標(biāo)人同意延長的，應(yīng)相應(yīng)延長其投標(biāo)保證金的有效期，但不得要求或被允許修改或撤銷其投標(biāo)文件；投標(biāo)人拒絕延長的，其投標(biāo)失效，但投標(biāo)人有權(quán)收回其投標(biāo)保證金。Iftheextensionofthebidvalidityperiodisnecessaryduetospecialcircumstances,theinvitershallnotifyallbiddersinwritingtoextendthebidvalidityperiod.Ifthebidderagreestoextendthebidvalidity,shallextendthevalidityofitsbidsecurityaccordingly,providedthat,shallnotrequireorbeallowedtomodifyorrevokeitsbiddocuments;Ifabidderrefusestoextendhisbid,hisbidfails,howeverthebidderhastherighttowithdrawhisbidbond.4.承包人Contractor4.1承包人的一般義務(wù)Contractor'sgeneralobligations4.1.1遵守法律CompliancewithLaw承包人在履行合同過程中應(yīng)遵守法律，并保證發(fā)包人免于承擔(dān)因承包人違反法律而引起的任何責(zé)任。

Thecontractorshallabidebythelawintheperformanceofthecontractandensuretheemployerfreefromanyliabilityarisingfromthecontractor'sviolationoflaw.4.1.2依法納稅Taxpaymentpursuanttolaw承包人應(yīng)按有關(guān)法律規(guī)定納稅，應(yīng)繳納的稅金包括在合同價(jià)格內(nèi)。

Thecontractorshallpaytaxespursuanttorelevantlawsandregulations,andthetaxespayableshallbeincludedinthecontractprice.4.1.3完成各項(xiàng)承包工作Completionofcontractwork承包人應(yīng)按合同約定以及監(jiān)理人根據(jù)第3.4款作出的指示，實(shí)施、完成全部工程，并修補(bǔ)工程中的任何缺陷。除專用合同條款另有約定外，承包人應(yīng)提供為完成合同工作所需的勞務(wù)、材料、施工設(shè)備、工程設(shè)備和其他物品，并按合同約定負(fù)責(zé)臨時(shí)設(shè)施的設(shè)計(jì)、建造、運(yùn)行、維護(hù)、管理和拆除。Thecontractorshall,inaccordancewiththecontractandtheinstructio?nsgivenbythesupervisorunderarticle3.4.,carryout,completealltheworksandrepairanydefectsintheworks.Unlessotherwisestipulatedintheparticularconditionhereof,thecontractorshallprovidetheservices,materials,constructionequipment,engineeringequipmentandotheritemswhichnecessaryforthecompletionofthecontractworkandshallberesponsiblefordesign,construction,operation,maintenance,managementanddemolitionofthetemporaryfacilitiesasstatedinthecontract.4.1.4對(duì)設(shè)計(jì)、施工作業(yè)和施工方法，以及工程的完備性負(fù)責(zé)

Beresponsibleforthedesignandoperation/methodsofconstruction,aswellasthecompletenessoftheproject承包人應(yīng)按合同約定的工作內(nèi)容和進(jìn)度要求，編制設(shè)計(jì)、施工的組織和實(shí)施計(jì)劃，并對(duì)所有設(shè)計(jì)、施工作業(yè)和施工方法，以及全部工程的完備性和安全可靠性負(fù)責(zé)。

Thecontractorshall,subjecttotheworkcontentandprogressrequirementsstipulatedinthecontract,preparetheorganizationandimplementationplanofbiddingsectionconstructionandshallberesponsibleforalldesign,constructionoperationsandconstructionmethods,aswellasthecompletenessandsafetyandreliabilityofallprojects.4.1.5保證工程施工和人員的安全Ensurethesafetyofprojectconstructionandpersonnel承包人應(yīng)按第9.2款約定采取施工安全措施，確保工程及其人員、材料、設(shè)備和設(shè)施的安全，防止因工程施工造成的人身傷害和財(cái)產(chǎn)損失。

