22、 havving beenn acccepteed byy thee Selllerss. 索賠：貨物物抵達(dá)目的的地后900天內(nèi)，如如果質(zhì)量、技術(shù)規(guī)格格或數(shù)量發(fā)發(fā)現(xiàn)與合同同的規(guī)定不不符(除過保險險公司和運運輸公司的的責(zé)任所負(fù)負(fù))，買方應(yīng)應(yīng)該依據(jù)中中華人民共共和國出入入境檢驗檢檢疫局的檢檢驗報告或或者是賣方方的調(diào)試人人員在安裝裝調(diào)試時出出具的報告告，有權(quán)要要求替換或或補償，所所有的費用用(包括商檢檢費、替補補件來回的的運費、保保險費、倉倉儲費、貨貨物裝貨卸卸貨費等)均由賣方方承擔(dān)。賣賣方的質(zhì)量量保證為簽簽定關(guān)于此此批貨物的的驗收報告告后12個月內(nèi)內(nèi)；由于貨貨物內(nèi)在的的質(zhì)量、差差的做工、選材不當(dāng)當(dāng)

23、而造成操操作中的貨貨物損壞，買買方應(yīng)立即即書面通知知賣方，并并同時隨附附中國商檢檢局出具的的檢驗報告告作為索賠賠依據(jù)。賣賣方在接到到買方的索索賠后，有有責(zé)任立即即解決相應(yīng)應(yīng)的質(zhì)量問問題、全部部或部分地地替換貨物物或根據(jù)貨貨物損壞的的程度進行行折價； 如果賣方方在收到買買方的上述述索賠后一一個月內(nèi)未未能作出答答復(fù)，則視視為索賠已已為賣方所所接受。15. 27、立立即在不可可抗力產(chǎn)生生的十四日日內(nèi)將有關(guān)關(guān)情況通知知買方，并并且賣方應(yīng)應(yīng)用航空郵郵件將有關(guān)關(guān)政府當(dāng)局局部門出具具的證明不不可抗力產(chǎn)產(chǎn)生的文件件寄送給買買方。在此此情況下，賣賣方仍應(yīng)盡盡最大努力力采取各種種措施促使使貨物的發(fā)發(fā)運。如果果事故持續(xù)續(xù)十周，買買方有權(quán)取取消該合同同。16.
