MemberStatesshallensurethatthetextsoftheainprovisionsofnationallawwhichtheyadoptinthefieldcoveredbythisDirectivearecommunicatedtotheommission.Article5ThisDirectiveisaddressedtotheemberStates.共94頁(yè)第5頁(yè)1970L0157——2004年5月1日—014.001M3第二條在如下條件下，各成員國(guó)不得在涉及到容許聲級(jí)和排氣系統(tǒng)的范圍內(nèi)，拒絕就批準(zhǔn)機(jī)動(dòng)車車型、排氣系統(tǒng)或被認(rèn)為是獨(dú)立技術(shù)裝置的此類系統(tǒng)的部件的EEC型式認(rèn)證發(fā)放歐共體或國(guó)家型式認(rèn)證：—如果車輛滿足附件I中聲級(jí)和排氣系統(tǒng)方面的要求；—如果排氣系統(tǒng)或者根據(jù)《指令70/156/EEC》?M9第二條作為2而看作是排氣系統(tǒng)中獨(dú)立技術(shù)裝置的部件滿足附件II中的要求。第二a條各成員國(guó)均不得在涉及到容許聲級(jí)和排氣系統(tǒng)的范圍內(nèi)，拒絕或者禁止銷售、注冊(cè)、投入使用或使用聲級(jí)和排氣系統(tǒng)滿足附件I之要求的車輛的銷售、注冊(cè)或投入使用。M32. 如果在第二條涵義內(nèi)，某排氣系統(tǒng)或者根據(jù)《指令70/156/EEC》?M9第二條?的涵義視作是排氣系統(tǒng)中獨(dú)立技術(shù)裝置的部件已經(jīng)取得了型式認(rèn)證，那么在涉及容許聲級(jí)和排氣系統(tǒng)的范圍內(nèi)，按照本指令第二條各成員國(guó)均不得禁止上述排氣系統(tǒng)或者部件投放市場(chǎng)。B第三條為了考慮到技術(shù)的發(fā)展，除了根據(jù)?M3附件I第5.2.2.1項(xiàng)和第5.2.2.5項(xiàng)?而規(guī)定的要求之外，應(yīng)按照關(guān)于機(jī)動(dòng)車及其掛車型式認(rèn)證的《委員會(huì)指令》的第十三條中的規(guī)定的程序，采用調(diào)整附錄所需采納必要的修正案調(diào)整附件中的要求。第四條1. 為了在本指令通告后十八個(gè)月內(nèi)遵照?qǐng)?zhí)行，各成員國(guó)應(yīng)執(zhí)行實(shí)施必需的包含符合本指令所需要的要求在內(nèi)的規(guī)定，并即時(shí)將實(shí)施情況通知委員會(huì)。2.
