30天注銷保單通知條款

被保險(xiǎn)人可隨時(shí)書面通知保險(xiǎn)人注銷本保險(xiǎn)單，保險(xiǎn)人將依照短期費(fèi)率計(jì)收保險(xiǎn)生效期間的保費(fèi)。保險(xiǎn)

人亦可提前三十天書面通知被保險(xiǎn)人注銷本保險(xiǎn)單，保險(xiǎn)人將退還被保險(xiǎn)人從保險(xiǎn)單取消之日起未滿期限的

按日比例計(jì)算的保險(xiǎn)費(fèi)。

Theinsurancemayatanytimebeterminatedattheoptionoftheinsurer,giving30days'noticetothateffectbeing

givingtotheinsured,inwhichcasetheCompanyshallbeliabletorepayondemandaratableproportionofthe

thedefenceorsettlementofsuchclaimandinnocaseshalltheReinsuredmakeanyadmissionofliabilityunderthe

共同被保險(xiǎn)人條款

鑒于組成被保險(xiǎn)人之各方當(dāng)事人為獨(dú)立的、不同的實(shí)體（不管本保單條文中是否有任何相關(guān)約定），各

方當(dāng)事人的一切權(quán)利也應(yīng)被視為獨(dú)立的，如同他們各自持有保障其各自權(quán)益的獨(dú)立保單一樣。任何一方未能

遵從、履行或遵守本保單的條款或條件，不會(huì)導(dǎo)致本保險(xiǎn)單其它各方的權(quán)利受損。

對(duì)本保險(xiǎn)單項(xiàng)下的任何索賠或保單明細(xì)表列明的自負(fù)責(zé)任之外的索賠，本公司將放棄向被保險(xiǎn)人任何一

方或其董事、代理、雇員或其他保單追償?shù)臋?quán)利。

Joint-InsuredClause

AsallthepartiescomprisingtheInsuredoperateasseparateanddistinctentitiestherightsofeachofthepartiesinall

respectsshall(notwithstandinganythingcontainedorimpliedhereintothecontrary)betreatedasthougheachofthe

partieshadseparatepoliciesfortheirrespectiverightsandinterests.

Notwithstandinganythinginthepolicytothecontrary,itisexpresslyunderstoodandagreedthatthefailureofany

Insuredpartytocomplywith,fulfillorobservethetermsandconditionsofthepolicyshallnotprejudicetherightsof

anyotherInsuredpartyorpartiesunderthepolicy.

TheCompanyherebyagreetowaiveallrightsofsubrogationoractionwhichtheymayhaveoracquireagainstany

ofthepartiescomprisingtheInsuredortheirdirectorsagentsoremployeesortheirinsurancearisingoutofany

occurrenceinrespectofwhichanyclaimisadmittedhereunderorwhichbutfortheapplicationofanyRetained

LiabilitymentionedintheScheduleofthispolicywouldbemadehereunder.

雙方認(rèn)可的有合法執(zhí)業(yè)資格的機(jī)構(gòu)作為公估人，公估費(fèi)用由保險(xiǎn)人承擔(dān)。

變更、保險(xiǎn)標(biāo)的危險(xiǎn)程度的增加或其它重要事項(xiàng)的變化而失效。但投保人、被保險(xiǎn)人一旦知道該情況，應(yīng)立

即通知保險(xiǎn)人，并支付從風(fēng)險(xiǎn)增加之日起至保險(xiǎn)期間屆滿之日止期間可能的額外保險(xiǎn)費(fèi)，否則保險(xiǎn)人不承擔(dān)

保險(xiǎn)責(zé)任。

經(jīng)雙方同意，發(fā)生保險(xiǎn)責(zé)任范圍內(nèi)損失，保險(xiǎn)人在收到被保險(xiǎn)人的索賠請(qǐng)求及相關(guān)單證資料之日起六十

天內(nèi)，未能確定賠償金額的，根據(jù)被保險(xiǎn)人的要求及公估人（理算師）的建議，保險(xiǎn)人可預(yù)先支付部分賠款，

金額限于預(yù)計(jì)賠償金額的40%。

分期付費(fèi)條款A(yù)/PremiumInstalImentClause

分期付費(fèi)條款A(yù)

經(jīng)雙方同意，本保險(xiǎn)合同項(xiàng)下保險(xiǎn)費(fèi)可以按照約定的分期支付日期和金額支付。

若投保人未按約定支付保險(xiǎn)費(fèi)，從應(yīng)付之日起至實(shí)際支付之日止的期間內(nèi)發(fā)生保險(xiǎn)責(zé)任范圍內(nèi)的損失

