外國籍非軍用船舶通過瓊州海峽管理規(guī)則

外國籍非軍用船舶通過瓊州海峽管理規(guī)則第一條根據(jù)《中華人民共和國政府關(guān)于領(lǐng)海的聲明》，瓊州海峽是中國的內(nèi)海，一切外國籍軍用船舶不得通過，一切外國籍非軍用船舶如需通過，必須按照本規(guī)則的規(guī)定申請批準(zhǔn)。第二條為便利對瓊州海峽進(jìn)行管理，設(shè)“中華人民共和國瓊州海峽管理處”（以下簡稱瓊州海峽管理處）。本規(guī)則由瓊州海峽管理處監(jiān)督執(zhí)行。第三條瓊州海峽管理處對瓊州海峽管理的區(qū)域（以下簡稱管理區(qū)）暫定如下：木欄頭燈樁（約北緯２０度０９分３７秒、東經(jīng)１１０度４１分）與生狗吼沙燈樁（約北緯２０度２６分、東經(jīng)１１０度３０分２２秒）聯(lián)線（簡稱東線）以西，▲尾角燈樁（約北緯２０度１３分３０秒、東經(jīng)１０９度５５分３０秒）與臨高角燈樁（約北緯２０度００分２２秒、東經(jīng)１０９度４２分０６秒）聯(lián)線（簡稱西線）以東的水域。第四條外國籍非軍用船舶如需通過瓊州海峽，必須辦理以下手續(xù)：（一）在進(jìn)入管理區(qū)四十八小時(shí)以前或在開出港啟航以前，將船名、國籍、總噸、航速、船身顏色、煙囪標(biāo)志以及何日、何時(shí)由何地開往何處等情況，詳細(xì)電報(bào)瓊州海峽管理處，請求過峽。（二）接到批準(zhǔn)過峽的通知后，應(yīng)在進(jìn)入管理區(qū)二十四小時(shí)以前或在開出港啟航后二小時(shí)內(nèi)，向瓊州海峽管理處確報(bào)進(jìn)入管理區(qū)的時(shí)間。以上請求過峽和批準(zhǔn)過峽等的來往電報(bào)，均由中國外輪代理公司?？诜止敬D(zhuǎn)。第五條瓊州海峽管理處對于已經(jīng)批準(zhǔn)通過海峽的外國籍非軍用船舶，認(rèn)為必要時(shí)，可以臨時(shí)通知禁止通過。第六條外國籍非軍用船舶通過管理區(qū)的時(shí)間，一律以白天為限，均應(yīng)在日出后進(jìn)入管理區(qū)，日落前全部通過管理區(qū)。瓊州海峽管理處根據(jù)申請過峽外國籍非軍用船舶的航速，核準(zhǔn)其進(jìn)出海峽的具體時(shí)間。第七條外國籍非軍用船舶進(jìn)出瓊州海峽一律走中水道，但經(jīng)瓊州海峽管理處特別許可的不在此限。第八條外國籍非軍用船舶通過管理區(qū)時(shí)，應(yīng)在下列規(guī)定的航區(qū)范圍內(nèi)航行：自東線距木欄頭燈樁四海里處至西線距臨高角燈樁四海里處聯(lián)線以北，自東線距木欄頭燈樁六海里處至排尾角燈樁正南四海里處繼至西線距臨高角燈樁十四海里處聯(lián)線以南的水域。第九條外國籍非軍用船舶通過瓊州海峽，必須嚴(yán)格按照所報(bào)時(shí)間及規(guī)定的航區(qū)通行。在進(jìn)入管理區(qū)和在管理區(qū)通行時(shí)，如見有從岸上或艦艇上發(fā)出的信號，應(yīng)立即回答并無條件地執(zhí)行信號要求。由于不遵守上述規(guī)定而發(fā)生的后果概由船方自行負(fù)責(zé)。第十條外國籍非軍用船舶通過瓊州海峽時(shí)，不得使用雷達(dá)。如在航行中遇濃霧、暴雨等視線惡劣的情況，需要使用雷達(dá)時(shí)，應(yīng)向瓊州海峽管理處提出報(bào)告，說明理由以及當(dāng)時(shí)的船位、航速等，經(jīng)批準(zhǔn)后方準(zhǔn)使用。如當(dāng)時(shí)情況緊急，危及船舶航行安全時(shí)，可以一面申報(bào)一面使用，并在事后，將使用起迄時(shí)間和經(jīng)過情況詳細(xì)報(bào)告瓊州海峽管理處備案。第十一條外國籍非軍用船舶通過瓊州海峽時(shí)，不準(zhǔn)進(jìn)行照像、測量以及其他違反中華人民共和國法令的行為。第十二條外國籍非軍用船舶違反本規(guī)則，按下列規(guī)定處理：（一）在未進(jìn)入管理區(qū)之前，可以命令其停止進(jìn)入管理區(qū)，由原路返航繞海南島航行，或者俟其辦妥過峽手續(xù)并經(jīng)批準(zhǔn)后，再行過峽。（二）如果已經(jīng)進(jìn)入管理區(qū)，可以命令其停航并監(jiān)送至?？诟圻M(jìn)行檢查，根據(jù)檢查情況給予處分。在處理后，視情況可以準(zhǔn)其通過管理區(qū)，或令其退出管理區(qū)，直到押送其退出海峽。RULESFORTHECONTROLOFNON-MILITARYVESSELSOFFOREIGNNATIO-NALITYPASSINGTHROUGHTHEQIONGZHOUSTRAITImportantNotice:(注意事項(xiàng))英文本源自中華人民共和國務(wù)院法制局編譯,中國法制出版社出版的《中華人民共和國涉外法規(guī)匯編》(1991年7月版).當(dāng)發(fā)生歧意時(shí),應(yīng)以法律法規(guī)頒布單位發(fā)布的中文原文為準(zhǔn).ThisEnglishdocumentiscomingfromthe

