kesubstitutionimmediatelyandbearallexpensesforthesubstitutionandrentduringthesuspenseofusingthevehicle.8、乙方要保護(hù)好甲方車(chē)輛上的特征標(biāo)志，不得涂改遺失，嚴(yán)禁私自拆、換車(chē)輛上的任何部件及設(shè)備，嚴(yán)禁拆動(dòng)里程表，如有拆動(dòng)，將按使用期內(nèi)規(guī)定里程總數(shù)的5倍罰款。PartyBisnotallowedtorepairorchangeanypart，accessory，interenviro____entandexteriorappearanceoftherentedvehicle.Itisprohibitedtochangeorthrowawayanypartandequipmentorpulloutorrefitthemileagemeters.Incaseanytraceofsuchpullingoutorrefittingisfoundout，PartyBshallpayapenaltyequaltofivetimestheamountforthemileagelimiteddefinedintheleaseforthetotalleseterm.四、意外交通事故處理及保險(xiǎn)TrafficAccidentandInsurance1、乙方發(fā)生交通事故〔包括非道路交通事故〕，應(yīng)立即向交通管理部門(mén)報(bào)案，保護(hù)好現(xiàn)場(chǎng)〔快處快撤除外〕，并按市內(nèi)2小時(shí)、市外4小時(shí)的原那么通知甲方，事故處理完畢將交通管理部門(mén)的證明和其它索賠材料在15天內(nèi)送交甲方，甲方據(jù)此辦理保險(xiǎn)索賠事宜，逾期因不能提供交通管理部門(mén)證明和其它索賠材料而無(wú)法向保險(xiǎn)公司索賠的，其事故造成的全部損失均由乙方承當(dāng)。發(fā)惹事故后，未經(jīng)甲方同意，乙方不得擅自處理事故和安排修理。Incaseoftrafficaccident〔includingofnon-roadaccident〕，PartyBshallpreservethesitewheresuchaccidenttakeplace〔excludingfastdealandmoveaway〕andimmediatelyreporttrafficadministrationdepartmentandinformPartyAundertheprincipleofwithin2hoursCity-inand4hoursout-of-city.PartyBshallprovideareportontheactualaccident.Certificateforcasesettlementissuedbythetrafficadministrationdepartmentandotherindemnificationdocumentswithinfifteen〔15〕daysshouldbetransmittedtoPartyA.PartyshallassistPartyBinhandlingaccidentsandberesponsibleforclaiminginsuranceindemnifications.IfPartyBfailstoprovidenecessarydocumentstoPartyAwithinfifteendayscountingfromthedatewhentheinsuredvehicleisrepairedorwhenthecaseisconcluded，itshallberegardedthatPartyBrevoketherightforclaimsvoluntarily.PartyBcanonlyhandletheaccidentandhavetheleasedvehiclerepairedbyPartyA‘swrittenapproval.2、事故期間，由于乙方司機(jī)駕駛引起的交通事故，根據(jù)保險(xiǎn)的條款和交通部門(mén)裁定，第三者強(qiáng)迫險(xiǎn)局部除外，負(fù)事故次責(zé)的，賠償甲方事故費(fèi)用總額的10%；負(fù)事故半責(zé)的，負(fù)責(zé)賠償甲方事故費(fèi)用總額的15%；負(fù)事故主責(zé)的，賠償甲方事故費(fèi)用總額的20%；負(fù)事故全責(zé)的，賠償甲方事故費(fèi)用總額的30%.IncaseofsuchaccidentcausedbyPartyB‘sdesignateddriver，accordingtothejudgingoftrafficadministrationdepartmentandinsurancepany，asidethirdpersonliabilityriskinsurance，PartyBshallpay10percentoftotalaccidentexpenseswithlesserresponsibilities；pay15percentoftotalaccidentexpenseswithhalfresponsibilities；pay15percentoftotalaccidentexpenseswithhalfresponsibilities；pay20percentoftotalaccidentexpenseswithminorresponsibilitiesandpay30percentexpensesoftotalaccidentexpenseswithwholeresponsibilities.3、乙方所租用車(chē)輛在非正式道路上發(fā)生單車(chē)細(xì)微肇事事故，應(yīng)立即向交通管理部門(mén)報(bào)案或向保險(xiǎn)公司報(bào)案，等待保險(xiǎn)公司到現(xiàn)場(chǎng)勘查，甲方代為向保險(xiǎn)公司索賠，保險(xiǎn)公司實(shí)行40%的絕對(duì)免賠率，理賠缺乏局部由乙方承當(dāng)。