(4)Shippingadvice；ImmediatelyaftercompletionofloadingofgoodsonboardthevesseltheSellershalladvisetheBuyerbyfaxore-mailofthecontractnumber,nameofgoods,quantityorweightloaded,invoicevalue,nameofvessel,portofshipment,sailingdateandportofdestination.

ShouldtheBuyerbeunabletoarrangeinsuranceintimeowingtotheSeller'sfailuretogivethementionedadviceofshipmentbyfaxore-mail,theSellershallbeheldresponsibleforanyandalldamagesand/orlossattributabletosuchfailure.

(5)Inspection:Incasethequality,quantityorweightofthegoodsbefoundnotinconformitywiththosestipulatedinthisContractafterreinspectionbytheChinaEntry-ExitInspectionQuarantine(CIQ)within60daysafterarrivalofthegoodsattheportofdestination,theBuyershallreturnthegoodsorlossesuponthestrengthofInspectionCertificateissuedbyCIQ,withtheexceptionofthoseclaimsforwhichtheinsurersorownersofthecarryingvesselareliable.AllexpensesandlossesarisingfromthereturnofthegoodsorclaimsshouldbebornebytheSeller.

(6)ForceMajeure:TheSellershallnotberesponsibleforlatedeliveryornon-deliveryofthegoodsowingto"ForceMajeure"causes,suchaswar,flood,fire,storm,heavysnow,earthquake,seaquake,etc.However,insuchcases,theSellershallimmediatelynotifytheBuyerbye-mailorfaxabouttheaccidentandfurnishtheBuyerwithacertificateattestingsucheventorevents.Ifthe"ForceMajcure"causelastsover60days,theBuyershallhavetherighttocanceltheContractortheundeliveredpartoftheContract.

(7)Claims:

Shouldthequality,quantityand/orweightbefoundnotinconformitywiththosestipulatedinthisContract,asidefromthoseusualnaturalchangesofqualityandweightintransitandlosseswithintheresponsibilityoftheshippingcompanyand/orinsurancecompany,theBuyershallhavetherightwithin30daysafterthearrivalofthegoodsattheportofdestination,tolodgeclaimsconcerningthequality,quantityorweightofthegoods,buttheBuyershouldprovidetheSellerwiththecertificatesissuedbytheInspectionandQuarantineOrganizationconcerned.

(8)Arbitration:AlldisputesinconnectionwiththisContractortheexecutionthereofshallbeamicablysettledthroughnegotiation.Incasenosettlementcanbereachedbetweenthetwoparties,thecaseunderdisputeshallbesubmittedtotheForeignTradeArbitrationCommissionoftheChinaCouncilforthePromotionofInternationalTradeforarbitration.ArbitrationshalltakeplaceinBeijing,ChinaandshallbeexecutedinaccordancewiththeProvisionalRulesofProcedureofthesaidcommission,andthedecisionmadebythecommissionshallbeacceptedasfinalandblindinguponbothparties.
