聘〔雇〕用契約書

_________〔以下簡稱甲方〕為應(yīng)業(yè)務(wù)需要,聘〔雇〕用_________先生〔女士〕〔以下簡稱乙方〕為約聘〔雇〕人員,雙方訂立契約條款如下:

一、聘〔雇〕用期間:自_________年_________月_________日起至_________年_________月_________日止。

二、聘〔雇〕用報酬:甲方按月支給乙方報酬_________薪點(diǎn)〔_________元〕。

三、工作內(nèi)容〔詳細(xì)敘明〕:_________。

四、受聘〔雇〕責(zé)任:

乙方受聘〔雇〕后須確保甲方公務(wù)機(jī)密,有保密期限者從其規(guī)定,無保密期限者自離任日起_________年為限〔解聘〔雇〕者亦同〕。乙方不得有不法行為或違犯約定義務(wù),如有違犯者,除涉及民、刑事責(zé)任,由甲方依法追究外,并得隨時解聘〔雇〕。

在聘〔雇〕用期間,乙方愿承受與甲方約定之工作上的指派調(diào)遣,并遵守此工作上之相關(guān)規(guī)定。假設(shè)乙方違犯上述相關(guān)規(guī)定確屬情節(jié)重大,甲方得隨時終止契約;甲、乙雙方如因特別事故須提早終止契約時,應(yīng)于一個月前提出預(yù)告,經(jīng)甲、乙雙方協(xié)議后乙方始得離任。乙方離任時,應(yīng)先按照規(guī)定辦妥離任手續(xù)。如有損害公物,或侵權(quán)情事〔或違背甲方智能財產(chǎn)權(quán)規(guī)定〕,應(yīng)負(fù)責(zé)賠償。

五、乙方在受聘〔雇〕用期間,除應(yīng)遵守甲方一切行政法規(guī)之規(guī)定外,其假期、離任儲金給與、勞工保險及全民健保等,依左列約定:

假期核給:依_________辦理。

離任儲金之扣繳及給與依_________規(guī)定辦理,按月扣繳儲存生息,并于離任時依規(guī)定發(fā)給。

按乙方每月支報酬之百分之_________提存儲金,其中百分之_________由乙方于每月報酬中扣繳作為自提儲金,另百分之_________由甲方提撥作為公提儲金,并由甲方在金融機(jī)構(gòu)開立專戶儲存孳息,列帳管理。

乙方因契約期滿離任、或經(jīng)甲方同意于契約期限屆滿前離任、或在職因公、因病或意外死亡者,發(fā)給公、自提儲金本息。

乙方因違背契約所定義務(wù)而經(jīng)甲方予以解聘,或未經(jīng)甲方同意而于契約期限屆滿前離任者,僅發(fā)給自提儲金之本息。

其余未盡事宜請參考_________有關(guān)規(guī)定。

乙方受聘〔雇〕用期間,甲方應(yīng)善盡投保勞工保險及全民安康保險之義務(wù)。

六、乙方于受聘〔雇〕期間之著作或工作成果,如系于甲方企劃下,或法定工作期間完成者,其所有權(quán)歸屬甲方。因前開著作或工作成果所生之智能財產(chǎn)權(quán),應(yīng)依本院之相關(guān)規(guī)定辦理。

七、本契約期間屆滿當(dāng)然失效,如因業(yè)務(wù)需要須續(xù)聘時,另行簽訂新契約。

八、本契約未訂定事項(xiàng),悉依?聘用人員聘用條例?及_________相關(guān)規(guī)定辦理。

九、本契約以中文本為準(zhǔn)。如中、英文二本互相歧異或抵觸時,以中文本為準(zhǔn)。

十、本契約法律糾紛以_________法院為第一審管轄法院。

一、本契約乙式參份,除一份由甲方報院備查外,另由雙方各執(zhí)乙份。

Whereas,AiswillingtoofferBemployment,andBiswillingtoacceptsuchemploymentsubjecttothefollowingtermsandconditions:

1.TermofEmployment

Thepartiesagreethatthetermofthisagreementshallbemencingfromthis_________dayof_________,_________tothe_________dayof_________,_________.

2.Remuneration

B'sdutiesshallinclude_________.

4.B'sObligationsandTermination

4.1BshallhandleinaconfidentialmannerallmattersrelatingtoA'sbusiness.Thisconfidentialityobligationshallremaineffectiveduringtheperiodspecifiedintheregulationsorworkingrulesconcerned.Incasethatnotimeperiodisspecified,itremainseffectiveforsuccessive_________years'termsafterB'sterminationofthisemployment.IntheeventthatBviolatesanylaworregulation,orbreachesthisAgreementorworkingrulesconcerned,AmayinitsdiscretionreprimandBorterminatethisAgreement.AalsoreservestherighttoinstitutesuitagainstBforcivilpensationortoimposecriminalliability.

