1、道路交通事故論文:道路交通事故責任主體的認定【中文摘要】道路交通事故人身損害賠償糾紛案件已成為當前各基層法院民商事案件中的主要案件類型之一。在司法實踐中,正確認定道路交通事故責任主體對處理此類糾紛有著極為重要的理論及實踐意義。鑒于司法實踐中對交通事故責任主體的認定面臨的諸多困境,在侵權(quán)責任法中,就專章立法對機動車交通事故責任主體進行了較為詳細的規(guī)定,使得上述問題得到了很大程度上的統(tǒng)一,在審判實務中具有重要的現(xiàn)實意義。但是由于立法的局限性和現(xiàn)實生活的復雜多樣性,雖然侵權(quán)責任法在一定程度上改變了我國原有的民事訴訟法及道路交通安全法,等法律法規(guī)過于粗略的問題,但仍然存在諸多不足。本文除了引言外,主要
2、包括案情介紹、案件焦點與分歧意見、研究結(jié)論三個部分。引言部分:主要說明研究道路交通事故責任主體認定的實踐意義。第一部分:案情介紹。主要是介紹一起道路交通事故案件的案情。包括法院對案件事實的認定、原告的訴稱、被告的辯稱及法院的裁判結(jié)果。第二部分:案件焦點與分歧意見。包括法院對案件焦點的歸納和雙方當事人對案件的分歧意見。第三部分:研究結(jié)論。此部分為論文的核心。主要涉及以下六個方面的內(nèi)容: 1、銀色轎車與張華駕駛的貨車之間的法律關(guān)系認定:通過對共同侵權(quán)、共同危險行為和無意思聯(lián)絡的數(shù)人侵權(quán)之間的分析比較,最終認定案件中兩侵權(quán)車之間成立無意思聯(lián)絡的數(shù)人侵權(quán)。2、雇員在從事雇傭活動中發(fā)生道路交通事故時責任
3、主體的認定:通過對侵權(quán)責任法與人身損害賠償解釋中關(guān)于雇主責任的分析比較,最終認定雇員張華無須對在從事雇傭活動過程中致人損害的后果承擔賠償責任,應由雇主李飛對外承擔全部賠償責任。3、掛靠機動車發(fā)生道路交通事故時責任主體的認定:鑒于當前理論和實務中對掛靠機動車發(fā)生交通事故時責任主體認定上存在的爭議較大,加之侵權(quán)責任法對此也未作出明確規(guī)定,本文從掛靠業(yè)務的性質(zhì)和出發(fā),最終認定掛靠單位應當對掛靠機動車發(fā)生交通事故時致人損害的后果承擔連帶責任。4、保險公司在道路交通事故人身損害賠償糾紛案件中訴訟地位的認定:通過對相關(guān)法律法規(guī)的分析比較,最終認定保險公司可以以承保機動車交通事故責任強制保險(以下簡稱交強險
4、為由在道路交通事故人身損害賠償糾紛中作為被告進入訴訟,不能以承保商業(yè)第三者責任保險為由在道路交通事故人身損害賠償糾紛中作為被告進入訴訟。5、機動車駕駛員肇事后逃逸時對受害人的救濟:通過目前對駕駛員肇事后逃逸時對受害人權(quán)益維護上存在的制度缺失,提出應當盡快建立和完善機動車社會救助基金制度和其他社會保障機制。6、對案件的處理意見:結(jié)合對上述問題的探討分析,就本案的處理上提出自己的看法?!居⑽恼縉owadays, the cases of compensation for damage of traffic accidents have become one of the mainly type

7、 offset some shortages of Law of Civil Procedure and The traffic Safety Law of PRC to some extent, it still leaves much to be improved on the basis of the limitation of law and the rich diversity of life. This paper includes four dimensions:introduction, the background of the case, case central poin
8、t and different opinions, and a conclusion.A introduction of the practical significance of responsibility affirmation in traffic accident.Describing the background of a traffic accident, which including affirmation of the case, prosecutors allegation and respondents allegation, as well the juridical
9、 result of the court.Focusing on the summary and conclusion of case central point from the court and the disagreement between both parties.The fourth dimension is the core of the paper and consists of six parts.a. The identification of civil legal relationship between the silvercar and Zhang Huas lo
10、rry:It is affirmed that the case belongs to the number of people without meaning contact for infringement through the analysis and comparison of contributory infringement, joint dangerous behavior and the number of people without meaning contact for infringement.b. The identification of the tortfeas

13、ice, and there is no clear and specific rules and provisions in Tort Law of the Peoples Republic of China, so that the paper affirms that the organization hung rely on by the join-operated lorry shall bear joint liabilities from the perspectives of quality and purpose.d. The identification of the pr
14、oceeding position of the insurance company in the case concerning personal damagecompensation with traffic accidents. It is certified that the insurance company can be regarded as the respondent based on the motor vehicle traffic accident responsibility compulsory insurance instead of business insur
15、ance through analyzing relevant law rules.e. Taking immediate measures to offer help to victims after the hit-and-run driver escape. It is necessary to consummate social assistance funds for road traffic accident function and motion pattern and other live insurance systems for lack of safeguarding t
