7、ning agreement are over the contractterm, the contract term is extended to the maturity of the agreed work (service) termunder the training agreement.二、工作內容和工作地點ii. job descriptions and working place1、乙方同意按甲方工作需要,從事 崗位(工種)工作,乙方應保質保量完成 該崗位所承擔的各項工作內容。乙方的工作地點在海鹽縣境內,1.party b agrees to engage in_(post,
8、work posts) accordingto needs of the party a. party b shall guarantee to finish the various working contents ofthe posts with quality and quantity. the location of party b is within the territory of thehanyan county.2、甲方可以根據(jù)生產(chǎn)和工作需要及乙方的身體狀況、工作能力和表現(xiàn)升、 降乙方的職務,調整乙方的工作崗位或地點,乙方愿意服從甲方的安排。party a may promot
9、e or demote the posts of party b and adjust the working post orlocation of party b according to production and working needs and the physicalcondition and working capacity and performance of party b and party b is willing toaccept the arrangement of party a.二、 工作時間和休假iii. working hours and leaves1、經(jīng)
10、甲、乙雙方協(xié)商確認按下列第條款執(zhí)行工時制度。after the mutual consultations of the parties, the working hour system shall besubject to the no._ of the following:a、執(zhí)行標準工時制度。perform the standard work hour system.b、根據(jù)本行業(yè)的生產(chǎn)經(jīng)營特點,并經(jīng)勞動保障部門批準執(zhí)行綜合計算工時 制度。according to the manufacturing and operation feature of the industry, perfor
11、m thecomprehensive working hour system after approval of the labor security department.2、乙方依法享受國家規(guī)定的法定節(jié)假日。party b is entitled to have the legal holidays stipulated by the country.四、勞動報酬iv labor remuneration1、乙方提供正常勞動,甲方確保支付乙方基本工資不低于元/月;party b provides the normal work and party a ensures that the ba
12、sic salary paid toparty b shall not be lower than rmb _ yuan/month.2、執(zhí)行定額計件工資制的,按多勞多得原則計算工資。加班加點按規(guī)定支 付乙方加班工資。regarding those who exercise the piece wage, their wageshall be based on theprinciple of“;more pay for more work”. overtime work of partyb shall be paid according to the rule.3、如執(zhí)行點率(考核)或年薪工資
13、制,按績效考核結果計算工資。if the point (review) or the annual pay salary system is performed,the salary shall be calculated according to the result of the performance appraisal.4、乙方在試用期間的工資為 元/月。the salary of party b during probation is rmb _ yuan/m.5、甲方根據(jù)實際經(jīng)營狀況、內部規(guī)章制度、對乙方的考核結果,以及乙方 的工作年限、獎懲記錄、崗位變化等,調整乙方的工資水平,但
14、不得低于國家規(guī) 定的最低工資標準。party a may adjust the salary level of party b according to the operation condition,internal rules system, appraisal result, work tenure, punishment and rewards recordsand change of the post of party b etc. but it shall not be lower than the salary standardsstipulated by the country
15、.6、甲方以貨幣形式按月支付乙方工資。party a shall pay the salary of party b by month in currency.五、勞動紀律v labor discipline1、 乙方對甲方依法制定的規(guī)章制度已經(jīng)熟知,并嚴格遵照執(zhí)行。party b has been aware of the rules and regulations of party b stipulated accordingto the law and abide by it strictly.2、 乙方應遵守職業(yè)道德,不得損害甲方利益。party b shall abide by th
16、eprofessional ethics which shall not injure the interests of party a.六、社會保險和福利待遇vi social insurance and welfare1、 甲方按國家和地方政策規(guī)定為乙方辦理社會保險有關手續(xù),并承擔相應 的義務。party a shall deal with the relevant formalities of social security for party baccording to the country and local policies and take up the relevant li
17、abilities.2、乙方的福利待遇按國家及甲方的規(guī)定執(zhí)行。the welfare of party b shall be subjectto the rules of the country and party a.七、勞動保護、勞動條件和職業(yè)危害防治viilabor protection, labor condition and occupational harmprevention and cure 1、甲方根據(jù)生產(chǎn)崗位的需要,按照國家有關勞動安全、 衛(wèi)生的規(guī)定為乙方配備必要的安全防護措施,發(fā)放必要的勞保用品。party a shall equip party b with the n
18、ecessary safety protection measures andissue the necessary labor protection articles according to the needs of the post and therules of the labor safety and hygiene.2、 乙方在勞動過程中應當嚴格遵守安全操作規(guī)程,嚴禁違章作業(yè),防止勞 動過程中的事故,減少職業(yè)危害,并應自覺愛護甲方的工具等財產(chǎn)。during the labor process, party b shall abide by the safety operation
19、procedure toprevent the accidents during the labor process, decrease the occupational harm andconsciously protect the assets such as the tools of the party a. it is strictly forbidden tomakethe operation by violating the rules.3、甲方應當建立、健全職業(yè)病防治責任制度,加強對職業(yè)病防治的管理, 提高職業(yè)病防治水平。party a shall set up and opti
