Quarantine案例我國某制造廠進口一套設(shè)備，合同規(guī)定，貨到后，由中國商檢局進行檢驗，合同還明確規(guī)定：賣方提供的是“全新設(shè)備”。在到貨檢驗安裝過程中，發(fā)現(xiàn)設(shè)備中部分部件有使用過的痕跡，于是憑商檢局出具的商檢證書向外商索賠。起初，外商矢口否認其提供的設(shè)備有問題，拒絕理賠。后來，中方邀請外商的總裁來現(xiàn)場看貨，經(jīng)中方強調(diào)合同中訂有“全新設(shè)備”條款和中國商檢局出具的證明是有效的。在中方有理有據(jù)的情況下，外商終于賠償買方50萬美元。啟示通過上述案例，說明進出口貨物檢驗的重要性，只要在買賣合同中明確合理地規(guī)定檢驗條款，并按約定的條款認真檢驗，一旦發(fā)現(xiàn)貨物不符合同規(guī)定，即可憑檢驗證明向責(zé)任方索賠，以維護合同當(dāng)事人的合法權(quán)益。I.IntroductiontoI&QIninternationaltrade,inspectioninstitutionsmustusu.examinethequality,quantity,packing,etc.ofthegoodsdeliveredbythesellertomakesurewhetherthegoodsareinconformitywiththestipulationsofthecontractandL/C,orinspectsafetyandsanitationconditions(衛(wèi)生條件),environmentalandlaborprotectionconditionsastothegoods,orquarantineplantsandanimals(動植物檢疫)inaccordancewiththerelativelawsanddecreesofthecountry.Receiptmeansthatthegoodshavecomeintothecontrolofthebuyerwithoutownershiporagreementtoanyaspectofthegoods.Acceptancemeansthatthebuyerhasthecontrolofthegoodswithconsentregardingthegoodsdelivered.ReceiptandacceptanceReceiptdoesnotmeanacceptanceandacceptance
