2、hina.'1 .termofthecontract:thetermofthiscontractisforyearsandshallcommenceon,andshallcontinueuntil,unlessearlierterminatedpursuanttothiscontract.theemployeeshallundergoaprobationaryperiodof_months.2 .jobdescription:theemployeragreestoemploymr./ms.(name)as(jobtitle)indepartment,locatedin(officelo

3、cationandcity).3 .remunerationoflaboura.thesalaryoftheemployeeshallbemonthlypaidbytheemployerinaccordancewithapplicablelawsandregulationsofp.r.c.itshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryintianjin.b. thesalaryoftheemployeeisrmb$permonthintheprobationaryperiodandrmb$aftertheprob

4、ationaryperiod.c. ifthedelayordefaultofsalarytakesplace,theemployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.workinghours&rest&vocationa.thenormalworkinghoursoftheemployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffiv

5、edaysperweek,foranaverageoffortyhoursperweek.b.theemployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsoftheprcandthecompany'sworkrules.c.theemployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunion

6、andtheemployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.however,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.socialsecurity&welfarea.theemployerwillpayforallmandatorysocia

7、lsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheemployeeaccordingtotherelevantgovernmentandcityregulations.b.duringtheperiodofthecontract,theemployeeswelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofp.r.c.6.workingprotection&workingconditions

8、a.theemployershouldprovidetheemployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsofthestateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.theemployershouldprovidetheemployeewithsafetyeducationandtechniquetraining;theemployeetobeengag

9、edinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.c.theemployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.7.labourdisciplinea.theemployermaydraftbylawsandlabourdisciplinesofthecompany,accordingtowhich,theemployershallha

10、vetherighttogiverewardsortakedisciplinaryactionstotheemployee;b.theemployeeshallcomplywiththemanagementdirectionsoftheemployerandobeythebylawsandlabourdisciplinesoftheemployer.c.theemployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheemployerduringtheperiodofthiscontract;this

11、obligationofconfidentialityshallsurvivetheterminationofthiscontractforaperiodoftwo(2)years.8.termination,modification,renewanddischargeofthecontracta.therelevantclausesofthecontractmaybemodifiedbytheparties:i .thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;ii .duetotheforcema

12、jeure,thecontractcannotbeexecuted;iii .therelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningthecontract.b.thecontractmaybeautomaticallyterminated:i .thiscontractisnotrenewedattheexpirationofthiscontract;ii .theemployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii .th

13、edeathoftheemployeeoccurs;iv .theforcemajeuretakesplace;v .theconditionsofterminationagreedinthecontractbythepartiesarise.c.thecontractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d.thecontractmaybedischargedthroughconsultation

14、bytheparties;e.thecontractmaybedischargedbytheemployerwithimmediateeffectandtheemployeewillnotbecompensated:i .theemployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;ii .theemployeeseriouslyviolatesdisciplinesorbylawsoftheemployer;iii .theemployeeseriouslyneglectshisduty,engagesinmalpra

15、cticeforselfishendsandbringssignificantlosstotheemployer;iv .theemployeeisbeingpunishedbyphysicallabourforitsmisfeasancev .theemployeeisbeingchargedwithcriminaloffences:f.thecontractmaybeterminatedbytheemployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i .theemployeefailsillorisinjuredto(oth

16、erthanduetowork)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheemployerassignstohim;ii .theemployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii .thecircumstanceshavemateriallychangedfro

17、mthedatethiscontractwassignedtotheextentthatitisimpossibletoexecutethecontractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.iv .theemployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisserious

18、lyintrouble,undersuchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure)g.theemployeeshallnotbedismissed:i .thecontracthasneitherexpirednorconformedto8.d,8.e,8.f,8.g;ii .theemployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbythelabourauthentic

19、ationcommissioninbaodicounty,tianjin.iii .theemployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicableprclawandregulationsandcompanypolicy;iv .theemployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;oriii .theapplicableprclawsandregu

20、lationsotherwiseprohibittheterminationofthiscontract.h.thecontractmaybedichargedbytheemployeebygivingnoticeinwrittenform30(thirty)daysinadvance.however,theemployeemayinformtheemployertodischargethecontractatrandomunderthefollowingoccasions:iv theemployeeisstillintheprobationaryperiod;v i.theemployer

21、forcetheemployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;vi i.theemployerdoesnotpaytheremunerationoftheemployeeaccordancewiththerelevantclauseinthecontract;vii theemployerviolatestherelevantregulationsofstateortianjinforitsterriblesafeandhealthcondition,whichisharmfultotheemploye

22、eshealth.viii econtractcannotbeterminatedbytheemployeebeforetheexpirationifnotconformingto8.d,8.h,j.theemployershallpaytheeconomiccompensationtotheemployerifthecontractisterminatedconformingto8.d,8.f,8.h.i-8.h.iv.additionalfeeformedicalallowanceshouldbepaidtotheemployeeifthecontractisterminatedconfo

23、rmingto8.f.i.9.breachliabilitiesa. duetoeitherpartysfault,ifbreachingthecontract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceofthecontract;ifthepartiesbothbreachthecontract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b. duetoeitherpartysfaul

24、t,ifbreachingthecontracttodamagetheotherparty.thedamageshouldbecompensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofprc.c.duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;c.theemployeewantstoresignandhasreceived

25、trainingprovidedbytheemployer,theemployeeshallcompensateforthetrainingcost.themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:theemployeeshallcompensatermbwithin_year(s)inthecompanyifthecontractisterminatedbytheemployeeathiscause;theemployeeshallcompensatermbwithin_year(s)inthecompanyifthecontractisterminatedbytheemployeeathiscause;theemployeeshallcompensatermbwithin_year(s)inthecompanyifthecontractisterminatedbytheemployeeathiscause;10.labordisputeswherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthiscontract,thepar