Incaseofslightaccidentinnon-roadenviro____ent，PartyBshallreporttotrafficadministrationdepartmentortheinsurancepanyandwaitingfortheperambulation.PartyAshallberesponsibilityforclaiminginsuranceindemnification.Insurancepanydoesnottakeforty〔40〕percentexpensesoftotalaccidentexpense，soPartyBshallberesponsibleforallthedamagesasidefromtheinsuranceindemnifications.4、乙方租用甲方車(chē)輛發(fā)生各類(lèi)事故后的損失費(fèi)用，先由乙方支付，甲方按保險(xiǎn)公司理賠規(guī)定辦理索賠手續(xù)，且在保險(xiǎn)公司理賠后，由甲方退還給乙方。保險(xiǎn)公司免賠局部由乙方承當(dāng)。Incaseofvehicledamages，PartyBshallpaytotalexpensesfirstly.PartyAshallberesponsibleforclaiminginsuranceindemnificationsaccordingtotheproceduresandregulationsoftheinsurancepanyandrefundtheexactindemnificationstoPartyB.partyBshallberesponsibleforalldamagesasidefromtheinsuranceindemnifications.5、乙方如發(fā)生違背交通法規(guī)的嚴(yán)重違法和交通事故，造成保險(xiǎn)費(fèi)率的上浮局部，由乙方承當(dāng)。詳細(xì)上浮按保險(xiǎn)公司標(biāo)準(zhǔn)執(zhí)行。Incaseofseriousaccidentorvehicledamages，PartyA‘svehicleinsurancerategoupbyit，PartyBshallpaytheextraincreasedinsuranceexpensesaccordingtothecriterionofinsurancepany.6、由乙方指定的駕駛員造成各類(lèi)事故的車(chē)輛停駛和修理期間，甲方不免費(fèi)提供交換車(chē)；乙方要承當(dāng)事故車(chē)停駛、修理期間的租金。DuringtheprocessingoftheaccidentcausedbythedriverdesignatedbyPartyB，PartyBshallberesponsibleforthevehiclerentstill.PartyAdonotprovidefreesubstitutionvehicle.7、乙方發(fā)生行車(chē)事故，無(wú)論有無(wú)責(zé)任，均按事故修理費(fèi)的10%補(bǔ)償甲方車(chē)輛的殘值損失。Inanycaseofvehicledamages，PartyBshallpensatepartyAanamountatten〔10〕percenttotalexpensesfordamagecausedbyaccelerateddepreciation.8、乙方在租賃期間發(fā)生車(chē)輛喪失，須出示當(dāng)?shù)毓补芾聿块T(mén)出具的有效證明，由甲方向保險(xiǎn)公司辦理索賠手續(xù)。乙方必須承當(dāng)車(chē)輛喪失后原車(chē)型三個(gè)月的租賃費(fèi)和保險(xiǎn)公司賠償后缺乏局部的車(chē)輛損失費(fèi)。Iftheleasedvehicleisstolenduringtheleaseterm，PartyBshallprovideeffectiveevidenceissuedbyresidentsPoliceadministrationdepartment.AndPartyAshallberesponsibleforclaiminginsuranceindemnification.PartyBshallundertaketheresponsibilitiesofthree〔3〕monthsrentandalldamageexpensesasidefrominsuranceindemnifications.9、乙方必須嚴(yán)格遵守道路交通平安法和施行條例，確保行車(chē)的平安。如發(fā)生交通違法和交通事故或者被“電子警察”拍攝行為的，必須積極做好事后工作，自覺(jué)承受公安交警部門(mén)處理，并及時(shí)交納罰金，對(duì)于未繳納局部，甲方有權(quán)從押金中扣除。乙方歸還車(chē)輛7天以后，甲方退還乙方不計(jì)利息的押金余額。根據(jù)上海市機(jī)動(dòng)車(chē)第三者責(zé)任保險(xiǎn)費(fèi)率浮動(dòng)制度的規(guī)定，乙方必須承當(dāng)因?yàn)樯鲜鲈蛩恋乃廛?chē)輛保險(xiǎn)費(fèi)費(fèi)用上浮的責(zé)任。假如因?yàn)槲闯惺芄步痪块T(mén)處理而造成所作用車(chē)輛不能參加年度檢驗(yàn)，致使車(chē)輛被強(qiáng)迫停駛，乙方必須承當(dāng)相關(guān)責(zé)任和費(fèi)用。PartyBshallstrictlyabidebythetrafficlawandregulationsduringtheleaseterm.Incaseofbreachoftrafficregulationandlaw〔includingpoliceCCTV〕，PartyBshallberesponsibleforallrelatedpenaltyvoluntarily.PartyAhastherighttodeductthepenaltythatPartyBhasnotpaidfromthedeposit.PartyBwillberefundedthedepositwithoutinterestsafter7workingdaysoftheleasedcarreturned.AccordingtothefloatingregulationofShanghaithirdpersonliabilityriskinsurance，PartyBshallundertaketheresponsibilitiesfortheincreasedinsuranceexpensescausedbythereasonmentionedabove.Moreover，PartyBshallberesponsibilitiesforpenaltyandexpensesiftheleasedvehiclecannotpassannualcheckandevenarestoppedrunning.