?甲方(用人單位)PartyA(Employer):_______________________法定代表人(主要負(fù)責(zé)人)_:__________聯(lián)系電話_:__________通訊地址_:_______________________郵政編碼_:__________乙方(勞動者)PartyB(Employee):_______________________性別_:__________身份證號碼_:_____________________________現(xiàn)住址_:____________________________聯(lián)系電話_:_______________________為建立勞動關(guān)系,明確雙方權(quán)利及義務(wù),依據(jù)中華人民共和國《勞動法》《勞動合同法》及有關(guān)規(guī)定,甲乙雙方遵循平等自愿、協(xié)商一致的原則訂立本合同。Article1.Definitions1."Employer"referstothePartythathirestheEmployeeandhastheobligationtopaytheEmployee'ssalary.2."Employee"referstothePartythatprovideslaborservicestotheEmployerandhastherighttoreceiveremuneration.Article2.WorkArrangementandDuties1.TheEmployeeshallbeengagedinthepositionof________________attheEmployer'sworkplace.2.TheEmployeeshallberesponsibleforperformingthedutiesassignedbytheEmployerwithinthescopeofhis/herposition,andshallabidebytheEmployer'sworkregulationsandethics.Article3.WorkingHoursandRest1.TheworkinghoursoftheEmployeeshallbeinaccordancewiththeprovisionsoftheEmployer'sworkinghourssystem.2.TheEmployeeshallbeentitledtorestandholidaysinaccordancewiththeprovisionsofthelawandtheEmployer'sregulations.Article4.WageandPayment1.TheEmployershallpaytheEmployeeasalaryaccordingtotheagreedamountandpaymentmethod.2.ThesalaryshallbepaidtotheEmployeeinaccordancewiththeprovisionsofthelawandtheEmployer'sregulations.Article5.SocialInsuranceandWelfare1.TheEmployershallpaytheEmployee'ssocialinsurancepremiumsaccordingtothelawandtheregulations.2.TheEmployeeshallbeentitledtosocialinsurancebenefitssuchasunemploymentinsurance,medicalinsurance,andwork-relatedinjuryinsuranceinaccordancewiththelawandtheregulations.3.TheEmployershallprovidetheEmployeewithwelfarebenefitssuchashousingprovidentfund,employeebenefits,andpaidleaveinaccordancewiththelawandtheregulations.Article6.TrainingandDevelopment1.TheEmployershallprovidetheEmployeewithnecessarytraininganddevelopmentopportunitiestoimprovetheEmployee'sprofessionalskillsandworkability.2.TheEmployeeshallactivelyparticipateintheEmployer'straininganddevelopmentactivitiesandstrivetoimprovehis/herownqualityandability.Article7.ConfidentialityandNon-Competition1.TheEmployeeshallkeeptheEmployer'stradesecretsandconfidentialinformationconfidentialandshallnotdiscloseorusethemwithouttheEmployer'spriorwrittenconsent.2.TheEmployeeshallnotengageinanyactivitiesthatpetewiththeEmployerduringtheemploymentperiodandaftertheterminationoftheemploymentrelationship.Article8.TerminationandDiscontinuationoftheEmploymentRelationship1.TheemploymentrelationshipbetweentheEmployerandtheEmployeemaybeterminatedordiscontinuedinaccordancewiththeprovisionsofthelawandthecontract.2.IftheEmployeeviolatestheprovisionsofthecontract,theEmployerhastherighttoterminatetheemploymentrelationshipwiththeEmployeeinaccordancewiththeprovisionsofthecontract.3.IftheEmployerviolatestheprovisionsofthecontract,theEmployeehastherighttorequesttheEmployertocontinuetheemploymentrelationshiporclaimdamagesinaccordancewiththeprovisionsofthecontract.Article9.DisputeResolution1.IfadisputearisesbetweentheEmployerandtheEmployeeduringtheperformanceofthecontract,thetwopartiesshallfirsttrytoresolveitthroughconsultationormediation.2.Ifthedisputecannotberesolvedthroughconsultationormediation,theEmployeemayfilealawsuitwiththelabordisputearbitrationmissionorthepeople'scourtinaccordancewiththelaw.Article10.OtherProvisions1.ThiscontractisthesupplementarydocumentoftheLaborContractconcludedbetweentheEmployerandtheEmployee.ThecontentsofthesupplementarydocumentareconsistentwiththeLaborContract.IfthecontentsofthesupplementarydocumentconflictwiththeLaborContract,thesupplementarydocumentshallprevail.2.Thiscontractismadeinduplicate,andeachpartyholdsonecopy.Thecontractisvalidfromthedateofsigningbybothparties.PartyA(Emplo
