲乙雙方同意,有下列情形之一的,一方可書面通知另一方解除本合同。違反合同的一方,應向另一方按月租金的倍支付違約金,給對方造成損失的,支付的違約金不足以抵付損失的,還應賠償造成的損失與違約金的差額部分:9.2 BothpartiesagreethateitherpartymaynotifytheotherpartytocancelthisContractinwrittenformincaseofanyofthefollowingsituation,andthepartythatbreachesthisContractshallpaytheotherpartytheliquidateddamagesequivalenttotime(s)ofthemonthlyrent,andincasethatthelossesincurredtobothpartiescannotbeoffsetbytheliquidateddamagespaidbythebreachingparty,thebreachingpartyshallpaythedifferencebetweentheincurredlossesandtheliquidateddamages;(一)甲方未按時交付該房屋,經乙方催告后日仍未交付的;(I)PartyAfailstohandoverthepremisesontime,andevendaysafterexigentnoticeofPartyB;(二)甲方交付的該房屋不符合本合同的約定,致使不能實現租賃目的的;或甲方交付的房屋存在缺陷,危及乙方安全的;(II)ThepremiseshandedoverbyPartyAdonotcomplywiththeagreementinthisContract,whichthereforemakesitimpossibletorealizetheleasingpurpose;orthepremiseshandedoverbyPartyAhavethedefectsendangeringthesafetyofPartyB;(三)乙方在甲方按時交付該房屋的情形下,未能配合辦理交房手續(xù),經甲方催告后日仍未配合辦理交房手續(xù)的;(III)InspiteofthetimelyhandoverofthepremisesbyPartyA,PartyBfailstocooperatetogothroughtheproceduresforthehandoverofthepremisesdaysaftertheexigentnoticeofPartyA;(四)乙方未征得甲方書面同意改變該房屋用途,致使該房屋損壞的;(IV)PartyBchangedtheuseofthepremiseswithoutwrittenpermissionofPartyAandthereforeincurredthedamageofthepremises;(五)因乙方原因造成該房屋主體結構損壞的;(V)ThemainstructureofthepremisesisdamagedduetothereasonsofPartyB;(六)乙方擅自轉租該房屋或轉讓該房屋承租權的;(VI)PartyBsubleasesthepremisesortransferstheleasingrightofthepremiseswithoutpermissionofPartyA;(七)乙方逾期不支付租金累計超過月的;(VII)Partyfailstopaytherentuptomorethanmonths;(八)。(VIII).十、違約責任X.Breachingliability10.1該房屋交付時存在缺陷的,甲方應自交付日起日內進行修復,逾期不修復的,甲方同意減少租金并變更有關租金條款。10.1Incaseofanydefectwiththepremisesatthetimeofhandover,PartyAshallmaketherepairwithindaysafterthehandover,andifnorepairismadeevenafterthestipulatedperiod,PartyAagreestoreducetherentandchangetheclauserelatedtotherent.10.2因甲方未告知乙方,該房地產出租前已抵押或產權轉移已受到限制,造成乙方損失的,甲方應當負責賠償。10.2 IncasethatPartyAfailstonotifyPartyBthatthepremiseshavebeenpledgedortheownershiptransferofthepremiseshasbeenrestricted,anylossincurredtoPartyBtherefromshallbepaidbyPartyA.10.3租賃期間,甲方不及時履行本合同約定的維修與養(yǎng)護責任,致使該房屋損壞,造成乙方財產損失或人身傷害的,甲方應承擔賠償責任。10.3Duringtheleasingperiod,PartyAfailstotimelyperformthemaintenanceresponsibilityofthepremisesasagreedintheContract,whichthereforehasincurredthedamageofthepremises,thenanypropertylossorpersonalinjuryincurreduponPartyBshallbecompensatedbyPartyA.10.4租賃期間,非本合同規(guī)定的情況,甲方擅自解除本合同,提前收回該房屋的,甲方應按月租金的倍向乙方支付違約金。若違約金不足以抵付乙方損失的,甲方還應負責賠償。10.4 Duringtheleasingperiod,PartyAunilaterallycancelledthisContractandtookbackthepremisesinadvanceincaseofthesituationsotherthanthosestipulatedintheContract,PartyAshallpayPartyBtheliquidateddamagesequivalenttotimesofmonthlyrent.IftheliquidateddamagescannotcompensateforthelossincurreduponPartyB,PartyAshallprovidefurthercompensation.10.5乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋或者增設附屬設施和設備的,甲方可以要求乙方□恢復房屋原狀□賠償損失。