PLANTCONSTRUCTIONCONTRACT

第一條定義

“業(yè)主”指。

“承包商”指。

“工廠”指在附錄×中指定的構(gòu)成固定設(shè)備的全部機(jī)器、設(shè)備和材料。

“工地”指按本合同用于建筑工廠的全部地皮。

“工程”指承包商按本合同實(shí)施的工程。

“合同價(jià)格”指業(yè)主向承包商支付的全部工程款項(xiàng)。

Article1-Definitions

其次條承包商的職責(zé)

1.承包商應(yīng)負(fù)責(zé)設(shè)計(jì)、籌劃以及在工地上建筑工廠。

2.除了業(yè)主依據(jù)第×條供應(yīng)的項(xiàng)目和設(shè)施，承包商應(yīng)供應(yīng)全部為使工廠勝利建筑所必需的設(shè)備、材料、工具、設(shè)施、勞工和服務(wù)。

3.承包商應(yīng)依據(jù)附錄×中的日程支配施工。

4.承包商應(yīng)依據(jù)附錄×中的規(guī)定為業(yè)主培訓(xùn)工廠設(shè)備的操作和修理人員。

5.承包商應(yīng)向業(yè)主供應(yīng)附錄×中規(guī)定的備件。

6.承包商應(yīng)向業(yè)主供應(yīng)附錄×中指定的修理設(shè)備。

Article2-Contractor\\’sResponsibilities

1.TheContractorshalldesign,engineer,andconstructthePlantattheSite.

2.TheContractorshallprovideallequipment,materials,tools,facilities,labourandservicesnecessaryforthesuccessfulconstructionofthePlantexceptthoseitemsandfacilitiestobesuppliedbytheOwnerunderArticle(…).

3.TheContractorshallperformtheWorksinaccordancewiththeScheduleinAppendix(…).

4.TheContractorshallprovidetheOwner\\’spersonnelwithtrainingofoperationandmaintenanceofthePlantinaccordancewithAppendix(…).

5.TheContractorshallsupplytheOwnerwiththesparepartsspecifiedinAppendix(…).

6.TheContractorshallsupplytheOwnerwiththemaintenanceequipmentspecifiedinAppendix(…).

第三條業(yè)主的職責(zé)

1.業(yè)主應(yīng)供應(yīng)工地，并在本合同有效期內(nèi)允許承包商自由地、不受干擾地出入該工地。

2.業(yè)主應(yīng)按時(shí)供應(yīng)附錄×中指定的物件和設(shè)施。

3.業(yè)主將從有關(guān)部門獵取為工廠建筑、設(shè)備運(yùn)行所必需的執(zhí)照和許可證，包括承包商雇員的工作許可證。

4.業(yè)主應(yīng)按第×條中規(guī)定的合同價(jià)格向承包商支付工程款項(xiàng)。

Article3-Owner\\’sResponsibilities

1.TheOwnershallmakeavailabletheSiteandgranttheContractorfreeanduninterruptedaccesstheretothroughoutthedurationofthisContract.

2.TheOwnershallprovidethoseitemsandfacilitiesspecifiedinAppendix(…)atthetimethereinestablished.

3.TheOwnerwillobtainfromtherelevantAuthoritiesthoselicensesandpermitsnecessarytoconstructandoperatethePlantontheSiteincludingworkpermitfortheContractor\\’semployees.

4.TheOwnershallpaythecontractorfortheWorksperformedtheContractPricesetoutinArticle(…).

第四條合同價(jià)格

1.在本合同生效后××天內(nèi)，業(yè)主應(yīng)向承包商支付金額為合同價(jià)格，作為承包商完成該工程并擔(dān)當(dāng)本合同規(guī)定的全部義務(wù)的全部酬勞。

2.合同價(jià)格不再上調(diào)，完成工種的成本風(fēng)險(xiǎn)應(yīng)由承包商擔(dān)當(dāng)，商定合同價(jià)格時(shí)應(yīng)認(rèn)為承包商已獲得全部信息并已把全部可能影響成本的因素估量在內(nèi)。

Article4-ContractPrice

1.Within(…)daysaftertheeffectivedateofthisContract,theOwnershallpaytheContractorasfullandcompletecompensationforaccomplishingtheWorksandassumingallobligationsunderthisContracttheContractPriceintheamountof.

2.TheContractPriceisnotsubjecttoescalation,andthecostofexecutingtheWorksshallbetheriskoftheContractorwhoshallbedeemedtohaveobtainedallinformationandtakenintoaccountallcircumstanceswhichmayaffectthecostinagreeingtheContractPrice.

第五條設(shè)計(jì)圖樣

1.承包商應(yīng)依據(jù)合同，在附錄××規(guī)定的時(shí)間內(nèi)向業(yè)主提交工廠建筑所需的圖樣，供業(yè)主審批。業(yè)主應(yīng)在收到這些圖樣后一個(gè)月內(nèi)，對(duì)圖樣進(jìn)行審核，并作出批準(zhǔn)或不批準(zhǔn)的打算。

2.承包商應(yīng)對(duì)上述圖樣中的任何缺點(diǎn)、錯(cuò)誤或疏漏負(fù)責(zé)，除非這種缺點(diǎn)、錯(cuò)誤或疏漏是因業(yè)主書面供應(yīng)的不精確?????信息所致。

3.業(yè)主或承包商相互供應(yīng)的全部圖樣和技術(shù)資料，收到方應(yīng)作為機(jī)密文件對(duì)待，除非另有商定，收到方不得將這些圖樣和資料用于與本合同無(wú)關(guān)的其他目的。

Article5-Drawings

1.TheContractorshallsubmittotheOwnerforapprovalandreviewwithinthetimespecifiedinAppendix(…)suchdrawingsasmayberequiredforConstructionofthePlantunderthisContract.WithinonemonthafterreceivingsuchdrawingstheOwnershallreviewandapproveordisapprovethedrawing.

2.TheContracto
