evantmatters.投標(biāo)人須在提交投標(biāo)文件前視察工程現(xiàn)場，并被視為對投標(biāo)事宜構(gòu)成影響的現(xiàn)場、鄰近建筑物位置、性質(zhì)及情況、信道、工作空間及其它一切有關(guān)事項完全了解清楚。(21)Thetenderershallunderstandclearlythoseworkscurrentlyunderconstructionorexistingbuildingsclosetothesite.Thetenderershallmakesufficientconsiderationandtakeanynecessaryspecialprotectionmeasurestoavoiddamagessuchasfalling,settlement,shakeormovementstothebuildingsclosetothesiteduringtheconstruction.ThetenderershallcoordinatewithallthecontractorsemployedbytheEmployerforthescopeofthisproject.投標(biāo)人須清楚知道施工地點附近正在進行建筑的工程或現(xiàn)有建筑物，投標(biāo)人應(yīng)作出充份的考慮，并采取一切所需要的特別保護措施以避免因工程施工過程中引致施工地點附近的建筑物倒塌、下陷、震蕩和移動等損害。投標(biāo)人須與本工程施工范圍內(nèi)所有由雇主雇用的承包人互相協(xié)調(diào)和配合，使工程順利進行。本地塊鄰近地鐵站，因地鐵公司有明文規(guī)定，不容許在地鐵結(jié)構(gòu)物一定距離范圍內(nèi)，進行任何地基基礎(chǔ)施工。鐵孔時須遵守地鐵公司對隧道/站沿線施工所定的守則及規(guī)范，以免影響地鐵結(jié)構(gòu)。(22)Thetenderershall,beforesubmissionoftender,dispatchhisstafftoinvestigatethelocation,workingspace,accessroad,andthesiteconditionsforeachdrillhole,toensurinvestigationworkcouldbecarriedoutforeachdrillhole.Thetenderershallnotclaimformoneyorextensionoftimebecauseofneglectormisunderstandingtheconditionsofthesite.在呈上標(biāo)書前，投標(biāo)人必需派員到工地視察每一個鉆孔的位置、工作空間、進出信道及現(xiàn)場實際情況，以確保每一個鉆孔可進行勘察工作。投標(biāo)人不能因忽視或誤解工地情況而提出額外索償或延長工期。(23)Thetenderershallstrictlycomplywiththerequirementsofthetenderdocuments.Ifthetendererfailstocomplysomerequirements,heshalllistindetail,i?temizeandcomparesuchdiscrepanciesfromthetenderdocumentsuponsubmissionoftender.IfthetendererdoesnotnotifytheEmployersuchdiscrepanciesuponsubmissionoftender,orthetenderermisunderstandtheaboveinanyway,anyclaimsonsuchgroundswillnotbeconsidered投標(biāo)人必須嚴格地符合招標(biāo)文件之要求，如投標(biāo)人未能符合招標(biāo)文件內(nèi)某些要求，應(yīng)在投標(biāo)時附函詳列，分項說明及對照該等與招標(biāo)文件不符之差異。如投標(biāo)人沒有于投標(biāo)時按上述要求把該等差異以書面知會雇主，或任何對上述之誤解，由此引起之索賠將不受理。2FormofTender投標(biāo)書Note：Inallcases,thetenderermustgivetheregistrationnumber,dateofissue,registeredaddressandtheissuinginstitutionoftheirbusinesslicenseandinvestigationqualificationcertificate:注：在任何情況下，投標(biāo)人必須在此填寫其營業(yè)執(zhí)照及勘察證書的注冊編號、簽發(fā)日期、注冊地址及發(fā)照機關(guān)：1)I/We,havingexaminedtheConditionsofContractsincludingGeneralandSpecialConditionsofContract,SpecificationandBillsofQuantitiesfor,doherebyoffertoundertaketheresponsibilityrequestedintheTenderDocuments,includingbutnotlimitedtothematerialsupply,machinery,transportation,installation,tests,executionofsiteinvestigationworksandsubmissionofinvestigationreports(hereinafterreferredtoas“theWorks”)allinaccordancewiththeTenderDocumentsforthesumofRenminbi(USD).orsuchsumsasmaybeascertainedinaccordancewiththerelevantConditionsofContract.