40,41&42fromthenewChapter8toMARPOLAnnexI.1.新增第8章如下:Anewchapter8isadded:“第8章-防止油輪間海上貨油過駁期間造成污染“CHAPTER8–PREVENTIONOFPOLLUTIONDURINGTRANSFEROFOILCARGOBETWEENOILTANKERSATSEA第40條適用范圍Regulation40Scopeofapplication本章中的規(guī)定適用于150總噸及以上從事海上油輪間貨油過駁作業(yè)(過駁作業(yè))的油船及其在2012年4月1日或以后進(jìn)行的過駁作業(yè)。但是,在該日期之前但在第41.1條所要求的過駁作業(yè)計劃經(jīng)主管機關(guān)批準(zhǔn)之后進(jìn)行的過駁作業(yè)應(yīng)盡可能符合過駁作業(yè)計劃。Theregulationscontainedinthischapterapplytooiltankersof150grosstonnageandaboveengagedinthetransferofoilcargobetweenoiltankersatsea(STSoperations)andtheirSTSoperationsconductedonorafter1April2012.However,STSoperationsconductedbeforethatdatebutaftertheapprovaloftheAdministrationofSTSoperationsPlanrequiredunderregulation41.1shallbeinaccordancewiththeSTSoperationsPlanasfaraspossible.本章中的規(guī)定不適用于包括鉆井平臺的固定或浮動平臺;用于近岸石油生產(chǎn)和儲存的浮式生產(chǎn)、存儲和卸載設(shè)施(FPSO);和用于近海儲存已開采石油的浮式儲油裝置(FSU)1 經(jīng)修訂的《防污公約》附則I第7章(第MEPC.117(52)決議)和《聯(lián)合國海洋法公約第56條適用并針對這些操作。RevisedAnnexIofMARPOL,chapter7(resolutionMEPC.117(52))andUNCLOSarticle56areapplicableandaddresstheseoperations.Theregulationscontainedinthischaptershallnotapplytooiltransferoperationsassociatedwithfixedorfloatingplatformsincludingdrillingrigs;floatingproduction,storageandoffloadingfacilities(FPSOs)usedfortheoffshoreproductionandstorageofoil;andfloatingstorageunits(FSUs)usedfortheoffshorestorageofproducedoil1.3.本章中的規(guī)定不適用于船舶加裝燃油作業(yè)。Theregulationscontainedinthischaptershallnotapplytobunkeringoperations.4.本章中的規(guī)定條款不適用于為保障船舶安全或海上人命救助,或為應(yīng)對具體污染事故以最大華洋海事中心HMCSHIPTOSHIPOPERATIONSPLAN限度減少污染損害而進(jìn)行的過駁作業(yè)。TheregulationscontainedinthischaptershallnotapplytoSTSoperationsnecessaryforthepurposeofsecuringthesafetyofashiporsavinglifeatsea,orforcombatingspecificpollutionincidentsinordertominimizethedamagefrompollution.5.本章中的規(guī)定不適用于其中一條船為軍艦、海軍輔助船舶或者其他由國家擁有或經(jīng)營并在當(dāng)時僅用于政府非商業(yè)服務(wù)的船舶的過駁作業(yè)。但是,各國應(yīng)通過采取不妨害此類船舶操作或操作能力的適當(dāng)措施確保過駁作業(yè)的方式盡可能實際合理地符合本章的要求。TheregulationscontainedinthischaptershallnotapplytoSTSoperationswhereeitheroftheshipsinvolvedisawarship,navalauxiliaryorothershipownedoroperatedbyaStateandused,forthetimebeing,onlyongovernmentnon-commercialservice.However,eachStateshallensure,bytheadoptionofappropriatemeasuresnotimpairingoperationsoroperationalcapabilitiesofsuchshipsthattheSTSoperationsareconductedinamannerconsistent,sofarasisreasonableandpracticable,withthischapter.第41條關(guān)于安全與環(huán)境保護(hù)的一般規(guī)定Regulation41GeneralRulesonsafetyandenvironmentalprotection任何從事過駁作業(yè)的油輪均須在不晚于2011年1月1日或以后進(jìn)行的第一次年度、中期或換證檢驗時,隨船攜帶一份規(guī)定如何進(jìn)行過駁作業(yè)的計劃(過駁作業(yè)計劃)。每艘油輪的過駁作業(yè)計劃應(yīng)經(jīng)主管機關(guān)批準(zhǔn)。過駁作業(yè)計劃應(yīng)用船上工作語言寫成。AnyoiltankerinvolvedinSTSoperationsshallcarryonboardaPlanprescribinghowtoconductSTSoperations(STSoperationsPlan)notlaterthanthedateofthefirstannual,intermediateorrenewalsurveyoftheshiptobecarriedoutonorafter1January2011.Eachoiltanker’sSTSoperationsPlanshallbeapprovedbytheAdministration.TheSTSoperationsPlanshallbewrittenintheworkinglanguageoftheship.過駁作業(yè)計劃的編寫應(yīng)考慮到本組織所確定的過駁作業(yè)最佳實踐導(dǎo)則22 國際海事組織經(jīng)修訂的“油污手冊,第一部分:預(yù)防”,以及國際航運公會和石油公司國際海事論壇的“船到船過駁指南:石油”,2005年第四版。