買房定金簽字合同協(xié)議書合同目錄第一章:合同雙方第二章:定義與解釋第三章:房屋信息第四章:定金支付第五章:定金的處理第六章:合同的履行第七章:違約責(zé)任第八章:爭議解決第一章:合同雙方1.1合同甲方(買方)1.1.1甲方姓名/名稱:1.1.2甲方身份證號碼/統(tǒng)一社會信用代碼:1.1.3甲方聯(lián)系地址:1.1.4甲方聯(lián)系電話:1.2合同乙方(賣方)1.2.1乙方姓名/名稱:1.2.2乙方身份證號碼/統(tǒng)一社會信用代碼:1.2.3乙方聯(lián)系地址:1.2.4乙方聯(lián)系電話:第二章:定義與解釋2.1合同術(shù)語2.1.1“房屋”指本合同附件一所列明的房產(chǎn)。2.1.2“定金”指甲方按照本合同約定支付給乙方的購房誠意金。2.1.3“合同總價”指甲方購買房屋的總金額。2.1.4“合同履行”指甲方支付購房款,乙方交付房屋并辦理過戶手續(xù)的行為。第三章:房屋信息3.1房屋基本情況3.1.1房屋坐落:3.1.2房屋所有權(quán)證號:3.1.3房屋面積:3.1.4房屋結(jié)構(gòu):3.1.5房屋用途:第四章:定金支付4.1定金金額4.1.1定金金額為人民幣(大寫):元整(小寫):¥元。4.2定金支付方式(1)現(xiàn)金支付;(2)銀行轉(zhuǎn)賬;(3)其他支付方式:4.3定金支付時間4.3.1甲方應(yīng)在簽訂本合同之日起日內(nèi)支付定金。第五章:定金的處理5.1定金抵扣購房款5.1.1在甲方支付合同總價時,定金自動抵扣部分購房款。5.2定金退還5.2.1在合同履行完畢后,乙方應(yīng)在日內(nèi)將定金退還給甲方。第六章:合同的履行6.1甲方義務(wù)6.1.1甲方應(yīng)按照本合同約定的期限和金額支付購房款。6.1.2甲方應(yīng)配合乙方辦理房屋過戶手續(xù)。6.2乙方義務(wù)6.2.1乙方應(yīng)保證房屋權(quán)屬清晰,無產(chǎn)權(quán)糾紛。6.2.2乙方應(yīng)在合同約定的時間內(nèi)交付房屋并辦理過戶手續(xù)。第七章:違約責(zé)任7.1甲方違約7.1.1如甲方未按合同約定支付定金或購房款,應(yīng)支付違約金。7.2乙方違約7.2.1如乙方未按合同約定交付房屋或辦理過戶手續(xù),應(yīng)支付違約金。第八章:爭議解決8.1協(xié)商解決8.1.1合同履行過程中如發(fā)生爭議,雙方應(yīng)通過友好協(xié)商解決。8.2訴訟解決8.2.1如協(xié)商無果,任何一方均有權(quán)向合同簽訂地人民法院提起訴訟。第九章:房屋交付9.1交付時間9.1.1乙方應(yīng)在本合同約定的交付日期前,將房屋及其附屬設(shè)施交付給甲方。9.2交付標(biāo)準(zhǔn)(1)房屋結(jié)構(gòu)安全,無漏水、裂縫等質(zhì)量問題;(2)房屋內(nèi)部設(shè)施齊全,能夠正常使用;(3)房屋及其附屬設(shè)施與合同附件描述相符。第十章:房屋過戶10.1過戶手續(xù)10.1.1乙方應(yīng)在交付房屋后,按照相關(guān)法律規(guī)定與甲方共同辦理房屋過戶手續(xù)。10.2過戶費(fèi)用10.2.1房屋過戶所產(chǎn)生的稅費(fèi),按照國家相關(guān)規(guī)定由雙方各自承擔(dān)。第十一章:房屋質(zhì)量保證11.1質(zhì)量保證期限11.1.1乙方保證房屋質(zhì)量,自房屋交付之日起計算,保證期限為年。11.2質(zhì)量問題處理11.2.1在質(zhì)量保證期限內(nèi),如房屋出現(xiàn)質(zhì)量問題,乙方應(yīng)負(fù)責(zé)修復(fù)。第十二章:物業(yè)交接12.1物業(yè)資料移交12.1.1乙方應(yīng)在房屋交付時,將物業(yè)相關(guān)資料移交給甲方。12.2物業(yè)費(fèi)用結(jié)算12.2.1乙方應(yīng)結(jié)清至房屋交付日期前的物業(yè)管理費(fèi)、水電費(fèi)等費(fèi)用。第十三章:合同變更與解除13.1合同變更13.1.1雙方經(jīng)協(xié)商一致,可以變更本合同內(nèi)容,并簽訂書面變更協(xié)議。13.2合同解除(1)雙方協(xié)商一致;(2)法律規(guī)定應(yīng)當(dāng)解除合同的其他情形。第十四章:不可抗力14.1不可抗力定義14.1.1本合同所稱不可抗力,是指不能預(yù)見、不能避免并不能克服的客觀情況。14.2不可抗力處理14.2.1因不可抗力導(dǎo)致合同無法履行時,受影響的一方應(yīng)立即通知對方,并采取合理措施減輕損失。第十五章:其他條款15.1合同效力15.1.1本合同自雙方簽字(或蓋章)之日起生效,對雙方具有法律約束力。15.2合同副本15.2.1本合同一式兩份,甲乙雙方各執(zhí)一份,具有同等法律效力。附件:附件一:房屋基本信息表附件二:房屋交付標(biāo)準(zhǔn)及附屬設(shè)施清單附件三:物業(yè)交接資料清單簽字部分:甲方(買方)簽字/蓋章:_________日期:____年____月____日乙方(賣方)簽字/蓋章:_________日期:____年____月____日______________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________
