2、ackground:IdentificationCardNo:Residence:Thiscontractisexecutedbytwopartiesinaccordancewiththeapplicableprovisionof“TheLaborLawofthePeoplesRepublicofChina”,“LawofthePeoplesRepublicofChinaonEmploymentContracts”andotherlawsandregulationsonthebasisofequality,voluntarinessandconsensus.Article1Termofcont
3、ractandProbationPeriod,andshallcommenceon()Fixedperiod.ThetermofthisContractshallbe_years,from_/_/_to_/_/_duringwhichthereshallbeaprobationperiodof_months,from_/_/_to_/_/_.Unfixedperiod.ThetermofthisContractshallbecalculatedfromthedateof_/_/_,includingtheprobationperiodof_months.Thiscontractshallbet
4、erminatedwhenthecircumstancesofstatutoryterminationoccur.Thetermforfulfillingtheproductionwork.ThetermofthisContractshallbefromthedateof_/_/_,aftersuchproductionworkiscompleted,bothpartiesshallterminatethelaborcontract.IfthisContractissignedbeforeemployment,thelaborrelationshallbeestablishedsincethe
5、dateofemployment.Article2JobDescriptionTheEmployeragreetoemployMr./Ms._(name)as_(jobtitle)in_Department,locatedin_(officelocationandcity).PartBshallcompletehisworkaccordingtothejobdutiesdefinedbyPartyA.Article3Workinghours,restbreaksandholidaysPartyAshallimplementthefollowing()typeofworkinghoursyste
6、mforthepositionofPartyB.Standardworkinghoursystem.Comprehensiveworkinghoursystem.Flexibleworkinghoursystem.Inaccordancewithgovernmentrequirements,partyAandpartyBshouldstrictlycomplywithrulesofwokingtimes.ForoptionA,thenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforan
7、averageoffivedaysperweek,foranaverageoffortyhoursperweek.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theexten
8、dedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.ForoptionBorC,onthebasisofensurepartyBhaveagoodhealthandwouldlistentopartyBsidea,partyAcantakemeasuresofconcentratedwork,concentratedrest,additionaltimeoff,flexibleworkinghourtoensurepartyBcanenjoythe
9、rightofrests,vocationsandcancompleteproductionsandworkingtasks.PartyBshallbeentitledtolegalannualvacations.Article4LaborRemunerationThesalaryoftheEmployeeisRMB_permonthintheprobationaryperiod.Thissalaryshouldnotlowerthanthelowestsalarystandardonthesamepositioninourcompanyor80%ofitsofficialwage,andit
10、salsoshouldntlowerthanlocalminimumwagestandard.Aftertheprobationaryperiod,thesalaryoftheEmployeeshallbeRMB_,andthewageswillbemadeby()a.Hourlywagesb.piecewagesAccordingtothewagedistributionsystemofpartyA,bythetwosidesconsensus,Duringthetermofthecontract,thesalaryadjustedbypartyAforpartyBisthewageofth
11、iscontract(shouldntlowerthanlocalminimumwagestandard).PartyBssalarywillbepaidby()a.offeredbybanksb.payincashPartyAshouldpaythelegaltendertopartyBasmonthlysalary,thepartyAshouldpaythewagesbeforeeachmonth,andofferthepayrolltopartyB.Incaseoftheholidayorweekend,partyAshouldpayattherecentworkingdaypaymen
12、taheadoftime.PartyAshouldpaypartyBovertimewagesinaccordancewithrelevantregulationifpartyArequestpartyBtoworkovertimeonworkingday,workonoff-daysorlegalholidays.AndthisshallbecarriedoutbyrelevantlawsandregulationsandtherelevantregulationspreparedbyPartyAinaccordancewithlaw.Article5Insurance,Welfareand
13、BenefitsPartyAshallpayrelevantsocialinsurancetodesignatedauthoritiesonPartyBSbehalfinatimelymannerinaccordancewithgovernmentrequirements.Andthepersonalpartwillbedeductedfromthesalary.PartyBsvocationofpregnancy,childbirth,breast-feedingandthecorrespondingtreatmentshouldaccordingtotherelevantregulatio