10.5 IfPartyBdecoratesthepremisesoraddstheaccessoryfacilitiesorequipmentswithoutwrittenpermissionofPartyAorbeyondthescopeandrequirementsagreedinwrittenpermissionofPartyA,PartyAmayrequirePartyBto□recoverthepremisestotheoriginalstate,□compensatefortheloss.10.6租賃期間,非本合同規(guī)定的情況,乙方中途擅自退租的,乙方應按月租金的倍向甲方支付違約金。若違約金不足以抵付甲方損失的,乙方還應負責賠償。10.6Duringtheleasingperiod,incaseofthesituationotherthanthosestipulatedintheContract,PartyBstopstherenting,PartyBshallpayPartyAtheliquidateddamagesequivalenttotime(s)ofmonthlyrent.IftherentisnotenoughtooffsetthelossincurreduponPartyA,PartyBshallprovidefurthercompensation.十一、居間條款XI.Intermediaryclause三方一致確認,甲、乙雙方是在丙方的居間介紹之下達成本交易的,甲、乙、丙三方簽署本合同,即為丙方居間成功,甲、乙雙方愿意按照約定向丙方支付傭金。具體約定詳見甲方與丙方,以及乙方與丙方各自簽署的傭金確認書。ThreepartiesunanimouslyconfirmthatPartyAandBreachthisContractundertheintermediaryintroductionofPartyC,andthesignatureofthisContractbythreepartiesmeansthesuccessofintermediaryserviceofPartyC,forwhichPartyAandBarewillingtopayPartyCthecommissionasagreed.Formoredetails,refertothecommissionconfirmationlettersignedbetweenPartyAandC,andbetweenPartyBandPartyC.十二、定金條款XII.Downpayment甲乙雙方約定,在簽訂本合同時,乙方支付(□人民幣□美元□)元(大寫萬仟佰拾元整)作為定金,由乙方直接或通過丙方支付給甲方,或者由丙方根據甲方的授權予以保管。PartyAandBagreethatatthetimeofsigningthisContract,PartyBshallpay(□RMB□USD□)(SayOnly)asthedownpayment,whichshallbepaidtoPartyAdirectlyorviaPartyC,orPartyCmaykeepthedownpaymentwiththeauthorizationofPartyA.若到本合同約定的交房日期甲方未能按時交房的,經乙方催告后日仍未交付的,甲方需雙倍返還定金給乙方;若到本合同約定的交房日期乙方未能配合交房的,經甲方催告后日仍未配合辦理交房手續(xù)的,則甲方有權沒收乙方支付的定金;發(fā)生本條款所述情形時,守約方有權選擇適用本條款或第9.2款的相關約定。若甲乙雙方履行完畢交房手續(xù),則該定金作為租金或者租賃保證金(押金)的一部分進行抵充。IntheeventthatPartyAfailstohandoverthepremisesatthedateofhandoverasagreedinthisContract,andevendaysafterexigentnoticeofPartyB,thenPartyAshallpaydoublethereturnofthedeposittoPartyB;incasethatPartyBfailstocooperatewithPartyAforthehandlingproceduresofthehandoverbythedateofhandoveragreedinthisContract,andevendaysafterexigentnoticeofPartyA,PartyAshallhavetherighttoconfiscatethedownpaymentpaidbyPartyB;incaseofanysituationinthisArticle,theobservantpartyshallhavetherightundertheregulationsinthisArticleorArticle9.2.Ifbothpartieshandledtheproceduresforthehandoverofthepremises,thedownpaymentshallbeusedtooffsettherentortheguaranteedeposit(securitydeposit)fortherent.十三、其他條款XIII.Others13.1本合同及附件一自甲、乙、丙三方于本合同簽章處簽字或簽章后立即生效。13.1ThisContractanditsAppendixIshallcomeintoeffectuponthesignaturesorsealstampingofPartiesA,BandC.13.2本合同空格處填寫文字與鉛印文字具有同等法律效力,若填寫文字與鉛印文字相沖突,以填寫文字為準。若有未盡事宜,可簽訂補充協(xié)議進行約定,若補充協(xié)議與本協(xié)議相沖突,以補充協(xié)議為準。13.2 ThewordsfilledandprintedintheblankpartofthisContractshallhavesamelegalforcewiththeContractitself,andincaseofanyconflictbetweenthefilledwordsandprintedwords,thefilledwordsshallprevail.Foranyuncoveredmatter,supplementaryagreementmaybesigned,andifthereisanyconflictarisingbetweenthesupplementaryagreementandthisContract,thissupplementaryagreementshallprevail.13.3甲、乙、丙三方在履行本合同過程中發(fā)生爭議,應通過協(xié)商解決;若協(xié)商解決不成的,三方同意依法向該房屋所在地的人民法院起訴。13.3 AnydisputearisingamongthesethreepartiesduringtheperformanceofthisContractshallberesolvedthroughamicab
