EMPLOYMENTAGREEMENT（外籍教師）雇傭協(xié)議PartyA(EmployingParty):甲方（雇用方）：Address:地址：LegalRepresentative：法定代表人：IdentificationNumber：身份證號碼：PartyB(EmployedParty)：乙方：（受雇方）：Name:Gender:Nationality:姓名：性別：國籍：BirthDate:PassportNo:出生年月：護照號碼：Address:地址：I.PartyBwishestoengagetheserviceofPartyAGanzhouKingDoctorKindergartenofOxfordInternationalasaforeignEnglishteacher.Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.乙方自愿作為甲方外教在甲方從事教學服務工作。雙方在友好合作的基礎上簽訂本合同，并發(fā)誓遵守合同中所規(guī)定的各項條款。II.Theperiodofservicewillbefromto.乙方在甲方服務期限為至。III.ThedutiesofPartyB(SeeTHEAPPENDIXOFSTANDARDWORKCONTRACTFORFOREIGNTEACHERS)乙方義務。（詳見《外籍教師工作合同附件》）IV.PartyB'smonthlysalarywillbe￥6000RMB.乙方在甲方工作期間月工資為：￥6000元，以人民幣形式支付。V.PartyA'sObligations甲方義務：1.PartyAshallintroducetoPartyBthelaws,decreesandrelevantregulationsenactedbytheChinesegovernment,thePartyA'worksystemandregulationsconcerningadministrationofforeignexperts.甲方有義務向乙方介紹甲方所在當?shù)氐南嚓P法律、法規(guī)以及甲方工作機制、規(guī)程、規(guī)定以及與外國專家管理相關的規(guī)章制度。2.PartyAshallconductdirection,supervisionandevaluationofPartyB'swork.甲方對乙方的工作負責指導、監(jiān)督以及評價。3.PartyAshallprovidePartyBwithnecessaryworkingandlivingconditions.甲方必須向乙方提供乙方工作和生活必需的條件和設施。4.PartyAshallprovidePartyBwithanassistantforworkingandlivingaffairs.甲方應向乙方提供工作和生活聯(lián)系人5.PartyAshallpayPartyB'ssalaryregularlybythemonth.甲方應向乙方每月按期發(fā)放工資。VI.PartyB'sobligations乙方義務：1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina'sinternalaffairs.乙方必須遵守中國的法律、法規(guī)和將關規(guī)定，不干涉中國內(nèi)政。2.PartyBshallobservePartyA'sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA'sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA'sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.乙方必需遵守甲方的工作制度及與外國專家管理相關的規(guī)定，并接受甲方在工作方面的安排、指導、監(jiān)督和評價。未經(jīng)甲方批準，乙方不得從事任何兼職工作。3.PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.乙方必須按照計劃保質保量完成甲方委派的工作。4.PartyBshallrespectChina'sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert.乙方必須遵守中國的宗教政策，不允許從事與外籍專家身份不符的宗教活動。5.PartyBshallrespecttheChinesepeople'smoralstandardsandcustoms.乙方必須尊重中國人民的道德規(guī)范和風俗習慣。6.IfPartyBhasanycontagiousorseriousdiseases,orifPartyBisfemaleinpregnancy,childbirthorbabynursingperiod,PartyBhasthedutytoinformPartyAbeforethecontractissignedsothatPartyAcanprovidespecialcaretoPartyB.Otherwise,PartyAwillnotbearanyrelatedresponsibilities.乙方如有嚴重疾病或傳染性疾病、或者女性有懷孕、待產(chǎn)、哺乳等情況，必須在簽訂合同之前，向甲方如實聲明，否則造成后果由乙方承擔全部責任。VII.Revision,CancellationandTerminationoftheContract合同的修改、取消和終止：1.Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent(exceptthatmentionedinVI,6).雙方必須嚴格遵守合同中所規(guī)定的內(nèi)容。不經(jīng)雙方同意，不得擅自單方修改、取消或者終止合同。但本合同第VI條第六款所規(guī)定的情況除外。2.Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.在雙方同意的情況下，可以對合同進行修改、取消或者終止。但在此之前，必須嚴格遵守合同。3.PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions;在以下情況下，甲方有權以書面形式通知乙方終止合同：(1)PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout.乙方?jīng)]有完成合同中所規(guī)定的內(nèi)容，或者經(jīng)甲方提醒仍沒有履行合同中所規(guī)定的義務。(2)Accordingtothedoctor'sdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysickleave.經(jīng)醫(yī)生診斷，乙方在連續(xù)30日病假后仍不能恢復正常工作。4.PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions:在以下情況下，乙方有權以書面形式通知甲方終止合同：(1)PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.甲方?jīng)]有按照規(guī)定為乙方提供工作和生活所需條件和設備。(2)PartyAhasnotpaidPartyBasscheduled.甲方?jīng)]有按期向乙方發(fā)放勞務報酬。VIII.BreachPenalty違約金Wheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpaya任何一方不能按照合同中所規(guī)定內(nèi)容執(zhí)行，都將視為breachpenaltyof￥50000RMB.