Definitions“Carriage”meansthewholeoranypartofthecarriage,loading,unloading,storing,warehousing,handlingandanyandallotherserviceswhatsoeverundertakenbytheCarrieri

4、nrelationtotheGoods.“Carrier”meansA.P.M?ller-M?rskA/StradingasMaerskLineof50Esplanaden,DK-1098,CopenhagenK,Denmark.“Container”includesanycontainer(includinganopentopcontainer),flatrack,platform,trailer,transportabletank,palletoranyothersimilararticleusedtoconsolidatetheGoodsandanyconnectedequipment.

5、"Freight”includesallchargespayabletotheCarrierinaccordancewiththeapplicableTariffandthisbilloflading.“Goods”meansthewholeoranypartofthecargoandanypackagingacceptedfromtheShipperandincludesanyContainernotsuppliedbyoronbehalfoftheCarrier.“HagueRules”meanstheprovisionsoftheInternationalConventionf

6、ortheUnificationofCertainRulesrelatingtoBillsofLadingsignedatBrusselson25thAugust1924andincludestheamendmentsbytheProtocolsignedatBrusselson23rdFebruary1968,butonlyifsuchamendmentsarecompulsorilyapplicabletothisbilloflading.(Itisexpresslyprovidedthatnothinginthisbillofladingshallbeconstruedascontrac

7、tuallyapplyingthesaidRulesasamendedbysaidProtocol).“Holder”meansanyPersonforthetimebeinginpossessionofthisbillofladingtoorinwhomrightsofsuitand/orliabilityunderthisbillofladinghavebeentransferredorvested.“MaerskLine”isthetradenameoftheCarrier.“Merchant”includestheShipper,Holder,Consignee,Receiveroft

8、heGoods,anyPersonowningorentitledtothepossessionoftheGoodsorofthisbillofladingandanyoneactingonbehalfofsuchPerson,oranyprincipalofsuchPerson.“MultimodalTransport”arisesifthePlaceofReceiptand/orthePlaceofDeliveryareindicatedonthereversehereofintherelevantspaces.“OceanTransport”meansthesameasPort-toPo

9、rtShipment.“Package”whereaContainerisloadedwithmorethanonepackageorunit,thepackagesorothershippingunitsenumeratedonthereversehereofaspackedinsuchContainerandenteredintheboxonthereversehereofentitled“Carriers“Receipt”areeachdeemedaPackage.“Person”includesanindividual,corporation,orotherlegalentity.“P

10、ort-to-PortShipment”ariseswhentheCarriageisnotMultimodal.“Subcontractor”includesowners,charterersandoperatorsofvessels(otherthantheCarrier),stevedores,terminalandgroupageoperators,roadandrailtransportoperators,warehousemenandanyindependentcontractorsemployedbytheCarrierperformingtheCarriageandanydir

11、ectorindirectSubcontractors,servantsandagentsthereofwhetherindirectcontractualprivityornot.“TermsandConditions”meansallterms,rights,defences,provisions,conditions,exceptions,limitationsandlibertieshereof.“USCOGS”AmeanstheUSCarriageofGoodsbySeaAct1936.“Vessel”meansanywaterbornecraftusedintheCarriageu

12、nderthisBillofLadingwhichmaybeafeedervesseloranoceanvessel.2.Carrier'sTariffThetermsandconditionsoftheCarriersapplicableTariffareincorporatedherein.Attentionisdrawntothetermsthereinrelatingtofreestoragetimeandtocontainerandvehicledemurrageordetention.CopiesoftherelevantprovisionsoftheapplicableT

13、ariffareobtainablefromtheCarrieruponrequest.InthecaseofinconsistencybetweenthisbillofladingandtheapplicableTariff,thisbillofladingshallprevail.3. WarrantyTheMerchantwarrantsthatinagreeingtotheTermsandConditionshereofheis,orhastheauthoritytocontractonbehalfof,thePersonowningorentitledtopossessionoftheGoodsandthisbilloflading.4. Subcontracting4.1 TheCarriershallbeentitledtosub-contractonanytermswhatsoeverthewholeoranypartoftheCarriage.4.2 TheMerchantundertakesthatnoclaimorallegationwhetherarisingincontract,bailment,tortorotherwiseshallb
