民辦教育促進法匯編（完整版）資料(可以直接使用，可編輯優(yōu)秀版資料，歡迎下載）LawofthePeople'sRepublicofChinaonthePromotionofPrivately-runSchools(Adoptedatthe31stMeetingoftheStandingCommitteeoftheNinthNationalPeople'sCongressonDecember28,2002andpromulgatedbyOrderNo.80ofthePresidentofthePeople'sRepublicofChinaonDecember28,2002)ContentsChapterIGeneralProvisionsChapterIIEstablishmentChapterIIIOrganizationandActivitiesofSchoolsChapterIVTeachersandEducateesChapterVSchoolAssetsandFinancialManagementChapterVIAdministrationandSupervisionChapterVIISupportandRewardChapterVIIIAlterationandTerminationChapterIXLegalResponsibilityChapterXSupplementaryProvisionsChapterIGeneralProvisionsArticle1ThisLawisenactedinaccordancewiththeConstitutionandtheEducationLawwithaviewtoimplementingthestrategyofinvigoratingthecountrythroughscience,technologyandeducation,promotingthesounddevelopmentofprivately-runschools,andsafeguardingthelawfulrightsandinterestsoftheprivately-runschoolsandtheeducatees.Article2ThisLawshallbeapplicabletoactivitiesconductedbypublicorganizationsorindividuals,otherthanStateorgans,toestablishandrunschoolsandotherinstitutionsofeducationwithnon-governmentalfinancialfunds,whicharegearedtotheneedofsociety.IncasestowhichnoprovisionsofthisLawareapplicable,theprovisionsintheEducationLawandotherlawsconcerningeducationshallapply.Article3Privately-runschoolsbelongtopublicwelfareundertakingsandconstituteacomponentpartofthecauseofsocialisteducation.Withregardtoprivately-runschools,theStateappliestheprinciplesofenthusiasticencouragement,vigoroussupport,correctguidance,andadministrationaccordingtolaw.People'sgovernmentsatalllevelsshallincorporatetheundertakingsoftheprivately-runschoolsintotheirplansofnationaleconomicandsocialdevelopment.Article4Privately-runpolicyschoolsshallabidebylawsandregulations,implementtheeducationoftheState,guaranteetheeducationalqualityanddevotetheireffortstothetrainingofvarioustypesofpeopleforthecauseofsocialistdevelopment.Privately-runschoolsshallimplementtheprincipleofseparatingeducationfromreligion.NoorganizationsorindividualsmaymakeuseofreligiontoconductactivitiesdesignedtointerferewiththeeducationalsystemoftheState.Article5Privately-runschoolsandgovernment-runschoolsshallshareequallegalstatus,andtheStatesafeguardstheautonomyoftheprivately-runschools.TheStateprotectsthelawfulrightsandinterestsofthesponsors,principals,teachersandstaffmembersandeducateesofprivately-runschools.Article6TheStateencouragesdonationsmadeforestablishingandrunningschools.TheStaterewardsandcommendsorganizationsandindividualsthathavemadeoutstandingcontributionstothedevelopmentoftheundertakingsofprivately-runschools.Article7TheadministrativedepartmentforeducationundertheStateCouncilshallbeinchargeoftheoverallplanning,comprehensivecoordinationandmacro-administrationoftheworkrelatingtoprivately-runschoolsnationwide.TheadministrativedepartmentforlaborandsocialsecurityandtherelevantdepartmentsundertheStateCouncilshallrespectivelybeinchargeoftheworkrelatingtotheprivately-runschoolswithinthescopeoftheirdutiesasdefinedbytheStateCouncil.Article8Theadministrativedepartmentsforeducationunderthelocalpeople'sgovernmentsatorabovethecountylevelshallberesponsiblefortheworkrelatingtoprivately-runschoolsintheirownadministrativeregions.Theadministrativedepartmentsforlaborandsocialsecurityandtherelevantdepartmentsunderthelocalpeople'sgovernmentsatorabovethecountylevelshallrespectivelyberesponsiblefortheworkrelatingtoprivately-runschoolswithinthescopeoftheirduties.ChapterIIEstablishmentArticle9Publicorganizationsthatestablishprivately-runschoolsshallpossessthequalificationsofalegalperson.Individualsthatestablishprivately-runschoolsshallpossesspoliticalrightsandfullcapacityforcivilconduct.Aprivately-runschoolshallhavethequalificationsofalegalperson.Article10Theestablishmentofaprivately-runschoolshallmeetthelocalneedforeducationaldevelopmentandtherequirementsprovidedforbytheeducationLawandrelevantlawsandregulations.Thestandardsfortheestablishmentofprivately-runschoolsshall,mutatismutandis,conformtothosefortheestablishmentofgovernment-runschoolsofthesamegradeandcategory.Article11Theestablishmentofprivately-runschoolsthatprovideeducationforacademiccredentials,pre-schooleducation,trainingforpreparingself-studyexaminationsandotherculturaleducationshallbesubjecttoexaminationandapprovalbytheadministrativedepartmentsforeducationunderthepeople'sgovernmentsatorabovethecountylevelwithinthelimitsoftheirpowersdefinedbytheState;theestablishmentofaprivately-runschoolthatmainlyprovidestrainingforvocationalskills,includingtrainingforvocationalqualification,shallbesubjecttoexaminationandapprovalbytheadministrativedepartmentforlaborandsocialsecurityunderthepeople'sgovernmentatorabovethecountylevelwithinthelimitsofitspowersdefinedbytheState,whichshallsendaduplicateoftheapprovaldocumenttotheadministrativedepartmentforeducationatthesamelevelfortherecord.Article12Toapplyforpreparingtoestablishaprivately-runschool,thesponsorshallsubmittotheexaminationandapprovalauthoritythefollowingmaterials:(1)anapplication,thecontentsofwhichmainlyinclude:thesponsor,theaimsofeducation,sizeofthestudentbody,leveloftheschool,formsofeducation,conditionsforestablishingandrunningtheschool,internalmanagementsystem,raisingoffundsandtheirmanagementanduse,etc.;(2)nameofthesponsorsandtheiraddressesorthetitleofthesponsoranditsaddress;(3)sourceoftheassets,amountofthefundsandtheireffectivecertificates,inwhichthepropertyrightsareclearlystated;and(4)wheretheassetsoftheschoolaredonated,anagreementonthedonations,inwhichthenamesofthedonators,theamountoftheassetsdonated,theiruseandmanagement,andtherelevanteffectivecertificatesareclearlystated.Article13Theexaminationandapprovalauthorityshall,within30daysfromthedateitreceivestheapplicationforpreparingtoestablishaprivately-runschool,makeadecisioninwritingonwhethertoapproveitornot.Ifitapprovestheapplication,itshallissueawrittenapprovalforpreparingtoestablishtheschool;andifitdoesnotapprovetheapplication,itshallexplainthereasons.Theperiodofpreparationforestablishmentofsuchaschoolshallnotexceedthreeyears;andifitexceedsthreeyears,thesponsorshallrenewitsapplication.Article14Toapplyforofficialestablishmentofaprivately-runschool,thesponsorshallsubmitthefollowingmaterialstotheexaminationandapprovalauthority:(1)thewrittenapprovalforpreparingtoestablishtheschool;(2)areportonthepreparationsmadefortheestablishment;(3)articlesofassociationoftheschoolandthenamelistsofthecomponentmembersofthefirstexecutivecouncil,boardofdirectorsorotherdecision-makingbodiesoftheschool;(4)effectivecertificatesoftheassetsoftheschool;and(5)qualificationcertificatesoftheprincipal,teachers,andbook-keepersandaccountants.Article15Whereconditionsfortheestablishmentofaschoolaresatisfiedandthestandardsforestablishmentarereached,anapplicationmaydirectlybemadeforitsofficialestablishment,andthematerialsspecifiedinArticle12andsubparagraphs(3),(4)and(5)ofArticle14ofthisLawshallbesubmitted.Article16Whereanapplicationforofficialestablishmentofaprivately-runschoolismade,theexaminationandapprovalauthorityshall,withinthreemonthsfromthedateitreceivestheapplication,makeadecisioninwritingonwhethertoapproveitornot,andserethedecisionontheapplicant;andwhere,inthisregard,anapplicationismadefortheofficialestablishmentofaprivately-runinstitutionofhighereducation,theexaminationandapprovalauthoritymay,withinsixmonthsfromthedateitreceivestheapplication,likewisemakeadecisioninwritingonwhethertoapproveitornotandservethedecisionontheapplicant.Article17Theexaminationandapprovalauthorityshallissuealicenseforestablishmentofaschooltotheprivately-runschoolfortheofficialestablishmentofwhichitgivesapproval.Wheretheexaminationandapprovalauthoritydoesnotapprovetheofficialestablishmentofaschool,itshallexplainthereasons.Article18Whereaprivately-runschoolobtainsthelicenseforestablishmentand,inaccordancewiththeprovisionsofrelevantlawsandadministrativeregulations,registerswiththeregistrationauthority,thelattershallimmediatelyhandlethematterinaccordancewithrelevantregulations.ChapterIIIOrganizationsandActivitiesofSchoolsArticle19Aprivately-runschoolshallsetupanexecutivecouncil,aboardofdirectorsorotherformsofdecision-makingbodiesoftheschool.Article20Theexecutivecouncilortheboardofdirectorsoftheschoolshallbecomposedofthesponsorsortheirrepresentatives,theprincipal,andtherepresentativesoftheteachersandstaffmembers.Morethanone-thirdofthecouncilmembersordirectorsshall,atleast,havefiveyears'educationorteachingexperienceeach.Theexecutivecouncilortheboardofdirectorsoftheschoolshallbecomposedofnotlessthanfivepersons,withoneofthemservingaschairmanofthecouncilorboard.Thenamelistofthechairmanandmembersofthecouncilorthechairmanoftheboardanddirectorsshallbesubmittedtotheexaminationandapprovalauthorityfortherecord.Article21Theexecutivecouncilortheboardofdirectorsofaschoolshallexercisethefollowingfunctionsandpowers:(1)toappointanddismisstheprincipal;(2)toamendthearticlesofassociationoftheschoolandformulaterulesandregulationsoftheschool;(3)tomakedevelopmentplansandapproveannualworkplans;(4)toraisefundsforrunningtheschool,andexamineandverifythebudgetsandfinalaccounts;(5)todecideonthesizeandthewagestandardsoftheteachersandstaffmembers;(6)todecideonthedivision,mergingandterminationoftheschool;and(7)todecideonotherimportantmatters.Thefunctionsandpowersofotherformsofdecision-makingbodiesshallbedefinedinreferencetotheprovisionsofthisArticle.Article22Thechairmanoftheexecutivecouncilortheboardofdirectorsortheprincipalofaprivately-runschoolshallserveasthelegalrepresentativeoftheschool.Article23Aprivately-runschoolshall,inreferencetothequalificationsfortheprincipalofagovernment-runschoolofthesamegradeandcategory,appointitsprincipal,andtheagelimitmayappropriatelybeextendedbothways,andtheappointmentshallbereportedtotheexaminationandapprovalauthorityforverificationandapproval.Article24Theprincipalofaprivately-runschoolshallbeinchargeofeducation,teachingandadministrationoftheschool,andexercisethefollowingfunctionsandpowers:(1)tocarryoutthedecisionsmadebytheexecutivecouncil,boardofdirectorsoranyotherformofdecision-makingbody;(2)toputintoexecutionthedevelopmentplans,drawuptheannualworkplansandfinancialbudgets,andformulatetherulesandregulationsoftheschool;(3)toappointanddismissstaffmembersoftheschool,andgiverewardsandimposepunishments;(4)tomakearrangementsforeducation,teachingandscientificresearch,andensurethequalityofeducationandteaching;(5)toberesponsibleforthedailyworkofschooladministration;and(6)otherpowersdelegatedbytheexecutivecouncil,theboardofdirectorsoranyotherformofdecision-makingbodyoftheschool.Article25Aprivately-runschoolmay,onthebasisoftheirclassifications,thelengthofschoolingandtheiracademicperformanceandinaccordancewiththerelevantregulationsoftheState,issueacademiccredentials,certificatesforcompletingacourseorqualificationcertificatesoftrainingtothestudentsitenrolled.StudentswhoreceivetraininginvocationalskillsmaybeawardedvocationalqualificationcertificatesoftheStatewhentheyareconsideredqualifiedbythevocationalskillsappraisalauthorityapprovedbytheState.Article26Aprivately-runschoolshall,inaccordancewithlaw,ensurethattheteachersandstaffmembersparticipateindemocraticmanagementandsupervisionthroughtherepresentativeassemblyoftheteachersandstaffmemberswiththeteachersasthemainbody,orthroughotherforms.Teachersandstaffmembersofaprivately-runschoolshall,inaccordancewiththeTradeUnionLaw,havetherighttoformtradeunionorganizationstoprotecttheirlawfulrightsandinterests.ChapterIVTeachersandEducateesArticle27Teachersandeducateesofprivately-runschoolsshallenjoyequallegalstatusastheteachersandeducateesofgovernment-runschoolsshall.Article28Teachersappointedbyprivately-runschoolsshallpossessthequalificationsforteachingspecifiedbytheState.Article29Privately-runschoolsshallconductideologicalandmoraleducationandprofessionaltrainingamongteachers.Article30Privately-runschoolsshallguaranteethewagesandwelfarebenefitsforteachersandstaffmembersaccordingtolaw,andpaysocialinsurancepremiumsforthem.Article31Theteachersandstaffmembersofprivately-runschoolsshall,inaccordancewithlaw,shareequalrightswiththoseofgovernment-runschoolsinrespectofprofessionaltraining,appointmentofposts,calculationofthelengthofserviceasateacherorstaffmember,commendationandreward,andsocialactivities.Article32Privately-runschoolsshall,inaccordancewithlaw,safeguardthelawfulrightsandinterestsofeducatees.Privately-runschoolsshall,inaccordancewiththeregulationsoftheState,establishthesystemforadministrationofstudents'recordsandgiverewardsandsanctionstoeducatees.Article33Educateesofprivately-runschoolsshallenjoyequalrightsasthoseofgovernment-runschoolsofthesamegradeandcategoryinrespectofadmissionintoschoolsofahighergrade,employment,preferentialtreatmentandbeingelectedasadvancedstudents.ChapterVSchoolAssetsandFinancialManagementArticle34Privately-runschoolsshall,inaccordancewithlaw,establishfinancialandaccountingsystemsandassetsmanagementsystem,andkeepaccountbooksinaccordancewiththerelevantregulationsoftheState.Article35Privately-runschoolsshallenjoypropertyrightsofthelegalpersonsinrespectoftheassetsprovidedbysponsorstoprivately-runschools,State-ownedassets,donatedpropertyandschoolaccumulation.Article36Duringtheperiodofexistenceofprivately-runschools,alltheassetsshall,inaccordancewithlaw,bemanagedandusedbytheschools,andnoorganizationorindividualmaytakeillegalpossessionofthem.Noorganizationorindividualsmay,inviolationoflawsorregulations,collectanyfeesfromprivately-runinstitutionsofeducation.Article37Theitemsandratesoffeestobecollectedbyprivately-runschoolsfromeducateeswhoreceiveeducationfromacademiccredentialsshallbeworkedoutbytheschools,submittedtorelevantdepartmentsforapprovalandmadepublic;andtheitemsandratesoffeestobecollectedfromothereducateesshallbeworkedoutbytheschoolsconcerned,submittedtorelevantdepartmentsfortherecordandmadepublic.Thefeescollectedbyprivately-runschoolsshallbeusedmainlyforeducationalandteachingactivitiesandtheimprovementofschoolsconditions.Article38Theuseandthefinancialmanagementoftheassetsforprivately-runschoolsshallbesubjecttosupervisionbytheexaminationandapprovalauthorityandrelevantdepartments.Privately-runschoolsshallpreparetheirfinancialandaccountingstatementstowardstheendofeachfiscalyear,entrustpublicaccountingfirmstoauditthestatementsaccordingtolaw,andpublishtheauditresults.ChapterVIAdministrationandSupervisionArticle39AdministrativeDepartmentsforeducationandtherelevantdepartmentsshallprovideguidancetoprivately-runschoolsinrespectofeducationandteachingandtrainingamongteachers.Article40Administrativedepartmentsforeducationandtherelevantdepartmentsshall,inaccordancewithlaw,exercisesupervisionoverandprovideguidancetoprivately-runschools,inordertopromotetheenhancementofthequalityofsuchschools;andtheyshallmakearrangementsorentrustpublicintermediarybodieswiththearrangementsforassessingthelevelandthequalityofeducationofsuchschools,andmaketheresultsoftheassessmentknowntothegeneralpublic.Article41Thegeneralregulationsandadvertisementsforstudentenrollmentofprivately-runschoolsshallbesubmittedtotheexaminationandapprovalauthorityfortherecord.Article42Whereaprivately-runschoolinfringesuponthelawfulrightsandinterestsofeducatees,theeducateesandtheirrelativesshallhavetherighttomakepetitiontotheadministrativedepartmentforeducationandanyrelevantdepartment,