4.2DuringthetermofthisAgreement,Bshallplywiththedirectionsandinstructionsofhis/hersupervisors,performhis/herdutiesinaccordancewithallregulationsandrelevantworkingrules.WhereBviolatesanyobligationspecifiedinthisparagraphandthecaseisconsideredtobeseriousinnature,AmayinitsdiscretionterminatethisAgreement.IfatanytimethepartiesintendtoterminatethisAgreementduetocausesbeyondthereasonablecontrolofsuchparty,eithershallgivethirty

(30)days'noticeofcancellationtotheotherpartypriortotheintendedterminationdate.Bshallvacatehis/herofficeunderandpursuanttothestipulationsagreeduponbybothparties.Bshallsubmittotheproceedingsinprescribedmannerastobevacatedofhis/heroffice.IncaseofanyoneofthefollowingconditionswhichisduetoB'sfault,Bshallberesponsibleforpensation:

(1)WhereBinflictsdamagetoorexcessivelyabusesmachinery,equipment,tools,rawmaterials,productsorotherarticlebelongingtoAcademiaSinica;

(2)WhereBmitstorts;

(3)WhereBviolatesA'sownershipofintellectualpropertyrights.

5.1"Absenceonleave"shallbeoperatedpursuantto"RegulationofAbsenceonleaveforPersonnelservedinallExecutiveYuanorganizationsunderCivilContractualRelationship".

5.2Thedeductionandgrantof"pay-as-you-go"contributionbenefitshallbeoperatedpursuantto"Regulationof'pay-as-you-go'contributionbenefitforPersonnelservedinallorganizationsandschoolsunderCivilContractualRelationship".Certainamountofsalaryshallbedeductedpermonthandaccrueonthefinancialinstituteoverthetermofthisemployment.

5.2.1Anamountequaltosevenpercent(7﹪)ofthemonthlysalaryshallbecontributed.Fiftypercent(50﹪)ofthecontributionshallbedrawnfromB'smonthlysalary.(hereinaftercalled"personalcontributionbenefit")Ashallprovidetheotherfiftypercent(50﹪)ofthecontribution(hereinaftercalled"publiccontributionbenefit"),andshallopenaspecialaccountonfinancialinstituteastoaccumulateandmanagethiscontribution(personalpluspublic).

5.2.2Thetotalamountofthecontributionbenefits(personalpluspublic)shallbegrantedtoB,ifatanytime(a)BleavestheofficeontheexpiryofthisAgreement,(b)BvacatestheofficepriortotheexpirationdatewiththeconsentofA,and(c)Bdeceasesduetoundertakingofduty,illnessoraccident.

5.2.3TheamountofpersonalcontributionbenefitsaccumulatedshallbegrantedtoB,ifatanytime(a)AterminatesthisAgreementinasmuchasBbreachesanyobligation,and(b)BresignsfromtheofficepriortotheexpirationdatewithouttheconsentofA.

5.2.4AnymatteroreventnotprovidedinthecontextofthisArticleshallbeoperatedpursuantto"Regulationof'pay-as-you-go'contributionbenefitforPersonnelservedinallorganizationsandschoolsunderCivilContractualRelationship"andrelevantregulations.

5.3DuringthetermofthisAgreement,AshallinsureBsubjecttothetermsandconditionspursuanttolaborinsuranceregulationsandnationalhealthinsuranceregulations.

6.BothpartiesagreethatAshallownproprietaryrightpertainingtotheliteraryworksorachievementspletedbyBundertheprojectsinitiatedorcoordinatedbyAduringthetermofthisAgreement.Theownershipofintellectualpropertyrights(includingbutnotlimitedtocertainpatents,trademarks,copyrights,technicalinformationandknow-how)accruedfromtheliteraryworksorachievementshereincontainedissubjecttotherelevantregulationsandrulesprovidedbyA.

7.Expiration

Attheexpirationofthetermofthisagreement,theemploymentrelationshipshallautomaticallyterminatewithoutanycondition.Anewemploymentagreementshallbesignedfortherenewalandcontinuanceofsuchrelationship,ifagreedtoanybybothparties.

8.AnymatteroreventnotprovidedinthecontextofthisAgreementshallbegovernedbyandinterpretedinaccordancewith"EmploymentRegulationforPersonnelunderCivilContractualRelationship"(stipulatedbyAcademiaSinica)"EmploymentRegulationforPersonnelservedinallExecutiveYuanorganizationsunderCivilContractualRelationship".

9.GoverningLanguage

TheChinesetextofthisAgreementshallbedeemedtheoriginal.IntheeventofanydisputeormisunderstandingastotheinterpretationofthelanguageortermsofthisAgreement,theChineselanguage