審查生產(chǎn)設(shè)備項目合同條款包括合同標(biāo)準條款及合同專用條款、圖紙、技術(shù)規(guī)范及工程量清單之后，我司愿按上述招標(biāo)文件及按人民幣美元(USD)的金額，或按上述有關(guān)合同條款所確定的其它金額，承擔(dān)招標(biāo)文件要求的責(zé)任包括但不限于整個工程的物料供應(yīng)、機械、運送、安裝、測試、進行地質(zhì)勘察工程及提交勘探報告（以下簡稱“本工程”）。2)Ifmy/ourtenderisaccepted,I/Weguarantee:如果我司的投標(biāo)書被接受，我司保證：2.1Thecontractshallbecommencedonthe5thcalendardays(excludingthedayofissueoftheorder)ofreceiptoftheEmployer’sortheEmployerRepresentative’sordertocommencetheWorks.在雇主或其代表簽發(fā)出開工指令起計第五個日歷天（不包括簽發(fā)指令的當(dāng)天）開始計算合同工期。2.2ThecontractualperiodoftheWorkshallbe70calendardays.Thecontractualperiodincludesbutisnotconfinedtoanypreparationworks,deliveryofmechanicalequipment,anyapplicationtorelateddepartments,siteinvestigationworks,submissionofinvestigationandtestreportsandthetimeneededfortheexaminationandapprovalbyrelateddepartments.本工程合同工期為70個日歷天。合同工期包括但不限于任何準備工作、施工機械進場、向有關(guān)部門的任何申請、進行地質(zhì)勘察工程、提交勘探及試驗報告及有關(guān)部門審批等所須的時間。3)I/WeagreetoabidebythisTenderforaperiodof90calendardaysorwithintheextendedperiodapprovedbymyself/ourselvesafterthatperiod(“Expiration”forshort)commencingfromthespecifieddateoftender.Thetendershallremainbindinguponme/usandmaybeacceptedbytheEmployeratanytimebeforetheexpirationofthatperiod.我司同意在從指定的回標(biāo)日期起的90個日歷天或其后經(jīng)我司同意延長的時間內(nèi)（以下簡稱”期限”）遵守本投標(biāo)書。在此期限屆滿之前，本投標(biāo)書仍然對我司具有約束力，并可隨時被雇主接受。4)UnlessanduntilaformalAgreementispreparedandexecutedthisTendertogetherwiththeletterofawardissuedbytheEmployerorhisrepresentativewithintheperiodmentionedinClause3hereof,shallconstituteabindingcontractbetweenus.直到制訂并簽署正式合同文件前，由雇主或雇主代表在本投標(biāo)書第3.條所述的期限內(nèi)發(fā)出的中標(biāo)通知書將成為我司與雇主雙方之間具有約束力的合約。5)I/WeunderstandthatitisyourintentionnottocreateanycontractualrelationsinthisinvitationtotenderuntiltheawardoftheContractandyouarenotboundtoacceptthelowestoranyTender.我司知道雇主無意在招標(biāo)階段與任何投標(biāo)人建立合約關(guān)系。而雇主亦無義務(wù)必須接受所收到的價格最低的或其它任何投標(biāo)書。Clause2TheEmployershallprovidethefollowingdocumentsintimetotheInvestigator,andberesponsibleforitsprecisenessandreliability.第二條：發(fā)包人應(yīng)及時向勘察人提供下列文件資料，并對其準確性、可靠性負責(zé)。3.2.1ProvidetheProjectApprovalDocument(photocopy),andsiteplan(boundaryofredline),permitssuchasconstructionpermit,investigationpermit(photocopy).3.2.1提供本工程批準文件（復(fù)制件），以及用地（附紅線范圍）、施工、勘察許可等批件（復(fù)印件）。3.2.2ProvideInvestigationTaskAssignmentDocument,technicalrequirementandtopographicchartforthescopeofwork,architecturalmasterl