20、mize the occupational disease cureresponsibility system, enforce the management over the occupational disease andpromote the cure level of the occupational disease.八、教育與培訓viii. education and training甲方應當依據(jù)國家有關職業(yè)教育與就業(yè)準入的有關規(guī)定以及本單位的實際情況,為乙方提供職業(yè)教育和技能培訓。乙方參加培訓應按規(guī)定與甲方另行簽訂培訓協(xié)議party a shall provide party b
21、with the occupational education and skill trainingaccording to the actual condition of the company and relevant rules of the country onthe occupational education and post permit. party b shall enter into the trainingagreement with party a additionally for the training taken.九、勞動合同的解除、變更、終止ix. revoca
22、tion, modification and termination of the labor contract1、甲乙雙方解除、變更、終止、續(xù)訂勞動合同應當依照勞動合同法和 國家及省、市等有關規(guī)定執(zhí)行。if the parties revoke, modify, terminate and extent the labor contract, they shallperform them according to the relevant rules of the labor contract law and the country,province and city etc.3、 經(jīng)甲乙雙
23、方協(xié)商一致,可變更合同相關內容,變更勞動合同,應當采用 書面形式。after the mutual consultations of the parties, the contract may be modified inwriting.4、 乙方符合勞動合同法第三十九條情形之一者,甲方有權解除勞動合 同。if party b has one of the circumstances under article 39 of the labor contract, partya is entitled to revoke the labor contract.5、 乙方要求解除勞動合同,應當提前
24、三十日(試用期內提前三日、專業(yè)人員提前六個月)以書面形式通知甲方,可以解除勞動合同if party b requires to revoke the labor contract, they shall inform party a in writingwith thirty (30) day pre-notice (the person under probation needs a pre-notice ofthree(3) days and the professional people with the pre-notice of six months).6、甲方應在解除或者終止勞動合
25、同時,為乙方出具解除或者終止勞動合同 的證明,并在15日內為勞動者辦理相關手續(xù)。乙方應在甲方出具解除或者終止 勞動合同的證明后10日內辦理工作移交,如涉及經(jīng)濟補償?shù)陌磭矣嘘P規(guī)定在 辦結工作交接時支付。upon the revocation or termination of the labor contract, party a shall issue thecertification for revocation or termination of the labor contract to party b and deal withthe relevant formalities for
26、 the laborer within fifteen (15)days. party b shall make thework handover within ten (10) days after issuance by party a of the certificate ofrevocation or termination of the labor contract. regarding any economic compensation,they shall be paid upon the handover of the work according to the rules o
27、f the country.十、違反勞動合同的責任x. responsibilities for violating the labor contract1、本合同一經(jīng)簽訂,甲乙雙方應嚴格執(zhí)行。任何一方違反規(guī)定解除勞動合 同的,應當向對方賠償因違約造成的經(jīng)濟損失。once the contract is entered into, the parties shallstrictly perform it. regarding any party whoviolate the labor contract and raise the revocation, they shall compensa
28、te the otherparty for the economic losses arisen.6、乙方違約解除合同,在合同期間(含轉崗)由甲方出資進行職業(yè)技術或 提升培訓的,按培訓協(xié)議約定向甲方支付違約金;若無培訓協(xié)議,按國家有關規(guī) 定執(zhí)行。regarding party b who violates the contract to revokes the contract, during thecontract term (including the post transfer), if party a invests in party bs occupationaltechnology
29、 or development training, party b shall pay the party b with the penaltyaccording to the agreement. if there is no training agreement, it shall be subject to therelevant rules of the country.3、乙方因違章作業(yè)或失職行為給甲方造成損失的,甲方有權追究乙方賠償 責任,并按違紀行為給予處理。if party b causes losses to party a due to the operation viol
30、atingthe rule or negligence behavior, party a is entitled to recourse party b with thecompensation responsibilities and punish the violating behaviors.十一、勞動爭議處理及其它xi . labor disputes settlement and miscellaneous1、甲乙雙方在本合同履行中發(fā)生勞動爭議,應協(xié)商解決或由本單位工會組 織調解解決;也可以向所在鎮(zhèn)勞動爭議協(xié)調委員會申請調解,調解不成或不愿調解的,可向海鹽縣勞動爭議仲裁委員會申請仲
31、裁,對仲裁裁決不服的,可以向海鹽縣人民法院起訴regarding the labor disputes arisen of the parties during the performance of thecontract, they shall be solved through consultations or intervened by the trade union ofthe unit or applied for the medication from the labor dispute coordination committee inthe town. regarding th
32、ose who fail to reach the agreement or are not willing to beintermediated, they may arbitration from the labor dispute arbitration committee fromhanyan country. regarding those who dont agree with the arbitration, they may lawsuite from the peoples court.7、 乙方不得泄露甲方的商業(yè)和技術秘密,不得利用甲方的技術或財物與他 人研制產(chǎn)品。party b shall not disclose the commercial and technology secrets of party b andshall not take advantag