14、ns,suchasmaternityinsurance,femaleemployeeslaborprotection,etc.ThetreatmentforPartyBsoccupationaldiseaseorjobrelatedinjuries(death),sicknessornon-jobrelatedinjuries,andtheproviedofmedicaidexpensespaidshouldbecarryoutbyndustrialinjuryinsurance,medicalinsuranceandrelatedprovisions.Article6WorkingProte
15、ction&WorkingConditionsPartyAandPartyBshallstrictlycomplywiththenationalregulationswhichconcerningproductionsafetyandabidebyregulationsoflabourprotectionandoccupationalhazardsandprotectionofworkers.PartyAshallprovidePartyBprotectionfacilities,equipmentandlaborprotectionarticlesandotherlaborprotectio
16、nconditionsinaccordancewiththenationallabor.PartyBshallstrictlycomplywiththesafeoperationandtherelevantrulesandregulationspreparedbyPartyAinaccordancewithlaw.IfPartyAillegalcommandorforceriskoperation,partyBhavetherighttorefuseit.PartyAmuststrictlyimplementrelevantOccupationalDiseasePreventionLaws,f
17、orthepositionsexposetooccupationaldiseasehazards,suchasexposuretodust,radioactivesubstancesandothertoxicandhazardoussubstances,PartyAshouldtellthetruthanditsconsequencesonoccupationalhazards,protectivemeasuresandtreatmentofoccupationaldiseasestopartyB,andtakepreventivemeasuresandprotectionfacilities
18、whichmeettherequirementsofthenationaloccupationalhealth.IfPartyBisengagedintheoperationthatmayexposetooccupationaldiseasehazards,PartyAshallorganizeoccupationalhealthexaminationbeforegoondutyandleavethepostinaccordancewithrelevantnationalprovisions,andshallconductregularoccupationalhealthexamination
19、onPartyBduringthecontractterm.Article7Amendment,TerminationandEndingofEmploymentContracts1.Theemploymentcontractcouldbeamendedinafriendlynegotiationwiththeamendmentprocedureoperatingintime.2.OtherthanthecircumstancesstipulatedinArticle38in“EmploymentContractLaw”,PartyBmayterminatehisemploymentcontra
20、ctupon30dayspriorwrittennoticetoPartyA.Duringhisprobationperiod,hemayterminatehisemploymentcontractbygivingPartyAthreedayspriornotice.3.PartyAmayterminateemploymentcontractinvolvinginthecircumstancesspecifiedinArticle39,40&41in“EmploymentContractLaw”.ShouldPartyBfallsinthecircumstancespecifiedinArti
21、cle42in“EmploymentContractLaw”,PartyAmustnotterminateemploymentcontractaccordingtoitemsregulatedinArticle40&41in“EmploymentContractLaw”.4.Theemploymentcontractmayterminateifitconformstothecircumstanceasspecifiedin“EmploymentContractLaw”andothernational,provincialandmunicipalemploymentcontractrelated
22、provisions.5.Terminationofemploymentcontracttoemployeeswhosufferemploymentinjuryoroccupationaldiseaseshallbeoperatedagainstnationalemploymentinjuryprovisions.6.PartyAshallpaytheemployeeseverancepayinvolvinginthecircumstancesspecifiedinArticle46in“EmploymentContractLaw”.7.Atthetimeofterminationorendi
23、ngofanemploymentcontract,PartyAshallissueaproofofterminationorendingoftheemploymentcontractand,within15days,carryouttheproceduresforthetransferofPartyBsfileandsocialinsuranceaccount.PartyBshallcarryouttheproceduresforthehandoverofhisworkasagreedbytheparties.Article8Covenants1.Accordingtoprovisionsof
24、Article22,23&24in“EmploymentContractLaw”,covenantsareagreedbelow:a.b.2)Othercovenants:Article9PartyAshallestablishinternalrulesandregulationsagainstlegalprocedureswithPartyBinformedandnoted.PartyBshallstrictlyabidebyrulesandregulationssetbyPartyA.Article10Whereanemploymentdisputebetweenthepartiestakesplaceduringtheperformanceofthiscontract,thepartiesconcernedmayseekforasettlementthroughconsultationormayapplytotheemploymentdisputemediationcommitteeofPartyAsun