Thecontractorshall,asstipulatedinarticle10.2,takeconstructionsafetymeasurestoensurethesafetyoftheprojectanditspersonnel,materials,equipmentandfacilities,andtopreventpersonalinjuryandpropertylosscausedbytheprojectconstruction.4.1.6負(fù)責(zé)施工場地及其周邊環(huán)境與生態(tài)的保護(hù)工作

Responsiblefortheprotectionoftheconstructionsiteanditssurroundingenvironmentandecology.承包人應(yīng)按照第9.4款約定負(fù)責(zé)施工場地及其周邊環(huán)境與生態(tài)的保護(hù)工作。

Thecontractorshall,inaccordancewitharticle10.4,beresponsiblefortheprotectionoftheconstructionsiteanditssurroundingenvironmentandecology.4.1.7避免施工對(duì)公眾與他人的利益造成損害

Avoidanceofdamagetothepublicandothers'interestscausedbyconstruction承包人在進(jìn)行合同約定的各項(xiàng)工作時(shí)，不得侵害發(fā)包人與他人使用公用道路、水源、市政管網(wǎng)等公共設(shè)施的權(quán)利，避免對(duì)鄰近的公共設(shè)施產(chǎn)生干擾。承包人占用或使用他人的施工場地，影響他人作業(yè)或生活的，應(yīng)承擔(dān)相應(yīng)責(zé)任。

Thecontractorshall,incarryingoutalltheworkstipulateduponinthecontract,notinfringeupontheemployer'srighttousepublicroads,watersources,municipalpipenetworksandotherpublicfacilitieswithothersandavoidinterferencewithneighboringpublicfacilities.Ifthecontractoroccupiesorusesanotherperson'sconstructionsite,whichaffectanotherperson'sworkorlife,shallbearcorrespondingresponsibilitiesthereof.4.1.8為他人提供方便Provisionofconvenienceforothers承包人應(yīng)按監(jiān)理人的指示為他人在施工場地或附近實(shí)施與工程有關(guān)的其他各項(xiàng)工作提供可能的條件。除合同另有約定外，提供有關(guān)條件的內(nèi)容和可能發(fā)生的費(fèi)用，由監(jiān)理人按第3.5款商定或確定。

Thecontractorshall,asinstructedbythesupervisor,providepossibleconditionsforotherstocarryoutotherworksrelatedtotheprojectatorneartheconstructionsite.Unlessotherwisestipulatedinthecontract,thecontentsofrelevantconditionsandpossibleexpensesshallbeagreedordeterminedbythesupervisorinaccordancewitharticle3.5.4.1.9工程的維護(hù)和照管MaintenanceandCareofWorks工程接收證書頒發(fā)前，承包人應(yīng)負(fù)責(zé)照管和維護(hù)工程。工程接收證書頒發(fā)時(shí)尚有部分未竣工工程的，承包人還應(yīng)負(fù)責(zé)該未竣工工程的照管和維護(hù)工作，直至竣工后移交給發(fā)包人為止。Thecontractorshall,priortoissuanceoftheprojectacceptancecertificate,beresponsibleforthecareandmaintenanceoftheproject.Thecontractorshallalsoberesponsibleforthecareandmaintenanceofsomeunfinishedprojectsatthetimewhenissuanceoftheprojectacceptancecertificate,untilitishandedovertotheemployeraftercompletion.4.1.10其他義務(wù)Otherobligations承包人應(yīng)履行合同約定的其他義務(wù)。

Thecontractorshallperformotherobligationsstipulatedinthecontract.4.2履約擔(dān)保PerformanceSecurity承包人應(yīng)保證其履約擔(dān)保在發(fā)包人頒發(fā)工程接收證書前一直有效。發(fā)包人應(yīng)在工程接收證書頒發(fā)后28天內(nèi)將履約擔(dān)保退還給承包人。Thecontractorshallensureitsperformanceguaranteeremainvaliduntiltheemployerissuestheprojectacceptancecertificate.Theemployershallreturntheperformanceguaranteetothecontractorwithin28dayssubsequenttotheprojectacceptancecertificateisissued.4.3分包Subcontracting4.3.1承包人不得將其承包的全部工程轉(zhuǎn)包給第三人，或?qū)?/p>