五、違約責(zé)任LiabilitiesofBreachingtheContracts1、乙方假如不履行合同條款，甲方有權(quán)收回車(chē)輛，終止合同，并有權(quán)收取賠償金。PartyAhastherighttoterminatethecontractandtakebacktheleasedvehicleifPartyBfailstocarryouthisimportantobligationsunderthiscontractandmayclaimindemnificationfromPartyB.2、合同期滿后，乙方未辦理延期手續(xù)，也未按時(shí)歸還甲方車(chē)輛的，甲方有權(quán)提交司法機(jī)關(guān)，依法處理。給甲方造成經(jīng)濟(jì)損失的，按合同第一條第4款予以賠償。3、在合同期內(nèi)因乙方原因提早終止合同，乙方須首先付清實(shí)際租賃期間的相關(guān)費(fèi)用并賠償相關(guān)費(fèi)用。租期壹月及壹月以上的，賠償甲方不低于合同總金額的30%費(fèi)用，租期壹周以上壹月以內(nèi)的支付合同未履行局部總租金40%的費(fèi)用補(bǔ)償給甲方。IncaseofterminatethecontractinadvancecausedbyPartyB，heshallpaythetotalrentandberesponsibleforrelatedexpenses.PartyBshallpayTen〔30〕percentpenaltyofthetotalrentiftheleasedtermcoversonemonthorabove.AndPartyBshallpaytoPartyATwenty〔40〕percentpenaltyoftheremainingrentiftheleasedtermcoversOneWeektoOneMonth.4、乙方應(yīng)嚴(yán)格按照本合同履行其義務(wù)，由于乙方未能完善履行其義務(wù)而造成的損失，均由乙方自行承當(dāng)，造成甲方任何損失，乙方應(yīng)付賠償責(zé)任。PartyBshallstrictlycarryouthisresponsibilitiesofthiscontractandbeartotalresponsibilitiesvoluntaryfordamagesandexpensescausedbyinpletelyfulfillingresponsibilities.AndPartyAisentitledtoclaimindemnificationsfromanydamagescausedbyPartyB.六、其他Others1、本車(chē)使用93型號(hào)燃料，因未使用指定燃料造成的車(chē)輛損失等后果由乙方承當(dāng)。車(chē)輛燃料費(fèi)用由乙方自理。還車(chē)時(shí)，假設(shè)車(chē)內(nèi)存油低于出廠時(shí)存油，乙方要按市場(chǎng)價(jià)向甲方繳納所差油費(fèi)。Theleasedvehiclesuits93〔model〕gasoline.PartyBshallbearalldamagescausebymisusinggasoline.PartyBitselfshalltakethegasolinecostduringleasedtermandpaythebalancegasolinefeeparewithoutetimeaccordingtothetemporalgasolineprice.2、因車(chē)輛行駛中發(fā)生故障給乙方造成保險(xiǎn)責(zé)任范圍以外的經(jīng)濟(jì)損失，甲方不予負(fù)責(zé)。PartyAdoesnottakeresponsibilitiesforPartyB‘sdamagesoutofinsuranceforcecausedbymachineconkout.3、履行合同中發(fā)生異議的，由雙方協(xié)商解決，協(xié)商不成而提出訴訟，由甲方所在地人民法院受理。Anydisputesarisingfromorinconnectionwiththiscontractshallbesettledthroughamicableconsultation.Incasenosettlementisreachedthroughconsultations，thetwopartiesagreetoreferthedisputestothePeople‘scourtforsettlementinPartyA’sarea.4、合同期間，乙方司機(jī)發(fā)生電子警察違章抄報(bào)者，乙方應(yīng)積極配合處理違章，否那么甲方有權(quán)按乙方租賃時(shí)登記司機(jī)的駕駛證上報(bào)交通管理部門(mén)，由交通管理部門(mén)負(fù)責(zé)催辦，直至撤消駕駛證，其后果由乙方自負(fù)。IncaseofrecordedbyPoliceCCTV，thedriversdesignatedbyPartyBshallpositivelytakethetreatmentandpaythepenaltyintime.Otherwise，PartyAisentitledtoreportthedrivers‘informationtotrafficadministrationofficeandaskforinsistence.PartyBshallbeartheresponsibilitiestothedamagesincludingrevokingdriverlicense.5、本合同自雙方簽字蓋章后立即生效，合同壹式貳份，雙方各執(zhí)壹份。Thiscontracthasitslegaleffectafterbothofthepartiessignature.Thiscontractisdoneindupli
