1、合同發(fā)包方（簡稱甲方）Party A: 承包方（簡稱乙方）Party B:根據(jù)中華人民共和國合同法以及其他有關(guān)法律法規(guī)規(guī)定的原則，甲、乙雙方在平等、自愿、協(xié)商一致的基礎(chǔ)上達(dá)成如下協(xié)議，共同遵守。Accord ing to“P.C Con tract Law”， and other releva nt laws and regulati ons to the sp ecific circumstances of this p roject, p arties A and B have hereby equally and volun tarily en tered into the follow

2、ing agreeme nt executed on the basis of mutual resp ect.1.工程概況P roject overview1.1 工程名稱:P roject n ame: 1.2 工程地點(diǎn):Project locatio n: 1.3 工程范圍:7.1 新研發(fā)中心和新廠房的網(wǎng)絡(luò)綜合布線系統(tǒng)的施工；7.2 數(shù)據(jù)中心的建設(shè)，主要包含：數(shù)據(jù)中心的裝飾工程、電氣系統(tǒng)、空調(diào)系統(tǒng)、機(jī)房閉 路監(jiān)控系統(tǒng)、機(jī)房門禁系統(tǒng)、消防系統(tǒng)改造、機(jī)柜系統(tǒng)等。P roject conten ts:9.The new R & D and new plant con struct io

4、the con tract, Party A has started adva nee and on-sitecon diti ons in p lace.工程施工合同Con tract合同編號簽訂日期(Co ntract NO.)(Date ):結(jié)合本工程的具體情況,合同Project cost: Total project cost is 詳細(xì)合同價格表見附件報價清單。Detailed con tract price list see attached quotatio n list.在詳細(xì)設(shè)計和施工過程中，若工程量發(fā)生變化，按合同單價相應(yīng)調(diào)整工程造價；若材質(zhì)發(fā)生變化，按雙方商定的補(bǔ)充協(xié)議

6、2.1 由乙方向甲方提供指定帳戶、甲方以支票方式或銀行轉(zhuǎn)賬方式向乙方結(jié)算合同款；Party B shall p rovide the desig nated acco unt to party A, Party A by check or bank tran sfer topay the con tract p ayme nt to Party B.2.2本合同生效后，甲方付給乙方合同總價的40%作為工程預(yù)付款，即Y _元;After the sig ning of this con tract, P arty A shall pay to P arty B 40% of the total

9、e con diti ons of this p roject have the time to start;1.5工程造價：合同工程總造價為Y元（CNY ）,人民幣大寫yua n ( CNY ).7 天以內(nèi)，甲方付給合同協(xié)助乙方辦理進(jìn)駐施工現(xiàn)場所需人員證件、批件等有關(guān)手續(xù)；To assist Party B to enter the construction site personnel required documents, approval documentsand other relevant procedures;c. 為乙方提供現(xiàn)場工程辦公室和足夠的現(xiàn)場倉庫；To provide

10、on-site engineering office and sufficient field warehouse;d. 積極協(xié)助乙方施工，協(xié)調(diào)施工時與各部門的配合，并負(fù)責(zé)提供工程所需的現(xiàn)場平面圖及 建筑結(jié)構(gòu)圖。Actively assist Party B construction, coordination with various departments, and responsible forproviding the needed for the project site plans and architectural drawings.e. 及時按合同規(guī)定之付款進(jìn)度向乙方支付工程款

11、項(xiàng)。Timely according to the terms of the contract payment schedule to pay Party B project funds.3.2 乙方職責(zé)： Responsibilities of party B: a. 乙方在工程開始前應(yīng)組織有關(guān)人員研究和熟悉圖紙，參與設(shè)計交底，安排施工總進(jìn)度計 劃并提交給甲方；Party B before the project begins shall organize relevant personnel to study and be familiar withdrawings, involved i

12、n the design work, arrangement of construction general schedule plan and submitto Party A;b. 向甲方或項(xiàng)目監(jiān)理提供所購各種產(chǎn)品、設(shè)備的技術(shù)資料，接受進(jìn)場檢驗(yàn)；To the party A or project supervision to provide the purchase a variety of products, equipment,technical information, accept entry inspection;c. 遵守甲方或監(jiān)理方對施工現(xiàn)場的有關(guān)規(guī)定；Abide by th

13、e party or the supervision on construction site of the relevant provisions;d. 按時完成乙方所承擔(dān)的施工任務(wù)，保證工程施工質(zhì)量。Timely completion of construction tasks undertaken by Party B, to ensure construction quality.4.施工與工程設(shè)計變更Construction and engineering design change乙方在施工中要根據(jù)國家頒發(fā)的施工驗(yàn)收規(guī)范和質(zhì)量檢驗(yàn)標(biāo)準(zhǔn)，以及設(shè)計要求進(jìn)行， 要求全部工程達(dá)到合格標(biāo)準(zhǔn)。

16、arty合同A, the Party B causes, losses shall be borne by Party B.在施工中，若甲方 A 有變更設(shè)計文件的要求，應(yīng)書面通知乙方；若乙方發(fā)現(xiàn)設(shè)計文件 有錯誤或嚴(yán)重不合理的地方， 也應(yīng)書面通知甲方， 雙方商定并修改設(shè)計文件和圖紙后方可繼 續(xù)施工。During the construction, if the party A to change the design document, shall give a written noticeto Party B; if Party B is found the design documents