的，保險(xiǎn)人不承擔(dān)賠償責(zé)任。

投保人在付清本保險(xiǎn)合同項(xiàng)下全部保險(xiǎn)費(fèi)之前，如保險(xiǎn)標(biāo)的發(fā)生損失，保險(xiǎn)人應(yīng)支付的賠償金額超過投

ThePolicyshallprotecteachInsuredinthesamemannerandtothesameextentasthoughaseparatePolicyhad

beenissuedtoeach,butnothinghereinshalloperatetoincreasetheInsurer'sliabilityatsetforthelsewhereinthis

PolicybeyondtheamountoramountsforwhichtheInsurerwouldbeliableiftherehadbeenonlyoneInsured.Any

breachofaconditionofthisPolicybyanyInsuredshallnotaffecttheprotectiongivenbythisPolicytoanyother

Insured.

經(jīng)雙方同意，保險(xiǎn)人同意放棄對(duì)下列各方可能擁有的代位請(qǐng)求賠償?shù)臋?quán)利：

（一）被保險(xiǎn)人的關(guān)聯(lián)或聯(lián)營公司；

（二）被保險(xiǎn)人的子公司或控股公司；

（三）被保險(xiǎn)人的董事、合伙人；

（四）被保險(xiǎn)人的雇員。

本條款”2000年問題”系指，因涉及2000年日期變更，或此前、期間、其后任何其他日期變更，包括閏年的

計(jì)算，直接或間接引起計(jì)算機(jī)硬件設(shè)備、程序、軟件、芯片、媒介物、集成電路及其他電子設(shè)備中的類似裝

置的故障，進(jìn)而直接或間接引起和導(dǎo)致保險(xiǎn)財(cái)產(chǎn)的損失或損壞問題。

本公司對(duì)由于下列原因，無論計(jì)算機(jī)設(shè)備是否屬于被保險(xiǎn)人所有，直接或間接導(dǎo)致、構(gòu)成或引起保險(xiǎn)財(cái)產(chǎn)損

失或損壞由此產(chǎn)生的直接損失或間接損失不負(fù)賠償責(zé)任：

1）不能正確識(shí)別日期；

2）由于不能正確識(shí)別日期，以讀取、存儲(chǔ)、保留、檢索、操作、判別、處理任何數(shù)據(jù)或信息，或執(zhí)行命令和

指令；

3）在任何日期或該日期之后，由于編程輸入任何計(jì)算機(jī)軟件的操作命令引起的數(shù)據(jù)丟失，或不能讀取、儲(chǔ)

存、保留、檢索、正確處理該類數(shù)據(jù)；

4）因涉及2000年日期變更，或任何其他日期變更，包括閏年的計(jì)算而不能正確進(jìn)行計(jì)算、比較、識(shí)別、排

序和數(shù)據(jù)處理；

5）因涉及2000年日期變更，或任何其他日期變更，包括閏年的計(jì)算，對(duì)包括計(jì)算機(jī)、硬件設(shè)備、程序、芯

片、媒介物、集成電路及其他電子設(shè)備中的類似裝置進(jìn)行預(yù)防性的、治理性的、或其他性質(zhì)的更換、改變、

修改。

本保單所載其他條件不變。

44Year2000Problem”inthisclausemeansdirectorindirectlossordamagetopropertyarisingfrommalfunctionof

anycomputerhardware,system,software,chip,media,integratedcircuitandothersimilarelectronicdevicescaused

directlyorindirectlybythedatechangetotheYear2000oranyotherdatechangeincludingleapyearcalculations

occurringbefore,duringorafterYear2000.

TheCompanywillnotbeliablefordirectorindirectlossordamagetopropertycausedbyreasonsbelow,whether

suchcomputersystembelongstotheInsuredornot:

i)unabletorecognizedatecorrectly;

ii)failtoretrieve,capturesave,retain,search,manipulate,interpretorprocessanydataorinformationorcommand

orinstructionasaresultofunabletorecognizedatecorrectly;

iii)lossofdata,failtoretrieve,capturesave,retain,searchorprocessdatacorrectlyasaresultoftheoperationof

anycommandwhichhasbeenprogrammedintocomputersoftwareinanydateorafterthatdate;

iv)unabletocalculate,compare,differentiate,sequenceorprocessdatacorrectlyasaresultofchangingthedateto

Year2000oranyotherdateincludingleapyearcalculationsoccurringbefore,duringorafterYear2000;

v)anyimplementedorchangeormodificationofanycomputer,hardware,system,chip,media,integratedcircuit

andotherelectricaldevicefbrpreventative,remedialorotherwiserelatingtochangingthedatetoYear2000orany

otherdateincludingleapyearcalculationsoccurringbefore,duringorafterYear2000.

Subjectotherwisetotermsandconditionsofthispolicy.
