3.ThePurchaserfurtheragreestocutandremoveallofthetimberconveyedinthiscontractinstrictaccordancewiththefollowingconditions:

(a)UnlessanextensionoftimeisagreeduponinwritingbetweentheSellerandPurchaser,alltimbershallbepaidfor,cut,andremovedonorbeforeandnoneafterthe_____dayof_______,20___,andanymaterialnotsoremovedshallreverttotheSeller.

(b)Unmarkedtreesandyoungtimbershallbeprotectedagainstunnecessaryinjuryfromfellingandloggingoperations.?If,however,unmarkedtreesarecut,damagesshallbepaidtheSellerattherateof$1pertreeperMbd.ft.forallotherspecies,andintheeventthatanysuchtreesarecut,saidtreesshallremainuponthepremisesandshallbethepropertyoftheSeller.

(c)NecessaryloggingroadsshallbeclearedbythePurchaseronlyaftertheirlocationshavebeendefinitelyagreeduponwiththeSellerorhisrepresentative,andanytreestoberemovedintheclearingoperationsshallfirstbemarkedbytheSeller.

(d)Duringthelifeofthiscontractandontheareacovered,careshallbeexercisedbythePurchaserandhisemployeesagainstthestartingandspreadoffire,andtheyshalldoallintheirpowertopreventandcontrolfires.

(e)Anyliabilityfordamage,destruction,orrestorationofprivateorpublicimprovementsorpersonaldamagesoccasionedbyorintheexerciseofthiscontractshallbethesoleresponsibilityofthePurchaser,andthePurchasershallsaveharmlesstheSelleronaccountofsuchdamages.

(f)Theriskiflossordamagetothetreeshereinpurchased,fromanyandallcauseswhatever,shallbebornebypurchasersfromthedatehereof.

4.TheSellerandPurchasermutuallyagreeasfollows:

(a)Allmodificationsofthecontractwillbereducedtowriting,dated,signed,andwitnessedandattachedtothiscontract.

(b)Anyneedforreassignmentofinterestofeitherpartymaybechangedwithin10daysfollowingwrittenconsentbybothparties.?Alltermsofthiscontractlegallybindthenamedrepresentativestoexcusethisdocumentaswritten.