theChinaOcean-shippingAgencyCorporation.Article5Whendeemednecessary,theQiongzhouStraitAdministrativeOfficemay

sendasummarynoticetoforbidanon-militaryvessel

of

foreign

nationalitywhichhasobtainedtheapprovaltopassthroughtheStrait.Article6[*1]Allnon-militaryvessels

nationality

to

pass

through

theadministrativeareashalldosowithoutexceptionwithindaytime.

All

ofthemmustentertheadministrativeareaaftersunriseandleave

it

beforesunset.TheQiongzhouStraitAdministrativeOfficeshall

checkandapprovetheexacttimeforenteringandleavingtheStrait

accordingtothe

speedofthenon-militaryvesselsofforeign

nationalitywhichhave

applied

topassthroughtheStrait.Article7Exceptthosewhichhaveobtainedspecial

usethe

middlewatercourse.Article8Non-military

vessels

nationality

passing

Stake

and

the

point

fournauticalmilesduesouthofthePaiweijiaoLamp

Stakeandthen

the

pointonthewest14nauticalmilesfromthe

LingaojiaoLampStake.Article9Non-militaryvesselsof

foreignnationalitytopassthroughthe

QiongzhouStraitmustdosoin

strictaccordancewith

the

reported

time

and

theprescribedarea.

Iftheyseeanysignalssentfromashoreornavalvesselswhiletheyare

navigatingintoorwithin

the

administrative

area,

theyshall

give

an

immediate

reply

and

unconditionally

carry

outthe

instructionsconveyed

by

the

signals.

Any

consequences

arising

fromfailuretoobservetheabove-mentionedstipulationsshallbeborne

by

thevesselsthemselves.Article10Non-military

vesselsofforeignnationalitypassingthroughthe

QiongzhouStrait

shallnotuseradars.Ifitisnecessarytousetheradar

in

caseof

densefog,rainstorm,orotherbadconditionsaffectingvisibility,the

vesselsshallreporttothe

Qiongzhou

Strait

Administrative

Office

toexplainthe

necessity

and

report

their

positions,

speeds

and

otherinformation.Theymayusetheradaronlyafter

obtaining

permission.

Incaseofanemergencyendangeringnavigationalsafetyof

thevessels,

theymayusetheradarwhilemakingthereports;andafter

the

emergency,

thevesselsshallmakeadetailedreportconcerning

thelengthoftimeforusingtheradarandthewholecourseof

the

incident

to

the

QiongzhouStraitAdministrativeOfficeforthe

record.Article11Photographs,surveysorother

activitiesviolatingtherelevant

laws

andregulationsofthePeople's

Republicof

China

are

forbidden

when

non-militaryvesselsof

foreignnationalitypassthroughtheQiongzhouStrait.Article12Wherenon-militaryvesselsofforeignnationalityviolatetheseRules,thecasesshallbedealtwithasprescribedbelow:(1)Thosevesselsthathavenotyetenteredtheadministrativearea

maybeorderednottoenterbuttogobackbythe

original

route

and

navigateroundtheHainanIsland;

or

they

may

be