錯誤!未指定文件名。違約。違約方應承擔￥50000元人民幣的違約金。錯誤!未指定文件名。IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyA'sconsent,andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB'sreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyB'sreturnexpenses如果因不可抗原因乙方請求終止合同，andpayabreachpenaltytoPartyB.須出示有關部門開具的證明材料，經(jīng)甲方批準，自費返程路費。如果沒有正當理由乙方擅自終止合同，乙方應自費返程路費，并承擔違約責任。如果甲方因不可抗原因結束合同，經(jīng)乙方同意后，應由甲方負責提供乙方返程路費。如甲方?jīng)]有正當理由擅自終止合同，應負責向乙方提供返程路費，并承擔違約責任。．IX.Theappendixofthiscontractisaninseparablepartofthecontractandhasequaleffect本合同附件與合同正文具有同等法律效力。X.Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty2weekspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.PartyBshallbearallexpensesincurredwhenstaying本合同自簽訂之日起生效，到合同期滿自然終止。如其中onafterthecontractexpires.任何一方有意延期，必須在合同期滿2周前向對方提出，在雙方同意下簽訂續(xù)約。合同期滿后，乙方負責之后的所有滯留費用。XI.Arbitration仲裁Thetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtothelocalcourt.有關合同內(nèi)容的含義，須雙方及時互相溝通，及時處理其中可能存在的爭議。如果經(jīng)雙方協(xié)商不能達成一致，可申請可向甲方所在地法院起訴。PartyAPartyB甲方：乙方：(Signature)(Signature)（簽名）（簽名）Date日期日期(PassportofPartyB)（乙方護照）THEAPPENDIXOFSTANDARDWORKCONTRACTFORFOREIGNTEACHERS外籍教師工作合同附件ⅠRequiredworkassignmentoftheemployedparty受雇方工作任務：1.Preparelessonswellpriortoteaching上課之前充分備課；2.ConductEnglishlessons課堂授課；3.Assessstudents'work對學生學習進行考核4.Takeanactivepartinstudents'extra-curriculumactivitiesoftheemployingParty積極參與學生課外活動。ⅡThesalarytreatment工資待遇1.Directpayment直接支付thofeachmonthfromthedayof20MonetarysalaryRMB/month.Thesalarywillbepaidonthestartingworktotheexpirationofthecontract.Incasethetimeisshorterthanawholemonth,thepaymentshallbecountedbyday.Thedailywageshallbe1/30ofthemonthlysalary(thesamewithFebruary).每月以人民幣形式支付工資。工資發(fā)放日期為合同簽訂后一直到合同期滿之間每月20日。如果遇到不滿一個月，按照天數(shù)計算工資，此時每日工資為月工資的1/30（二月份同）。2.Indirectpayment.間接支付1）Theemployingpartyagreestoprovidehousingconditionsandpayforthewaterandelectricity.雇用方提供住房條件和其水電費。2）Theemployingpartyagreestopaytwiceforthedomestictravelingbonus.每學期兩次的國內(nèi)差旅交通費報銷。3)Theemployingpartyagreestoaffordholidaysbonus.節(jié)假日補貼。ⅢWorkTime,RestandHolidays工作時間、休息和假期1.Theworktimeoftheemployedpartyshallbe40hourseveryweek(two-dayweekend)Iftheworktimecannotreachtheabove-mentionedamount,PartyAcanarrangeforPartyBsomeotherconcernedworkoractivities,otherwise,theemployedpartyshouldbepaidashavingreachedit.受雇方每周工作量為40小時（周末雙休）。如果受雇方不能達到以上工作量，雇用方可根據(jù)需要安排受雇方其他工作作為補充。如果因雇用方原因致使受雇方不能達到要求所需工作量，則視為乙方已經(jīng)滿足工作量。2.Iftheemployingpartyarrangesovertimeworkforthepartyemployed,itwillpaytheemployedpartyasalaryhigherthanthatnormalworktimeaccordingtolegalstandard.Theexactpaymentshouldbenegotiatedbetweenthetwoparties.如果雇用方安排受雇方從事工作量以外的工作，應付給雇用方額外工資。額外數(shù)額由雙方協(xié)商。holidaysandfestivalsinChina:paid3.TheemployedpartyisentitledtothefollowingNewYear'sDay,SpringFestival,MayDay,NationalDayandotherholidaysstipulatedbylawsandregulations.受雇方在中國享有以下假期和假日：元旦，春節(jié)，“五·一”勞動節(jié)，國慶節(jié)以及法律、法規(guī)中所規(guī)定的其他節(jié)日。ⅣSickleaveandprivateaffairsleave病假和個人事假1.Certificatefromdoctorsforforeignersappointedbythehostinstitutionshouldbepresentedwhentheemployedpartyasksforsickleave.受雇方請病假應持有雇用方指定的醫(yī)療機構開具的醫(yī)療證明。2.Privateaffairsleaveoftheemployedpartyshallbeapprovedbytheemployingparty.Theemployingpartywilldeductthesalarybyday.Inthecontractterm,theprivateaffairsleavesshouldnotexceed10days.Thecontinuousprivateaffairsleaveshallbenomorethan3days,andtwodays'salarywillbedeductedforeachdaythereafter.雇用方應準許受雇方請個人事假。期間工