IMO’s“ManualonOilPollution,SectionI,Prevention”asamended,andtheICSandOCIMF“Shipto-shipTransferGuide,Petroleum”,fourthedition,2005.TheSTSoperationsPlanshallbedevelopedtakingintoaccounttheinformationcontainedinthebestpracticeguidelinesforSTSoperationsidentifiedbytheOrganization2.TheSTSoperationsPlanmaybeincorporatedintoanexistingSafetyManagementSystemrequiredbychapterIXoftheInternationalConventionfortheSafetyofLifeatSea,1974,asamended,ifthatrequirementisapplicabletotheoiltankerinquestion.任何適用本章規(guī)定并從事過駁作業(yè)的油輪須遵守其過駁作業(yè)計劃。AnyoiltankersubjecttothischapterandengagedinSTSoperationsshallcomplywithitsSTSoperationsPlan.華洋海事中心HMCSHIPTOSHIPOPERATIONSPLAN全面掌控過駁作業(yè)的人員應(yīng)具備履行所有相關(guān)職責(zé)的資格,這些資格應(yīng)考慮到本組織所確定的過駁作業(yè)最佳實踐導(dǎo)則中的資格3 4 經(jīng)修訂的《防污公約》附則I第3和4章(第MEPC.117(52)號決議);關(guān)于在《油類記錄簿》中記載燃油加裝和貨油過駁作業(yè)的要求,以及過駁作業(yè)計劃中要求的任何記錄。RevisedAnnexIofMARPOLchapters3and4(resolutionMEPC.117(52));requirementsforrecordingbunkeringandoilcargotransferoperationsintheOilRecordBook,andanyrecordsrequiredbytheSTSoperationsPlan.Records4ofSTSoperationsshallberetainedonboardforthreeyearsandbereadilyavailableforinspectionbyaPartytothepresentConvention.第42條通知Regulation42Notification本章所適用的每艘油輪,如計劃在本公約當(dāng)事國的領(lǐng)?;?qū)俳?jīng)濟區(qū)進(jìn)行過駁作業(yè),應(yīng)至少在計劃進(jìn)行過駁作業(yè)的48小時之前通知該當(dāng)事國。在特殊情況下,如果第2段中規(guī)定的所有信息無法提前48小時得到,卸載貨油的郵輪須至少提前48小時通知本公約的當(dāng)事國將要進(jìn)行過駁作業(yè)并且第2款中規(guī)定的信息將盡早地向該當(dāng)事國提供。EachoiltankersubjecttothischapterthatplansSTSoperationswithintheterritorialsea,ortheexclusiveeconomiczoneofaPartytothepresentConventionshallnotifythatPartynotlessthan48hoursinadvanceofthescheduledSTSoperations.Where,inanexceptionalcase,alloftheinformationspecifiedinparagraph2isnotavailablenotlessthan48hoursinadvance,theoiltankerdischargingtheoilcargoshallnotifythePartytothepresentConvention,notlessthan48hoursinadvancethatanSTSoperationwilloccurandtheinformationspecifiedinparagraph2shallbeprovidedtothePartyattheearliestopportunity.本條5 2007年12月31日的第MSC-MEPC.6/Circ.4號通函或其后續(xù)修正案中列出的國家操作層聯(lián)絡(luò)點。ThenationaloperationalcontactpointaslistedindocumentMSC-MEPC.6/Circ.4of31December2007oritssubsequentmendmentsThenotificationspecifiedinparagraph1ofthisregulation5shallincludeatleastthefollowing:.1參與過駁作業(yè)的油輪的船名、船旗、呼號、IMO編號和預(yù)計抵達(dá)時間;name,flag,callsign,IMONumberandestimatedtimeofarrivaloftheoiltankersinvolvedintheSTSoperations;.2計劃過駁作業(yè)開始的日期、時間和地理位置;華洋海事中心HMCSHIPTOSHIPOPERATIONSPLANdate,timeandgeographicallocationatthecommencementoftheplannedSTSoperations;.3過駁作業(yè)是在錨泊時進(jìn)行還是在行駛中進(jìn)行;whetherSTSoperationsaretobeconductedatanchororunderway;.4油的類型和數(shù)量;oiltypeandquantity;.5過駁作業(yè)的計劃持續(xù)時間;planneddurationoftheSTSoperations;.6過駁作業(yè)服務(wù)提供者或全面掌控人員的身份和聯(lián)絡(luò)信息;以及identificationofSTSoperationsserviceproviderorpersoninoveralladvisorycontrolandcontactinformation;and.7確認(rèn)油輪上有滿足第41條要求的過駁作業(yè)計劃。aconfirmationthattheoiltankerhasonboardanSTSoperationsPlanmeetingtherequirementsofregulation41.如果油輪預(yù)計抵達(dá)進(jìn)行過駁作業(yè)地點或區(qū)域的時間改變超過6個小時,該油輪的船長、船東或代理須向本條第1款規(guī)定的本公約當(dāng)事國提供一份修改后的預(yù)計抵達(dá)時間。IftheestimatedtimeofarrivalofanoiltankeratthelocationorareafortheSTSoperationschangesbymorethansixhours,themaster,owneroragentofthatoiltankershallprovidearevisedestimatedtimeofarrivaltothePartytothepresentConventionspecifiedinparagraph1ofthisregulation.”2在表格B油輪構(gòu)造與設(shè)備記錄中新增第8A節(jié)如下:IntheRecordofConstructionandEquipmentforOilTankers,FormB,newsection8Aisaddedasfollows:“8A