andthesaiddepartmentshallhandleitwithoutdelay.Article43TheStatesupportsandencouragespublicintermediarybodiestoprovideservicestoprivately-runschools.ChapterVIISupportandRewardArticle44People'sgovernmentsatorabovethecountylevelmaysetupspecialfundsforfinancingthedevelopmentofprivately-runschoolsandforrewardingandcommendingthecollectivesandindividualsthathavemadeoutstandingcontributions.Article45People'sgovernmentsatorabovethecountylevelmaytakesuchmeasuresasfinancialaidandtheleaseortransferofidleState-ownedassetsinsupportofprivately-runschools.Article46Privately-runschoolsshallenjoypreferentialtaxationpolicyformulatedbytheState.Article47Civilian-runschoolsmay,inaccordancewiththerelevantlawsandregulationsoftheState,acceptdonationsaffordedbycitizens,legalpersonsorotherorganizations.TheState,inaccordancewithrelevantregulations,appliespreferentialtaxationpolicytocitizens,legalpersonsorotherorganizationsthatdonatepropertytoprivately-runschools,andbestowscommendationsonthem.Article48TheStateencouragesfinancialinstitutionstosupportthedevelopmentofprivately-runschoolsbymeansofcredit.Article49Whereapeople'sgovernmententrustsaprivately-runschoolwiththetaskofcompulsoryeducation,itshall,inaccordancewiththeagreementofentrustment,appropriatethenecessaryamountoffundsforeducation.Article50Whereaprivately-runschoolisconstructedorexpanded,thepeople'sgovernmentconcernedshallgiveitpreferentialtreatmentinaccordancewiththeregulationsontheuseoflandfor,andtheconstructionof,publicwelfareundertakings.Nolandtobeusedforeducationmaybeusedforotherpurposes.Article51Afterthecostofaprivately-runschoolisdeducted,thefundsforitsdevelopmentarewithheldandthesumofmoneyforothernecessaryexpensesisdrawninaccordancewiththerelevantregulationsoftheState,thefundprovidersmayobtainareasonableamountofrequitalfromthecashsurplusoftheschool.SpecificmeasuresforobtainingreasonableamountsofrequitalshallbeformulatedbytheStateCouncil.Article52TheStatetakesmeasurestosupportandencouragepublicorganizationsandindividualstoestablishandrunprivately-runschoolsforthedevelopmentofeducationinminoritynationalityareasandinout-lyingandpoverty-strickenareas.ChapterVIIIAlterationandTerminationArticle53Theexecutivecouncilortheboardofdirectorsofaprivately-runschooltobedividedormergedintootherschoolsshall,afterfinancialsettlement,applytotheexaminationandapprovalauthorityforapproval.Whereaprivately-runschoolappliesfordivisionormerging,theexaminationandapprovalauthorityshall,withinthreemonthsformthedateitreceivestheapplication,giveareplyinwriting;andwheretheapplicationismadeforthedivisionormergingofaprivately-runinstitutionofhighereducation,theexaminationandapprovalauthoritymay,withinsixmonthsfromthedateitreceivestheapplication,likewisegiveareplyinwriting.Article54Foralterationofthesponsorofaprivately-runschool,themattershallbeputforthbythesponsorand,afterfinancialsettlementanduponagreementbytheexecutivecouncilortheboardofdirectorsoftheschool,submittedtotheexaminationandapprovalauthorityforverificationandapproval.Article55Foralterationofthename,level,orcategoryofaprivately-runschool,themattershallbesubmittedbytheexecutivecouncilortheboardofdirectorsoftheschooltotheexaminationandapprovalauthorityforapproval.Whereanapplicationismadeforthealterationofaprivately-runschoolfromonetypetoanother,theexaminationandapprovalauthorityshall,withinthreemonthsfromthedateitreceivestheapplication,giveareplyinwriting;andwheretheapplicationismadeforalterationtoaprivately-runinstitutionofhighereducation,theexaminationandapprovalauthoritymay,withinsixmonthsfromthedateitreceivestheapplication,likewisegiveareplyinwriting.Article56Whereaprivately-runschoolisfoundinoneofthefollowingcircumstances,itshallbeterminated:(1)itisrequiredtobeterminatedaccordingtotheprovisionsofthearticlesofassociationoftheschool,andtheterminationisapprovedbytheexaminationandapprovalauthority;(2)thelicenseforrunningtheschoolisrevoked;or(3)itcannotcontinueduetoinsolvency.Article57Whenaprivately-runschoolistobeterminated,itshallmakeproperarrangementsforthestudentsinschool.Whenaprivately-runschoolprovidingcompulsoryeducationistobeterminated,theexaminationandapprovalauthorityshallassisttheschooltomakearrangementsforthestudentstocontinuetheirstudies.Article58Whenaprivately-runschoolistobeterminated,itshallmakefinancialsettlementaccordingtolaw.Whereaprivately-runschoolrequeststerminationitself,itshallmakearrangementsforthesettlement;whereitisabolishedbytheexaminationandapprovalauthorityaccordingtolaw,thesettlementshallbearrangedbytheauthority;andwhereitisterminatedbecauseitcannotcontinueduetoinsolvency,thesettlementshallbearrangedbythePeople'sCourt.Article59Propertyofaprivately-runschoolshallbeliquidatedinthefollowingorder:(1)tuitionfeesandextrasandotherexpensespaidbyeducateesthatshouldbereturned;(2)wagespayabletotheteachersandstaffmembersandthesocialinsurancepremiumsthatshouldbepaid;and(3)otherdebtsthatshouldbeclearedoff.Theremainingpropertyofaprivately-runschoolafterthedebtsmentionedaboveareclearedoffshallbedisposedofinaccordancewiththeprovisionsofrelevantlawsandadministrativeregulations.Article60Whenaprivately-runschoolisterminated,thelicenseforrunningtheschoolshallbetakenback,itssealsdestroyedanditsregistrationcancelledbytheexaminationandapprovalauthority.ChapterIXLegalResponsibilityArticle61Where,inconductingeducationactivities,aprivately-runschoolviolatestheprovisionsoftheEducationLawortheTeachersLaw,itshallbepunishedinaccordancewiththerelevantprovisionsoftheEducationLawortheTeachersLaw.Article62Whereaprivately-runschoolcommitsoneofthefollowingacts,theexaminationandapprovalauthorityortherelevantdepartmentshallorderittorectifywithinatimelimitandgiveitadisciplinarywarning;ifthereareunlawfulgainsderivedtherefrom,theyshallbeconfiscatedafterreturningthefeescollected;ifthecircumstancesareserious,itshallbeorderedtostopenrollingstudentsanditslicenseforrunningtheschoolshallberevoked;andifacrimeisconstituted,itshallbeinvestigatedforcriminalresponsibilityaccordingtolaw:(1)dividingormergingtheprivately-runschoolwithoutauthorization;(2)alteringthename,level,categoryandsponsoroftheprivately-runschoolwithoutauthorization;(3)publishingfalsegeneralregulationsofenrollmentoradvertisementsforthepurposeofdefraudingmoney;(4)unlawfullyissuingorforgingacademiccredential,certificatesofcoursescompleted,certificatesoftrainingorvocationalqualificationcertificates;(5)seriouslyaffectingeducationandteachingduetohaphazardadministration,whichexertsabadinfluenceonsociety;(6)obtainingthelicenseforrunningtheschoolbysubmittingfalsesupportingdocumentsorconcealingimportantfactsbyotherdeceptivemeans;(7)forging,counterfeiting,dealingin,rentingorlendingitslicenseforrunningtheschool;or(8)terminatingtheschoolinbadfaith,illegallywithdrawingitsfundsormisappropriatingthefundsforrunningtheschool.Article63Wheretheexaminationandapprovalauthorityortherelevantdepartmentcommitsoneofthefollowingacts,itshallbeorderedbytheauthorityatthehigherleveltorectify;ifthecircumstancesareserious,thepersonsdirectlyinchargeandtheotherpersonsdirectlyresponsibleshallbegivenadministrativesanctionsaccordingtolaw;ifeconomiclossesarecaused,itshallbeartheresponsibilitytopaycompensationaccordingtolaw;andifacrimeisconstituted,itshallbeinvestigatedforcriminalresponsibilityaccordingtolaw:(1)failingtogiveareplywithintheprescribedtimelimittoanacceptedapplicationfortheestablishmentofaprivately-runschool;(2)givingapprovaltoanapplicationwhichdoesnotconformtotheconditionsprovidedforinthisLaw;(3)causingseriousconsequencesduetocarelessadministration;(4)collectingfeesinviolationoftherelevantregulationsoftheState;(5)infringinguponthelawfulrightsandinterestsofaprivately-runschoo
