鑒于甲方為乙方提供商品混凝土（以下簡稱“商砼”），為確保雙方權益，經甲乙雙方友好協(xié)商，特訂立本合同，以便共同遵守。

第一條商品混凝土的供應

1.1甲方同意在合同有效期內，向乙方供應商砼。

1.2乙方應在本合同簽訂后3個工作日內，向甲方支付預付款人民幣【】元整。

1.3商砼的供應數量、供應周期、供應地點等事項，詳見附件。

第二條商品混凝土的質量和驗收

2.1甲方應按照國家標準和行業(yè)規(guī)范，保證供應的商砼質量。

2.2乙方應在商砼到達施工現場后及時進行驗收，并在驗收合格后進行使用。

2.3如乙方對甲方供應的商砼質量有異議，應在驗收合格后24小時內書面通知甲方，并提供相關證據。甲方應在接到通知后24小時內，派員赴現場進行調查和處理。

第三條價格和支付

3.1商砼的價格為人民幣【】元/立方米，具體價格詳見附件。

3.2乙方應按照本合同約定的付款方式和付款時間，向甲方支付商砼款項。

3.3乙方逾期支付款項的，應按照逾期金額的0.05%支付違約金。

第四條deliveryandacceptance

第五條Warranty

5.1甲方shallensurethequalityoftheconcreteproductssuppliedconformstonationalstandardsandindustryregulations.

5.2乙方shallinspecttheconcreteproductsuponarrivalattheconstructionsiteandusethemonlyafterpassingtheacceptance.

5.3If乙方hasanyobjectionstothequalityoftheconcreteproductssuppliedby甲方,乙方shallnotify甲方inwritingwithin24hoursaftertheacceptance,andproviderelevantevidence.甲方shallsendpersonneltothesiteforinvestigationandhandlingwithin24hoursafterreceivingthenotice.

第六條PriceandPayment

6.1Thepriceoftheconcreteproductsis人民幣【】yuanpercubicmeter,andthespecificpriceisdetailedintheattachment.

6.2乙方shallpaythe款項duefortheconcreteproductsaccordingtothepaymenttermsandmethodsspecifiedinthiscontract.

第七條Default

7.1Ifeitherpartyfailstoperformitsobligationsunderthiscontract,theotherpartymayterminatethiscontractandclaimdamages.

7.2Ifanydisputesariseduringtheperformanceofthiscontract,bothpartiesshallresolvethemthroughfriendlynegotiation.Ifnegotiationfails,eitherpartymaysubmitthedisputetothepeople'scourtwithjurisdictionovertheplacewherethecontractisperformed.

第八條Miscellaneous

8.1Thiscontractshallbecomeeffectiveuponthesigningofbothpartiesandshallbevalidfor【】daysfromthedateofsigning.
