退款協(xié)議書(shū)英文

RefundAgreement

ThisRefundAgreement(hereinafterreferredtoasthe"Agreement")isenteredintobyandbetween[Seller/CompanyName],locatedat[CompanyAddress],and[CustomerName],locatedat[CustomerAddress],collectivelyreferredtoasthe"Parties".

WHEREAS,thePartieshaveenteredintoaprioragreementforthesaleandpurchaseofgoodsorservices(hereinafterreferredtoasthe"Contract");

WHEREAS,arefundisrequestedbytheCustomerduetocertaincircumstances;

NOW,THEREFORE,inconsiderationofthemutualpromisesandcovenantscontainedherein,thePartiesagreeasfollows:

1.RefundAmount

TheSelleragreestorefundtheCustomerthesumof[Amount][Currency],whichrepresentsthetotalamountpaidbytheCustomerundertheContract.

2.RefundMethod

Therefundshallbemadeby[PaymentMethod],tothe[BankName]accountprovidedbytheCustomer.TheSellershallinitiatetherefundwithin[Number]businessdaysupontheexecutionofthisAgreement.

3.RefundConditions

3.1Therefundshallonlybeapplicableinthefollowingcircumstances:

-Non-deliveryofgoodsorservicesasspecifiedintheContract;

-DefectivegoodsorservicesthatdonotconformtothespecificationsoutlinedintheContract;

-CancellationoftheContractinaccordancewiththetermsandconditionsagreeduponbybothParties.

3.2TheCustomershallbeartheresponsibilityofnotifyingtheSelleroftherefundrequestwithin[Number]daysfromtheoccurrenceoftheeventgivingrisetotherefundclaim.FailuretodososhallresultinthewaiveroftheCustomer'srighttoclaimarefund.

4.ReleasefromLiability

Uponreceiptoftherefund,theCustomeracknowledgesthattheSellerhasfulfilledallobligationsrelatedtotherefundclaim,andreleasestheSellerfromanyfurtherliabilityrelatingtotheContract.

5.GoverningLawandJurisdiction

ThisAgreementshallbegovernedbyandinterpretedinaccordancewiththelawsofthe[Jurisdiction].AnydisputearisingunderorinconnectionwiththisAgreementshallbesubjecttotheexclusivejurisdictionofthecourtsof[Jurisdiction].

6.EntireAgreement

ThisAgreementconstitutestheentireagreementbetweenthePartiesandsupersedesallpriororalorwrittenagreements,understandings,orrepresentations.

INWITNESSWHEREOF,thePartieshaveexecutedthisRefundAgreementasoftheEffectiveDate.
