冬日里的安全守護(hù)誓言合同編號(hào)：__________鑒于甲方為充分保障其在冬季期間的安全，確保財(cái)產(chǎn)不受損失，humanizedlanguage，andtoensurethesafetyofthepartiesinvolved,thefollowingtermsandconditionsarehereestablishedandagreeduponbothparties:Article1:ScopeofServices1.1The乙方shallprovidethefollowingservicestothe甲方：(a)Dailyinspectionofthepremisestoensurenohazardsordangerousconditionsexist;(b)Appropriatemeasurestobetakenintheeventofsnowfall,iceaccumulationoranyotherweatherrelatedincidents;(c)Ensuringtheheatingsystemisfunctioningproperlyandmaintainingasafetemperatureinsidethepremises;(d)Regularmaintenanceandchecksonthefirealarmsystemandemergencyexitstoensuretheyareinproperworkingcondition;(e)Anyotherservicesasagreeduponbothparties.1.2The乙方shallhavetherighttoenterthepremisesduringthetermofthisagreementtoperformtheservicesagreedupon.Article2:DutiesandResponsibilities2.1The甲方shall:(a)Providethe乙方withallnecessaryinformationregardingthepremisesanditsoccupants;(b)Cooperatewiththe乙方inperformingtheservices;(c)Ensurethatnohazardousmaterialsorsubstancesarekeptonthepremises;(d)Complywithallapplicablelaws,regulationsandstandardsinrelationtosafetyandsecurity.2.2The乙方shall:(a)Performtheserviceswithduecareandskill,inaccordancewithapplicablelaws,regulationsandstandards;(b)Immediatelyreportanyhazards,dangerousconditionsorotherissuestothe甲方;(c)Takeappropriateactiontomitigateanyrisksordangersidentifiedonthepremises;(d)Maintainaccuraterecordsofallservicesperformedandinspectionsconducted.Article3:TermandTermination3.2eitherpartymayterminatethisagreementatanytimegivingthirty(30)days'writtennoticetotheotherparty.Article4:Payment4.1The甲方agreestopaythe乙方thesumof$__________(the"Fee")fortheservicesrenderedunderthisagreement.4.2TheFeeshallbepaidthe甲方withinthirty(30)daysafterthereceiptofthe乙方'sinvoice.Article5:Indemnification5.1The乙方shallindemnifyandholdharmlessthe甲方againstanyandallclaims,demands,liabilities,losses,damagesandexpenses(includingreasonableattorney'sfees)arisingoutoforinconnectionwiththeperformanceoftheservicesunderthisagreement,excepttotheextentcausedthenegligenceorwillfulmisconductofthe甲方.5.2The甲方shallindemnifyandholdharmlessthe乙方againstanyandallclaims,demands,liabilities,losses,damagesandexpenses(includingreasonableattorney'sfees)arisingoutoforinconnectionwiththeuseofthepremisesthe甲方,excepttotheextentcausedthenegligenceorwillfulmisconductofthe乙方.Article6:GoverningLawandJurisdiction6.1ThisagreementshallbegovernedandconstruedinaccordancewiththelawsoftheStateof________________.6.2AnydisputesarisingoutoforinconnectionwiththisagreementshallbesubmittedtotheexclusivejurisdictionofthecourtsoftheStateof________________.Article7:EntireAgreementThisagreementconstitutestheentireagreementbetweenthepartiesandsupersedesallprioragreements,understandingsandrepresentations,whetherwrittenororal,betweentheparties.INWITNESSWHEREOF,thepartieshaveexecutedthisagreementasofthedatefirstabovewritten._________________________Name:____________________Title:____________________Address:__________________Phone:_____________________________________________Name:____________________Title:____________________Address:__________________Phone:____________________一、附件列表：1.甲方場(chǎng)所詳細(xì)信息2.乙方服務(wù)記錄和檢查報(bào)告3.安全和緊急程序手冊(cè)4.保險(xiǎn)證明文件5.乙方員工身份和資質(zhì)證明6.甲方財(cái)產(chǎn)清單7.乙方服務(wù)設(shè)備和工具清單8.合同執(zhí)行期間的所有通訊記錄二、違約行為及認(rèn)定：1.乙方未能按照約定提供服務(wù)或服務(wù)不符合約定標(biāo)準(zhǔn)的，視為違約。2.甲方未能按照約定支付費(fèi)用的，視為違約。3.雙方未能履行合同中的其他義務(wù)的，視為違約。4.違約行為的認(rèn)定應(yīng)基于合同條款和適用的法律規(guī)定。三、法律名詞及解釋：1.甲方：指合同中指定的權(quán)利義務(wù)主體。2.乙方：指合同中指定的權(quán)利義務(wù)主體。3.服務(wù)：指乙方根據(jù)合同約定向甲方提供的各項(xiàng)保障和安全服務(wù)。4.費(fèi)用：指甲方根據(jù)合同約定支付給乙方的報(bào)酬。5.違約：指合同一方或雙方未能履行合同約定的義務(wù)。四、執(zhí)行中遇到的問(wèn)題及解決辦法：1.服務(wù)不符合標(biāo)準(zhǔn)：及時(shí)與乙方溝通，要求乙方在規(guī)定時(shí)間內(nèi)整改達(dá)標(biāo)。2.支付費(fèi)用爭(zhēng)議：