18、xtended period, bothparties shall timely consultations, and through the written form to determine the extension of thetime limit: a. 因天災(zāi)或人力不能抗拒的原因被迫停工的；Because of natural disaster or the manpower irresistible reasons forced shutdown;b. 因甲方提出變更計劃或變更施工圖而不能繼續(xù)施工的；Because party A proposed changes to the

19、plan or change the construction graph therefore cannot continueconstruction;乙方不能按期供設(shè)備或所供材料或者設(shè)備不合規(guī)格要求，被迫停工或不能順利施工的； Party B fails tosupply equipment or for the materials or equipment of different specifications, was forced to shutdown or not smooth construction;5.竣工驗(yàn)收與售后服務(wù)Final acceptance and after-s

20、ales service乙方必須嚴(yán)格執(zhí)行隱蔽工程驗(yàn)收制度， 凡隱蔽工程完成后， 必須經(jīng)過驗(yàn)收并作好記錄 (隱 蔽工程指墻內(nèi)、吊頂內(nèi)的管線施工等) 。Party B must strictly enforce the hidden work system, where the hidden work has been completed, mustpass inspection and make records (hidden works refers to the wall, the ceiling inside the pipelineconstruction, etc.).整體工程竣工后，

21、乙方向甲方提交竣工文檔并提交書面驗(yàn)收申請。甲方接到申請后 日內(nèi)組織有關(guān)人員按照合同內(nèi)容和事先約定的驗(yàn)收條款進(jìn)行項(xiàng)目驗(yàn)收，并出具雙方簽字的驗(yàn) 收報告。如甲方不能按期組織驗(yàn)收，須提前通知乙方，并與乙方另行商定驗(yàn)收日期，但甲方 必須承認(rèn)乙方的竣工時間。甲方推遲驗(yàn)收，其間所發(fā)生的管理費(fèi)和各項(xiàng)損失均由甲方負(fù)擔(dān)。 如果提交驗(yàn)收申請后一個月仍未能完成驗(yàn)收，則以竣工之日作為系統(tǒng)的保修開始日期。When the whole project is completed, Party B shall submit to party A complete documentation and submita writte

24、 failed to complete acceptance, the completion date as the system合同warranty start date.工程驗(yàn)收合格后進(jìn)入質(zhì)保期。質(zhì)保期為驗(yàn)收合格之日起 對系統(tǒng)除人為因素外的所有故障負(fù)責(zé)免費(fèi)維修或更換。Project after acceptance into the warranty period. 25、tion to human factors all faultis responsible for free repair or replacement.在質(zhì)保期內(nèi)， 乙方做到對甲方求援電話 2 小時內(nèi)響應(yīng)， 8 小時內(nèi)抵達(dá)現(xiàn)場并著手解決問 題。質(zhì)保期結(jié)束后，乙方對系統(tǒng)進(jìn)行有償維護(hù)。有償維護(hù)的費(fèi)用由雙方協(xié)商。During the warranty period, Party B shall do to help telephone response within 2 hours, 8 hours toarrive at the scene and set about solving the p

26、roblem. After the end of the warranty period, PartyB on the system paid maintenance. Paid maintenance costs through consultation by the two parties.6.技術(shù)服務(wù)和培訓(xùn)Technical service and training由乙方按技術(shù)培訓(xùn)大綱負(fù)責(zé)對甲方的有關(guān)操作人員和維修人員進(jìn)行使用級培訓(xùn)。通過 培訓(xùn)，使甲方的受訓(xùn)人員能掌握系統(tǒng)設(shè)備的配置， 能進(jìn)行正確操作和日常維護(hù)及一般常見故 障排查。接受培訓(xùn)的人員由甲方確定，日期由甲乙雙方共同商定。Part

28、ied by the party A, the date mutually agreed by both parties.在保修期內(nèi)，乙方提供兩次上門巡檢服務(wù)，包括各系統(tǒng)運(yùn)行狀況的查看、記錄，以及 必要的設(shè)備維護(hù)。During the warranty period, Party B shall provide two on-site inspection services, including the statusof system view, recording, and the necessary equipment maintenance.乙方為甲方免費(fèi)提供網(wǎng)絡(luò)綜合布線系統(tǒng)和數(shù)據(jù)中心的

36、-Num甲方在合同規(guī)定的付款期限內(nèi)未能及時付款，視為甲方違約。甲方每日按合同款項(xiàng)的 千分之一賠償乙方損失。Party A in the contract payment period failed to timely payment, regarded as a breach of contract.Party A according to the contract sum 1/1000 daily compensation for any loss of Party B.7.6 甲乙任意方因第三者的原因造成違約的，應(yīng)向?qū)Ψ匠袚?dān)違約責(zé)任。Any party for the third part

37、y reasons for default, shall be liable to the other party for breach.8.合同的變更The modification of Contract合同合同需在甲乙雙方公平協(xié)商， 達(dá)成一致的條件下進(jìn)行變更， 變更的內(nèi)容需以文字正本形式經(jīng) 雙方授權(quán)人簽字并蓋章后生效。 一切變更內(nèi)容作為附件存在與合同正本具有相同的法律效力。Any modification must on the basis of fair negotiation and be accepted by both sides.
