ChapterIGeneralProvisions

Article1Purpose

Inordertoensuretheemergencyequipmentanddevicecanplayaroleintheemergencyresponseandrescue,regulatethemanagementofemergencyequipmentanddevice,thisregulationisformulated.

Article2Scopeofapplication

Thisregulationappliestoalltypesofenterprises,publicinstitutions,andotherorganizationsthatstore,useormanageemergencyequipmentanddevices.

Article3Definition

Emergencyequipmentanddevicereferstotoolsandequipmentusedinemergencyincidents,includingbutnotlimitedtofirefightingequipment,medicalequipment,rescueequipment,communicationequipment,protectivegear,andlightingequipment.

ChapterIIClassificationandManagementofEmergencyEquipmentandDevices

Article4Classificationofemergencyequipmentanddevices

(1)Firefightingequipment:includingfireextinguishers,firehoses,waterpumps,sprinklersystems,foamextinguishingagents,andotherfirefightingequipment.

(2)Medicalequipment:includingfirstaidkits,automaticdefibrillators,resuscitators,andothermedicalequipment.

(3)Rescueequipment:includingropes,ladders,hooks,stretchers,inflatableboats,andotherrescueequipment.

(4)Communicationequipment:includingwalkie-talkies,emergencyphones,satellitephones,andothercommunicationequipment.

(5)Protectivegear:includinghelmets,respirators,protectivegloves,protectiveglasses,andotherprotectivegear.

(6)Lightingequipment:includingemergencylights,flashlights,searchlights,andotherlightingequipment.

Article5Managementofemergencyequipmentanddevices

(1)Theunitthatisresponsiblefortheemergencymanagementshouldestablishaspecialemergencyequipmentanddevicemanagementinstitution.

(2)Emergencyequipmentanddevicemanagementshouldbeincludedintheunit’semergencymanagementsystemandtherelevantregulationsandstandardsshouldbeformulated.

(3)Emergencyequipmentanddevicesshouldbepurchasedaccordingtorelevantnationalstandardsandshouldundergoperiodicalinspectionandmaintenance.

(4)Emergencyequipmentanddevicesshouldbestoredinadedicatedarea,andusageinstructionsshouldbeclearlyposted.

(5)Emergencyequipmentanddevicesshouldberegularlyinspectedbystaffresponsibleformanagement,regardingtheintegrityandeffectivenessoftheequipment.

(6)Regulardrillsandexercisesshouldbecarriedout,andtheemergencyequipmentanddevicesshouldbedeployedinstrategicpositionsforquickandeasyaccessintheeventofemergencysituations.

(7)Thereplacementanddisposalofemergencyequipmentanddevicesshouldbedoneinaccordancewithrelevantnationalstandards.

ChapterIIIResponsibilityandObligationsofEmergencyEquipmentandDeviceManagement

Article6Responsiblepartiesforemergencyequipmentanddevicemanagement

(1)Thelegalrepresentativeofanenterpriseorthepersoninchargeofapublicinstitutionorotherorganizationhastheoverallresponsibilityforthemanagementofemergencyequipmentanddevices.

(2)Thecentralmanagementinstitutionoradesignatedpersonshouldspecificallymanagetheemergencyequipmentanddevices.

Article7Obligationsofemergencyequipmentanddevicemanagement

(1)Emergencyequipmentanddevicesmustbewell-maintainedandmanagedinaccordancewithnationalstandards.

(2)Regularchecksshouldbecarriedouttoverifytheintegrityandfunctionalityofequipment,andanydamageshouldberepairedorreplacedimmediately.

(3)Intheeventofanemergencysituation,theemergencyequipmentanddevicesshouldbepromptlydeployed.

(4)Riskassessmentsshouldbecarriedoutregularly,andadjustmentsshouldbemadewhererisksareidentified.

(5)Trainingforemployeesontheusage,care,andmaintenanceofemergencyequipmentanddevicesshouldbeconductedregularly.

ChapterIVInvestigationandHandlingofViolations

Article8Investigationofviolations

(1)Anyviolationoftheemergencyequipmentanddevicemanagementregulationsorrelevantnationalstandardswillbesubjecttoinvestigation.

(2)Thecentralmanagementinstitutionoradesignatedpersonwillberesponsiblefortheinvestigation.

Article9Handlingofviolations

(1)Anyviolationcanbepunisheddependingontheseriousnessoftheviolation.

(2)Thespecificmethodofpunishmentwillbedeterminedbythecentralmanagementinstitutionoradesignatedpersoninaccordancewithregulationsandstandards.
